2. The Dean of the Academic Board, USMA, is hereby delegated:

a. Signature authority to complete DO Fom1 785 (Record of Disenrollment tl·om Ofticer Candidate-Type Training) in accordance with paragraph 7-7d, AR 210-26, United States Militmy Academy (9 December 2009/RAR 6 September 2011 ). This authority may be further delegated to the Brigade Tactical Officer.

c. Authority to approve official travel for attendance at private organization meetings held within the continental United States at Govemment expense in accordance with Chapter 4, Part J of the Joint Travel Regulation (JTR) and Chapter 4 of the Joint Federal Travel Regulation (JFTR) .

d. Authority to downgrade award recommendations for the Meritorious Service Medal and to award Am1y Commendation Medals and lower awards l\.1r personnel assigned or attached to the USCC in accordance with para!:,YTaph 3-19 of AR 600-8-22, Militm:v ;hvards (11 December 2006/RAR 24 June 2013).

e. Authority to enter into support agreements with Department of Defense and non-DoD Federal activities, in accordance with DoD! 4000.19, when funding is avai!Gble to pay for the support, provided it is in the best interest of the United States Government, the supplying activity is able to provide the support, the support cannot be provided as conveniently or cheaply by a commercial enterprise, and it does not conflict with any other agency's authority,. 4. The Chief of Stall~ USMA, is hereby delegated:

a. Authority to accept gifts of travel and related expenses for members of the USMA in accordance with 31 U.S.C. 91353 as implemented by Anny Directive 2007-01, Policy .for Travel by Department of the Army Officials (25 January 2007). This delegation does not extend to authority to accept gifts of travel and related expenses for spousal and/or other family members travel.

b. Approval authority on financial liability investigations in accordance with AR 735-5, Policies and Procedures for Propert;v Accountability (I 0 May 2013 ).

c. Authority to review and decide tonnal grievances submitted by civilian employees of the USMA in accordance with Article 48 ofthe current collective

bargaining agreement between the American Federation of Government Employees, Local 2367 and the United States Military Academy; and Article 7 of the cuJTent collective bargaining agreement between the International Association of hrc Fighters, Local F-7 and the United States Military Academy.

Authority to sign as the certifying official on the Department of Energy Form 5631.20 (Request for Visit or Access Approval) allowing USMA staff, faculty, and cadets access to rcstticted data and Critical Nuclear Weapons Design lnfonnation in accordance with AR 380-5, Department of the Army ll?formation Security Program (29 September 2000).

e. Authority to approve ofticial travel for attendance at private organization meetings held within the continental United States at Government expense in accordance with Chapter 4, Part J of the Joint Travel Regulation (JTR) and Chapter 4 of the Joint Federal Travel Regulation (JFTR).

f. h. Final approving authority for fonnal line of duty investigations in accordance with para. 1-1 Ob of AR 600-8-4, Line o( Duty PoliC:l'. Procedures. and ln1·estigations (4 September 2008).

5. The Commander, U.S . Anny Garrison. West Point (USAG), is hereby delegated:

a. Authority to accept gifts of travel and related expenses for members of USAG in accordance with 31 U.S.C. ~ 1353 as implemented by Anny Directive 2007-0 I, Policy .for Travel by Department ofthe Army Officials (15 January 2007). This delegation docs not extend to authority to accept gifts of travel and related expenses for spousal and/or other family members travel.

b. Authority to approve environmental documentation requiring installation commander approval in accordance with AR 200-1, Environmental Protection and Enhancement ( 13 December 2007).

c. Authority to take all actions on matters pertaining to private organizations authorized to operate at West Point in accordance with AR 210-22, Pri1'0tc> Orguni::ations on Department of'the Army Installations (22 October 200 I), DoD Instruction I 000.15, Private Organizations on DoD Installations (24 October 2008) and DoD Regulation 5500.7-R, DoD .Joint Ethics Regulation ( 17 November 2011 ).

d. Authority to recommend that National Headquarters, Am1y Emergency Relief, declare Anny Emergency Relief loans uncollectible in accordance with paragraph 1-16 of AR 930-4, Army Emergency Rclie/(22 February 2008).

c. Authority to suspend or curtail operations on the installation, or any part thereof: during duty hours for administrative, public safety, or security reasons due to adverse weather conditions; criminal, anti-terrorist, or other emergent disaster-related events; or other similar circumstances, and to authorize a liberal leave policy for those employees who are not in essential operations.

f. Authority to initiate DA Fom1 337 (Request for Approval ol' Disposal of Buildings and Improvements) for the disposal of all excess real prope1iy and to approve the disposal of real property, including the demolition of public buildings or facilities but excluding family housing, when the current real property cost of any item is less than $25,000, in accordance with AR 405-90, Disposal ofReal Estate (10 May 19R5).

g. Authority to bar military and civilian personnel fi·om the installation. Circumstances which would warrant a bar include, but are not limited to, the following situations:

(I) Participation on the West Point Military Reservation (WPMR) in picketing, demonstrations, sit-ins, protest marches, political speeches, circulation of petitions f(.)r signature, or other similar activities in violation of DOD, Army, or USMA Regulations, Policies, Directives, and Instructions.

(2) Thefts, including shoplifting, and other crimes committed on the WPMR.

(3) A refusal to vacate designated areas, including assigned quarters on the WPMR, or a re-entry into such areas or quarters, atler the eil'ectivc date of the notice of eviction or tennination of quarters.

h. Authority to enter into franchise agreements or delegate another franchising authority for cable television services on the installation in accordance with paragraph 3-7 of AR 25-13, Telecommunications and lln(/ied Capabilities (25 March 2013 ).

i. Authority to review and approve procedures for conducting risk management in accordance with paragraphs 1-8 and 1-9 or AR 385-63, Range Safety (30 Jan 2012) and USMA Reg. 385-11, Range Control (I June 1998).

j. Authority to administratively suspenu or revoke driving privileges on the installation in accordance with paragraph 2-4 of AR 190-5, Motor Vehicle Trr~ffic Supen•ision (22 May 2006).

6. The Gl Adjutant General, USMA, is hereby delegated:

a. Authority to approve or disapprove requests for retention on active duty for continued medical care or disability processing in accordance with AR 635-200, Active Duty Enlisted Administratil•c Separations (27 April 20 I 0/RAR 6 September 20 I I).

b. Authority to approve transition pennissive TDY requests or excess leave in accordance with paragraph 5-31 c of AR 600-R-1 0, Lea1•es and Passes ( 15 February 2006/RAR 4 August 2011 ).

c. Authority to approve and disapprove requests for United States Military Academy tour extensions.

d. Authority to approve or disapprove Anny Educational Requirements System (AERS) validations and re-validations in accordance with AR 621-108, Militm:v Personnel Requirl!mentsfor Ci1·ilian Education (26 March 2007).

7. The Staff Judge Advocate, USMA, is hereby delegated:

a. Authority under Article 25(e), UCMJ, to excuse up to one-third of detailed court­martial members before the comi-martial is assembled in accordance with paragraph 5-21 c of AR 27-10, J.,;filitcny Justice (3 October 2011 ).

b. Authority to approve, but not disapprove, the payment of transportation expenses and allowances for civilian witnesses to appear before A1iicle 32 hearings, UCMJ actions, and criminal or civil investigations in accordance with paragraph 5-12 nfAR 27-10, lvlilircn:1' Justice (3 October 201 I).

c. Signature authority for the following matters: refe1nl or court-mmiial charges; court­martial convening orders; colllt-mmtial promulgating orders; correspondence implementing couit-mmtial member selections; confinement orders; notification of appointment as a recoupment investigating ofticer, misconducl investigating officer, or member of an administrative separation board; authenticating documents rei ating to mi I i tary justice and special actions (e.g .• cadet separation proceedings) in accordance with AR 25-50, Preparing and Managing Correspondence (3 June 2002), and AR 27-10, Militmy Justice (3 October 20 II). This authority may be further delegated by the SJA, in writing, to the Chief of Military Justice, to the Legal Administrator, and the Senior Paralegal NCO. The authority to sign confinement orders may be further delegated by the S.IA, in writing, to all trial counsel.

d. Authority to accept service of process ft)r civil suits against the USMA and the Superintendent while functioning within the scope of ofticial duties in accordance >vith AR 27-40, Litigation ( 19 September 1994).

e. Authority to determine persons who may be admitted to observe investigative proceedings convened under the provisions of AR 210-26, United States Militw:v Academy (9 December 2009).

8. The 0-H/DircGtor, Resource Management, USMA, is hereby delegated:

a. Management approval tor analytical services in accordance with AR 5-5, Army Studies and Analyses ( 13 April 20 II) and AR 5-14, Management of Contracted ildl'isOJy and Assistance Scn·iccs (15 January 1993).

b. Authority to apply appropriate acGotrnting principles and standards in accordance with the ChiefFimmcia/ Officers (CFO) Act of 1990 ..

c. Authority to obligate funds issued to USMA in accordance with Volume 3, DoD Financial Management Regulation (FMR) 7000.14-R and subsequent updates. HQDA and/or the 08, USMA will issue quarterly, annual, and/or as required fund targets to the Directorates, as approved by the USMA leadership. The G-8 will ensure that the amounts of the fund targets are not exceeded.

d. Authority to further distribute USMA funds, to delegate responsibility for fund control within the 08, and to impose restrictions required to maintain control of such funds. This delegation does not relieve the 08 of responsibility for violations of 31 U .S.C. 1517, the Anti Deficiency Act, that result !'rom failure to comply with fund control policies or procedures in acGorclance with Volumes l-15, DoD FMR 7000.14-R ..

c. Authority to certify 08 appropriated fund financial reports and sGhedulcs in accordance with 31 U .S.C 150 I and Volume 3, DoD FMR 7000.14-R.

9. The Director of Academy Advancement (DAA) is delegated the authority to accept gifts of a value of$5,000 or less in accordance with I 0 USC ~ 4356 and USMJ\ Regulation 1-100 (6 March 2009) .

I 0. The Civilian Personnel Officer, West Point, is hereby delegated the authority to act for the Supeiintendent in administration of the civilian personnel management program for appropriated and nonappropriated fund activities, in accordance with Civilian Personnel Regionalizntion Guidance 97-1 ( 18 December 1996 ), to include:

a. Providing the service and assistance necessary to obtain, compcnsntc, usc, develop, and retain an effective civilian work force;

b. Approval of training by, in, or through nongovernmental facilities for civilian employees;

c. Authority to serve as the principal poii1t of contact for labor relations.

II. 13. All Activity Directors, Department Heads or their designated representative in the f:.'Tade of LTC or GS-14 and above are hereby delegated authority to approve all leave and pass requests for personnel assigned or attached in accordance with A R 6 0 0- 8- I 0 paragraph 1-41~ Leaves and Passes ( 15 February 2006/RAR 4 August 20 I I). This authority many not be used to establish leave and control procedures independent to HHC, USMA Commander's Leave and Pass Policy.
