5. TRANSPORTATION COMMITTEE/DIRECTOR COMMENTS Tom Kirk provided an update on Ferguson v CVAG et al. The lawsuit challenged three funding sources for CV Link. The Judge dismissed the lawsuit March 9, 2018. CVAG did not have to go to court. The decision ended any lingering questions about potential Measure A use. In September, CVAG Committees recommended STIP funding for Avenue 66 grade separation and CV Link. California Transportation Commission voted on STIP allocations in March. Avenue 66 was allocated $6.1 Million. Construction to start later this year. CV Link was allocated $2 Million from an earlier state budget delay and another $16.655 Million. There is now over $100 Million secured for CV Link. CVAG had planned to present an autonomous shuttle demonstration in between Coachella weekends, however, logistics were not finalized with all parties in time for NAVYA to deliver the shuttle here next month. CVAG continues to research other opportunities for the demonstration.

Staff Report

Subject: 2018 – 2020 Street Sweeping Contract with M&M Sweeping, Inc. Contact: Eric Cowle, Transportation Program Manager ([email protected]) Recommendation: Approve a Contract with M&M Sweeping, Inc. for CVAG’s Regional PM10 Street Sweeping Program from July 1, 2018 to June 30, 2020 for a not-to-exceed amount of $634,110.78, with an option for an additional two years. Background: In June of 2016 the Executive Committee approved a two-year contract with M&M Sweeping Inc. for the Regional PM10 Street Sweeping Program. The contract contained an option for an additional two years. CVAG’s Regional Street Sweeping Task Force meets on an as-needed basis to provide feedback and monitor the performance of CVAG’s street sweeping contractor. In their February 2018 meeting, the Taskforce was unanimous in its recommendation to exercise the two-year option with M&M Sweeping, Inc. The Taskforce also requested that a two-year extension be added to the new contract as well. Funding for the Regional PM10 Street Sweeping Program has traditionally come from AB2766, COLMAC and the Mobile Source Reduction Committee (MSRC). The AB2766 funds are allocated to CVAG’s individual jurisdictions as a percentage of vehicular license plate renewals, and then redirected to the Regional PM10 Street Sweeping Program. COLMAC funds are provided by Riverside County through the Coachella Valley Air Quality Enhancement Program. MSRC funds have come through grants awarded to CVAG for the Program. Over the past three years, the MSRC grant had been reduced from $250,000/year to $125,000/year to $0/year. In meetings with the South Coast Air Quality Management District (SCAQMD), CVAG staff was encouraged to apply for grant funding to continue to fully operate the PM10 Sweeping Program. Accordingly, in April of 2018 CVAG applied for $1,207,674 in SCAQMD funding to cover the next five years budget shortfall to operate the program. SCAQMD will announce the grant awards later this summer. There are adequate funds available through the 2018 calendar year to operate the Program. Depending on the amount of the SCAQMD grant amount awarded to CVAG, changes may become necessary in calendar year 2019 to the scope of services in the Regional PM10 Street Sweeping Contract. Provisions will be made in the contract with M&M Sweeping, Inc. to allow for this situation. Fiscal Impact: CVAG has budgeted for the AB2766 contributions (currently at 75% from each jurisdiction) and the COLMAC grant, which is currently approved through 2020. CVAG has applied for SCAQMD funding to cover the remaining Program costs. Adjustments may need to be made to the Street Sweeping Contract Scope depending on whether funding is received and the amount of the grant award.

Staff Report

Subject: Costs incurred for Ferguson v. CVAG, et al Contact: Erica Felci, Governmental Projects Manager ([email protected]) Recommendation: Information. Background: At the April 2, 2018 Transportation Committee meeting, CVAG staff was asked to compile information on the costs incurred during the lawsuit that former Palm Desert Councilman Jim Ferguson filed to challenge the CV Link project. Mr. Ferguson’s lawsuit was filed in October 2017 against CVAG, the Riverside County Transportation Commission (RCTC), and the South Coast Air Quality Management District (SCAQMD. The lawsuit challenged three sources of funding that have been secured for CV Link: Measure A, the Transportation Uniform Mitigation Fund (TUMF) and an air quality grant from SCAQMD. In 2015, similar claims had been raised by the City of Rancho Mirage and had been rebutted by a comprehensive legal opinion obtained by CVAG. The public agencies prepared several filings in order to respond to the lawsuit’s baseless claims, which involved the respective attorneys and staff. On March 9, 2018, Riverside County Superior Court Judge James Latting dismissed the lawsuit. CVAG, RCTC and SCAQMD never had to appear in court because the Judge ruled that Mr. Ferguson had failed to raise any valid legal claims in his lawsuit. Mr. Ferguson has until June 4, 2018 to file an appeal. CVAG’s legal bills to date total $39,545.39 and RCTC’s legal costs were about $35,000. SCAQMD was defended by in-house counsel. These costs do not include the staff time that was spent in relation to the lawsuit. Fiscal Analysis: Because the $39,545.39 in legal fees were in defense of Measure A, Measure A funding will be used to cover costs. This is the first time that Measure A has been used on costs related to CV Link.

Staff Report Subject: Da Vall Interchange with I-10 Project Study Report (PSR) Contact: Eric Cowle, Transportation Program Manager ([email protected]) Recommendation: Approve Amendment #1 to the Reimbursement Agreement between the City of Cathedral City and CVAG for the Da Vall Drive/ I-10 Interchange Project – Project Study Report Phase. Background: In April 2009, the CVAG Executive Committee approved a Reimbursement Agreement with the City of Cathedral City for the Da Vall Drive/ I-10 Interchange Project – Project Study Report (PSR) Phase. At that time, CVAG’s Interchange Improvement Preparation Fund funded all PSR work. The Agreement provided for 100% regional funding, up to $1.3 million, to complete the PSR for the interchange project. Work began in the summer 2009. In February 2011, CVAG requested that all work on the project cease due to funding limitations. Other CVAG interchange PSR projects within the region were placed on hold as well. At the time, the Da Vall project PSR was approximately 35% complete. Prior to the work stoppage in 2011, Cathedral City had an agreement with Caltrans that provided for oversight of the PSR process at no charge to the City. In 2011, Caltrans determined that they would no longer spend state funds subsidizing locally funded projects, and consequently submitted an estimate of $190,000 that needs to be spent to have Caltrans review the PSR process. The City has now expressed interest in completing the project. Cathedral City is only requesting to complete work outlined within the existing Reimbursement Agreement with CVAG, which will complete the Project Initiation documents known as the PSR. Cathedral City would require a new Agreement to move beyond the PSR into the Project Assessment and Environmental Design (PAED) phase of the project. Completing this initial phase of the project will help the City identify potential alternatives and define a project well enough to explore external funding opportunities. While the improvements on Da Vall Drive from Varner Road to Ramon Road do not currently score more than nine points on the 2016 TPPS, the interchange project was approved for funding under CVAG’s Interchange Improvement Preparation Fund in 2009. The highest scoring project in the 2016 TPPS had 15 points, with 12 points needed to make the top ten percent. At least one potential interchange alignment, and all of the proposed Da Vall Drive improvements, are anticipated to take place within Cathedral City and Riverside County and a small portion of tribal Land. Widening of Da Vall within the City of Rancho Mirage has already either taken place or has been conditioned as part of another development.

Fiscal Analysis: As the Caltrans oversight cost was not included the initial Consultant Agreement, Cathedral City requests that an additional $190,000 be added to the Reimbursement Agreement with CVAG. This raises CVAG’s obligation from $1,300,000 to $1,490,000. CVAG has transportation funding available to cover the additional, not-to-exceed amount of $190,000. Subject: Indian Canyon Drive Two-Way Conversion Project Contact: Eric Cowle, Transportation Program Manager ([email protected]) Recommendation: Approve a Reimbursement Agreement between the City of Palm Springs and CVAG for a project to convert Indian Canyon Drive from one-way to two-way traffic between Camino Parocela and Alejo Road. Background: In June 2017, CVAG’s Executive Committee approved a project in the City of Palm Springs to make roadway improvements to Indian Canyon Drive as part of the Regional 2017 Bicycle and Pedestrian Safety Program. At the time, Indian Canyon Drive consisted of four northbound lanes from Camino Parocela to Alejo Road. In October 2017, the Palm Springs City Council took formal action to approve a two-way conversion for Indian Canyon Drive that would provide two northbound lanes, one southbound lane and one center left-turn lane from Camino Parocela to Alejo Road. The City approved the change to reduce vehicular speeds along Indian Canyon Drive and to alleviate congestion on Palm Canyon Drive, which runs parallel through downtown. The project is about a mile in length. The two-way conversion compliments the funded bicycle and pedestrian safety improvements and adds increased signalization necessary to accommodate the new southbound traffic. The conversion project would be constructed concurrently with the bicycle and pedestrian safety project this summer. This section of Indian Canyon Road has been on the TPPS since the 1990s, with maximum points scored in accident rates, and additional points provided from pavement condition and system connectivity. While currently scored at 10 points, this TPPS project is not within the top ten percent. The highest scoring project in the 2016 TPPS has 15 points, with 12 points needed to make the top ten percent. But given CVAG’s investment in the bicycle and pedestrian improvements along this same corridor, participation in the two-way conversion makes logical sense. The Bicycle and Pedestrian Safety Program had a grant cap of $2,000,000, which the Palm Springs’ Indian Canyon project reached. This regional participation is not proposed as an addition of Bicycle and Pedestrian Safety Program dollars, but as the funding of a TPPS project whose priority is increased by the Bicycle and Pedestrian Safety Program investment. Fiscal Analysis: CVAG has transportation funding available to cover a not-to-exceed amount of $1,500,000, which is 75% of the estimated $2,000,000 construction cost.
