Request for Proposal Appeals Policy I Policy A. The following reasons shall be grounds for automatic rejection of an application due to failure to conform to the requirements of the RFP: 1. Applicant did not meet the required application deadline 2. The application is not signed in the appropriate places. Signatures on

attachments or other documents do not count as signatures on the application 3. Application is incomplete 4. Non-compliance with administrative requirements, including but not limited to

absence of attachments 5. Application submitted in an unacceptable manner, e.g. telephone, fax, e-mail

B. Nothing in this policy shall preclude the WIB from notifying the applicant of the deficiencies in the application; however, all corrections must be completed and received by the WIB by the application deadline as set forth in the RFP.

A request for protest (appeal) shall be denied in the following instances:

1. The rejection of an application for the reasons listed in section I.A above;

2. Disagreement with review panel's exercise of its proper discretion or professional judgment in the evaluation of a proposal; and

3. As an opportunity to receive feedback regarding the perceived strengths and limitations of its proposal from the WIB RFP Review Committee.

C. Unsuccessful applicants may file an appeal if there is reason to believe that there has been an unfair application of the RFP policy and / or the RFP procedure as stated in NJAC 10:3-3.

D. The RFP shall become public information at the completion of the RFP process including the protest process, despite any other disclaimers submitted by the applicant to the contrary.

E. The WIB shall hold all awards of contracts pending potential requests for protest of non-winning applicants. The protester must provide an explanation as to why it believes that a hearing is necessary to resolve the protest. If an appeals hearing is requested, the Contracts shall not be awarded until after the completion of the appeals process.

F. The WIB may, in those instances where failure to award the contract will jeopardize the safety and welfare of the program participants, award the Contract despite the

above provisions. The WIB shall document all cases where such action(s) is required and notify interested parties.

II Procedures

1. All protests shall be in writing and received by the WIB within seven (7) days from the date of the announcement of the award decision. The protest shall set forth a detailed statement of the legal and factual grounds of protest including copies of relevant documents if applicable. If the protester requires a hearing, the protester must provide an explanation as to why it believes a hearing is necessary to resolve the protest. The WIB shall date stamp all protest requests upon receipt.

2. An impartial panel consisting of members of the Workforce Investment Board as deemed necessary shall review the information presented by all parties and present a recommendation to the WIB Director.

3. A review panel shall be convened and the review of the protest data shall be completed within ten (10) days from the receipt of the protest request.

4. The Chairperson of the WIB RFP Review Panel shall summarize and submit a written recommendation to the Director and all parties participating in the internal review within five (5) days from the termination of the panel review. A written decision shall b565e mailed out to the appellant.

5. The Division of Workforce Operation’s Director shall be entitled to review all records and documents referenced in the presentation of the case. Such documents, if required, shall be made available to the Division Director.

6. Parties to the protest have seven (7) days from the date of the recommended disposition to deliver to the WIB Director any written comments and exceptions to the decision.

7. A Disposition shall be made within fifteen (15) days from the date of the request and sent by mail to the petitioner.

ATTACHMENT E Instruction for Certification

1. By signing and submitting this proposal, the prospective recipient of Federal assistance funds is providing the certification as set out below.

2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective recipient of Federal assistance funds knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the Department of Labor (DOL) may pursue available remedies, including suspension and/or debarment. 3. The prospective recipient of Federal assistance funds shall provide immediate written notice to the person to whom this proposal is submitted if at any time the prospective recipient of Federal assistance funds learns that its certification was erroneous when submitted or has become erroneous by reason of charged circumstances. 4.
