A PTI photograph showed Kumar leaving the PM’s South Block office and a TV crew promptly reported that the minister had met Singh. However, the minister soon denied he had met the PM and PMO sources stated the same. The minister’s mystery visit to the PMO coincided with indications that the Congress leadership might be veering round to take tough calls to contain the fal- lout of the allegation that the government tried to sabo- tage the probe into the irreg- ular allocation of coal block allocations, sparked off in- tense conjecture about what he did for the 30-odd minutes he was at South Block and if any meaning can be read into his failure to meet Singh. Kumar, Singh’s personal choice for the law ministry, does not seem to enjoy much sympathy in the Congress as he is criticized by the judici- ary and the opposition for carrying out changes in CBI’s coal scam report, with party circles virtually unan- imous ascribing his survival to his proximity to the PM. Significantly, sources in the PMO said that the PM was indeed in his office on Thursday morning when the PTI photograph showed Ku- mar coming out of South Block. There was specula- tion that Kumar sought a few minutes with him but did not get an audience and, there- fore, returned after meeting some officials. According to a PTI report, Kumar said: “I did not meet the Prime Min- ister today.” Kumar did attend a Cabi- net meeting the evening where he spoke on an agenda pertaining to his ministry. A personal audience with the PM, however, would have giv- en him an opportunity to pre- sent his take on the SC’s com- ments. It is understood that the law minister does not feel the court has been scathing despite the widespread inter- pretation that his role was criticized by the SC, indicat- ing he continues to see no reason to quit. While Kumar did not meet the PM, attorney gener- al G E Vahanvati did and is believed to have explained the implications of the court’s comments and order. On Wednesday, the court had pointedly asked if the integ- rity of the investigation was not subverted by changes in the status report made on the suggestions of the law minis- ter and government officers. As the highest court in the land revisits its 1997 judg- ment in the ‘Vineet Narain vs Union of India’ case to build jurisprudence on insulating the CBI from executive inter- ference, its central protago- nist, journalist and anti-cor- ruption crusader Vineet Narain, was in court. Speaking to TOI after Wednesday’s marathon hear- ing where the SC derisively referred to the CBI as a “caged parrot”, Narain said he wasn’t surprised but felt an acute sense of deja vu dur- ing the coal scam hearings. “In more than 15 years since the verdict on my PIL, we haven’t travelled any dis- tance. My PIL filed in 1993 de- manded an honest probe in the hawala case which had dangerous consequences for the nation’s security and fi- nances. Despite SC monitor- ing, the case was never prop- erly probed. I saw how CBI and government’s top law of- ficers played a dubious role to ensure the probe was botched up. From SC’s obser- vations in the coal scam, it’s clear we are back to square one,” he said. However, Narain added a sobering note to the current euphoria over the SC’s sting- ing observa- tions and said: “Con- trary to general expectation, the SC on Wednesday didn’t emphasize much on accusa- tions against the political leadership. In a carefully treaded path, they expressed anguish and anger in no un- certain terms against inter- ference of the executive in the ongoing investigations. It appears the court is more in- terested in ensuring that the 1997 judgment is implement- ed in letter and spirit. So much so, they have asked the law officers to come back with a firm commitment.” Narain, whose investiga- tive journalism during the 1990s threatened to singe the “high and mighty”, believes no political party wants to let go of the CBI and the coal al- lotment case is no different. Narain hasn’t just been an interested observer in the current PIL proceedings be- fore the apex court. Encour- aged by the SC’s repeated ref- erence to the hawala judgment authored by the late Justice J S Verma, the ac- tivist has filed a written sub- mission in court, urging the judges to pay heed to his sug- gestions on making the CBI effective and efficient. ‘Nothing’s changed since ’97 ruling’ Abhinav Garg TNN Hyderabad: It is an open se- cret in the corridors of Rail Nilayam, the headquarters of the South Central Railway that their boss, general man- ager Devi Prasad Pande will become member (traffic) of the Railway Board in the first week of July. They are also aware that Pande, who arrived in Secunderabad a month ago on April 10, has just come here to fulfill the requirement that mandates only officers who have served as general manag- ers of a zonal railway can be appointed as a board member. Pande, a 1976 batch Indian Railway Traffic Service (IRTS) officer, was additional member (traffic) at the Rail- way Board before he para- chuted to this city. In the meanwhile, the post of mem- ber (traffic) is being held by the chairman of the Railway Board, Vinay Mittal. “So why is Mr Mittal hold- ing charge? Is it to warm the chair for Mr Pande till he ful- fills the mandatory require- ment of being a zonal general manager?” asks a railway officer. The question is signifi- cant in view of the recent scandal in appointments in railway posts. Mittal will superannuate at the end of June this year and the expectation is that his exit will lead to Pande’s eleva- tion. Though Pande has a good track record, there is a senior officer whose claims are being overlooked. S V Arya, general manager of the West Central Railway headquartered in Ja- balpur, in normal course should have been appointed as the member (traffic) but due to inexplicable reasons his claims have been overlooked. TIMES NEWS NETWORK New Delhi: Amid uncer- tainty about his tenure and signs that the CBI is prepar- ing to quiz him in connec- tion with the “cash-for-post- ing” scam, railway minister Pawan Bansal on Thursday skipped a Cabinet meeting. Although the minister reportedly stayed away from the meeting because he was under the weather, his ab- sence coincided with strong indications that the Con- gress leadership was con- templating taking a few hard decisions to repair the damage caused by allega- tions of corruption, and es- calated speculation about his ministerial innings. The government has been embarrassed by daily revelations of the business ventures of his family mem- bers and nephew Vijay Sin- gla who was arrested receiv- ing a Rs 90 lakh bribe. Even though Bansal did attend a meeting of an empo- wered group of ministers on drought on Wednesday, Con- gress sources said the minis- ter might have decided to keep a low profile in view of the lengthening doubts about his continuation in the government. While Bansal hangs on, reports on how business en- terprises run by his family benefitted by receiving large loans from Canara Bank soon after a chartered accountant close to him was made a director have embar- rassed the government. Sinha offered the brief comment as he was sur- rounded by TV crews on his return to Delhi on Thursday morning. Inundated by ques- tions on the SC’s remarks, Sinha said whatever the court had said was correct. The court had come down heavily on the CBI for shar- ing the status report on the coal allocation scam probe with law minister Ashwani Kumar and PMO and coal ministry officials. The agen- cy had issued a statement, saying: “CBI assures the Su- preme Court of thorough and qualitative investiga- tion into Coalgate. It will fol- low directions of Supreme Court in letter and spirit.” Observing that the CBI was like a “caged parrot”, the court had said it should stand up to all “pulls and pressures” and not share its probe with anyone, includ- ing the law minister. In a sig- nificant order on Wednesday, a bench headed by Justice R M Lodha had asked the gov- ernment to make efforts to come out with a law before July 10 to insulate the CBI from external intrusion. When asked about his re- action, Sinha said: “It is up to the government. We accept Supreme Court’s observa- tions with great respect.” CBI director agrees with ‘caged parrot’ remark by SC TIMES NEWS NETWORK New Delhi: The Central Vig- ilance Commission has sought a detailed report from the CBI on its controversial decision to share the coal scam status report with the government, even as many observers are hoping that the government will come up with a comprehensive auton- omy package for the agency unlike in the past. The CVC is believed to have taken cognizance of the entire development in the coal scam, and has sought de- tails. The commission has superintendence over the CBI under the CVC Act, 2003 on all cases of corruption be- ing investigated by the feder- al agency. The CVC has also sought a detailed report from the CBI on the status of its in- vestigation into the scam. Given the Supreme Court’s strictures on the law minister, the attorney gener- al and officials of the PMO and the coal ministry carry- ing out changes to the CBI re- port, it is not clear what ac- tion the CVC will initiate. Given the partial superin- tendence that the CVC has over the CBI, many within the government are arguing that, this time, the agency’s autonomy should be compre- hensive and not piecemeal. The Supreme Court on Wednesday asked the gov- ernment to come up with a comprehensive proposal be- fore July 10 to protect the CBI from external “influence and intrusion”. The court also pointed out that despite its judgment in the Vineet Na- rain case 15 years ago order- ing autonomy for the CBI, the situation has only got worse. Government officials said when the government comes up with its suggesti- ons, it should not play the kind of games played last time when such an opportu- nity came. The CVC Act said the CVC will “review the pro- gress of investigations con- ducted by the Delhi Special Police Establishment Act in- to offences alleged to have been committed under the Prevention of Corruption Act, 1988”. This limited the CVC’s oversight over the agency, with a large part of the CBI’s activities outside the CVC’s superintendence. CVC seeks coal report from CBI QUERY ON CHANGES TIMES NEWS NETWORK New Delhi: The CBI has ar- rested a bevy of business- men and others in connec- tion with the railway ‘jobs for sale’ scam and this is giving the agency a headache in more ways than one. As if questioning them and trying to piece together evidence was not enough, the agency is having to coordi- nate delivery of home cooked food to the accused and even employing a food taster to sample the eatables lest they be laced with poisonous sub- stances. Then, it has to take care of the medication of sev- eral of the arrested persons. Among those in CBI cus- tody are railway minister Pa- wan Bansal’s nephew Vijay Singla, businessmen Sand- eep Goyal, Ajay Garg, Sushil Daga, Samir Sandhir, Rahul Yadav, Manjunath and Rail- way Board member (staff) Mahesh Kumar. An officer from the inves- tigating team told TOI that the accused had to be kept in- side CBI headquarters at Lodhi Road during the re- mand. Most of them were giv- en food by the agency but some, on the special request of their families, were al- lowed home cooked food. For this, the agency had to take the help of ‘food tasters’ from within the CBI to make sure that nothing harmful was mixed in their food. The agency also has to take care of medicines of some of the accused like Ma- hesh Kumar, Vijay Singla and others, sources said. “Some accused had their spe- cific demands, which we ob- viously refused to fulfil but this process consumes a lot of time,” said an officer. The agency had to keep the accused persons in an in- terrogation room or in the in- vestigating officer’s room during the day time, when they needed to be questioned or confronted with the other accused or any documentary evidence, while at night, guards had to be around to keep an eye on them. In the third part of its tapes, Cobra- post claimed it has recorded officials of Bank of India, Central Bank of India, Bank of Maharashtra, Allahabad Bank and Bank of Baroda, all major public sector banks, as well as IndusInd Bank, ING Vysya Bank, HDFC Bank , ICICI Bank and Axis Bank, among private sec- tor banks. Officials of these banks alleg- edly offered to help a corrupt politician invest his black money into banking ac- counts and various insurance products. In part one of its exposé, Cobrapost had claimed that officials of ICICI Bank, HDFC Bank and Axis Bank were willing to assist a corrupt politician to convert his corrupt money. In the second part, Cobrapost had unveiled secret tapes of 23 banks and insurance firms offering to help launder money. Among the 23 were SBI and Life Insurance Corporation. “The RBI continues to act as a protec- tor, and not as a regulator or enforcer. The RBI is loathe to admit that there ex- ists a massive money laundering racket in our financial institutions across the board, flourishing under its very nose, simply because if it were to admit to this deep-rooted malaise, it would strip the RBI of its halo as ‘one of the best banking regulators’ in the world,” Cobrapost said. New videos allegedly show bank of- ficials offering to help the assistant of a corrupt politician to exploit banking channels to route dirty money into banks and insurance products. The latest tapes covered 10 banking institutions, including HDFC Bank, ICI- CI Bank and Axis Bank, which were al- ready covered in the first part of the Co- brapost exposé. In the third part, more officials of already named banks figure. “The videos, across the large spec- trum of such illegal activity, clearly prove that this is not simply the design of some criminally oriented officers, or for that matter, some young, front-of- fice executive succumbing to perform- ance pressures. It proves without doubt that this corruption is endemic, and spread through the Indian banking and insurance system,” a statement by Cobrapostsaid.     Speaking to TOI afterWednesdays marathon hear-ing where the SC derisivelyreferred to the CBI as acaged parrot, Narain said

    he wasnt surprised but feltan acute sense of deja vu dur-ing the coal scam hearings.

    In more than 15 yearssince the verdict on my PIL,we havent travelled any dis-tance. My PIL filed in 1993 de-manded an honest probe inthe hawala case which haddangerous consequences forthe nations security and fi-nances. Despite SC monitor-ing, the case was never prop-erly probed. I saw how CBIand governments top law of-ficers played a dubious roleto ensure the probe wasbotched up. From SCs obser-vations in the coal scam, itsclear we are back to squareone, he said.

    However, Narain added a

    sobering noteto the currenteuphoria overthe SCs sting-ing observa-tions andsaid: Con-

    trary to general expectation,the SC on Wednesday didntemphasize much on accusa-tions against the politicalleadership. In a carefullytreaded path, they expressedanguish and anger in no un-certain terms against inter-ference of the executive inthe ongoing investigations. Itappears the court is more in-terested in ensuring that the1997 judgment is implement-ed in letter and spirit. Somuch so, they have asked the

    law officers to come backwith a firm commitment.

    Narain, whose investiga-tive journalism during the1990s threatened to singe thehigh and mighty, believesno political party wants to letgo of the CBI and the coal al-lotment case is no different.

    Narain hasnt just beenan interested observer in thecurrent PIL proceedings be-fore the apex court. Encour-aged by the SCs repeated ref-erence to the hawalajudgment authored by thelate Justice J S Verma, the ac-tivist has filed a written sub-mission in court, urging thejudges to pay heed to his sug-gestions on making the CBIeffective and efficient.

    Sinha offered the briefcomment as he was sur-rounded by TV crews on hisreturn to Delhi on Thursdaymorning. Inundated by ques-tions on the SCs remarks,Sinha said whatever thecourt had said was correct.

    The court had come downheavily on the CBI for shar-ing the status report on thecoal allocation scam probewith law minister AshwaniKumar and PMO and coalministry officials. The agen-cy had issued a statement,saying: CBI assures the Su-preme Court of thoroughand qualitative investiga-tion into Coalgate. It will fol-low directions of SupremeCourt in letter and spirit.

    Observing that the CBIwas like a caged parrot, thecourt had said it shouldstand up to all pulls andpressures and not share itsprobe with anyone, includ-ing the law minister. In a sig-nificant order on Wednesday,a bench headed by Justice RM Lodha had asked the gov-ernment to make efforts tocome out with a law beforeJuly 10 to insulate the CBIfrom external intrusion.

    New Delhi: The Central Vig-ilance Commission hassought a detailed report fromthe CBI on its controversialdecision to share the coalscam status report with thegovernment, even as manyobservers are hoping that thegovernment will come upwith a comprehensive auton-omy package for the agencyunlike in the past.

    The CVC is believed tohave taken cognizance of theentire development in thecoal scam, and has sought de-tails. The commission hassuperintendence over theCBI under the CVC Act, 2003on all cases of corruption be-ing investigated by the feder-al agency. The CVC has alsosought a detailed report fromthe CBI on the status of its in-vestigation into the scam.

    Given the SupremeCourts strictures on the lawminister, the attorney gener-al and officials of the PMOand the coal ministry carry-ing out changes to the CBI re-port, it is not clear what ac-tion the CVC will initiate.

    Given the partial superin-tendence that the CVC hasover the CBI, many within

    the government are arguingthat, this time, the agencysautonomy should be compre-hensive and not piecemeal.

    The Supreme Court onWednesday asked the gov-ernment to come up with acomprehensive proposal be-fore July 10 to protect the CBIfrom external influence andintrusion. The court alsopointed out that despite itsjudgment in the Vineet Na-rain case 15 years ago order-ing autonomy for the CBI, thesituation has only got worse.

    Government officialssaid when the governmentcomes up with its suggesti-ons, it should not play thekind of games played lasttime when such an opportu-nity came. The CVC Act saidthe CVC will review the pro-gress of investigations con-ducted by the Delhi SpecialPolice Establishment Act in-to offences alleged to havebeen committed under thePrevention of CorruptionAct, 1988. This limited theCVCs oversight over theagency, with a large part ofthe CBIs activities outsidethe CVCs superintendence.

    New Delhi: Investigative website Co-brapost has released further secret tapesto show alleged money laundering bymore banks.

    In the third part of its tapes, Cobra-post claimed it has recorded officials ofBank of India, Central Bank of India,Bank of Maharashtra, Allahabad Bankand Bank of Baroda, all major publicsector banks, as well as IndusInd Bank,ING Vysya Bank, HDFC Bank , ICICIBank and Axis Bank, among private sec-tor banks. Officials of these banks alleg-edly offered to help a corrupt politicianinvest his black money into banking ac-counts and various insurance products.

    In part one of its expos, Cobraposthad claimed that officials of ICICI Bank,HDFC Bank and Axis Bank were willingto assist a corrupt politician to converthis corrupt money. In the second part,Cobrapost had unveiled secret tapes of 23

    banks and insurance firms offering tohelp launder money. Among the 23 wereSBI and Life Insurance Corporation.

    The RBI continues to act as a protec-tor, and not as a regulator or enforcer.The RBI is loathe to admit that there ex-ists a massive money laundering racketin our financial institutions across theboard, flourishing under its very nose,simply because if it were to admit to thisdeep-rooted malaise, it would strip the

    RBI of its halo as one of the best bankingregulators in the world, Cobrapostsaid. New videos allegedly show bank of-ficials offering to help the assistant of acorrupt politician to exploit bankingchannels to route dirty money intobanks and insurance products.

    The latest tapes covered 10 bankinginstitutions, including HDFC Bank, ICI-CI Bank and Axis Bank, which were al-ready covered in the first part of the Co-brapost expos. In the third part, moreofficials of already named banks figure.

    The videos, across the large spec-trum of such illegal activity, clearlyprove that this is not simply the designof some criminally oriented officers, or for that matter, some young, front-of-fice executive succumbing to perform-ance pressures. It proves without doubtthat this corruption is endemic, andspread through the Indian banking and insurance system, a statement byCobrapostsaid.
