The charges published in this tariff apply for the account ofEvergreen Trails, Inc. for the following transportation services as provided for in the carrier's Certificate ofPublic Convenience and Necessity.

Operate as passenger carrier to provide INTRASTATE CHARTER BUS SERVICE between points and places in the state ofNevada.

APPLICATION OF RATES AND CHARGES RuleNo. 10

Charter services at an hourly or mileage rate between points and places in the State ofNevada.

All charges herein are shown in dollars and cents and are payable in lawful United States Money. When the charges accruing on a charter movement, based on a time or mileage exceed the charges computed upon a rate based upon a greater time or mileage charge, the latter should apply.

Charges named herein do not include gratuities, admission fees, meals, shows, hotel accommodations or any other like charges. At the request of the charter party, carrier MAY make arrangements on the charter party's behalf for rooms, food and other activities as requested by the charter party. The cost ofthese arrangements will be added to all other charges.

Charges for transportation and other arrangements are due and payable as specified on each individual Charter Service Confirmation. Charges named herein include the service of the vehicle and the driver unless otherwise stated.

Scenic tours at a per capita rate to various points ofinterest for the purpose ofsightseeing or visiting those points ofinterest where a narrative lour is presented to the passengers.

Special services, transporting ofpersons who have acquired the exclusive use ofvehicles for the special itinerary between definite points oforigin and destinations between points and places in Clarie. County Nevada and points and places within the State of Nevada at a per capita rate.

ANIMALS Rule No. 20

Animals, other lhan "Guide Dogs" or other animals lhat assist a person \\ith disabilities will not be carried withoul prior arrangements wilh the carrier and unless the animal is properly confined.

LIMIT OF BAGGAGE LIABILITY Rule No. 25

Baggage will not be checked. Personal baggage, musical instruments, athletic equipment, and other paraphernalia necessary for the purpose ofthe trip, limited to the capacity of the charter coach, will be transported in the custodyofthe charter party al no additional charge. Carrier will nol be liable for loss or damage to baggage or contents thereof unless occasioned by lack of reasonable care on its part for a maximum liability of $250.00 for the loss of, or damage to any single piece of baggage including its contents.

LIMIT OF LIABILITY Rule No. 35

The carrier will not be liable for delays caused by an Act ofGod, Public Enemies, Authority oflaw, Quaranline, Riots, Strikes, Accident, Breakdowns, Highway conditions, or any other condition beyond its control, and does not guarantee arrival or departure time from any given point al any specified lime. However. lhe carrier will endeavor to maintain the schedule submitted by its agent and/or employee but the same is not guaranteed.

CLAIMS Rule No. 40

I. A claim by a shipper orconsignor against a conunon or contract motor carrier for lost ordamaged freight orbaggage must be submitted to the carrier within 7 days after the loss or damage is discovered.

2. Within 14 days after receipt of the claim, the carrier shall : (a) Compensate the shipper or consignor; or (b) Deliver to the shipper or consignor a wrilten denial of the claim.

3. A denial o f a claim any be appealed by the shiooer or consianor to the Authorit .

OBJECTIONABLE PERSONS Rule No. 45

The carrier will refuse lo carry or will remove, at any proper point enroule, any person who is intoxicaled or believed lo be under the influence ofnarcotics. The carrier will also refuse to carry passengers whose physical or mental behavior, is such, as to render him or her incapable ofcaring for himself or herself without assistance or render himself or herself objectionable to other passengers, or involve any hazard or risk lo other persons or property being transported. EXCEPTION: This rule does not apply to persons who are ill and are accompanied by an attendant or nurse.

CANCELLATION OF SERVICE Rule No. 50

The carrier reserves the right to cancel any service because ofwealher or other conditions such as road hazards due to slides, stonns, or any other similar causes, nalural or olherwise which makes travel inadvisable.

EQUIPMENT SUBSTITUTION Rule No. 65

When scheduled equipment is not available or due to the total number ofpassengers, carrier may at their discretion, substilule equipment

AGENT Rule No. 70

Carrier may elect to appoint as its agenl any organizalion, firm, corporation, motel, hotel or legal gaming operation who individually or collectively, desire to obtain passenger bus transportation service between one or more common points of collection of all applicable charges and remittance !hereof direclly to the carrier without individual passenger fare collection by the carrier.

COMPUTATION OF CHARGES for Charter Bus Services Rule No. 292

Charges wilt be computed as provided in subparagraph (l ), (2). (3), (4), (S), and (6) of this rule.

(I) BASIC CHARGE - The basic charge to be assessed will be either the Time charge computed under the provisions of subparagraph 3, or the Live Mileage charge computed under the provisions of subparagraph 2 whichever is greater. The charges computed under the provisions ofsubparagraph 4, 5, and 6 ofthis Rule will be assessed in addition to the basic charge.

(2) LIVE MILEAGE -The Live Mileage charge provided in Rule No. 1500 will be assessed for each mile traveled by the charter coach between the point of origin and the point ofdestination.

(3) TIME CHARGES - The time charges provided for in Rule No. I 000 will be assessed for each 24 hour period, computed from the time the charter coach is ordered to be at the point oforigin, to the time the coach is vacated by the charter party at the point ofdestination.

(4) SPECIAL CHARGES-Special charges provided in Rule No. 725 will be assessed and added to the basic charge computed under subparagraph 1 of this Rule.

(5) DEADHEAD MILEAGE CHARGE-The deadhead mileage charge as provided in Rule No. 1700 will be added to all other charges. Deadhead charges start and end al origination and return to the bus yard.

(6) CLARK COUN1Y PASSENGER FEE - Any charter service that includes a pick-up and I ordrop-off at the airport will have an additional forty (40) cent per passenger charge, each way, added to the applicable charges.

CHARTER BUS SERVICES FRACTIONS, DISPOSITION OF

Rule No. 565

In computing charges or distances, all fractions must be retained at their full value until the final result is obtained then all remaining fractions will be disposed of in the following manner:

(1) Fractions of less than one-half cent or mile, OMIT. (2) Fractions ofmore than one-halfcent or mile increase to the next whole cent or mile. (3) Fraction ofquarter hours shall be rounded.

CHARTER BUS SERVICES SERVICE CHARGES

Rule No. 725

(I) All costs incurred by the carrier at the request of the charter party for entrance and parking fees to National Parks, amusement parks, vacation parks or other similar incidental fees will be collected from the charter party.

(2) At the request of the charter party, carrier MAY make arrangements on the charter party's behalf for rooms, food and other activities as requested by the charter party. The cost of the acconunodations will be added lo all other charges.

(3) Any additional mileage operated, or time incurred by the carrier occasioned by an Act ofGod. bad conditions of the roads, or any other circumstances beyond its control, will be charged at the applicable rate. Shown on pages 9-10.

(4) Any additional time incurred by the carrier at the request of the charter party, will be charged at the applicable rate. Shown on pages 9-10.

(5) Actual costs incurred for additional driver or drivers required by reason of the use of the charter equipment in such a manner that the original driver must be taken out of service to comply with applicable federal or state hours ofservice regulations, will be added to all other charges.

Charter Services Rates and Charges

FUEL SURCHARQf/PR!CE PER GALLON

Fuel Cost Price Adjustments (Surcharge): The following Fuel-Related Cost Price Adjustment (Surcharge) will apply on passenger transportation charges, as noted below.

I. On the 25111 day ofeach calendar month, the price per gallon ofdiesel will be determined based on the price stated by the US DOE EIA survey on "Retail ON-highway Diesel Prices-West Coast Average". This price will be obtained by calling the DOE Fuel Hotline at 202.586-6966 or via the DOE web site at www.cia.doc.gov.

2. Ifthe 25t1t day of the calendar month is a Federal Holiday, the price will be determined based on the state DOE price available on the next business day.

3. The DOE fuel price obtained will then be indexed based on the fuel price adjustment factor matrix set forth in this item to detennine the Fuel Cost Price Adjustment that will become applicable on the I., day ofthe month. The adjustment determined will apply for all transportation beginning on the I51 day ofthe following month and will remain in effect through the last day of that calendar month.

4. The surcharge will be added utilizing the matrix set forth below. The resulting charge is in addition to all other applicable transportation charges.

The above diesel fuel related cost price adjustments (surcharge) will apply to the total charter transportation charges shown on the invoice.

Fuel surcharge will be applied at appropriate percentage rate at time service was performc.-d.

Fuel surcharges will be shown separately from regular charter rates on invoices and will apply to the total amount of transoortation chanzes shown on the invoice for the service performed.

3o/o TAX PURSUANT TO SECTION 51 OF ABl75

The following rules apply to carriers who provide passenger transportation, excluding airport transport service:

Pursuant to Nevada Legislative Senate Bill No. 376 Sec. 36. Section 51 of Assembly Bill No. 175 of this session is hereby amended to read as follows:

Sec. 51 . I . Except as otherwise provided in subsection 2 and in addition to any other fee or assessment imposed pursuant to this chapter, an excise tax is hereby imposed on the connection, whether by dispatch or other means, made by a common motor carrier of a passenger to a person or operator willing to transport the passenger at the rate of 3 percent of the total fare charged for the transportation, which must include, without limitation, all fees, surcharges, technology fees, convenience charges for the use of a credit or debit card and any other amount that is part of the fare . The Department of Taxation shall charge and collect from each common motor carrier of passengers the excise tax imposed by this subsection.

2. The provisions ofsubsection I do not apply to an airport transfer service.

4 . As used in this section, "airport transfer service" means the transportation of passengers and their baggage in the same vehicle, except by taxicab, for a per capita charge between airports or between an airport and points and places in this State. The term does not include charter services by bus, charter services by limousine, scenic tours or special services.

NOTE I: The passenger transportation recovery charge must be passed along to all customers.

NOTE 2: The 3% passenger transportation recovery charge must be shown separately from the total fare as defined above.
