What is Probate?

Probate is the process of registering a deceased person’s Will in the Supreme Court so the named executor under the Will can deal with the deceased person’s assets (e.g. property, bank accounts and shares) and administer them according to the Will (or otherwise pursuant to a Deed of Family Arrangement).

What is Letters of Administration?

Letters of Administration is the process of applying to the Supreme Court to administer the deceased estate pursuant to section 14 of the Administration Act which sets out a formula as to how a deceased estate is to be distributed

What is Reseal of Probate?

Where the deceased died leaving assets situated in another State or Commonwealth country, a Grant of Probate or Letters of Administration may need to be issued by a Court of that jurisdiction.

If you have already obtained the Grant of Probate (or Letters of Administration) in another State or Country, then you will need to apply for the Grant of Probate to be “resealed”.

Do I need Probate in WA?

If the deceased died leaving a valid Will and assets in WA, you most likely will need to apply for a Grant of Probate in WA.

Do I need Letters of Administration in WA?

If the deceased did not leave a Will, or the Will is deemed to be invalid (ie was not executed correctly or they remarried or divorced after making the Will) and they left assets in WA, you will most likely need to obtain Letters of Administration in WA.

Do I need Resealing of Probate in WA?

If the deceased died leaving assets in more than one jurisdiction including WA, which is typically the case where the deceased had a share portfolio, then you will most likely need to have the Grant of Probate resealed.
