TERMS AND CONDITIONS

1. The prescribed tender document containing technical specification and Terms and Conditions can be downloaded from the official web site of Kashmir university i.e www.kashmiruniversity.ac.in/ www.kashmiruniversity.net A non-refundable tender fee of Rs. 500/- in the form of a Bank Draft in the name of Registrar, University of Kashmir shall have to be attached with the downloaded documents on its submission along with the following documents:-

Latest tax clearance certificate on the prescribed form

Registration certificate (if applicable)

Dealership certificate.

Performance certificate

2. LAST DATE FOR SUBMISSION OF TENDER DOCUMENTS:-

The tenders shall be addressed to Dean Academic Affairs and should reach his office by or before 20.02.2011 either by

Registered/ Speed Post/ Courier or delivered personally against proper receipts. The University shall not be responsible for any

postal delay or late submission of tenders

3. REJECTION OF THE TENDER:-

University reserves right to accept of reject any tender or all the tenders in full or in part without assigning any reason thereof.

4. OPENING OF TENDERS:-

The tenders shall be opened on 21.02.2011 at 2:00 p.m. in the presence of the tenderer(s) / their authorized representatives who

may like to be present at that time at their own expenses.

5. FILLING OF TENDER DOCUMENTS:-

Every page of the tender document should be duly signed, stamped, page marked and dated by the tenderer or their authorized

representative. In case of firms it should be signed and stamped by a member of the firm authorized to enter into contract and

shall furnish proper attorney along with the tender, rates should be typed, both in words and figures and should be covered by

transparent cello tape. Tenders once received shall not be returned, documents are non transferable.

6. VALIDITY OF THE RATES:-

The tendered rates must be valid for a period of 270 days from the date of opening of tenders, conditional tenders shall not be

accepted. No escalation of rates shall be allowed by the university during the currency of the contract.

7. EARNEST MONEY:- The tenders must be accompanied with the earnest money in the shape of a CDR/FDR for Rs. 20,000/- on

any Nationalized Bank pledged to the Registrar, Kashmir University.

Tenders not accompanied with the required earnest money shall be

rejected.

In case of successful tenderer the earnest money shall be released after supply of the material to the entire satisfaction of the authorities.

In case of unsuccessful tenderers the earnest money shall be released after finalization of the contract with the successful tenderer.

8. PRICE:- The rates quoted should be F.O.R. Kashmir University Campus, rates should be inclusive of all taxes etc. however tax

component should be shown separately. Tenderers may check the tax rates before quoting in their own interest. In case during the currency of contract it is established that the printed/ MRP/rates are lower than the quoted

/approved rates, the difference on this account with penalty as may be decided by the authorities shall be recovered from the successful tenderer.

In case of any service/ entry tax is payable during transit of the ordered items, the same shall be paid by the successful tenderer and shall be borne by the university under rules, against production of the documentary proofs.

The successful tenderer shall be responsible for the release of the consignment from Lakhanpur check post of commercial tax department if seized on any reason.

In cases where A. M. C. after the expiry of the guarantee/ warranty period is to be executed, tenderer may quote for the same separately.

In case of any discount the tenderer shall clearly indicate maximum discount they can offer in the items quoted by them in their tender.

9. Security Deposit:-

For due fulfillment of the contract, the successful tenderer shall furnish security / performance deposit in the shape of CDR/FDR or bank guarantee soon after the receipt of contract (5% to 10% of the total value of contract). The security deposit will be released after two months of the completion of the contract successfully.

10. Delivery Schedule:-

An early delivery is desirable, tenderers should quote specific delivery period of the items advertised. The supply shall however

be made in full within the delivery period as may be stipulated in the supply order, failing which penalty clause will be evoked.

11. Agreement:-

Successful tenderer shall have to execute formal agreement on non judicial stamp paper of Rs 50/= within the period of 20 days

from the day of communication of the acceptance of their tender. All expenses on account of stamps, registration and other

related charges shall be borne by the successful tenderer.

12. Force Majure:-

Any failure or omission to carry out the provisions of this contract shall not give rise to any claim by Kashmir University or the

successful tenderer one against the other if such a failure/ omission arises from the act of God which shall include all acts of

natural calamities such as fire, flood, earthquakes, hurricanes or any pestilence or civil strikes compliance with any statute or

regulation of government, lockouts, riots, embargoes or from any political or other reasons beyond the control of parties

including war, civil war or a state of insurrection. However, force majure shall not apply to the installation of the equipment, its

repair and maintenance by the company engineer and the service contract during the guarantee period.

13. Arbitration:_ If at any time any question or difference whichever shall arise between the successful tenderer and K.U. in relation with this

contract or a part thereof, the decision of Honorable Vice Chancellor shall be final and binding on both parties.

14. Penalties:- In case successful tenderer failing, declining, delaying or neglecting the supply of the goods as per the order or in the event of

any damage occurring or being caused by the successful tenderer or in the event of any default by the successful tenderer in

complying with any of the terms and conditions of the contract or a default or failure in compliance with any of the terms and

conditions of the contract, the Registrar, Kashmir University shall without prejudice to any other remedy available to it under

law for the time being in force in the J&K state:-

Terminate the contract after 30 days notice and /or Recover the amount of the loss caused by the damage, failure delay,

default (including the consequential damages) or a fault or failure as

may be determined by the Registrar Kashmir University and/ or

Forfeit CDR/FDR and/or Impose penalty equivalent to 5% of the total supply value of the order. The penalty shall however, be subjected to the

Force Majure and Arbitration Clauses of this NIT.
