UNIFORM ALLEGATIONS The uniform allegation hand book is designed to provide for the uniformity of allegations reported on the Rights of the Offender in the Revocation Process form. Because the Rights of the Offender in the Revocation Process form is now pre-populated in the Offender Information Management System (OIMS) from the Violation Report (VR) the examples provided are intended to assist the Parole Officer in completing the VR correctly. This format should also facilitate continuity in the hearing process, to include the conduct of hearings. The examples provided have been divided to differentiate the Statutorily Mandated Conditions versus the General Conditions of Release. Uniform Instructions Uniform Instructions refer to the standardized method of reporting the parole officer's instructions to the offender concerning rules, terms and conditions of release as they appear on the offender’s parole or mandatory release certificate.

The Summary section of the VR should include the specific instructions that were given to the offender. This constitutes the Instruction Narrative. These instructions help to establish that the offender was aware of the specific rule, term or condition when the alleged violation occurred. The Summary section should also include the specific alleged violation. This constitutes the Violation Narrative. This standardized method was developed to foster uniformity and clarity. The examples in this handbook illustrate how each Instruction Narrative and Violation Narrative should be written in the Violation Report. This section of the Violation Report establishes Probable Cause. Probable Cause is the level of proof that a reasonable person would require to believe an offense was committed. To establish probable cause, the narrative for law violations must include: • The offender was the one arrested, charged, indicted or convicted of the

offense; • The arrest has been verified through a reliable and credible source, i.e. a the

sheriff's office or police department; • The facts that the parole officer either has personal knowledge of or facts that

were related to the officer by a credible third party.

• The offense(s), date of offense(s) and location of offense(s). Only the essential information concerning the offense is necessary. Do not add extraneous information in this section. Additional information regarding a law violation should be entered in the Additional Offense Description of the Violation Report.

Note: Instructions from the releasing officer should only be used if the offender failed to report immediately after release from the institution and should thereafter be the last date all rules from the Parole Certificate/Mandatory Release Certificate were read to the offender. The parole officer should adhere to the examples as cited on the following pages.

GENERAL CONDITIONS OF RELEASE

General Conditions of Release as noted on the backside of the Parole Certificate are listed below. After each rule is an explanation of how to prepare/write an alleged violation of the applicable rule and a sample uniform allegation.

The format should include the rule, the name of the offense, the date of the offense, the location of the offense and any other element making the offense unique.

The information should be completed as follows:

On/About Enter the time period in which the violation is alleged to have

occurred or if it is an ongoing violation such as failure to report or failure to pay fees.

At/About Enter the location where the violation is alleged to have

occurred. District Parole Office name or City, county, and state will suffice.

Comp/Adj./Other On all technical violations, enter what the offender failed to do.

For law violations enter the offense that the offender committed.

Complainant Enter the name of the complainant. In criminal cases that

include victims, enter the name of the complainant or victim, -not the arresting officer’s name, or the arresting agency. In criminal cases such as DWI, Possession of Controlled Substance, or Public Intoxication, the complainant is the arresting officer. In drug related

Adjudication Enter the details of the case if it resulted in a conviction. This

information should consist of the following: The date of conviction, the Court of conviction, the cause number, and the sentence.
