    Stupid Property TricksAfter months of complaining

    about how the beauty of theForbidden Island of BoonvilleAvenue will be forever lost if therightful owner of said property,the general public, is allowed to setfoot on it, the Islanders went ahead andspray painted all over the pristine concreteleading to the bridge, claiming that particular

    square footage, between the road and thewater, to be a private easement. There are, ofcourse, several problems with this.

    1) Its not private property. Those 15feet are at the end of a public street, whichmeans that theyre not only wrong about theprivateness issue, theyve also just made amess of public property. Vulgar.

    2) There is a 15 foot utility easement fromeach waterfront house to the water. Per thedeed we were provided with by the District,residents are prohibited from putting upbuildings on those easements.The easementsend where the sides of the property do. Sincewhen do easements extend laterally from a lotto prevent people from walking at the end of astreet? Since never, thats when.

    3) The taxing district, which collects moneyfrom homeowners for weed and mosquitoabatement, doesnt own any property. At all.So if theyre claiming the 15 feet leading tothe bridge as District property, theyre out ofluck. And besides, that should be referred

    to as government property if it did belongto the District. No, theyre claiming privateproperty, which means it must belongto the owners of 710 Edgewater and 1164Booneville Ave, the two addresses straddlingthe end of Booneville Ave.

    Lets recap. At rst, the District said thatthey owned the headwaters of the Comal River.

    Then we published documents provided bytheir attorney which showed that they, in fact,do not. They also claimed to have exclusive

    use of The Forbidden Island ofBooneville Avenue, and, once

    again with the assistanceof their attorney, found thedocuments that showed that

    they, in fact, do not. The onlyclaim they could possibly make

    is for the exclusive use of Pecan Island,which is a completely different piece of land,in a different part of the river. Oops.

    The issue of taxes keeps coming up fromthe cuttersh who live off of the Islandersinvitations to swim in the headwaters. Nobodyhas ever paid property tax on that land. Thereis no HOA. There is no common property inthat neighborhood. The taxing district ownsnothing. The residents only own their lots.And now the San Antonio Express-News has

    picked up the story. Oh dear. Oh dearie dear.In the November 29 edition of the

    Express-News, District Chairman Cecil Eagerconceded that the District does not own theForbidden Island, and that he believe(s) itsowned by the residents of the subdivision.The residents of the subdivision, of course,own no common property. According to theExpress-News, Eagers statement does notconform with what he told police when heled a trespass report. Hmm. The stories arechanging awfully quick, especially for a groupthats had a 75 year head start on getting theirducks in a row. Were going to need to have apeek at that trespass report as well

    So heres where theyre at. According tothe Express-News, the police have acceptedsomething as proof that the Islanders do ownthe land at the end of Booneville Avenue, andthat they do have the right to close off that15 foot stretch of concrete. HOWEVER, thepolice were unable to provide that paperworkto us, advising that we would have to gothrough Patrick Stonewall Aten over at CityHall for a copy.

    omal County courtrooms will see a busyDecember as at least three high-prole casesontinue this month. Here are the three with a

    brief description of what could be expecteduring their hearings. Bear in mind that thecheduling and intended subject matter ofourt hearings have a tendency to changen short notice.

    onique Rathbun vs. Churchf Scientology (Dec. 11)

    he legal saga that has become a Comalounty womans harassment lawsuit againstarious entities within the church gets partially

    back on track as arguments continue over aemporary injunction and jurisdictional issues.

    Church lawyers have made a fewttempts to derail the lawsuit. The rst wasfailed attempt to have Monique Rathbuns

    ttorneys disqualied.In October, the Church of Scientology

    International (CSI) led an Anti-SLAPP motion,hich is an attempt to have a lawsuit dismissedver First Amendment Claims. The Church is

    insisting that its members had the legal righto protest Monique Rathbuns husband, Marty,

    former high-ranking member of the Church.he Church argues that since Marty Rathbun

    has spoken publicly against the Church, heis a public gure and, thus, fair game. While

    onique Rathbun has never spoken out againsthe Church, its lawyers argue that since she ismarried to Marty Rathbun and has appeared

    ith him as he has criticized the organizationnd its leadership, she is a public gure asell. CSI says the lawsuit is violating its Firstmendment right to associate.

    CSI also admitted that it hired privateinvestigators to spy on the Rathbuns, butlaims that it did so only to protect its religious

    rights because Marty Rathbun was practicingcientology outside of the Church, whichSI says violates the Churchs trademark,opyright and patent laws.

    While an Anti-SLAPP motion is led, a caseusually comes to a screeching halt until the judgerules on the motion, which must be done within30 days unless the docket is full. However, CSIllowed the court to continue already scheduled

    hearings on a temporary injunction against thehurch and disputes over jurisdiction.

    CSI attorneys have also tried, unsuccessfullyhus far, to put a gag order on Marty Rathbuno that he cannot discuss the case with either

    his wife or her counsel. Since Marty Rathbunnce oversaw the Churchs legal matters, CSIlaims that his involvement violates attorney-

    client privilege (although Rathbun is not anattorney). Judge Dib Waldrip was not swayed.

    Monique Rathbun is asking that atemporary restraining order against theChurch be turned into a temporary injunction.Church leader David Miscavige and Churchorganization the Religious Technology Centerhave argued that Texas courts have nojurisdiction over them.

    State vs. Justin Carter(Dec. 16)Comal teen Justin Carter made a commentabout attacking a kindergarten and wasarrested on charges of making a terroristicthreat. Carter maintains that the commentwas obviously sarcastic and satirical. He wasarrested, had his original bond raised, held injail for months (where, his parents say, he wasphysically and psychologically abused) whilethe states investigation moved at a slow pace.

    Then, some strange things happened.First, an anonymous donor paid for Cartersbond. Then, Carters original Facebook postdisappeared without a trace. Finally, theCanadian woman who originally alertedauthorities to the post cannot be found andpossibly never existed.

    Despite this lack of evidence, the State ispressing ahead with its case against Carter.The upcoming evidentiary hearing coulddecide if the case can continue.

    STOP vs. City of NewBraunfels (Dec. 19)In response to the City ordering a ban takingcans into the rivers, various river businesses ledsuit against New Braunfels, arguing that the Cityhas no authority to make rules governing therivers. Only the river authorities have the powerto make decisions regarding the waterways,insists Stop The Ordinances Please (STOP).

    The City and STOP have both led motionsfor summary judgments, which means thatboth sides believe there is enough evidencesupporting their cases and are asking Judge

    Jack Robinson to make a ruling.Both sides believe there are legal issues

    that may decide the outcome of the case,STOP attorney Jim Ewbank said. For the mostpart, the facts are not in dispute, only how thelaw applies to these facts.

    of our requests for information through MrAten are, well, stonewalled, so were noteven going to bother this time. Our readingof Texas law is that anyone can enter a Texasriver from the end of any public road. Eitherthe District or the residents have built a bridge

    on public land without permits (according toCity Hall). Perhaps someone should build abridge over the easement

Their arguments for collective

    doesnt mean the rest of Texas gives up itsrights to access a river.

    We should feel sorry for the Friends of Comal

    ISD PAC. They and their allies in the school-construction industry failed in last monthsattempt to raise $451 million to build 200new schools. In last weeks election, miserlyComal County voters rejected the bondproposal because they dont understand justhow much the children are our future. Thesevoters dont fully understand whats at stakehere: Projections show that the student body ofComal will increase by 6 million over the nexttwo years. These are desperate times.

    However, I want to tell the Friends of ComalISD that before you pull out the guns and tryand take the county by force to impose a school-building dictatorship, there are still severalalternatives to raising those needed funds.

    1). Donations: You could ask thosebig corporate PAC donors to now donateto building the schools. After all, these

    companies were very concerned about Comalstudents wellbeing, so they should be morethan happy to raise the money needed. Theyare friends, arent they?

    Hahahaha.2). Para-mutual betting: The district could

    build stables for the athletes at a much cheapercost. People would come from all over the stateto bet on the 100-meter dash. I know I would.

    3). Magic.4). Derivatives: This has been a popular

    way for the banking system to raise large sumsof money in short order. A derivative is like anancial bet, except in millions of dollars. Lookat the great success the American bankingindustry has had with derivatives.

    Just for example, the school boardcould invest in a derivative on whether thatsophomore guy, Steve, will ask Amanda outby Friday. Or, to take the American bankingapproach, bet Steve wont ask Amanda out,then lock him in a shed until Saturday, thussecuring your investment. No risks.

    5). Technology: Just develop somethingeveryone wants to use. I hear that the Twitter andthe Facebook are very popular with the youngpeople so, you know, do something like that.

    6). Fracking: Makes a lot of money, fracking

    does. Good, solid investment. OK, I dont knowwhat fracking is, but Ive heard things.7). Build them yourselves: Are there still

    shop classes? Free labor designed as a termproject is the same tactic that was used tobuild the Dallas Cowboys stadium. Besides,

    I think Ikea has kits.8). Tourism: Use the schools as hotelsduring tourist season. You could also letthe tourists tube in the high schools pool.Allow them to carry cans into the pool and

    youve s truck gold.9). Become famous: Make a video. It

    doesnt even have to be good. Look at thatgirl who did that Friday song -- she madea fortune. Whats a little national humiliationfor the sake of large sums of cash. You can doit with the rap music, or something.

    10). Be haunted: If one of districtsschools develops a reputation for beinghaunted, then you can call those guys fromTV who yell at ghosts. This will bring peoplefrom all over the world who will pay goodmoney to yell at ghosts, too.

    11). Sell cookies: Do you know how

    much the Girl Scouts made last year sellingcookies? $1.6 trillion. The operation is sosuccessful, the federal government even triedselling cookies, although there was littlepublic interest in Joe Bidens Bacon Sandiesand Ted Cruzs Hambone Crunch.

    When baking cookies, make sure toreflect the regions German heritage, withflavors based upon meat, potatoes, beer

    and irritability.12). Get something big: Tourists getexcited over something being the biggest.Fredericksburg has the worlds largest sliceof toast, Waco has the largest hair. We couldadvertise Walnut Avenue as the WorldsLargest Debacle.

    13). Go 3D: Paint half of your red highschool football eld blue and sell 3D glassesfor $5 per pair. Think of the satisfaction youwill feel when fans say, Wow. Its like I couldjust reach out and touch that eld.

    14). Make all students wearlederhosen: OK, this wont raise anymoney, but it would be fun.

    15). Ask for less money: Look, it doesntbehoove your cause to ask for almost a half-billion-dollar bond and have the primary supportfor that bond come from the same people who

    will, in turn, receive that money. The whole issuesmells bad. Regroup and try again with a morerealistic, less questionable goal.

    Dear Uncle Esel,I was wondering what your thoughts

    were on extending alcohol selling hoursto 2am vs midnight.

    I looked up some history on this(newspapers.com) and in 1979 PricklyPear approached city council aboutextending the hours and in two publichearings no one spoke out against thisrequest. It was approved. Ten in 1984,the M.A.D.D. approached council of thedangers of having extended hours andso there was a city wide vote. Te publicvoted FOR having the hours restricted,again. And as far as I know, nally, in1991 a business man approached thecity with a petition to extended thehours, and it went to the voters. Votersoverwhemingly, 4-1, voted againstextending the hours.

    Do you think it is time to extend thehours? Do you think voters will approveit? I mean that was two decades ago andour city has grown so much.

    Dear Chris,Uncle Esel has heard many people asking

    the same question in the last year. Thank youfor researching the info and writing such a wellprepared letter so I dont have too. Uncle Eselhas been puzzled by the argument of makingit safer by keeping the earlier cutoff. Uncle Eselhas known many drinkers who simply start theevening earlier and many people who live inplaces like San Antonio and Austin conrm thatthey usually start their festivities later than wesee around here. Of course the later hour alsomeans that younger people that are not of ageare also home, you know, because good peoplelike MADD parents have set strict rules and such.

    Uncle Esel also knows that some of thosedrinkers just drive to the next town and takeadvantage of their later hours. When you lookfor studies and data about the later hour, mostof the ones that arent sponsored by MADD orsome smooth-haired church leader show thatthe later hour does not create more incidentsof drinking related accidents.

    When English and Scottish drinkingreforms allowed for later hours they found thatincidents dropped 13% with some speculatingthat people were less likely to try to drink tobeat the clock and also less likely to drive. Ofcourse common sense also shows that thereis also less trafc at the later hour put on theroad to begin with. In the end, the biggestreason changing the laws has failed is from afalse Puritan attitude from those who feel theyknow better than the working class peoplefrequenting New Braunfels bars and pubs.Time for a change? Absolutely, but watch theelite old guard line up to ght it.

    Dear Pat,Most rules have some limitations on

    inoperative and/or unregistered cars andif you are a homeowner you signed atclosing a document that says you weregiven these rules and would abide by them.In addition, city ordinance has a provisionfor abandoned cars after 30 days also. Thisincludes cars in the roadway as well as in adriveway. This ordinance has been I placefor over forty years.

    Your best course of action will be to movethe car to your garage, behind a fence and outof view, to a storage facility, or of course youcan sell it. Not sure about your HOA, but thecity seems to be okay with old toilets sitting inthe yard if you are so inclined.

    like coffee or coffee drinks. I need to

    nd a substitute beverage that willbe tasty yet somehow hip. Ive heard

    that Mexicans have magical chocolate

    drinks called atole, champurrado, and

    chocolate, but I dont know what is in

    them or what they taste like. Do you

    have any advice?

    Dear Gabacho: Youre a smart

    gabacho, you know that? Coffee is among

    mankinds most overrated drinks, and has

    created a nation of babosos who think its

    perfectly ne to hacer cola at Starbucks

    every morning to buy some overpriced

    chingadera. Mexicans, on the other hand,

    line up for far-more-avorful-and-healthy hot

    drinks every morning.

    Atole is a gruel made of masa and

    usually piloncillo (unrened brown sugar)

    and cinnamon; Mexis have imbibed it since

    the Aztecs were stuck in caves in Aztln.

    Champurrado is atole mixed with chocolate;

    chocolate (or, in gaba speak, Mexican hot

    chocolate) isyou got it!hot chocolate,

    except the sweet stuff is of the bitter, better

    variety instead of some Nestl heresy.

    These drinks are sold year-round at

    panaderias, but most Mexican restaurants in

    American barrios start whipping up batches

    come December, when the cold comes in

    and a steaming cup of any of the three will

    take you through the day. Christmastime

    also brings a seasonal specialty: ponche.

    Every family has their own ponche recipe;

    ours includes guayabas, orange, pineapple,

    apples, cherries, cinnamon, grapes, cloves,

    piloncillo, tejocotes, and whatever else my

    tas throw in. And, after the kiddies hav

    their ll, un piquito de tequila, of course! I

    literally just hot fruit punch, but you kn

    us Mexicans: we take the menial and turn

    into the celestial.

    Dear Gabacho: I was shopping at

    a swap meet one time, and I saw that

    a little 12-year-old girl was trying to

    dress her fresh-from-the-border uncle

    into some black shades, big ol baggy

    pants, and a Fubu jersey. My actual

    question is: Why do border brothers who cannot speak any English at all

    like to shave their heads and dress like

    a cholo? Because, as luck would have it,

    that uncle was standing in front of me in

    line and his gross, pimply newly shaved

    head with fat rolls in back of his head

    was staring at me.

    I have a new obsession, and its called Popover! Popovers have been on my to-do list for quite

    some time and they are denitely worth the wait. A popover is a very simple, light hollow roll

    made from an egg batter similar to Great Britains ever popular Yorkshire Pudding. Popovers

    can be sweet, topped with fruit and whipped cream, and served for breakfast or brunch. They

    can also be savory by mixing them with various herbs and cheeses which, when served on the

    side of a hearty stew or pot roast, make a great vehicle to mop up sauces and gravies. The

    possibilities are endless. Traditionally, these tasty rolls are made in a popover pan which allows

    them to rise to a lofty height. I used a mufn pan and still achieved beautiful results. The key to

    success is a very hot oven and a preheated pan. Dont be tempted to peek during the baking

    process it will result in a deated popover. Remember, if youre looking, they arent cooking!

    Sherris Popovers

    1 cup whole or 2% milk, room temperature

    2 large eggs, room temperature

    3 tbls butter, melted and divided

    1 cup all-purpose four

    1/2 tsp baking powder

    1/4 tsp salt

    In a medium bowl, whisk together milk, eggs and melted butter. Add the dry ingredients

    and whisk until frothy and bubbly. Pre-heat oven to 450. Place popover pan or mufn pan in

    the oven and warm for 2 minutes. Remove the pan from the oven and divide the remaining

    butter in between the cups. Whisk the batter one more time and ll the cups of the way full.

    Place the pan to the back of the oven for 15 minutes. Reduce the oven temperature to 350 and

    bake an additional 15 minutes. Dont be tempted to open the oven! This is key!

    Finished popovers will be a rich golden brown. They will feel dry to the touch and sound

    hollow when tapped.

    I added a pinch of black pepper and a tablespoon of sharp cheddar cheese in the popovers

    pictured. This is a great base recipe to play with and be creative. You can add ham & cheese

    for a brunch menu, or chocolate chips for a dessert. Add fruit preserves after baking for a

    homemade tart. Just get in the kitchen and experiment!

    404 ErrorThanksgiving is over, and as I cringe at thetightness of my pants, I am relieved to seethat the federal website for Obamacare(healthcare.gov) has been xed. Or at leastthats what they tell us.

    Unfortunately, this new promise/statement doesnt appear to be any moretrue than any of the previous ones. In the realworld, xed usually implies that somethingworks. This is only mostly true for the

    website. The website is stable (functioning atall) about 90 percent of the time according tocurrent administration talking points.

    While 90 percent is better than whatthey had before and Im happy to hear thatthe servers at healthcare.gov arent smokingfor half the day anymore, Im not sure that 90percent should be considered acceptable oreven very good. My car is a used clunker that

    I bought as cheaply as I could and that worksbetter than 90 percent of the time. My laptopworks more than 90 percent of the time, and Istill went out and bought another to replace it.If my heat or water worked only 90 percent ofthe time, Id consider that a pretty signicantproblem. About the only thing that I own thatdoesnt work more than 90 percent of the timeis my dog, and it is only his cuteness that hasbought him any time. (That time may come toa quick end if I catch him watering any moreChristmas gifts under the tree.)

    Similarly, the administration now saysthat the website can handle some 50,000simultaneous users. Again, this is mostly true.Private estimates say that the sight begins toshut people out at something over 30,000users. When this happens, instead of seeingan error message, users are given the options

    of waiting on queue or receiving an email thatwill tell them when they should try again.

    The email system is beginning to sounddisturbingly like waiting on cable installation,where your appointment is scheduled tohappen sometime between 9 a.m. and nextTuesday. The new system is innitely better thanwhat was previously available when the sixthperson who signed on crashed the websiteentirely, losing everyones data and shockingKathleen Sebelius at her desk, though. The newvolume may be piddling when compared to

    something like Amazon.com, but it does offerthe statistical possibility of reaching the neededseven million enrollees by March. So far, twomonths of operation (if thats what were goingto call it) has left them about 85 percent shortof that magic break-even number.

    Perhaps the most amusing statementoffered about healthcare.gov is the assertionthat the website is operating at private sectorvelocity. Assuming that this is true (and Idont), it seems almost entirely irrelevant.

    If I cant get on the site in the rst place, itdoesnt really matter how fast it loads itspages. Unless youre factoring in my waituntil off peak hours, Im not sure youshould be allowed to proclaim private sectorvelocity. Furthermore, is the phraseologyhere intended to indicate that the privatesector is the bar for successful operation? Ifso, why did we take this out of the privatesector I the rst place? Next time, I wouldsuggest that the sites operation be referred toas having military efciency.

    Something that wasnt mentioned bythe administration is that neither the securityissues that the site has, nor the process thatsends the completed data out to the insurancecompanies have been addressed at all. Thisis understandable. It is the nature of politicsto accentuate the positive while ignoring thenegative. What purpose would it serve to tellme that using the website will virtually assurethat someone in a former Soviet Republic willbe using my social security number or thatwhen I call my new insurance company abouta rejected bill, they are likely to respond with,Kelly who? or both.

    Meanwhile, in the real world, Jeff Bezosis busy working on delivering my Amazon.

    com order by drone. He seems certain this ispossible within the next few years and that hecan get my order to me in 30 minutes or less.Im skeptical, but Bezos makes quite a bitmore money than I do for operating a retailventure that has never turned a prot, so hesclearly smarter than me. Sure it sounds likethe ying car I was promised so many yearsago, but Richard Branson has been workingon sending celebrities into space (Richard,one way tickets for them, please), so maybethe ying car is coming.

    The point, of course, is that the privatesector is always innovating. If they dont meetexpectations, they go out of business, and theirfailure never cost me a thing. Obamacare isgoing to cost us a bundle.

    Theres nothing to be done about thisnow. Obamacare is the law of the land, and itwill go into full effect barring a political shift ofunbelievable proportions, and thats the way itought to be. What we are seeing is the resultof the will of the people. The people may have

    made a mistake, they may have acted stupidly,they may have been lied to, but Obama andthe Democrats were given the votes theyneeded to foist this mess upon us.

    It is possible that Obamacare is ablessing in disguise. The effect may be sobad that people are left with a bad taste intheir mouths over government meddling for

    years to come. Already people are beinghurt by this, and thats unfortunate, butthat may lead to people throwing both thegovernment and the insurance companies tothe curb. Already doctors are talking aboutnot accepting Medicaid, Medicare, or evenprivate insurance. They may decide to cut outthe middleman entirely and adopt a straightpay-for-service system, and that might actuallylower costs for basic medical care.

    I can see the possibility of an organicrestructuring of the healthcare market.Government might be pushed out entirely,or they might be left with a minor regulatoryroll. Insurance companies might be forced toprovide only catastrophic care and at payoutrates that doctors and hospitals are willing toaccept. Hospitals might be forced to lowerprices to attract business. This might meanfewer paper pushers and more practitioners

    as well. Doctors might nd that they arepaid better when they are spending moretime serving patients and less time servingbureaucrats. We might nd ourselves travelingback in time a hundred years or so, but with allthe benets of todays technology.

    Try to think positively, and have somechicken soup. It couldnt hurt.
