Dear Mr. Haddadian:

I am writing in reference to your request for information regarding highmast lighting with LED technology. Certainly, LED's are progressing at a very fast pace and will someday reach the lumen packages needed for general illumination. While Holophane is actively researching this technology, it is not quite ready to replace traditional light sources, particularly in this application. At this point in time, three key elements hinder incorporating this elegant and progressive light source:

1. Required Lumen package/or highmast. Highmast requires high lumen density to achieve the recommended illumination levels. Typical IOOOW HPS lamps deliver approximately 150,000 lumens. Current commercially available LED's deliver approximately 50-701umens per watt (when properly thermally managed in a fixture). Thus a highmast fixture would require a minimum of2,000 or so 1W LED's to deliver the same lumen package. This is a very high part count to control from a quality and reliability standpoint.

2. Thermal and ElectricalManagement. Magnetic ballast technology is a very mature technology and extremely robust to both temperature fluctuations and electrical variation. LED's and the electronic drivers that power them must be thermally managed and electrically protected from surges. There is a scarcity of robust technologies commercially available to handle these challenging issues. While this hurdle is achievable from an engineering perspective, it creates a significant cost disparity and adds component complexity for an outdoor fixture.

3. Costo/assembkd Iumineire with LED's. While both the sheer number of LED's and the technology required to handle them are certainly barriers, the key hurdle remains the extremely high cost. For example, there are commercially available LED luminaires for roadway application that target to replace cobrahead type fixture. They cost $800·$1000 each vs. $80-$100 for the cobrahead... a significant price disparity driven by the high costs of LED's and the sophisticated technology required to electrically drive, thermally protect, and electrically isolate the components.

While we are very excited about this new technology and are actively working on applications to bring this technology to its full commercial potential, the reality is that it is not currently feasible to replace a very high lumen package like HighMast with an LED alternative.

IBEW Local 11 Allegations

IBEW Local 11 has furnished the POLA a binder titled "HELIX ELECTRIC FACT SHEET AND SUBSTANTIATING DOCUMENTS". Staff has reviewed this information and the following comments are provided.

1. IBEW provided information regarding a public agency's responsibilities regarding award of contract.

POLA Response: The POLA always performs a bid analyses after receipt of each bid. Bid proposals are reviewed for conformance with contract bidding requirements, verification of contractor's license and reference checks. The City Attorney is consulted in case it is determined that a bid/bids might be non-responsive and/or other questionable items are found in the bid proposals.

2. IBEW has provided many reference projects in the binder regarding lawsuits, safety violations and noncompliance.

POLA Response: Law suits: Most of the projects with the exception a few in 2003, and two in 2004, were between 1990 and 2002. In all Helix lawsuits, the charges were settled before going to trial. Safety. The Experience Modification Factor (EMF) for Helix is 0.66, which is considered low. This. EMF is calculated based on the number of accidents a company has had, and is used for Worker's compensation rate purposes. Helix has a low EMR of 0.66 and therefore is considered a safe contractor. In addition, the POLA Berths 302-305 Terminal Lighting project includes the "Electrical Safety Policy" which requires trained workers to work on this project. Non­compliance: The non-compliance notices were issued on the Westwood Replacement Hospital project. The non-compliance form was used as a means of communication between the owner and the contractor. Staff has checked Helix's recent projects. In all reference checks the clients were happy with the quality of work performed by Helix (see attached transmittal). Helix has received numerous project awards from many agencies including "Excellence in Construction - LAX Gateway Enhancement Project - 2002" and "Education Contractor of the Year - 2005".

Helix worked on the City of Los Angeles City Hall Retrofit project between 1998 and 2003 and successfully completed the project with no contract compliance issues. Helix is currently working on a major expansion project for the Los Angeles Department of Airports and has encountered no contract compliance issues thus far.

Helix Electric, Inc. (HEI) as the prime contractor on the subject project successfully completed this job per contract plans and specifications on time and on budget. HErs unique ability to work closely with the owner and identify design changes and modifications as needed added value to the overall performance and delivery of the contract specified work. As a result, HEI was able to meet and exceed budgeting and milestone requirements that were instrumental to the overall success of this project.

HEI conunitted highly professional and experienced field personnel to operate and perform its work. HEI's Superintendent and Foremen effectively coordinated all work between engineering, owner, and Operations and Maintenance groups while maintaining the required productivity levels demanded on this project. As a direct result of strong HEI project management skills, the team was able to reach consensus in a timely fashion in order to effectively recognize and resolve conflicts. The overall change order rate was below 5% which achieved the owner's expectations. Upon the final job walk, Operations and Maintenance staff praised the quality of the work and final product. The project goals associated with Quality, Cost, Schedule, and Scope were all met as a result of HEI's diligent efforts coupled with the Orange County Sanitation Districts support.

The UCDHS Education Building project is nearly complete and I wanted to let you know how much I appreciated the efforts of your project team.

I know that Helix has a large resume of projects of similar size and complexity to the UCDHS project. However, these projects are never easy. I am thankful we were able to have Helix Electric on this project.

I myself have been around this industry for more than 30 years and I've watched Helix Electric grow into a formidable company over the years. You must be very proud. In fact Eric and I have worked on projects together as far back as 20 years ago and I look forward to many more projects together.

As both Helix and Sundt concentrate on similar project types, it makes good sense to me that we should make a concerted effort to pursue projects together in the future.

I want to thank you personally for your contribution to this extraordinary project. Each team member, and there are over 2,500 of you, has much to be proud of in what you have accomplished individually and together.

There is a great story in this project. It is a story about how people came together from many diverse perspectives and made a meaningful contribution. You know about the hard work that you and others around you put into it each day. For some of you it was for many months. for others it was a couple years, and for some of you it has been a daily commitment for six or seven years. And you stayed with it. You worked for the good of the whole, for the vision ofwhat the team committed to do.

The CalPERS Board put their trust in the team to create the design and construct the bUilding to accomplish a great vision. You honored CalPERS values and their trust through the magnificent building that stands' here today, and wiJl be here for generations to come.

You have succeeded by communicating and collaborating daily; and through mutual respect, your commitment to excellence (our team motto) and integrity. And you have shown an undying willingness to persevere to solve problems at all levels and of all types. As the project is ending, some of you are still here. helping solve remaining issues in the same way you have participated throughout the life of this project. And for all of this I thank you.

I know 'from talking with many of you over the past seven years that you take great pride ;n the work you have done to make this a reality. You have told your family, friends, and neighbors about your work and how special it is. You brought them to see this building, sharing your sense of its special qualities. I too share this sense of pride and accomplishment in what we have done together as a team.

Subject: Helix Electric - Work on Alvarado and Miramar Water Treatment Plant Projects

Helix Electric has been our subcontractor on two large City of San Diego Water Treatment Plant Upgrade and Expansion projects.

Alvarado Phase I was a $52 million complex and a difficult project. When the owner initiated an $11 million change order and bankruptcy of the prime contractor, it was essential for the City and all subcontractors to work harder and more diligently to finish this project. One highlight of this project was that Helix staffworked cooperatively with the designer and the construction manager's team to overcome difficulties and challenges, while maintaining the existing plant in operation at all time. This project was substantially completed in June of2003. Helix's staff has been back several times to answer and address City concerns without asking for any additional compensation.

Miramar Water Treatment Plant Upgrade and Expansion - Contract A is an $82 million project that started mid 2003 and will be completed summer 0[2007. Helix is a major subcontractor for this project. Helix has been instrumental in working with the designer to incorporate a major change to the security plan which was a new scope to the project.

Overall, City of San Diego staff and our consultants have an excellent working relationship with Helix Electric which has resulted in successful completion of several difficult projects. Weare glad to provide this letter of recommendation to Helix Electric to be used for other agencies or private work.

Since 1996 the State of California has been involved with the design and construction of the Department of Health Services, Richmond Laboratory. The Richmond Laboratory is a 322,000 square foot Bio-Safety Level III (BSL-III) Laboratory that houses nine laboratories including a Genetic Disease Laboratory, Infectious Disease Laboratory, Food and Drug Laboratory, and an Environmental Health Laboratory. Phase II included the construction of three - 3 story laboratories, two- 3 story office buildings, an auditorium and a warehouse. During the construction phase of the project I had the pleasure of working with Helix Electric.

Helix Electric was responsible for providing all labor, materials and supervision associated with work pertaining to the electrical scope of the project. The electrical scope included power, communications, control, lighting, public address, fire alarm, etc. My experiences with Helix are that they were, on a consistent basis, cooperative in nature, provided a positive attitude in achieving the State's goal to complete the project and, in general, a pleasure to deal with.

The State of California is fortunate to have had the opportunity to work with Helix Electric on the Richmond Laboratory project. Please consider this letter my personal commendation to the Helix organization for providing superior services on the Richmond Lab project. . .
