Dit is dat die besluit na bewering nie in oor- eenstemming met beplanningsbeleid is nie, omdat die ontwikkeling buite die die stedeli- ke grens val; die grond na bewering ’n hoë landboupotensiaal het; en sekere vleigebie- de na bewering nie beskerm word nie. Faktore Volgens Die Burger het regter Davis in sy uitspraak beslis dat Bredell alle faktore oor die hoë landboupotensiaal, vleigebiede en die verskuiwing van die stadsgrens in ag ge- neem het toe hy sy besluit geneem het. Hy het ook die korrekte prosedures gevolg om tot die besluit te kom. Davis het verder gesê omdat die aansoek ’n hersieningsaansoek was, gaan hy nie die minister se beslissing met sy eie vervang nie. Indien dit ’n appèlaansoek was, sou hy Bredell se besluit vervang het indien hy ge- dink het dit moet verander, het Die Burger berig. Danny St. Dare, uitvoerende komiteelid van die Durbanville-gemeenskapsforum, het gesê die forum “is teleurgesteld in die be- sluit van die hof”. Daar word nou gewag op die geskrewe uit- spraak en dit sal eers bestudeer word om fi- naal te besluit of daar gronde is vir ’n appèl, het hy gesê. Buiten dié moontlike appèl, is daar ook nog ’n aansoek in die hooggeregshof hangen- de dat die Stad Kaapstad se besluit in April verlede jaar om die stedelike grens aan te pas om dié grond tot ’n stedelike ontwikke- lingsgebied te hersoneer, hersien word. Dié besluit gee die ontwikkelaar die reg om die grond te laat onderverdeel en ontwikkel. Aansoek St. Dare het gesê daar word nou gewag op ’n hooggeregshofdatum vir dié aansoek. Die aansoek is aanvanklik saam met boge- noemde aansoek ingedien op versoek dat die twee sake saamgevoeg word. Regter Davies het egter op 2 Desember met die eerste aanhoor van die saak dié aansoek teen die Stad Kaapstad van die rol geskrap nadat die samevoeging van die sake deur die respondent teengestaan is. Kwessie Nóg ’n hangende kwessie is die bedrog- klagte wat die Durbanville-erfenisvereni- ging in November 2012 by die polisie aan- hangig gemaak teen die ontwikkelaar. Daar word beweer dat daar met die verslag oor die landboupotensiaal van die grond ge- peuter is. Die saak word glo steeds onder- soek. George Sieraha, voorsitter van die Dur- banville-gemeenskapforum, het gesê hy gaan nie in hierdie stadium kommentaar le- wer oor die regter se uitspraak nie, omdat “die saak in hierdie stadium te sensitief is”. Hamlin Jansen van Vuuren, kurator van Rust-en-Vrede in Durbanville, staan by die reuse-tak van die historiese eikeboom wat afgebreek en die ou ingang van die gebou onder sytakke en blare verdwerg. Die nuwe jaar het by Rust-en-Vrede in Wel-lingtonweg, Durbanville met ’n slag begintoe ’n reusetak van ’n ou, historiese eike-boom in die tuin Sondag afgebreek het.

Die tak – kompleetmet ’n byenes in ’n hol-te in die tak – het met só ’n geweldige slagvoor die ou ingang na die gebou geval, datdit die alarmstelsel van die gebou aktiveerhet.

Toe TygerBurger gisteroggend daar kom,was die ou ingang na die gebou behoorlikverdwerg onder die sytakke en blare.

Volgens Hamlin Jansen van Vuuren, ku-rator vanRust-en-Vrede, het die sekerheids-firma haar omstreeks 17:00 gebel oor dievoorval.

Twee groot plantpotte is stukkend en ’ndeel van die gebou se geut is beskadig.

Volgens Jansen van Vuuren het hulle ge-mengde gevoelens oor die verlies van dietak, aangesien ’n swermbye kort-kort in dieholte in die boomtak kom nes maak het.

Hulle wag juis nou op die Stad Kaapstadomdie byenes te komverwyder, voordat dietak opgesaag en die stompe verwyder kanword.

Volgens Janse van Vuuren het die Stadonderneem om dit voor einde vandeesweekte doen.

’n Byenes is skaars drie, vier maande ge-lede ook uit die holte verwyder en dit moeskort-kort gedoen word, sê sy.

Volgens haar is dié boom en ander bomein die tuin nie verlede jaar gesnoei nie. Hul-le het die Stad in Junie gekontak om dieboom te kom snoei, maar dis nooit gedoennie.

Die Stad kon nie betyds vir kommentaarbereik word nie.

The support group in divorce recoverywill help people to recover from the painof divorce or separation and help inrebuilding a new life. ’n Buurman het aan die plaaslike seker-heidsfirma rapporteer dat hy verdagtes oor’n muur sien spring het. Die inbrekers hetby ’n venster van die huis in Claasenstraattoegang verkry deur die diefwering te buig.

’n Sekerheidsbeampte het gesien hoe ’nverdagte die erf probeer verlaat het net toehy daar aankom. Die verdagte het egter om-gedraai en terug in die huis in gevlug. Diesekerheidsbeamptehet gesiendieman is ge-

wapen.Nog sekerheidsbeamptes en die polisie is

ontbied en hulle het die huis omsingel omte verhoed dat die inbrekers ontsnap.

Die polisie se nasionale intervensie-een-heid (NIU) is ontbied, maar kon aanvanklikniemand in die huis vind nie. Die gewapen-demans is in die dakvandie huis opgespoorná ’n verdere soektog.

’n Skietery het ontstaan,waarin twee ver-dagtes gewond is, het Rhode gesê.

Die vyf verdagtes is in hegtenis geneem.Daar is beslag op twee vuurwapens gelê. Aldie goedwat hullewou steel, is teruggevind.

Die polisie het ook beslag gelê op ’n voer-tuig wat in Phillipi-Oos gesteel is.

Van die verdagtes word verbind met mis-daad in ander gebiede.

While families across the worldcame together to celebrateChristmas, one plucky dove

decided to find his own family.Pietie, as he is now known, has

made a new home for himself with theLepnik/Lambrechts family in Stellen-berg.“My grandmother was eating

peaches in the braai room and he justcame in and had a piece and stayed,”explains nine-year-old Björn Lepnik.“There have been other birds here

before, but they usually just stay awhile and then leave again,” hismom,Adele, adds.Matriarch Barbara Lambrechts, re-

calls seeingPietiewhile shewashang-ingup thewashingandwhen shewentback inside to knit, he simply joinedher.“But once he saw Björn and Adele

he just stayed with them,” she says.

Human contactPietie seems to be a normal laugh-

ing dove, but is very tame, and lovesbeing aroundpeople.He especially en-joys sitting on people’s shoulders orheads.“He must be used to people,” Adele says,

because he even allows people to touch him,but he’s got no tag on his leg like homingpigeons usually have. His origin remains amystery.Pietie flew into the family’s lives around

23 December last year, and has been theresince.Adele initially tried to encouragehimto sleep in a cage, but he seems more com-fortable spending his nights on top of the ex-tractor fan above the stove in her kitchen.During the day he often perches himself

on Adele’s laptop and “helps” her type, orwatches TV series with her, but only afterhe’s done his morning gallivanting.Another reason she believes he must be

used to human contact is the fact that he lis-tens when you speak to him and even plays

with Björn. He comes inside when the fami-ly ask him to and sits wherever they indi-cate he should.

Vocal repertoireWhen Pietie first came to stay with them,

he onlymade cooing sounds, but lately, he’sadded dove-like sounds to his vocal reper-toire, which makes Adele think he’s stillyoung.Adele has made sure that Bjorn under-

Beachgoers have been warned to be onthe lookout for sharks during the sum-mer season.

According to a statement by the City ofCape Town, the presence of great whitesharks in the in-shore areas increases at thistime of year.The Fish Hoek shark exclusion net is be-

ing deployed and retrieved daily and SharkSpotters are monitoring identified beachesto ensure the safety of all visitors to in-shoreareas, council stated.SinceSeptember, therehavebeen 57 shark

sightings at beachesmonitored by the SharkSpotters.There have been 36 sightings at Muizen-

bergCorner, sevenatFishHoek, five atMon-wabisi, three at St James, two at Kogel Bay,two at Glencairn, one sighting at The Hoekin Noordhoek and one at Clovelly.With the presence of great white sharks at

in-shore areas expected to increase over thesummer season, the City of Cape Town is en-suring that the necessary precautionarymeasures are being effected.Shark Spotters are monitoring identified

beaches and the Fish Hoek shark exclu-sion net is being deployed and retrieved dai-ly.

Effective barrierThe Fish Hoek exclusion net has proven

to be an effective shark safety measure bycreating a physical barrier preventing anysharks from entering the bathing area.Trials conducted during 2013 and 2014 in-

dicated that the risk to marine life remainsvery low and that there are high levels ofpublic support for the exclusion net becom-ing a permanent feature at FishHoekBeach.Until March, the Fish Hoek exclusion net

will operate daily, depending on the weath-er.Weekends, public holidays and school hol-

idays will be prioritised.

The exclusion net will not be deployed ifweather conditions (wind and swell) aredeemed to be unsuitable; this will be as-sessed on a daily basis. Should weather con-ditions deteriorate over the course of a dayafter the net has already deployed, the netmay be removed as a precautionary meas-ure.Additionally, if there is a high presence of

whales or other marine mammals in the ar-ea the net will not be deployed.–The net will also not be deployed when

trek-netting is taking place in the area.

If a whale moves into the area while thenet is deployed, the Shark Spotters herd theanimal away from the net and out of the ar-ea, using the exclusion net boat.This is in accordance with the approved

whale disentanglement strategy and resi-dents should not be concerned if this occurs.

Sightings commonOn days the exclusion net is deployed, the

operating hours will be from 09:00 to 17:00,and may occasionally be extended to allowfor lifesaving training or events.

The Shark Spotters will keep beach usersinformed via Twitter (@SharkSpotters) andFacebook as to whether the net is deployed.Surfers arewarned to be vigilant in the ar-

eas between Sunrise Beach and MacassarBeach during the spring and summermonths, as research has shown that sharkpresence in these waters is extremely com-mon at this time of year.Surfers should also be aware that sight-

ings of great white sharks at Noordhoekbeach are common on the days following anorth-west wind.

The 2014/15 festive season will godown as one of the safest on recordfor the City’s beaches.

This is due to the number of drowningincidents having dropped significantlyin comparison to previous festive seasonincidents.Three drowning incidents were re-

corded on beaches during the festive sea-son, between September 2014 and Janu-ary 2015, compared to 18 drowning inci-dents over the same period in 2013/14.With tens of thousands of people on the

city’s beaches over the festive season,this is an extraordinary feat, says Cityof Cape Town sport, recreation andamenities department director GertBam.

Combined effort“We are pleased that the combined ef-

forts of all role players have yielded suchpositive results. The department’s exten-sive summer safety campaign helped toeducate members of the public on basicsafety tips to observewhen on the beach-es. In addition, law enforcement officershave beenhighly visible andhave confis-cated a substantial amount of alcohol,which helped to reduce the number of in-cidents associatedwith intoxication,” hesaid.The decrease in the number of drown-

ing incidents also speaks to the qualityof the lifeguard service provided by Life-saving Western Province and their asso-ciated lifesaving clubs – particularlyover the weekends around Christmasand New Year’s Day when a number ofpeoplewere assisted by the lifeguards on

duty, Bam says.“Despite the drastic drop, every

drowning incident is one too many andeach incident is documented and re-viewed to ensure that further precau-tions are taken to prevent such incidentsfrom happening in the future,” he says.

Safety tips“Members of the public are reminded

to swimonly indesignated swimmingar-eas indicated by flags and law enforce-ment officers patrolling beaches to assistin ensuring that people swimonly in des-ignated areas. We ask that all people re-spect the instructions of both lifeguardsand Law Enforcement officers and alsoreport any irresponsible behaviour inthe water, such as people swimming offthe rocks, so that they can keep peoplesafe.”Beachgoers should keep the following

safety tips in mind:• Always swim between the red and

yellow flags. These indicate safe, super-vised swimming areas. An area outsideof these flags could have dangerous ripcurrents and tides.• Only swim in areas where other peo-

ple are present. Swim in groups and ad-vise friends or familywhen you go swim-ming.• If you find yourself in trouble, raise

your arm and wave to attract the life-guard’s attention. Try not to panic, asthis will make you tired.• If you see someone in trouble in the

sea, alert the lifeguards or find trainedhelp. Do not put your own life in dangeras well.

The introduction of the newgreen lidded wheelie bins forrecycled waste in the Bellvillearea was an excellent innovati-on. This has given all the localresidents a chance to getinvolved in a useful project.Unfortunately, there alwaysseems to be a downside.

Where I live in La Rochellewe have our normal refuseremoval service on Wednesdayand our recycled material onThursday. It is customary forresidents to put their bins outfirst thing in the morning. Thisis soon followed by a stream ofstrangers who inspect the binsfor useful material. Theirpreference seems to be bottlesand similar saleable objects. Ihave no problem with thesegentlemen collecting thismaterial and disposing of itsomewhere for remuneration.After all we are all endeavou-ring to eke out a living. What Ido feel strongly about is whenthey sit in the park to sort theirsaleable material and leave alltheir discarded mess behind forlocal residents to clean up. Mybiggest concern, however, isthat if this practice escalatesand there is little left in therecycle bins, it would no longerbe profitable for the recyclecompany to continue this verynecessary service.

The homeless problem inBellville is now becomingchronic and if this matter is notseriously attended to we willsoon be having more peopleliving on the streets than in thehouses.

Hoewel die meeste lande dié terreur-daad ten sterkste veroordeel het, hetvryheid van spraak weer op nuut onderdie vergrootglas gekom. Baie kommenta-tors meen dat die satiriese koerantCharlie Hebdo alle grense van vryheidvan spraak oortree het deur sy draakste-kery met Islam en ander godsdienste.

Wat dié kommentators nie in ag neemnie, is dat vryheid van spraak in dieFranse tradisie geen grense ken nie – ’nland met ’n eeue oue geskiedenis vanskerp en soms kwetsende satire.

Hoewel dié soort satire in weinig anderlande in die wêreld geduld word – selfsnie eers in die VSA en Brittanje nie –hou die beginsel daarvan tog vir onsalmal in Suid-Afrika ’n les in.

Verdraagsaamheid teenoor mense watnie dieselfde mening as jy huldig nie, isheel moontlik die grootste hiervan. Asiemand nie aan jou kerk behoort, joupolitieke sienswyse deel nie, nie vir diedieselfde rugbyspan as jy skree nie,beteken dit nie dat daardie persoonverkeerd is en sosiaal gekastreer moetword nie. Firework displays on New Year’s Eve isa common sight enjoyed by many.However, despite being a spectacular

sight, the illegal discharge of fireworks innon-designated areas has had a negative ef-fect on some pets and their owners.

One pet owner from Marinda Park inKuils River said she fears for the safety ofher dog after it ran off on New Year’s Evedue to fireworks near the family’s house.

“We came home from church after mid-night and discovered our dog had runaway,” said Yvette Smith.

Smith said the family’s dog Mo, a minia-ture pinscher adopted from the Animal An-ti-Cruelty League, has a limp and is easilytraumatised.

Lost petsAnimal welfare organisations have been

inundated with lost petsWanika Davids, spokesperson for the

Cape of Good Hope SPCA, said the organisa-tion collected about 20 runaway animals onNew Year’s Eve as a result of fireworks.

“Two of them were involved in motor ve-hicle accidents,” said Davids.

“Kraaifontein was the worst this year interms of illegal fireworks, judging by thecomplaints we have received,” she said.

Mpho Hlalele, Animal Anti-CrueltyLeague assistant general manager, saidthey had also their hands full. A total of 16lost dogs were handed in at their Bellvilleand Epping branches over New Year’s Eve.

“The majority were from Kuils River andKraaifontein and a few from Brackenfelland Goodwood.

“We cannot say whether they are all a di-

rect result of fireworks, but they were allhanded in on either the 1st or the 2nd of Jan-uary,” said Hlalele.

Strain on resources“That number may not sound terribly

high, but as you can imagine we have somany animals already in our care. It stillputs a strain on our already limited resour-ces,” Hlalele said.

She said most of the dogs do not have mi-crochips which could have helped the orga-nisation find the owners.

The City of Cape Town identified eightdesignated areas for fireworks. Despitethis, several complaints of fireworks in resi-dential areas were logged at the City’s 107call centre.

Richard Bosman, executive director forsafety and security at the City, said law en-forcement received 10 complaints relatingto the illegal discharge of fireworks on NewYear’s Eve.

People also complained to TygerBurgerabout fireworks discharged in Bellville andBrackenfell.

Theo Layne, spokesperson for the City’sfire and rescue services, said firefighters re-sponded to 14 vegetation fires between mid-night on New Year’s Eve and 01:00. Theyhave attributed the fires to the illegal dis-charge of fireworks as they do not usuallyrespond to so many vegetation fires duringthe night.

In a world where most people are so accus-tomed to seeing homeless people thatthey barely notice them, two members of

the community took positive action.While walking her dogs, Parklands resi-

dent Reese Harley noticed a homeless mansleeping in the park. That’s not unusual.But in an area where people often distrustthe homeless so much they don’t even makeeye contact, Reese began talking to him. Hisname is Michael Ntehelang and they gradu-ally got to know each other during her eve-ning walks.

Reese provided a few things to make hislife more comfortable, and then she saw anopportunity to change his life completely.

Reese runs a charity organisation calledPawfriends, helping township dogs andcats. She gets them sterilised to prevent un-wanted litters and helps obtain veterinarycare when needed. Sometime she workswith the Fallen Angels animal rescue orga-nisation.

Fallen Angels is a haven for forgotten andneglected animals near Melkbosstrand.They were started in February 2014, whenGayl Basson sold her house in FlamingoVlei to buy a piece of land.

Gayl and Shireen Williams are workingvery hard, with limited resources, to createa much-needed shelter for animals in need.Table View and surrounding areas is a vast,sprawling urban area which includes thepoor communities of Dunoon and Joe Slovo,yet there is no SPCA or animal welfare shel-ter in the area. All the organisations wor-king in the area rely on a foster system tohouse animals in need.

Fallen Angels still has no electricity andvery little infrastructure. They needed helpwith building enclosures and kennels, aswell as general care of their animals. Reesesaw a person who was down on his luck andneeded a job and a home, so she spoke to Shi-

reen and suggested that Michael might besuited to help them.

Shireen didn’t hesitate. She trusted Ree-se’s judgement and immediately went tofetch Michael and his few belongings.

After three years on the streets, a bad fa-mily situation and a drug history, Michael(22) is now living and working at Fallen An-gels. He has been there for two months andis very happy. He loves working with thedogs and helping with the cleaning and gar-dening. He is learning new skills every dayand is very happy to have a place to stay.

Fallen Angels and Pawfriends have chan-ged the destiny of many animal’s lives. Thistime they changed the destiny of a humanlife.

Spur Cape Summer Trail Series kicks off atTygerberg Nature Reserve tonight (Wednes-day).

The series is one of the most popularevents on the South African trail running ca-lendar, with each race in the countrywideseries usually selling out. This year seemsto be no different.

About 800 runners are expected to take ontonight’s challenging course, starting atsunset.

In order to cater for the growing numberof runners, the Spur Trail Series will for thefirst time implement batching. In both thelong and the short course, four batches willset off two minutes apart in order to alleviatecongestion on route and make the experien-ce more enjoyable to both the front runnersas well as the back-enders.

Bernard Rukadza will again be the man tobeat as he returns to defend his summer longcourse championship title. Some of his

strongest competition will come from long-time short course top performers RaydonBalie and Riaan Wildskut, as well as triath-lon veteran Lieuwe Boonstra.

In the ladies field, Marié Wessels will belining up as favourite but this is always awide open race and it remains to be seen whowill give her a run for her money.

The second race in the series, which alsostarts at sunset, will take place at the Con-stantia Greenbelt on Wednesday 28 January,with the third race taking place at LebanonForest in the Elgin Valley on Sunday 1 Fe-bruary.

A golf day in aid of the Yarden Children’sEnrichment Centre in Durbanville is due totake place on 12 February at the BellvilleGolf Club.

The centre is set to open this month andthe organisation is in desperate need of do-nations.

The idea for the centre came about whenthe parents of Pierre Cloete, who has a spas-tic quadriplegia cerebral palsy impairmentas well as epilepsy, struggled to find a schoolor daycare centre that would be able to ac-commodate him.

For the first eight years of his life, his pa-

rents had to employ a full-time caregiver totake care of him.

After realising there is a need for such aschool in the northern suburbs, Pierre’s pa-rents decided to open one.

The Bergsig Dutch Reformed Church inDurbanville has made five Sunday schoolclass rooms available in which the centrecan operate.

er boat roared forward at 80km/h.“Somewhere along the line there is always

a close call,” states the pilot nonchalantly.Neither of the two could afford to fall off

the boat if their aspiration of finishing firstoverall in the Trans Agulhas Challenge wasto be realised.It was day five of the world’s toughest in-

flatable boat race and they were knee-deepin the long haul.Pilot Stefan Lindeque, and co-pilot Tony

Ingram hoped the 131km stretch from Gans-baai to Strand would be calm and unevent-ful, but they also knew that power boatingbeyond the waves was never really “calmand uneventful”.

Limits of enduranceThe twowere thus not surprised when the

waters became choppier than a lumberjackon steroids.For 10kmnearCapeHangklip their endur-

ance was tested to the limits – this after theycompleted 188km on day one, 86km on daytwo, 161km on day three and 111km on dayfour.“The stretch from Gansbaai to Strand is

usually flat, but that day it was really chal-lenging. The pounding water was extremelyrough. After five days, 10km of poundingwas the last thing we wanted,” says TableView’s Lindeque.At that stage of the race they knew they

stood a chance of not only winning theirclass, but also trumping the faster modifiedpowerboat class – something that no-one

has ever achieved before.But if one of them was thrown overboard

then the bid for this remarkable achieve-ment would have to wait till next year.After amoment that seemed to last an eter-

nity, Tony landed on the boat again.A split second later the airborne Stefan al-

so returned to the inflatable Nulandis.That was close...
