THE REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE
FREEHOLDERS AND fOMMONALTY OF THE TOWN OF SOUTHAMPTON,
N.Y. WAS HELD AT TOWN HALL ON MONDAY, JANUARY 3, 1989,
AT 1 P.M.
William Bennett, Paul Parash, William T. Frank, and
Patrick A. Heaney and Deputy Town Attorney John ~ourgola.
Paul Parash acted as Temporary Chairman for the
purpose Of electing officers for the ensuing two years.
A motion was made by William Frank, seconded by
William Bennett nominating Edward J. Warner to be
President of the Board for the ensuing two years. The
Secretary cast one ballot electing Mr. Warner. The gavel
was then banded over to Mr.. Warner who thanked the Board
for their confidence in him, and stated that all he has
done in the past two years, he will continue to do in the
next two.
A motion was made by Edward Warner, and seconded by
Paul Parash nominating William Bennett as
Secretary-Treasurer of the Boar-d for the ensuing two
years. The Secretary cast one ballot for Mr. Bennett.
The minutes of the meeting of December 18, 198'9, were
read, and approved as read.
Patrick Heaney asked John Wourgola if there has been
any response from Mr. Grinblat. John Wourgola replied

that Mr. Grinblat has been out of town, and that his
attorney Mr. Grossmen has talked with him and will attend
this meeting.
John Andersen stated that Saft stopped making the
battery that we used, but has given him names of other
companies that do make a similar battery.
Tom Samuels, of James H. Rambo, Inc., was present to
discuss his application for permit for David ~awyer. He
also questioned the need for re-applying for th.e
applicat'ion for permit and fees £or Michael Namm, Private
Road, Shinnecock Hills. This application for permit
expired January 3, 1990. It was first applied for on
October s, 1987, and renewed on January 3, 1989. Under
the Rules and Regulations, a permit may be renewed once.
Richard Stinson, of Hampton Bays was present to
discuss his problem with the Boat Ramp Permit. Mr.
Stinson does not have a vehicle capable of trailering his
boat. He does have use of a company vehicle, from
Brookhaven Town, that be uses to trailer his boat. Since
it is a company vehicle others may use it, and he may be
issued a new one. A motion was made by William Bennett,
seconded by William Frank and duly carried to allow
Richard W. Stinson to use his boat trailer registration
inleu of the vehicle registration, and must be kept on
trailer at all times. Mr. Stinson was issued Permit No.
32.

present to discuss the problems with Trustees Roads. Paul
Par ash stated with all the developments on Trustees Roads
no one takes care of the problem with drainage. Edward
Warner stated that all the improvements made on the roads
are piece meal jobs. John Johnsen explained that in the
late 70 1 s Bob Nardy of the Board of Appeals, adopted an
unwritten ruling that if the Board of Appeals asked for
more work to be done than the applicant could' afford, it
would b,e waived. They were asking for $5,000. for
improvements. This requirement is still valued by the
Board of Appeals. A lengthy discussion followed. Edward
Warner asked John Johnsen to figure out an approximate
figure for the Trustee roads to be brought up to specs.
John Johnsen replied that a separate account would have to
be kept for each road. He continued to say that he would
take a couple different roads, and figure out an
approximate cost for them.
William Frank stated that Sagg. Pond and Mecox Bay both
are very high and need to be opened. A motion was made by
Paul Parash~ seconded by William Frank and duly carried to
open Sagg Pond and Mecox Bay as soon as possible. Cliff
Foster, Diversified Services and the New York State DEC
will be notified.
Fifteen (15) Applications for Pot permit were received.
Two (2) Mooring permit was approved.

The minutes of the meeting of January 3, 1990, were
read, amended, and approved as amended.
Ronald Grinblat was present to discuss what he has
done on Mermaid Lane and to ask the Board to reconsider
their decision to have him remove the retaining wall that
encroaches the Trustee Road, and restore that portion of
the, road that was disturbed to its natural state. Lee
Phillips was present to hear Mr. Grinblat 1 s side of the
story. Patrick Heaney stated that Mr. Grinblat has
backfilled the primary dune with construction debris. A
lengthy discussion followed. Edward Warner stated that
their point is it was surveyed, the retaining wall
encroaches Mermaid Lane, a Trustee Road, and the Board
want it removed, Ronald Grinblat was given 30 days to
remove the retaining wall that encroaches the Trustee
Road, restore that portion of Mermaid Lane that was,

and will be disturbed back to its natural state, and to
reimburse the Town Trustees for the cost incurred with
this violation. This includes but is not limited to the
$775.00 dispersed by the Trustees for preparation of the
survey. If the above is not complied with, within 30
days, the Trustees will remove and restore same at Mr.
Grinblat 1 s cost, also other fees will imply with this
violation.

Town Board to Joan Behrle:
WHEREAS: the Town of Southampton wishes to recognize
and express the appreciation of all of its citizens for
those who give their services to the community above and
beyond the norm; and
service in the Trustees Department for the Town of
Southampton, has decided to retire with her husband,
Ernie; and

been so helpful and ready to assist those in need; and
WHEREAS: we are saddened to hear that JOAN BEHRLE is
leaving our area, but happy that new opportunities are
opening up for her in her retirement especially on the
golf courses in North and South Carolina,
NOW, THEREFORE WE, THE SOUTHAMPTON TOWN BOARD, as well
as all residents in the Town of Southampton, do hereby
extend our thanks and appreciation to JOAN BEHRLE.
IN W,ITNBSS WHEREOF, we have hereunto set our hands and
caused the seal of the Town of Southampton to be affixed

WHEREAS: The Board of Trustees was created in 1686 by
the Dong an Patent to run the Town and Manage its
resources. As uplands were divided and sold into private
ownership the Board came to manage the Town's waters and
wetlands; and
Southampton on January 15, 1970, and served through
January 16, 1990; and
WHEREAS: her twenty years of service and devotion to
her duties as manager to the Trustee has reflected to the

WHEREAS: JOAN 0. BEHRLE will enjoy her retirement in
her new home in Ocean Isle Beach, North Carolina with her

Whiskey Hill Pond. With the help of Southampton College
they tested for water sample qualities. A lengthy
discussion followed. Patrick Heaney stated in the
document Mr. Anderson has just handed us it states the
agreement between the New York State Department of

Environmental Conservation and the Southampton Town
Trustees, that the state will provide for the testing of
coliform bacteria by state run laboratories. Under said
agreement, the N.Y.S.D.E.C. shall test for coliform
bacteria in land surfaces waters at no cost to the Town,
the state has not a heard to this agreement. William
Bennett suggested that the Trustees and Bruce Anderson,
should meet with William Masterson (Highway Department),
and Johq. Johnsen (Town Engineer) to discuss the problems
of Town Roads with road run off. Bruce Andersen explained
that would be a start, but the worst road run off are from
the State and County roads, and that they should except
responsibilities for them. Paul Parash Stated that
Legislator Fred Thiele, Jr. of the sixteenth District and
State Senator of the 1st district Kenneth P. LaValle
should be present at the meeting. William Bennett stated
we don't need any more statements, or studies, we know
what has to be done, so let's do it. A meeting will be
scheduled in February to discuss the problems of road run
off with Town, County and State personnel.
Joseph D. Rosolino, application for ramp permit was
discussed. Mr. Rosolino uses a company truck owned by J.
Graz, Inc. of Glenwood Landing. Mr. Rosolino is a
taxpayer in the Town of Southampton. Since this is
similar to Richard Stinson case, a motion was made by
Edward Warner, seconded by William Frank and duly carried

to allow Joseph D. Rosolino to use his boat trailer

be kept on the trailer at all times. Mr. Rosolino was

John Andersen, Senior Bay Constable reported the Peace
Officer School for Bay Constable's Dale Petruska and
Stuart Rose is slated for March 26 - April 20, 1990. The
Town Board will hold a Public Hearing for Ordinance 20, at
their February 27, 1990 meeting. John Andersen and Ted
Sadleir will attend. Bill Edgar is donating docks for the
clam racks again this year. Mr. Andersen is authorized to
spend under $250.00 for pipe, and hardware. The Trustees
Rules aud Regulations book needs to be revised before
placing an order for them.

the agency must be pre-existing, which we are. William
Frank told Constable Andersen to check all the conditions
before applying.

William Bennett brought in some oysters he found in Mecox Bay. The Trustees requested John Andersen and a Bay Constable on a good day this week, go and check the oysters in Mecox Bay.
Edward Warner asked Patrick Heaney to be on the Shellfish Advisory Committee with William Bennett. Patrick Heaney excepted the position. He replaces ex-Trustee Frank Smith. The Trustees will schedule a shellfish meeting with the Baymen on March 1, at 7:30 p.m.
Edward Warner questiqned John Wourgola on the Towd Point bridge and dock. John Wourgola requested it be discussed in Executive Session.
Donald Sausser brought to Edward Warner's attention that a bulkhead in Bast Quogue had to be replaced after 5 years. The reason being, the proper pressure treated CCA bUlkhead material was not used. Mr. Warner suggested the Board think of making an amendment to the Rules and Regulatibns stating that all CCA components have a minimum treatment of 2.5 lbs of treatment per cubic foot and 3/4 11

Edward Warner stated that he had a discussion with the
Union representatives regarding the resolutions on the Bay
Constables and Maintenance men. Due to that meeting, a
motion was made by Edward Warner, second by Paul Parasb
and duly carried to rescind the resolution that was passed
on February 5, 1990 regarding t·he vacation times of the
Bay Constables and Maintenance men, and the times the Bay
Constables must work weekends.

the naming of an island "Trustees Island". This happened
to be the wrong island. The island named already is known
as Gull Island.
William Frank stated Sagg is open and running due to
nature. Mecox is closed.
Attorneys object to the wording. It states the town will

paid by the State. The town would have to wait until 1992
until they were reimbursed.

John Johnsen, Town Engineer was present to discuss the
re-vamping of Trustees Roads. John Johnsen did an
analysis of Noyac Path from Cooks to Mill Stone. 13,000'.
The map identified each lot, the number of homes, and a
zoning map (how many potential lots), also it outlined the
GElS area. Esttm·ate that it would cost $50.00 per foot.
Patrick Heaney asked what the size was of the road. John
stated the size for the cost was figured at 26' ·width, but
it was passed. by the Town Board that the Highway
Department may except a road 20 1 or more in width. John
Wourgola asked if the T.rustees identified their worst
roads, could it then be turned over to the Highway
Department for an assessment district. John Johnsen
replied there would be some for and against it. The Town
would then take on the responsibility for a new assessment
district.
John Johnsen stated be would get back to the Trustees
regarding North Sea Harbor and Fish Cove Road Run Off
Project. It was noted that a Road Run Off Meeting is
slated for Thursday, March 15, 1990~ at 2:30 p.m.

to drive or operate a motor vehicle on bay beach areas or
on ocean beach areas between the Friday immediately
preceding Memorial Day and the 15th day of September in
each year between 9:00 a.m. and 6:00 p.m. Notwithstanding
the foregoing, no vehicles shall be allowed on Foster
Memorial Beach (commonly known as Long Beach, Noyac) at
any time from May 15th to September 15th. (Note:

Linda Ryan from Thomas Bourke, Attorney at Law firm in
Southampton was present to discuss her client David
Sawyer's application for permit. David Sawyer application
for permit was denied at our January 17, 1990. The
Trustees felt the- additional four 4 1 x 16' floats was
extreme for an residential area. Ms. Ryan Stated that an
application for permit was issued but the agent left out
part of the docks that have been in existence since 1967.
Therefore the agent
denied. A lengthy
discussion followed. The Trustees
to have her client re-apply.
Edward Warner presented to ex-Trustee Frank Smith his
retired Bag 1786.
A motion was made by Edward Warner, Seconded by
William Bennett and duly carried to extend the Lease
between Southampton Yacht Club and the Board of Trustees
as follows:

OF THE FREEHOLDERS AND COMMONALTY OF THE TOWN OF
SOUTHAMPTON, hereinafter referred to as "The· Trustees",
and SHINNECOCK YACHT CLUB, hereinafter referred to as "The
Club 11 , the said Trustees have given and granted to the
Club the sole and exclusive license to use the water of
Penniman Creek at the foot of Niamogue Land and the lands
lying thereunder, as the same is more particularly
described in said agreement; and
WHEREAS, there is a renewal provision in Paragraph 9
of said agre.ement, the terms of which have been complied
with by the Club;
of $ 200.00, the Trustees do hereby give and grant the_
Club and the Club does hereby accept a renewal of certain
written lease of May 1st, 1968, said renewal to be
effective for the period May lst, 1990 to April 30th 1993,
and under the same terms and condl tions as the aforesaid
lease of May 1st, 1968, excepting therein that portion of

and subject to the right of cancellation by either party

hear all persons either for or against the acceptance of a
Deed of Dedication, offered by Westhampton Associates to

said Trustees, for Beaver Dam Pond and a parcel of land
f't'onting on said Pond, Labelled as Park on the proposed
Subdivision Map of Lakeside at Westhampton, Situated at
Westhampton. Frank Smith was present to speak for the
acceptance. Mr. Smith stated if the Pond was under the
Trustees control, there would be regulations to protect
the waters. Jim Doyle also present to speak for the
acceptance. Mr, Doyle stated he has waited 24 years for
the ToW}\ Trustee.s to take control over. the pond, which is
a very valuable resource. A motion was made by William
Frank and Seconded by William Bennett and duly carried to
close the Public Hearing. William Frank suggested to hold
off on voting until next meeting. A motion was made by
Paul Parash, seconded by William Bennett, and duly carried
to vote on the Deed of Dedication. A motion was made by
William Bennett, Secon~ed by Patrick Heaney and passed by
a vote of 3wZ (Mr. Warner, and Mr. Frank voted no). The
Trustees made the. following comments regarding this deed
of Dedication. Patrick Heaney stated a sincere concern
has been expressed by members of the board over the
potential liability attached to the acceptance of this
pond into our inventory of natural resources. At present,
we have the stewardship of nearly 700 miles of saltwater
shoreline. We also are charged with the care of some 45
to SO freshwater ponds. Wben all properties and Right of
Ways are added together, we have liability exposure on
nearly 25,000 acres of property. Beaver Dam Pond contains
about 11 acreas. We would have to a quire title to about

2200 ponds this size to approximate the liability we
already have per acre. So, it is my opinion, that when
compared to the liability attached our vast holdings of
underwater lands, the argument against accepting this pond
on the basis of liability, simply CAN NOT HOLD WATER! We
live in a time when our Natural world is getting a little
smaller each year, and as I understand the terms of my
Dongan Patent obligation to you, we Trustees have a
greater ·obligation to nourish, and protect the natural
resources of the town for the benefit of its residents
than we have to fret over liability attached to the
stewardship of those natural resources. In a particular
way, we are the collective parents to the underwater lands
in the Town, and this little pond is like a stepchild in
search of a family. I simply can not turn my back on a
child. So, my vote is yes. William Bennett stated that
this is a great moment, 40 years ago the owners put up a
fence around the pond. Now the Village of Westhampton has
its pond back. William Frank stated he has reservations
with the liabilities. Like Trout Pond, this will cost the
TaxpaYers more with the maintenance and liabilities of the
Pond. Mr. Doyle stated last meeting that there are two
dams associated with the pond. Mr. Frank voted no. Paul
Parash stated that he agrees with both Mr. Frank and Mr.
Heaney, but he votes yes for the deed of dedication.
Edward Warner stated Mr. Bellrinder fenced off the Pond to
protect himself of liability. That he as Trustees has an
obligation to look out for the liability of the people.

Mr. Warner continued to say that the land would be taken
off the tax rolls, thereby creating higher taxes for the
people. So he votes no.
Edward Warner read the following report of the Bay
Constables: Maintenance Men started putting the light
poles and buoys in on March lS. They started at Sag
Harbor. Maintenance Men cleaned out half of the Alewife
Dreen in North Sea, will finish work when weather prevents
them fr~m going out on the Barge. Senior Bay Constable
Andersen and Bay Constable Sadleir checked Mecox for
Oyster spat. They found only a few live, which are
believed to be the one planted there last spring. Some
one drained Alcotts Pond in Bast Quogue.
Rose closed same with cement blocks.

l. Prior to beginning the work; offset stakes are to be established as a reference for installing the new bulkh~ad at the present location and configuration.
2. Filter cloth backing is to be installed on the inside of the new bulkheadlng to prevent sedimentation through the wall. .
3. To hinder siltation, the final grading of disturbed soils behind the new bulkhead shall be a minimum of four inches below the finished height of the wall.
4. Should it be deemed necessary to add backfill after grading has begun, only clean sand or gravel will be permitted. No organic top ~oils are to be placed along the inside of the new bulkhead.
5. The issuance of a permit shall not cause the Trustees to suffer liability in the event of damage to the beach, bulkhead, land, fence, or landscaping materials belonging to the property owner south of the proposed new bulkhead return, resulting from activities related to the construction of the new bulkhead.
