Pawar pointed outthat the Thane CreekFlamingo SanctuaryManagement Plan-2020-30 has recentlycovered six wetlands in-cluding Belpada,Bhendkhal, Pagote,Panje and Talawe underits satellite wetlandmanagement and con-servation plan. Thisplan clearly shows thedamage done to wet-lands in Uran.

This plan was drawnon the basis of a de-tailed, scientific studyby BNHS, as pointed outby Additional Chief Con-servator of ForestsVirendra Tiwari.

BNHS has alsoraised its worriesagainst destruction ofwetlands, including

Panje, around NMIAand clearly warned ofimpending bird hits toflights in and out ofNavi Mumbai Interna-tional Airport.

Earlier, NatConnectFoundation said in itsletter to the Chief Min-ister: “There seems tobe an all-out and multi-pronged approach togobble up the Panjewetland which is ironi-cally earmarked by CI-DCO as holding pond tosave the upcomingDronagiri node fromfloods.” The latest dis-turbing development isthat JNPT has pro-posed to build a seawallon the northern side ofPanje, touching theSector-20, Kumar add-ed.

When the house-keeping staff came tohis room post lunch, Mr.Basu asked him toclean the washroom.However, the cleaningstaff refused and said“if required would do itonce in 3-4 days”, saysMr. Basu who thencleaned the washroomhimself and fell sick af-ter doing it.

Moreover, the pa-tients, it is learnt, areasked to go to theground floor them-selves for any medi-cines or consultation.

Many patients havealso complained thatfood served is cold. In-fact says Mr. Basu, “On

Monday night, I evenfound an insect insidethe rice I was given toeat.”

After consistent fol-low-ups with numerousNodal Officers and withthe help from Corpora-tor Divya Gaikwad, Mr.Basu was finally shift-ed to Mango Suite onTuesday.

hijit Bangar said, “Ihave also received com-plaints from some ofthe patients with re-gards to the cleanlinessand cold food beingserved. One of the se-nior officials visited theCentre yesterday (26thAugust) and the need-ful is being done. As thisCovid facility is locatedquite far, monitoring itsometimes becomes dif-ficult. To solve this is-sue, we are now tryingto get maximum Covidbeds in the nearby ar-eas.”

A Ga-zette notification no.534 E dated 24th Au-gust, 2020 to amend theNational Highways Fee

(Determination ofRates and Collection)Rules, 2008 has beennotified in this respect.

This is another step

towards promoting theuse of digital paymentson Fee Plazas of NHs.The fee payable to-wards such discountsshall be paid throughpre-paid instruments,

smart card or throughFASTag or on boardunit (transponder) orany other such deviceonly.

The amendments tothe Rules would enable- i. For discount on re-turn journey within 24hours, it would bethrough FASTag orsuch other device and

FASTag made mandatory for availing alldiscounts on the National Highways Fee Plazas

ii. For discounts onall other cases, havinga valid FASTag is madenecessary.

The amendmentwould also enable thatin cases where there isa discount available fora return journey with-in 24 hours, there is noneed for a prior receiptor intimation and thecitizen would get thediscount automaticallyif return journey ismade within 24 hourswith a valid and a func-tional FASTag on thevehicle.

NAVI MUMBAI: A cou-ple promising the un-employed youths jobs invarious oil companiesin Dubai, United ArabEmirates, Uzbekistanextorted Rs 34 lakhfrom 11 unemployedyouths in Tamil Naduand cheated them with-out giving them anykind of job. The couple,identified as Vivek Ku-mar, 40, and Rituku-mari Vivek Kumar, 35,have been booked by theFinancial CrimeBranch for fraud.

The couple, VivekKumar and Ritu Ku-mari, who have beenbooked in the case,started a job consultingoffice in 2018 in Centu-rion Mall in Nerul andplaced advertisementoffering jobs in variousoil companies abroad.Sethil Kumaran San-mukhnadan, who wasresiding in Ulwe at thetime, went to VivekKumar’s office at Cen-turion Mall for a job.Vivek Kumar, however,said that Sethil Kumarcould not be sent for ajob abroad as he wasover 40 years of age.However, Vivek Kumaroffered him a commis-sion of Rs 20,000 foreach candidate if Sent-hil Kumaran hiredsome young candidates.

So Senthil Kuma-ran contacted 11 well-educated unemployedyouths who had beentrained by the Mer-chant Navy in his na-tive village of TamilNadu and called themto Navi Mumbai. Afterthat, Vivek Kumar vis-ited him along with theyouths. Vivek Kumardemanded a processingfee of around Rs 3 lakh60 thousand from eachcandidate for a job in anoil company in Dubai,United Arab Emirates.So, after depositing atotal of Rs 34 lakh 5thousand in Vivek Ku-mar’s company accountin the hope that all theyouth would get jobs,Vivek Kumar paid Rs 1lakh 40 thousand ascommission to SenthilKumaran. Vivek Ku-mar and Ritu Kumarithen made employmentcontracts for all theyoungsters for theirjobs, issued tourist vi-sas and plane tickets toDubai and sent them toDubai in March 2019.

Vivek Kumar ini-tially arranged accom-modation and meals forthe youngsters who hadgone to Dubai. But theydid not get a job in anycompany. Vivek Kumarwas approached by agroup of young peoplewho had gone to work

in Dubai after the expi-ration of a one-monthtourist visa. However, ashe was not contacted,they contacted SenthilKumaran. So SenthilKumaran himself wentto Dubai and paid for themeals and accommoda-tion of 11 young people.He also brought all theyoungsters to India inApril 2019 at his owncost. Vivek Kumar thenpromised the youths toget another job in thenew company in amonth. But till date, hehas not been able to getany job for these youngpeople.

Therefore, Sent-hilan Kumaran lodgeda written complaintwith the Navi MumbaiPolice Crime Branch.Accordingly, the Eco-nomic Crime BranchUnit-1 conducted a pre-liminary investigationinto the matter. Howev-er, as all the youths in-volved in the scam werefrom Tamil Nadu, As-sistant Inspector of Po-lice Anand Shahanehimself lodged a com-plaint. A case of fraudhas been registeredagainst Vivek Kumarand his wife at Nerulpolice station. The cou-ple closed their officeand fled after April 2019and are being searchedby police.

I think it was a positive news amidst all the Covid 19 news going on now,that Navi Mumbai has been ranked as third cleanest city in our country.Honestly, I was surprised when I heard this news and also did someresearch on it. This news also motivates the residents of Navi Mumbai tokeep it clean and green. As there is lockdown going on, so there hasbeen an immense decrease in littering of garbage. But it has brought asense of responsibility in us to maintain cleanliness and hygiene.

Mangrove protection is vitalMangrove forests are the world’s most productive and impor-

tant eco system. Apart from providing a safe haven for animals,mangroves have a major role in supporting humans too -- theyprovide food security, forest products and sustainable fishing tolocal communities living around the sea shores.

In addition, mangrove forests act as a natural defence barrieralong the tropical coastlines, protecting them from tides, stormsurges, currents and even tsunamis. They help in reducing soilerosion and act as an effective carbon sink.

In spite of the many advantages mangroves provide, this uniqueecosystem is under threat like most of the other ecosystems aroundthe world. According to the scientists, mangroves are disappear-ing 3 to 5 times faster than the overall forest losses in the recentyears. Mangroves are so sensitive that even minute changes intemperatures, atmospheric carbon dioxide, sea levels, rainfall, windand waves during storms can disrupt their existence.

Development of the seashore for housing, construction of damsand clearing of swamps are greatly contributing to the destructionof mangroves. In addition, unchecked and uncontrolled dumpingof construction debris is also leading to their destruction.

Recognizing the threat faced by mangrove forests in 123 na-tions of the world, the United Nations Educational, Scientific andCultural Organisation (UNESCO) as officially proclaimed July 26thof every year as the ‘International Day for the Conservation of theMangrove Ecosystem’. The earth and humanity simply cannot af-ford to lose these vital ecosystems. Reducing land, air and oceanpollution by using bio degradable alternatives can help in a bigway. We can also restrict overexploitation of resources by the hu-man communities which will regulate and conserve mangrove for-ests.

A healthy mangrove ecosystem is important for our own well-being. If their destruction continues at the present rate, the coastalshorelines will soon become sources of carbon dioxide, which willbe directly released into the oceans, resulting in great imbalancein carbon levels in the oceans and increase in ocean temperatures.Oceans, with their own marine ecosystem, are as fragile as themangroves and a slight increase in temperature will spell doomfor the myriad list of its inhabitants.

Incourse of thepandemic, even ingreat economies,many people arefacing the issuesrelated to ‘paymentof due rent’. Thisstill remains amajor task for thecommon man asthey are unaware ofthe remedy andprotection for themin the law.

Many wouldsuggest it is unfairto collect the rent insuch hard times ashe might be ingrave financial andemotional stress butlaw leads with logic.Under the law the‘Doctrine of ForceMajeure’ states thatit is the duty of theparties to waive offpermanently or totemporarily suspendthe event beyondthe control of theparties that rendersperformance of acontract impossiblehappens.

In other words ‘aparty obligated todischarge hisobligation to payrent on occurrenceof uncertain eventbeyond his control,is protected even ifhe fails to do so once

the event is consideredby law to be unexpect-ed and beyond thecontrol of any individ-ual. The lockdown andthe pandemic of 2020,is one such eventconsidered as sucheven which is under‘force majeure’.

The waiver,postponement andexemption of rent ismostly subjected tothe terms of thecontract, contingencyclause and the con-tractual agreementbetween the parties.The different situationmay arise if thecontract is not clearabout it but can beinferred by reasonableunderstanding.

In Delhi HighCourt, the case ofRamanand & Ors v.Girish Soni & Anr hasrejected a tenant’sapplication for suspen-sion of rent claimed onthe basis of ‘ForceMajeure’ but granteddeferment, postpone-ment of rentals, whichwas a significant reliefin situations hereinthe landlord hadrefused any concessionto the applicant.

It should beunderstood that thewaiver of rent, woulddepend upon facts andcircumstances of thecase. Mere inability ofthe party to access theproperty cannot makethe party unfit to payrent. There arevarious situations andjudgments whichclearly defines wheth-er the incident can betermed or is coveredunder Force majeure.The pandemic is onesuch instance whichwas not expected andcan be consideredunder this due to itsuncertain strike inthe country.

In our countrymany questions havearisen and the publicis unaware about it.These answers willgradually become anessential element ofour life in near future.Q.1 What to do if the

agreement is silentabout uncertainsituation during thetenure?

A. There are various caseswhen agreement is silentand lacks the forcemajeure clause andhence in these casessuspension of rentcannot be sought merelybecause of the lockdownor non-use of thepremises.

Q.2 What if there is noforce majeure clauseand the landlorddoes not agree fordeferment of rent forsome time. Whatrelief does a tenanthas?

A. There are manyinstances around uswherein the agreementdoes not comprise of theforce majeure clause.Hence, in these casesthe aggrieved party canapproach the courtseeking relaxation orbreather in payment ofthe same if incase thelandlord does not agreefor any waiver ordeferment. There is aDelhi HC judgmentwhich is relied upon bythe litigants.

Q.3 How will the rent anddues be paid ifOwner/Landlordagrees to defer thepayment of rent?

A. The Delhi HC held thatthe payment of rent canbe made in proportionto the sale turnover.This enables the tenantto pay in proportion toprofits and rest assuredin case of loses as he isnot obligated to payrent. In most agree-ments, basic rentalsguaranteed/assuredsupplemented form aimportant aspect andalso does a profit-sharing on the sales.This is also of greatrelevance, as theparties often seek thewaiver of the basicguaranteed rent fromthe landlord or throughCourts and often insist tomake payments onbusiness activity andturnover.

Q.4 If agreement hasforce majeure clause,how will the agree-

ment be executed?A. Just an existence the

clause of ‘ForceMajeure’ will not reallyensure the waiver fora tenant. It is essentialto understand whichcircumstances of theclause have the abilityto do so. It is essentialthat the contractbetween the partiescovers the scenario ofa possible ‘lockdown’or likewise event forwaiver to begranted. The contractsbetween partiescontemplate suspen-sion of rent only whenthe premise ispermanently/partiallydamaged or isrendered not usableor accessible.

SITUATION IN OURCITY

Even after beingaware of the ongoingpandemic in ourcountry which hasresulted in greathardship to manyindividuals and alsotenants, but despitethe governmentrequesting thelandlords to under-stand, delay or adopta lenient empathicview, the ownerchooses to go by thebook as nothing isclear by the law ofland. Hence, in theabsence of anythingto the contrary inthe tenancy agree-ment, the ‘lockdown’as a result of thenovel corona viruscannot be used bythe Tenant to delaythe payment of therent under law. It istotally as per his/hercontractualarrangement. But,as responsiblecitizen and human itwould be bothparties to negotiateand mutuallydiscuss the waiver,deferrals with thelandlord avoidingcomplexities andtime consuminglitigation. There isno smartness toapproach the courtin already toughtimes.

3294 idols immersed on thefifth day of Ganesh Chathurthi

NAVI MUMBAI: 3264domestic and 30 Sarva-janik Ganesh idols wereimmersed on the fifthday of Ganesh Chathur-ti at 135 artificial im-mersion sites. Thisyear, a large number ofidols were immersed inthe artificial ponds nearthe homes by the resi-dents.

“The immersion ar-rangements were car-ried out smoothly bythe officers and staff ofthe department, firedepartment and volun-teers assigned for theimmersion. Life guardswere placed at all theimmersion sites. The

NAVI MUMBAI: A 65-year-old woman livingin Nerul was misledby three people wholooted her jewelleryworth Rs 1 lakh 20thousand and fled.Nerul police haveregistered a case offraud against the threein the case and aresearching for them.

11 at around 1 pm lastTuesday along withher neighbour. Howev-er, as the shop wasclosed, she and herneighbour SindhuNikam were walkingback home. A personapproached them andtold Sindhu that as hewas blessed with a sonafter 12 years, he wasdistributing sari,slippers and ration toneedy women at St.Augustine’s School inSector 11.

Lured, Mathura

and Sindhu both wentto St. Augustine’sSchool in Sector-11with the person. Afterthat, another persontook Sindhu to anotherplace. After that, thetwo-thief askedMathura Patil toremove her ornamentsso that she looked poor.

Believing him,Mathura removedjewellery worth Rs 1lakh 20 thousand andput it in a plastic bagin her purse. Afterthat, thief took her bag

on the pretext ofkeeping prasad. Thethief stole Mathura’sjewellery and askedher to wait till Sindhucame back and fledfrom the place.

Despite waiting forlong when no onecame, Mathurabecame suspicious andchecked her bag andfound that the jewel-lery was missing fromthe bag. Later shewent to Nerul policestation and lodged acomplaint.
