This month, HMRC/HMT published an important consultation document on the Soft Drinks Industry Levy and are asking for views on the impact of these proposals to help determine the final shape of the levy.

UKWA urges members operating in the soft drinks industry to get involved by reading the proposals and taking part in the consultation process – this is your chance to make sure your voice is heard!

Our excise expert Alan Powell has analysed the proposal, which he says is effectively a non-harmonised excise duty, and has highlighted key points to consider.

• The levy will be applied “at source” ie on the producer or brand owner, but unlike the recognised excise tax warehousing model, there seems to be no “suspension” of the levy once the drinks have been packaged for UK production. The levy will apply as a de facto import duty for imported products and the tax is intended to be passed on in the supply chain

• The duty is a consumption tax so should not be borne (other than temporarily) by the producer or business in the chain, but like most excise duties there seems to be no bad debt provision if the incidence of tax (passing) on/paying back does not occur.

• Credit for exports (which is really drawback) is limited to the producer, which again penalises an intermediate company which exports those goods, particularly if the goods on which duty has been paid are not consumed in the UK (and possible double taxation if there is a sugar/soft drinks tax on the same goods in another member state).

Funding Apprenticeshipschanges will benefit our industry

In spring 2017 the way the government funds apprenticeships in England is changing. Some employers will be required to contribute to a new apprenticeship levy, and there will be changes to the funding for apprenticeship training for all employers.

There are important key changes that will benefit the industry and increase

apprenticeship take up by SME’s, including:• Government will pay 100%

apprenticeship training costs for some 16-18yr olds

• £1000 grant for employers taking on 16-18yr olds on Apprenticeship Standard

• Opportunity for some employers to ‘co-invest’ just 10% of apprenticeship training costs

• Government will co-investment in training apprenticeships at a higher level

• Available funding for Apprenticeship Standard, where employers pay the levy
