T1.1 Tender Notice and Invitation to Tender

The Campus Planning and Development Department of the University of the Witwatersrand, Johannesburg, invites tenders for the supply, installation and commissioning of the generator system for the Parktown Management Campus and other off-campus properties in terms of the NEC Engineering and Construction Short Contract.

Eligibility and preferencing criteria are stated in the tender documents. Only respondents who have suitable experience in supplying similar equipment and plumbing services with references are eligible to have their submissions evaluated. Documents MUST BE downloaded from the University’s website prior to attending the Compulsory Clarity Session in order to understand the scope and the requirements. The documents will be available at http://www.wits.ac.za/about-wits/tenders/ from Monday, 02 March 2020 at 12h00. A compulsory clarification meeting with representatives of the Employer will take place at the Ernest Oppenheimer Hall of Residence (EOH) basement parking (coordinates -26.180990, 28.037818), Parktown Management Campus, University of the Witwatersrand, 27 St Andrews Rd, Parktown, Johannesburg, 2193 on Friday, 06 March 2020, starting at 10h00. The University reserves its right to award this tender in full, in parts or not at all and call for new tenders in the event of unsatisfactory reply to this tender invitation. The closing date and time for receipt of the tender submission is Thursday, 19 March 2020 at 12h00. The physical address for submission of completed tender documents is the foyer of the Procurement Offices, Facilities and Services Building, Braamfontein West Campus, University of the Witwatersrand. T1.2 Tender Data

The conditions of tender are the latest edition of SANS 10845-3, Construction Procurement – Part 3: Standard conditions of tender. SANS 10845-3 makes several references to the Tender Data for details that apply specifically to this tender. The Tender Data shall have precedence in the interpretation of any ambiguity or inconsistency between it and the provisions of SANS 10845-3. Each item of data given below is cross-referenced to the clause in SANS 10845-3 to which it mainly applies.

Only those tenderers who are registered with the CIDB, or are capable of being so prior to the evaluation of submissions, in a contractor grading designation equal to or higher than a contractor grading designation determined in accordance with the sum tendered, or a value determined in accordance with Regulation 25 (1B) or 25(7A) of the Construction Industry Development Regulations, for a EP class of construction work, are eligible to have their tenders evaluated.

completion of at least three (3) contracts involving such work, each having a value in excess of R2 000 000 including VAT, satisfactorily completed or reached practical completion in the last three (3) years.

3. The tenderer has been represented at the compulsory clarification meeting by one of their full-time

4.12 Alternative tender offers for standalone gas generators for the off-campus properties will be considered. See Section 4.1 for eligibility criteria to submit alternative offers.

4.13.1 Parts of each tender offer communicated on paper shall be submitted as an original, plus one copies. In addition, the tenderer is requested to provide a scan of the complete tender submission in electronic PDF format on a flash disk.

4.13.4 The tenderer is required to submit with his tender the certificates as listed in List of returnable documents Section. All returnable documents, certificates and schedules must be current and valid and returned with the tender’s offer submission.

4.13.6 Telephonic, telegraphic, telex, facsimile or e-mailed tender offers will not be accepted.

4.15 The closing time for submission of tender offers is as stated in the Tender Notice and Invitation to Tender.

4.16 The tender offer validity period is twelve (12) weeks.

5.1 The Employer will respond to requests for clarification received up to five (5) working days before the tender closing time.

5.11.1 The financial offer will be reduced to a comparative basis using the Tender Assessment Schedule.

5.11.5 The procedure for the evaluation of responsive tenders is Method 3: Financial Offer and Preference.

The financial offer will be scored using the following formula:

Up to 100 minus W1 tender evaluation points will be awarded to tenderers who complete the preferencing schedule and who are found to be eligible for the preference claimed.

5.13 Tender offers will only be accepted if: a) the tenderer provides written proof from SARS that the tenderer either has no tax obligations or has made

arrangements to meet outstanding tax obligations; b) the financial offer is market related (see Regulations 6(9) and 7(9) of the 8(9) of the Preferential

Procurement Regulations 2017): c) the tenderer or any of its directors/shareholders is not listed on the Register of Tender Defaulters in terms

of the Prevention and Combating of Corrupt Activities Act of 2004 as a person prohibited from doing business with the public sector;

d) the tenderer has not: i) abused the Employer’s Supply Chain Management System; or ii) failed to perform on any previous contract and has been given a written notice to this effect; and e) the tenderer has completed the Compulsory Declaration and there are no conflicts of interest which may

impact on the tenderer’s ability to perform the contract in the best interests of the employer or potentially compromise the tender process.

5.17 The number of paper copies of the signed contract to be provided by the employer is one.

The Bills of Quantities must be fully priced as per the pricing assumptions.

The Tenderer’s attention is drawn to Part 2 of the Contract Data which requires the Tenderer to tender a percentage for overheads and profit added to the Defined Cost for people and a percentage for overheads and profit added to other Defined Cost. Failure to tender these percentages will render the tender non-responsive.

Compensation events which result in changes to the Prices are assessed on the basis of Defined Cost (i.e. the amount paid by the Contractor in Providing the Works (excluding any tax which the Contractor can recover) for people employed by the Contractor, plant and materials, work subcontracted by the Contractor and equipment). These percentages for overheads and profit are applied to components of Defined Cost when making changes to the Prices in terms of the Contract. These percentages cover everything that is not included in Defined Cost. Tenderers need to price these percentages realistically as they will be taken into account when evaluating tender offers – see Tender Assessment Schedule.

NOTE 1 The Standard Conditions of Tender contained in SANS 10845-3 prohibits anticompetitive practices (clause 3.1) and requires that tenderers avoid conflicts of interest, only submit a tender offer if the tenderer or any of his principals is not under any restriction to do business with employer (4.1.1) and submit only one tender either as a single tendering entity or as a member in a joint venture (clause 4.13.1). Preamble

Section 10(b) of the Broad-Based Black Economic Empowerment Act of 2003 (Act No. 53 of 2003) states that

“Every organ of state and public entity must take into account and, as far as is reasonably possible, apply any

relevant code of good practice issued in terms of this Act in developing and implementing a preferential

procurement policy.”

A number of codes of good practice have been issued in terms of Section 9(1) of the B-BBEE Act of 2003,

including a generic code of good practice and various sector codes. The sector codes vary the metrics, weightings

and targets used in the generic code of good practice to establish the overall performance of an entity and its B-

BBEE status. The B-BBEE status needs to be assessed in accordance with the applicable code.

Acceptance

By signing this part of this Form of Offer and Acceptance, the Employer identified below accepts the tenderer’s Offer. In consideration thereof, the Employer shall pay the Contractor the amount due in accordance with the conditions of contract identified in the Contract Data. Acceptance of the tenderer’s Offer shall form an agreement between the Employer and the tenderer upon the terms and conditions contained in this agreement and in the contract that is the subject of this agreement.

The tenderer shall within two weeks of receiving a completed copy of this agreement, including the Schedule of Deviations (if any), contact the Employer’s agent (whose details are given in the Contract Data) to arrange the delivery of any securities, bonds, guarantees, proof of insurance and any other documentation to be provided in terms of the conditions of contract

identified in the Contract Data. Failure to fulfil any of these obligations in accordance with those terms shall constitute a repudiation of this agreement.

Notwithstanding anything contained herein, this agreement comes into effect on the date when the tenderer receives one fully completed original copy of this document, including the Schedule of Deviations (if any). Unless the tenderer (now Contractor)

within five working days of the date of such receipt notifies the Employer in writing of any reason why he cannot accept the contents of this agreement, this agreement shall constitute a binding contract between the Parties.

The Employer has insured itself against the acts and omissions of persons acting on its behalf, and its students and staff are insured during the course and scope of the Employer’s business. The Employer’s maximum liability will be limited, whether for a single or multiple events, to the extent of its insurance cover herein.

81.2 The Contractor provides these insurances:

to and in an amount considered appropriate by the University’s Insurance Brokers. The Service Provider must

2 Loss or damage to equipment for a sum sufficient to provide for their replacement.

3 Loss or damage to Plant and Materials which are outside of the working areas and which are marked by the

Supervisor for the contract in accordance with the provisions of the contract sufficient to cover their replacement.

9 Termination and dispute resolution

93.1 The Adjudicator is the person selected by the Parties from the Panel of NEC Adjudicators set up by ICE-SA, a joint

division of the Institution of Civil Engineers and the South African Institution of Civil Engineering (see www.ice-sa.org.za), as per Clause Z1 of this Contract Data.

93.2(2) The adjudicator nominating body is the Chairman of ICE-SA, a Joint Division of the Institution of Civil Engineers

and the South African Institution of Civil Engineering (see www.ice-sa.org.za).

93.4 The tribunal is arbitration.

93.4 The arbitration procedure is as set out in the Rules for the Conduct of Arbitrations Fifth Edition 2005 published by the Association of Arbitrators (Southern Africa) The place where arbitration is to be held is Johannesburg The person or organisation who will choose an arbitrator

Z1 Selection and appointment of the Adjudicator

Add the following paragraph to clause 93.3 Within 2 weeks after declaring a dispute and if the Adjudicator was not yet appointed with a previous dispute, the notifying Party notifies the other Party of the names of two persons he has chosen from the Panel of NEC Adjudicators set up by ICE-SA, a joint division of the Institution of Civil Engineers and the South African Institution

of Civil Engineering (see www.ice-sa.org.za), whose availability to act as the Adjudicator the notifying Party has confirmed. The other Party selects one of the two persons chosen to be the Adjudicator within four days of receiving the notice, failing which the person chosen by the notifying Party will be the Adjudicator for the Contract. The Parties appoint the selected Adjudicator under the NEC3 Adjudicator’s Contract (Third edition with amendments up to and including April 2013).

Z2 Tax invoices

The Contractor submits his valid tax invoice in accordance with the law with his application for payment. Where the Contractor does not submit his valid tax invoice in accordance with the law within the time required the period within which payment is made in terms of clause 51.1, the period within which payment is made in terms of clause 51.1 and the time allowed in clause 90.4 are extended by the length of time from the date when the Contractor should have submitted the valid tax invoices to the date when he does submit it.

Z3 Acts or omissions by mandatories

In terms of Section 37(2) of the Occupational Health and Safety Act of 1993 (Act 85 of 1993), the Contractor hereby agrees that the Employer is relieved of any and all of its liabilities in terms of Section 37(1) of this Act in respect of any acts or omissions of the Contractor and his employees to the extent permitted by this Act, and that this contract comprises the written agreement between the Employer and the Contractor contemplated in section 37(2).

Z4 Insurance claims

In the event of any occurrence which is likely to or could give rise to a claim under the insurances arranged by the Employer, the Contractor: a) in addition to any statutory requirement or other requirements contained in the contract immediately notifies

the Employer’s Insurance Brokers and the Employer’s representative giving the circumstances nature and an estimate of the loss or damage or liability.

b) completes a Claims Advice Form available from the Insurance Brokers to whom the form is returned without delay.

c) negotiates the settlement of claims with the Insurers through the Employer’s Insurance Brokers and when required to do so obtains the Employer’s approval of such settlement.

The Employer and Insurers have the right to make all and any enquiries on the Site or elsewhere as to the cause and results of any such occurrence and the Contractor co-operates in the carrying out of such enquiries.

Z5 Insurance cover taken out by the Contractor

Insurance cover which the Contractor is required to take out in terms of the contract shall contain terms acceptable to the Employer’s insurance broker. A reason for not accepting the cover is that it does not comply with the contract.

Z6 Vendor registration The Contractor registers on the Wits University Vendor Database by completing the relevant Vendor Registration Form and providing all the required information. One hundred percent of the Prices for Work Provided to Date is retained in assessments of the amount due until the Contractor has registered on the Wits University Procurement Database.

Z7 Weather events

Replace “one seventh of the total number of days” in the first sentence of 60.1 (10) with “one fourteenth of the total number of days”

Z8 Low performance damages

In the event that the Contractor’s actions result in an unplanned loss of electricity to the campus and/or property where the works is taking place, the Contractor will be liable for the following low performance damages:

C2.1 Pricing assumptions C.2.1.1 The Contractor is paid an amount in accordance with the Price List equal to the lump sums of items which he has completed and an amount calculated by multiplying the quantity completed by the rate. C.2.1.2 The contract is a lump sum form of contract where the Prices to Provide the Works (i.e. to do the work necessary to complete the works in accordance with this contract and all incidental work, services and actions which this contract requires) are stated in the Price List. At each assessment date work carried out since the previous assessment date is identified from the items in the Price List and totalled to give the Price for Work Done to Date. Any change in the quantity stated for an item in the Price List is a compensation event and is assessed by multiplying the quantities by the rate. C.2.1.3 Instructions to do work or how it is to be done are not included in the Price List but in the Works Information (see Clauses 11.2(11) and 20.1). The Price List is only a pricing document. C.2.1.4 As the Contractor has an obligation to correct Defects (clause 41.1) and there is no compensation event for this, the lump sum Prices and rates must also include for the correction of Defects. C.2.1.5 If the Contractor has decided not to identify or to price a particular item of work, it will be assumed that Contractor has included the cost to the Contractor of doing the work within the other Prices or rates. C3: Scope of work

1 Description of the works 1.1 Employer’s objectives

The Employer’s objectives in this tender process is to secure the services of a competent and experienced contractor who will undertake the supply, installation and commissioning of the generator systems for the Parktown Management Campus and other off-campus properties in the Parktown area. This project forms part of the Employer’s overall campus business continuity programme and aims to introduce backup power generators for all of the university’s properties to mitigate disruptions to university operations as a result of planned or unplanned power failures.

1.2 Overview or the works The works is divided into two (2) main parts which include:

Part 1: Centralised diesel generator system on Parktown Management Campus:

The work for this Part 1 of the contract entails the complete supply and installation of synchronised diesel generator systems which supply to the Employer’s medium voltage reticulation network at its Parktown Management Campus. The system has been specified as an outdoor containerised solution to be deployed at the Parktown Management Campus near the council main in-take substation which supplies the campus at 11kV. The system will include all equipment necessary to supply to the 11kV network and is expected to have a bulk diesel supply of at least 48 hours continuous run-time. The equipment will include: 1MVA diesel generator, low voltage switchgear, step-up transformer, changeovers and the bulk diesel tank.

Part 2: Standalone diesel or gas generators for off-campus properties

The works for this Part 2 of the contract entails the complete supply and installation of standalone diesel or gas generator systems which supplies low voltage electrical distributions at its off-campus properties. Particularly, the supply and installation of new generator systems and all associated electrical works will be required for the following Jubilee Road properties:

Part 1: Centralised diesel generator system on Parktown Management Campus:

The scope of work is as per below. Refer to Annexure 4 for full detailed specifications for this Part 1.

Supply and installation of a fully containerized 11kV Switchgear container housing the 11kV generator synchronizing and supply / feeder switchgear. The arrangement must allow for this installed unit to be de-commissioned, disconnected, removed from the container housing and re-installed into a synchronous parallel arrangement with a second generator into a Permanent Generator room area.

Supply and installation of One new 1000kVA (prime rated) containerised diesel generator set complete with generator control system. The arrangement must allow for this installed unit to be de-commissioned, disconnected, removed from the container housing and re-installed into a synchronous parallel arrangement with a second generator into a Permanent Generator room area.

Supply and installation of One new 400/11000V, 1000kVA containerised dry type transformer - connected as a step-up generator transformer in a Ydn configuration with the 11kV star point connected to an external protected earth system. The arrangement must allow for this installed unit to be de-commissioned, disconnected, removed from the container housing and re-installed into a synchronous parallel arrangement with a second generator into a Permanent Generator room area.

Supply and installation of transformer Residual Protection.

All 11kV cabling and terminations. (Allow 50M route).

All 600/1000 V L.V cabling. (Allow 50M route).

All control cabling and wiring to facilitate the complete synchronized MV emergency power system.

4800 L Bulk Diesel tank system.

Diesel day tank installation and complete fuel transfer system to integrate with the bulk tank installed.

Complete Generator plant Scada/PLC control and synchronizing system to provide a fully automatic generator system with full facility for interface for alarm and operational interface to mobile phones as well as selected operational / alarm feedback to the existing BMS system.

Supply exhaust silencer system to comply with the engine supplier requirements and to not exceed sound levels of 65dBa at 7 meters. Generator containers also to be soundproof to 65dBA at 7 meters.

Complete Civil works associated with; excavation, site levelling, concrete floor slab lay-down area, interconnecting floor cable / pipe trenches.

Please note all power outages will be afterhours.

Issuing of a certificate of compliance for the installation.

Part 2: Standalone diesel or gas generators for off-campus properties

The scope of work is as per below. Refer to Annexure 5 for full detailed specifications for this Part 2.

The complete design, manufacture, works testing, delivery to site, rigging of equipment into position, installation on site and commissioning of fully automatic standby generators to three different Wits University sites in Parktown:

o Gables End, 3 Jubilee Road, Parktown – currently being used as small offices o Savernake, 13 Jubilee road, Parktown – Vice-Chancellor’s and staff residence o Knockando Hall, 21 Rockridge Road, Parktown – student residence (Relocate existing canopy

mounted 400kVA set from School of Public Health building at Wits Education Campus – less then 5km away)

The generating sets at each site will be required to be mounted within a soundproof enclosure at ground floor level in a position to be agreed on site. All three areas are residential use areas and a strict requirement of this tender enquiry is to ensure a solution presented that is well within the noise levels permitted for residential applications – the specified requirement for the two Jubilee Road sites is 45dba at 1M

For tender purposes it shall be assumed that the generator is located in a freely naturally ventilated area and Provisional allowances have been included for interface to the existing Main LV Board / DB Boards. Tenderers are to indicate the footprint dimensions of their proposed units.

Specific attention is drawn to the fact that the generator shall be set up in line with the main in coming supply and that the automatic mains failure change over circuit breakers/ contactors and control are to be housed in the Generator Panel and sized for the full mains load as indicated.

1.4 Location of the works The site for Part 1 of the contract is at the University’s Parktown Management Campus, address at 2 St Davids Pl, Parktown, Johannesburg, 2193. The site for Part 2 of the contract is part of the University’s Parktown Campus Cluster, addresses as follows:

1.5 Temporary works

The Contractor is fully responsible for the design, construction, and removal of any temporary works required for the work to be completed.

2 Engineering and Design 2.1 Design services and activity matrix

The Contractor will not be required to undertake any design work for this contract.

2.2 Employer’s design

The Employer has appointed a professional electrical engineering consultant to undertake the detailed assessment of the existing electrical infrastructure at the Parktown Management Campus and other standalone properties in the Parktown Area. The consultant has also been tasked to determine the load profiles of each campus / property as well as any existing generator capacity. The proposed generator systems have been designed and specified.

The Contractor will be responsible for putting into practice the schematic designs provided for the generator systems, in accordance with statutory structural and electrical works requirements and best practices.

2.3 Contractor’s design

Any design that may be required to be undertaken by the Contractor shall comply with relevant statutory requirements contained in regulations, the national and international standards stated in the document, and industry best practices.

3 Drawings

The Employer has provided the following drawings and schematics which describe the proposed generator systems. See Annexure 6 for drawings.

4.1 General The Contractor shall only incorporate in the works materials (substances that can be incorporated into the works), products (item manufactured or processed for incorporation into the works), components (products manufactured as distinct units to serve a specific function or functions) and assemblies (set of related components attached to each other) which are: a) fit for their intended purpose; and

b) capable of fulfilling required functions under intended use conditions or when in use, with planned

maintenance, under the influence of the environmental actions or a result of a self-ageing process for a period of time within industry accepted norms.

The construction of elements of the building that are the subject of National Building Regulations shall, unless otherwise indicated on the construction drawings or elsewhere specified in the Scope of Work, be in accordance with the relevant provisions of the corresponding part of SANS 10400, The Application of National Building Regulations. NOTE: Sub-regulation A14(1)(a) (Construction) of the National Building regulations requires that the construction of any building or element shall be such that the building or element as constructed does not compromise the design intent of any design solution that satisfies the requirements of a functional regulation.” This sub-regulation is deemed to be satisfied if such construction satisfies the requirements of the relevant Part of SANS 10400.

4.2 Applicable Standards

It shall be the responsibility of the Contractor to ensure that all equipment and methods used in the installation, comply with all relevant statutory regulations, in particular the latest amendments of the following:

a) The Occupational, Safety and Health Act.

b) Government, Provincial and Local Authorities Ordinances, Regulations, By- Laws, Rules and other legal instructions.

c) The following standards need to be applied where applicable: SANS 10142 The SANS Code of Practice for the Wiring of Premises IEC 60694 Common Specifications for High Voltage switchgear and control gear standards. IEC 60298 AC metal-enclosed switchgear and control gear for rated voltages above 1kV and up to and including 72 kV and related IEC Codes IEC 60129 Alternating current Isolators and earthing switches IEC 60529 Classification and degrees of protection provided by enclosures IEC 60265 High Voltage switches-Part 1: Switches for rated voltages above 1kV and less than 52kV IEC 60056 Circuit breakers IEC 60185 Current transformers IEC 60186 Voltage transformers IEC 60255 Electrical Relays

Any other applicable standard. Note that any national and/or international standard that is not listed above but applicable to the works still applies.

d) The Contractor shall immediately refer any anomalies to the appointed electrical engineering consultant for a decision.

4.3 Detailed specifications for the generator systems

The detailed specifications are as contained in Annexures 4 and 5 for the Parktown Management Campus and the off-campus properties solutions respectively.

The contractor is required to make themselves familiar with the installation requirements for any equipment and products tendered, and how the interface with the existing electrical system is to be effected.

4.4 Testing and Certification Relevant commissioning tests as itemised in the price list.

4.4.1 Commissioning Tests New generator systems will undergo factory acceptance testing and be commissioned on site as per manufactuerer’s requirements. All testing and commissioning records to be included as part of the handover documentation pack.

4.4.2 Cable Tests Cables will require possible joints and terminations, and as such cables are to be tested and certified prior to being energised.

4.4.3 Electrical Certificates of Compliance Once complete, Certificates of Compliance in accordance with SANS 10142 shall be issued for each of the generator stations.

4.4.4 Guarantee Period Guarantee period of the installation and commissioning of all new parts of the generator systems shall be twenty-four (24) months from date of successful commissioning. Documentation shall include but not be limited to;

4.5 Operating and Maintenance Manuals The Tenderer shall provide three (3) comprehensively indexed Operating and Maintenance Manuals, bound in loose leaf plastic covers.

4.6 Disposal of removed equipment

Old equipment that is removed from site shall be disposed of safely, and in an environmentally safe and responsible manner.

4.7 Plant and materials 4.7.1 Plant and materials supplied by the employer

The Employer supplies no plant and materials in relation to this work.

4.7.2 Materials, samples and shop drawings

The Contractor is to provide the Employer’s representative with information on any materials, equipment or plant proposed for incorporation in the works, and samples of such items on request. In addition, if there is any manufacture required of items to be incorporated in the works, such shop drawings shall be provided to the employer prior to the contractor beginning commencement of their manufacture.

Acceptance of such materials, equipment or plant or the specifications and drawings for manufactured items will not relieve the contractor of their responsibility and accountability for such items.

4.8.1 Requirements for equipment

The Contractor shall only utilise equipment that is safe and in good serviceable order. No work will be undertaken without using the appropriate and correct tools for the purpose.

4.8.2 Equipment provided by the Employer

The Employer provides no equipment in relation to this work.

4.8.3 Ownership of equipment provided by the Employer The Employer provides no equipment in relation to this work.

4.9 Existing services 4.9.1 Known services

The Contractor is required to identify all services prior to conducting any work within a building, and to ensure that all workers are made aware of the location and nature of such services.

4.9.2 Treatment of existing services

All existing services shall be treated as operational. In all circumstances, the existing services must remain operational until the scheduled cutover of the ring main system, so as to not disrupt the university’s operations on the campus and/or properties in general.

4.9.3 Damage to services

Should the contractor cause damage to any services, they will first secure the services, and make the area safe. They will thereafter inform the employer’s representative of the damage incurred, so that the relevant authority can be informed.

4.9.4 Reinstatement of services and structures damaged during construction

The contractor will remain at all times responsible for the swift and safe repair of any damage caused to services, whether it is through their own fault or not. The cost of such repairs shall be borne by the Contractor, and shall not be passed on to the Employer.

4.10 Planning and programming

The work will be undertaken with minimal disruptions to the residence’s daily operations. The new systems tie-in which will result in power disruptions will be scheduled during a time as agreed to with University stakeholders, and will likely be undertaken over weekends, public holidays, or during period when the university closes for vacations.

4.10.1 Software application for programming

The Contractor is required to use Microsoft Projects to prepare a high-level programme for the work. This programme must clearly indicate the dates when specific items of work are to be undertaken. The Contractor shall prepare their programming at least 2 weeks prior to commencing work, and such programme must be delivered to the Employer’s representative. Such programme is to be accepted by the Employer’s representative prior to work commencing.

4.10.2 Methods and procedures

The Contractor may be required to provide the Employer’s representative with method statements and detailed work procedures for any aspect of the work. Such methods and procedures will be scrutinised by the

Employer’s representative or others to ensure that the proposed approach is likely to achieve the required results, will be safe, that the processes involved comply with manufacturers’ conditions and requirements, to result in the anticipated outcomes. The Contractor will be required to amend these methods or procedures if the Employer’s representative (or others) do not believe that the approach will satisfy the specified requirements.

4.10.3 Quality plans and control

The Contractor shall prepare a quality assurance programme for the overall works, which shall be prepared and maintained for the duration of the contract.

Quality control mechanisms shall include the Contractor’s own internal quality testing to ensure that the work is free of defects. Such quality control shall be for the Contactor’s expense.

The requisite testing and commissioning of equipment is as stated in the detailed specifications in Clause 4.4 of the Scope of Work, and is considered to be included in the cost of installation and commissioning of the works.

4.10.4 Completion Strategy The Contractor shall develop a completion strategy to minimise the correction of defects after Completion and to achieve Completion on or before the Completion Date. Such a strategy shall include a systematic approach to ensuring that employees and subcontractors search for defects as the work progresses, programme their work in such a manner that defects are corrected ahead of Completion and sufficient time is allowed for commissioning. The completion strategy should be framed around the systematic acceptance and / or testing of materials, plant, workmanship and subsystems as the works proceed in order to address issues ahead of completion and the allocation of tasks to ensure satisfactory completion.

4.11 Site Establishment The Contractor may apply for a suitable site establishment to accommodate their tools and equipment. Such site establishment may not be available at all times and the Contractor will be responsible for establishing and disestablishing the site as required. The Contractor may not make use of the site for residential purposes, and no workers will be permitted to set up sleeping quarters on campus. The Contractor shall clear up all site establishment after use, and reinstate the same to the state prior to occupation, at the Contractor’s cost.

4.11.1 Facilities provided by the contractor The Contractor shall provide whatever facilities they require, and indicate proposed locations on campus for their establishment at the time that they submit their programme. The Contractor is responsible for establishing and removing all facilities that they might require for the performance of the works.

4.11.2 Services and facilities provided by the employer The Employer will provide connections to water and electricity in locations where those services are readily available.

4.12 Advertising rights The Contractor shall not permit any advertising to be displayed on any equipment or site establishment areas.

The Contractor may display discrete signage to indicate the ownership of plant or equipment only and as required in order to comply with health and safety requirements. All vehicles or equipment brought onto campus shall be easily identified as belonging to the Contractor

4.13 Notice boards The Contractor shall provide suitable notice boards that will be mounted outside the works area when they begin work. Such signboards shall indicate their name, the contact details of the responsible site agent, the name and number of the residence building and a short description of the works that are being performed there. In addition, warning notices and other barricade will be erected to keep the public away from the locations where there is work being performed. It is the Contractor’s responsibility to ensure that all persons are informed of the hazards associated with the works and to keep persons outside of the working areas from a health and safety perspective.

4.14 Permits and wayleaves The Contractor is responsible for obtaining from the authorities, any and all permits and wayleaves which might be required to perform the works.

4.15 Survey control and setting out of the works The Contractor is responsible for any and all setting out required for the generator system as well as any building works that are associated with this work. The Contractor will be responsible for rectifying any errors in setting out or survey of the works.

5 Title to objects and materials within the site Earth, stone, gravel and sand, and all other materials existing on, excavated from or obtained by the removal of vegetation or demolition of structures on the site, shall be at the Contractor’s disposal in so far as they are required for incorporation into the works.

6 Health and Safety 6.1 Access to and working on the University’s Campuses The major hazards identified by the Employer are that the works will take place within the university’s campuses and off-campus properties. The Contractor will be working in close proximity of operational buildings requires minimal disruption to day-to-day operations as well as noise caused by construction activities. As such, the Contractor must adhere to the University’s specification for access to and working on the campus (See Annexure 2).

6.2 Standard health and safety specifications The Contractor shall manage health and safety in accordance with the University’s generic occupational health, safety and environmental specification for construction contracts (see Annexure 1).

6.3 Particular health and safety specifications Particular hazards related to the installation of any part of the generator system will be identified by the Employer’s appointed representatives or agents. Such hazards will be detailed in the Employer’s appointed Health and Safety Agent’s baseline risk assessment and the Project Health and Safety specification prepared for this project that will be provided to the Contractor.
