2020-02-28 Michael Burns Design Engineer, Telecommunications Aurecon Aurecon Centre, Level 8, 850 Collins Street, Docklands, Melbourne VIC Australia 3008 Dear Michael, Broadmeadows Telstra Tower – Flora species assessment The Aurecon Ecology team were engaged to assess the flora species within the vicinity of the location of an approved Telstra telecommunications tower situated north west of the intersection of Johnstone Street and Pascoe Vale Road in Broadmeadows, immediately north west of the Johnstone Street on ramp (See Appendix 1).

A site visit was undertaken by Justin Sullivan, Senior Consultant Ecologist on the 21st February 2020, during which a flora assessment was undertaken. The scope of the assessment was to identify the flora species within the site, specifically the trees mapped in the draft plan.

The site comprised a very small area of open space, with the ground layer managed as a lawn. The ground layer was dominated by introduced flora, namely common introduced grasses (Chilean Needle-grass and Kikuyu) and broadleaf weeds (Ribwort and Paterson’s Curse). A small number of scattered native flora species were recorded, including wallaby grass at low cover levels (<5%). A full list of flora species recorded is provided in Appendix 3. No patches of native vegetation (as defined in the Guidelines for the removal, destruction or lopping of native vegetation, DELWP 2017) occurred in or immediately adjacent to the Telstra lease area.

Planted trees exist around the perimeter of the Telstra lease area, immediately to the north, east and south. These species were identified as part of this assessment and are detailed in Appendix 2. Planted trees have been tabulated clockwise from the north, and tree numbers and acronyms have been marked up on the draft plan in Appendix 1. None of the trees shown in the draft plan (Appendix 1) will be impacted by the proposed works, including all underground trenching.

Trees 6 to 12 occurred on a sloped garden bed immediately adjacent to the Camp Road (Johnstone Street) on ramp. A small number of planted herbs and grasses also occurred in this area. All flora in this area was considered to have been planted for amenity purposes.

HOW TO AMEND AN APPLICATION FOR A PLANNING PERMIT

9 December 2019 Planning Department Hume City Council Submitted via eportal Response to Request for Further Information Council Ref: P22358 Early in 2018, VicRoads contacted Telstra and advised that their existing site on VicRoads land adjacent to Camp Road would need to be removed due to the future subdivision and acquisition of the land by Hume City Council. VicRoads requested that the site be removed within one year.

The existing site (which was decommissioned earlier this year 2019) services the main Broadmeadows commercial and residential area. This includes important locations such as the Police Station, Hume City Council Offices, and the Broadmeadows Hospital.

Telstra was not able to secure a new location in time before the existing site was to be decommissioned. This meant that the area suddenly lost much of its Telstra 4G services. As a result, and after several complaints from the Police Station and the Hospital, Telstra installed a temporary facility in the rear grounds of the Police Station. This has recently been removed.

A pre-application meeting was held with Hume City Council officers in April 2019. At this time Council representatives expressed concern that the proposed initial site in the road reserve was within the boundaries of the land that Council is intending on acquiring. Upon review of the survey plan, it was confirmed the proposed Telstra Facility is not contained within the land that Hume Council intends to acquire from Vic Roads. Council officers also advised at this meeting that there was potential for an access road to be installed off Johnstone Street. However, Council could not provide a preliminary proposal of the proposed land use and proposed new access roads at this time.

Telstra decided to proceed with the application for the proposed new Telecommunications Site on the advice and statements made by VicRoads and submitted a planning permit application to Hume Council in July 2019 (P22358).

Council issued a Further Information Request on 2 August 2019 expressing concern (amongst other items) that the proposed location of the facility in the Camp Road Reserve would conflict with the Broadmeadows Structure Plan and the future planned Council Car Park adjacent. And was in a prominent arrival route to the activity centre.

On receipt and review of this Council advice, Telstra reviewed the site location with VicRoads and has proposed another location, well set back from Johnstone Street, in a location that will not interfere with Council’s future developed plans for the Camp Road Reserve site. The new location is at 2-8 Pearcedale Parade, and VicRoads have confirmed tenure for Telstra for an acceptable time period.

In addition to this, the new location is within 20m of the previous existing site and this will ensure that the new replacement site will maintain (and improve) the level of coverage in this area. The proximity of the amended location to the previous site will also ensure that there is no significant change in the visual aspects of the Telecommunications Facility, or any additional visual impact to the area.

This submission includes amended designs and an amended planning report (and attachments).

A response to the items of the Further Information request are also tabled below.

1. Proposed Telecommunications Facility report (July 2019) updated to address: a. Section 5.2, Requirement for a Planning Permit, updated to address the use

of the land including a response to Clause 36.04-1, 62.01, 52.19-1, and Section 5 of a Code of Practice for Telecommunications Facilities in Victoria, July 2004 to clearly demonstrate that the proposed use does not trigger the need for a planning permit. Alternatively, if it cannot be clearly demonstrated the use is exempt, the report should be updated to address the use of the land.

b. A response to the objectives of the Broadmeadows Structure Plan 2012 (Town Centre Precinct 1).

Telstra has amended this application so that the proposed facility is located on VicRoads land currently hosting a VicRoads Service Centre and associated car park. The site will be within 20m of the original facility. This land will not be subject to any future changes (or subdivisions) as advised by VicRoads and is not in a road reserve. Additionally, as the proposed facility is located so close to the original facility, it is considered that visualisations are unnecessary. The amended report shows photos of the original facility which will be very similar in height and appearance to the proposed facility. An urban context report is also considered unnecessary as the location has been amended outside the road reserve and will be not be subject to future change. It is noted that Council are intending to construct a multi-level car park on adjoining land to the east. This will service to further screen the proposed facility in its amended location. However, it is difficult to assess the actual future character due to this information not being publicly available.

Preliminary Assessment Comments- Application Response

Telstra has reviewed the comments and concerns expressed by Council in the Further Information letter and has subsequently amended to location of the proposed facility to a location that has been suggested by Council as better meeting the Hume Planning Scheme Provisions and also a location that has been recently approved by VicRoads.

Telstra maintains that a permit for Use for this application is not required. Please refer to Appendix G for a complete response to this issue. In addition to this, the proposal is assessed against Section 4 of the Code of Practice, not Section 5. Section 4 applies four principles of design to telecommunications facilities that are not exempt under Commonwealth Legislation. Section 5 applies to Telecommunications Facilities that do not require a planning permit. As the proposal requires a permit for works, this section does not apply. The Decision Guidelines in Clause 52.19-6 of the Hume Planning Scheme dot point 1, require that the responsible authority must consider, as appropriate: The principles for the design, siting, construction and operation of a Telecommunications facility set out in a Code of Practice for Telecommunications Facilities in Victoria. These principles are listed in Section 4 of the Code, not Section 5.

The location and height of the proposed facility is similar to the height of the original facility which has been removed, and also lower in height than surrounding buildings.

Executive Summary

This report has been prepared by Acquirecomm on behalf of Telstra in support of a planning permit

application for the relocation of Telstra existing site in the Camp Road Reserve onto a new 26.3 metre

telecommunications facility on VicRoads land (Service Centre) 2-8 Pearcedale Parade, Broadmeadows,

3047.

This application has been amended from the original location within the road reserve in consideration

to feedback provided from Council and contained in their further information letter dated 2 August

2019.

The site is legally described as Lot 1 TP920658, Certificate of Title VOLUME 09129 FOLIO 528

The proposed development of the site triggers the need for a permit under the following clauses of

the Hume Planning Scheme:

This report outlines the purpose and demand for a telecommunications facility in Broadmeadows and

addresses the planning merits of the proposal and its consistency with the relevant planning controls

and policies of the Hume Shire Planning Scheme. It is supported by the accompanied plans which show

the proposed layout and design of the facility.

The proposed development of the site represents the maintenance and provision of essential

telecommunications infrastructure to Broadmeadows and its surrounds. The proposed facility will

have an acceptable impact on the amenity of the area in terms of its use of materials and siting. The

1 Introduction

Mobile connectivity has grown in importance as the combination of smart phones and tablets with

increased mobile broadband speeds and capacity are changing the way we live and the availability of

these services is often taken for granted in metropolitan locations.

Telstra has a heritage of nearly 35 years in providing mobile telephony to Australians, having brought

every generation from 1G through to the 4G networks of today. Along that journey we have been

intimately involved with extending coverage through the rollout of new base stations as well as

creating new and innovative ways to stretch and improve mobile coverage into the far corners of the

nation.

Telstra has been investing in the expansion and upgrade of our wireless networks for the long term

and in the past five years alone we have invested around $5 billion in our mobile network.

The Telstra mobile network currently reaches over 99.3% of the population and is by far the largest

network in the country, covering 2.4 million square kilometres of the Australian land mass, thanks to

our long term commitment to network investment.

As the first carrier to bring 4G mobile services to regional Australia, we know how important high-

speed mobile can be to supporting local businesses, tourism and education, so we are also continuing

the expansion of our 4G and 4GX services.

4GX includes services provided over Telstra’s new 700MHz spectrum and delivers higher typical

mobile speeds on compatible devices, allowing more Australians to experience more reliable

connections and ultra-fast mobile internet.

2 Site Selection Process

2.1 Purpose and Demand

Early in 2018, VicRoads contacted Telstra and advised that their existing site on VicRoads land adjacent

to Camp Road would need to be removed due to the future subdivision and acquisition of the land by

Hume City Council. VicRoads requested that the site be removed within one year.

Telstra has been working with VicRoads to secure a new location on its land, whilst also looking for

other potential sites in the immediate area. These are examined in detail below in Section 2.3.

The existing site (which was decommissioned earlier this year 2019) services the main Broadmeadows

commercial and residential area. This includes important locations such as the Police Station, Hume

City Council Offices, and the Broadmeadows Hospital.

Telstra was not able to secure a new location in time before the existing site was to be

decommissioned. This meant that the area suddenly lost much of its Telstra 4G services. As a result,

and after several complaints from the Police Station and the Hospital, Telstra installed a temporary

facility in the rear grounds of the Police Station. This has been decommissioned in August 2019, and

an Inbuilding System has been installed within the Police Station for a short term solution.

The proposal for a new Telstra monopole at 2-8 Pearcedale Road is to maintain the existing services

in this dense urban area. The existing Telstra site within the Camp Road Reserve has been removed

and the new site is proposed approximately 20m to the west.

A pre-application meeting was held with Hume City Council officers in April 2019. At this time Council

representatives expressed concern that the proposed initial site in the road reserve was within the

boundaries of the land that Council is intending on acquiring. Upon review of the survey plan, it was

confirmed the proposed Telstra Facility is not contained within the land that Hume Council intends to

acquire from Vic Roads. Council officers also advised at this meeting that there was potential for an

access road to be installed off Johnstone Street. However, Council could not provide a preliminary

proposal of the proposed land use and proposed new access roads at this time.

Telstra decided to proceed with the application for the proposed new Telecommunications Site on

the advice and statements made by VicRoads and submitted a planning permit application to Hume

Council in July 2019 (P22358).

Council issued a Further Information Request on 2 August 2019 expressing concern (amongst other

items) that the proposed location of the facility in the Camp Road Reserve would conflict with the

Broadmeadows Structure Plan and the future planned Council Car Park adjacent. And was in a

prominent arrival route to the activity centre.

On receipt and review of this Council advice, Telstra reviewed the site location with VicRoads and has

proposed another location, well set back from Johnstone Street, in a location that will not interfere

with Council’s future developed plans for the Camp Road Reserve site.

In addition to this, the new location is within 20m of the previous existing site and this will ensure that

the new replacement site will maintain (and improve) the level of coverage in this area. The proximity

of the amended location to the previous site will also ensure that there is no significant change in the

visual aspects of the Telecommunications Facility, or any additional visual impact to the area.

It is also noted that Telstra removed its existing site upon notice from VicRoads at the impending land

purchase/transfer to Hume Council. The new amended location is on land also owned by VicRoads at

their service centre and in a position that has been reviewed and suggested by Council post the pre-

application meeting held in April 2019.

Telstra has proposed this new telecommunications facility to replace its existing facility servicing

Broadmeadows to ensure the area continues to receive reliable 3G and 4GX services and to provide

access to future network technology advances.

2.2 Site Selection

Telstra commences the site selection process with a search of potential sites that meet the network’s

technical requirements, with a view to also having the least possible impact on the surrounding area.

Telstra applies and evaluates a range of criteria as part of this site selection process.

Telstra assesses the technical viability of potential sites through the use of computer modelling tools

that produce predictions of the coverage that may be expected from these sites, as well as from the

experience and knowledge of the radio engineers. There are also a number of other important criteria

that Telstra uses to assess options and select sites that may be suitable for a proposed new facility.

These take into account factors other than the technical performance of the site, and include:

The potential to co-locate on an existing telecommunications facility.

The potential to locate on an existing building or structure.

Visual impact and the potential to obtain relevant town planning approvals.

Proximity to community sensitive locations and areas of environmental heritage.

The potential to obtain tenure at the site.

The cost of developing the site and the provision of utilities (power, access to the facility and

transmission links).

In deciding upon the location of a new facility for Broadmeadows, Telstra has carefully assessed all of

the above criteria, specifically the costs of relocating the existing site and ensuring that existing access

to reliable telecommunications are maintained at current levels as a minimum. This analysis is detailed

in the next section.

2.3.1 Co-location Opportunities

As noted above co-location on existing infrastructure and the upgrading of existing

telecommunications facilities are the first option Telstra examine when new infrastructure is required.

This focus on the utilisation of existing infrastructure is considered prudent by Telstra as it is faster to

deliver improvements, is less expensive, reduces possible impacts on the community and meets the

principles for the location of new infrastructure as set out in ‘A Code of Practice for

Telecommunications Facilities in Victoria’.

Telstra’s existing site in Broadmeadows on VicRoads land has recently been removed due to the future

acquisition of the land and at the request of VicRoads. Therefore, Telstra need to relocate the site as

close as possible to the original location and at a similar height to ensure that the current services are

maintained.

In considering candidates for a location to relocate the site to, Telstra reviewed the following sites as

summarised below and detailed in Figure 2.

Figure 2 below shows the location of the original site, temporary site, proposed site and surrounding

nearby sites;

1. This is the initial site proposed as Planning Permit Application P22358. Council advised that

the application would be unlikely to be approved.

2. Current temporary Telstra site (Cell on Wheels) installed at the Police Station at their request,

scheduled to be removed in August;

3. The original location of the Telstra site that has recently been removed due to the future

acquisition of the land from VicRoads;

4. This site is listed as an Inbuilding antenna system for VicTrack and is not a structure that could

support the Telstra site.

5. This site is an existing Optus and Vodafone rooftop site on the VicRoads building. This was

considered as a co-location option, however VicRoads advised that the future operations of

the building were uncertain and tenure at this site could not be secured for the required

length of time.

6. This site is a 9m Victrack pole. This could not be progressed as a co-location option as the

height of the pole would not meet the coverage objective for the Telstra site.

7. This site is located within 20m of the previous Telstra facility and has been proposed in

November 2019 as a result of further discussions with Hume Council in relation to their

concerns raised at site number

As described above, there are no viable co-location options in the immediate area.

Candidate A Vic Roads Building, 1100 Pascoe Vale Rd BROADMEADOWS VIC 3047

Located in a Public Use Zone (PUZ4 – Local Government), The site is a building owned by VicRoads and

hosts an existing Optus and Vodafone facility on the rooftop. This site was considered first as a

potential co-location option, however VicRoads advised that the future operations of the building

Candidate B Hume City Council building 1079 Pascoe Vale Rd Broadmeadows VIC 3047

This site was considered as a potential rooftop candidate. However, the considerable height of the

building would mean that the required antennas would need to have a significant downward tilt. This

requires a location on the building edge which could diminish the architectural values of the building.

Additionally, whilst Telstra does have several agreements with Hume Council for sites on Council land,

these typically take over 4 years to secure. As such, due to the predicted lengthy timeframes and the

visual impact on this landmark building, along with high costs associated with construction this site

was not progressed.

Candidate C, Replacement of Light Pole on VicRoads reserve

This site was considered as a potential co-location with a public utility candidate. However, Vic Roads

advised that the location of the light pole close to the road required it to be frangible, and therefore

it could not meet the structural requirements for a Telstra site.

Candidate D, New Telstra monopole on VicRoads land, adjacent to 2-8 Pearcedale Pd, (Site Rejected by

Council).

After extensive discussions with VicRoads, a location was agreed upon within the VicRoads reserve,

outside of the future Council acquisition land, and in a location that VicRoads advised was acceptable

to them now and into the future.

Council issued a Further Information Request on 2 August 2019 expressing concern (amongst other

items) that the proposed location of the facility in the Camp Road Reserve would conflict with the

Broadmeadows Structure Plan and the future planned Council Car Park adjacent. And was in a

prominent arrival route to the activity centre.

On receipt and review of this Council advice, Telstra reviewed the site location with VicRoads and has

proposed an alternative site, well set back from Johnstone Street, in a location that will not interfere

with Council’s future developed plans for the Camp Road Reserve site.

Summary

Telstra has submitted this application for a replacement telecommunications facility in

Broadmeadows in order to provide essential coverage in the area, and to improve mobile

communications performance across the region.

Telstra does not propose the installation of a new telecommunications facility without investigating

the potential for co-location on existing infrastructure. As there is no viable existing tall infrastructure

within the required search area to achieve a co-location, a new structure is required. However, as this

is a replacement facility, and it is located within 20 of the Telstra monopole that has recently been

removed, essentially there is no net increase in structures in the immediate area.

In this case, Telstra has amended its current application in consideration of Council’s concerns and

proposed a site within 20m of Telstra’s decommissioned site, on VicRoads land.

The site is accessible, technically viable and will result in an acceptable impact on the amenity of the

area, whilst also providing possible co-location opportunities for other carriers in the future.

The site selection process considered Hume Council’s comments, environmental and visual

constraints, existing and future land use characteristics, the orderly planning of the area and the

design of the facility. On balance, it is considered that the location and height of the facility ensures

and maintains an optimal service provision to the area.

3 Proposed Development

The proposed development at 2-8 Pearcedale Parade, Broadmeadows VIC 3138, comprises the

following:

The installation a 25-metre concrete monopole, with a triangular headframe attached to the

top of the pole.

The installation on the headframe of the nine (9) panel antennas, six (6) remote radio units,

and twin tower mast amplifiers strapped to antennas mounts behind the antennas.

The total height of the structure with the antennas attached to the headframe will be 26.3

metres.

The installation of an equipment shelter to house electrical equipment associated with the

facility.

Installation of ancillary equipment within the equipment shelter, a GPS antenna on the roof

of the shelter and underground power and fibre to support the facility;

The monopole and shelter will be contained by a Chainwire mesh fence, 5m by 10m.

The existing Telstra site 20m to the east, also on VicRoads land which is intended for a future

acquisition has recently been removed.

4 Subject Site and Locality

4.1 The Subject site and Locality

The subject site is located in the north east corner of the VicRoads Service Centre at 2-8 Pearcedale

Parade, Broadmeadows. The location is an area identified for future Civic activities and the area

bounded by Johnstone Street, Pearcedale Parade, Dimboola Road and Pascoe Vale Road currently

accommodates the VicRoads Service Centre, Broadmeadows Police Station, a Caltex Service Station,

a Council owned car park and the Broadmeadows Law Courts. VicRoads currently owns the southern

half of this block and previously requested that Telstra relocate its existing facility to allow for the

acquisition of the south eastern section (Camp Road Reserve) Hume City Council.

The proposed site will be located on a flat grassed area with the compound straddling the boundary

fence line to the north and east. To the north is the rear of the Broadmeadows Police Station car park

area. To the east is road reserve which currently supports the circular off on ramp from Pascoe Vale

Road to Camp Road. To the south is a grassy flat area at the rear of the VicRoads Service Centre Car

Park. Further south is Johnstone Street, a large 4 lane road with a traffic island and a residential area

with predominantly single storey dwellings. The closest dwellings are approximately 130m south of

the site. Views from these dwellings to the site are predominantly screened by the elevation of the

Camp Road overpass on both sides of the road. The dwellings facing Johnstone St to the west of Brook

Street will have the most exposed views to the site, but these view sheds will be within the context of

several light poles, power poles, and trees. Additionally, as this is a replacement facility, and it is

located within 20m of the Telstra monopole that has recently been removed, essentially there is no

net increase in structures in the immediate area.

There are a number of tall light poles and power poles throughout the grounds within the adjoining

car park and also in the road reserves. Telstra’s proposal to relocate its facility 20m west of the existing

site ensures that there is no proliferation of additional locations with tall structures in the area.

The site is contained on Lot 1 TP920658, Certificate of Title VOLUME 09129 FOLIO 528. The 10m by

5m compound area is located on the title boundary to ensure no impact to the BBQ and seating area

to the west. The location was identified by VicRoads as one that would not impede the operation of

the VicRoads Service centre and car park and is a location that will not by subject to change in the

medium term future.

5 Regulatory Framework &

Assessment

5.1 Federal Legislation

5.1.1 Telecommunications Act 1997

The Telecommunications Act 1997 (the Act) came into operation on 1st July 1997. The Act provides a

system for regulating telecommunications and the activities of carriers and service providers.

Under the Act, telecommunications carriers are no longer exempt from State and Territory planning

laws except in three limited instances:

There are exemptions for inspection of land, maintenance of facilities, installation of “low

impact facilities”, subscriber connections and temporary defence facilities. These exemptions

are detailed in the Telecommunications (Low-impact Facilities) Determination 2018 and these

exceptions are subject to the Telecommunications Code of Practice 2018;

A limited case-by-case appeals process exists to cover installation of facilities in situations of

national significance; and

There are some specific powers and immunities from the previous Telecommunications Act

1991.

5.1.2 Telecommunications (Low Impact Facilities Determination 2018

The Telecommunications (Low-impact Facilities) Determination came into effect on 1st July 1997 and

has recently been superseded by The Telecommunications (Low-impact Facilities) Determination 2018

The Determination contains a list of Telecommunications Facilities that the Commonwealth will

continue to regulate. These are facilities that are essential to maintaining telecommunications

networks and are unlikely to cause significant community disruption during their installation or

operation. These facilities are therefore considered to be ‘Low-impact’ and do not require planning

approval under State or territory laws.

5.1.3 Commonwealth Environment Protection and Biodiversity Conservation Act 1999

The Environment Protection and Biodiversity Conservation Act commenced on 16th July 2000. It

introduces a new role for the Commonwealth Government in the assessment and approval of

development proposals where those proposals involve actions that have a significant impact on

matters of National Environmental Significance, the environment of Commonwealth owned land and

actions carried out by the Commonwealth Government.

This proposal is not of National Environmental Significance, as it will not impact on:

World Heritage Areas;

Wetlands protected by International Treaty (The RAMSAR Convention);

Nationally listed threatened species and communities;

Nationally listed migratory species;

All nuclear actions; or

The environment of Commonwealth Marine area.

5.1.4 Mobile Base Station Deployment Industry Code

The Communications Alliance Ltd. C564:2018 Industry Code – Mobile Phone Base Station Deployment

(referred to as the Deployment Code) replaced previous versions in 2018. The purpose of the revisions

incorporated in the new Deployment Code are to provide certainty and clarity for all parties in the

implementation of the Code, for example, with regard to the consultation process with Council’s and

communities and with regard to providing and updating RF EMR Health and Safety information,

reports and signage in keeping with relevant standards.

The new Deployment Code cannot change the existing regulatory regime for telecommunications at

local, State or Federal level. However, it supplements the existing obligations on carriers, particularly

in relation to community consultation and the consideration of exposure to radio signals, sometimes

known as electromagnetic energy (EME or EMR).

The Code imposes mandatory levels of notification and community consultation for sites complying

with the Telecommunications (Low-impact Facilities) Determination 1997. It identifies varying levels

of notification and/or consultation depending on the type and location of the infrastructure proposed.

The subject proposal, not being designated a ‘Low-impact’ facility, is not subject to the notification or

consultation requirements associated with the Deployment Code. These processes are handled within

the relevant State and Local consent procedures.

Nevertheless, the intent of the Code, to ensure Carriers follow a ‘precautionary approach’ to the siting

of infrastructure away from sensitive land uses, has been followed in the selection of this site as This copied document is made available for the sole purpose

demonstrated in the Deployment Code section 4.1 Precautionary Approach Checklist which is

attached at Appendix D.

Included in the section 4.1 Checklist is a statement of how the public’s exposure to EME from the site

has been minimised. All emissions from the site will be well within the requirements of the relevant

Australian Standard. Details of this standard are contained in the following section.

Also attached at Appendix D is the Deployment Code section 4.2 Precautionary Approach Checklist

which demonstrates how the proposal has been designed in accordance with the Code’s

‘precautionary approach’.

This site has been selected and designed to comply with the requirements of the Deployment Code in

so much as the precautionary approach has been adhered to and, as a result the best design solution

has been achieved.

5.1.5 Electromagnetic Energy and Health

Telstra understands that some people have genuine concerns about the levels of Electromagnetic

Fields (EMF) that the Proposed Facility will emit and is committed to addressing those concerns

responsibly. EMF is sometimes known as electromagnetic radiation (EMR) or electromagnetic energy

(EME). Electromagnetic fields are present everywhere in our environment – the earth, sun and

ionosphere are all natural sources of EMF.

Telstra rely on the expert advice of international and national health authorities including the World

Health Organization (WHO) and the Australian Radiation Protection and Nuclear Safety Agency

(ARPANSA) for overall assessments of health and safety impacts.

The International Commission on Non-Ionizing Radiation Protection (ICNIRP) has issued guidelines on

levels of allowable public exposure to Radio Frequency (RF) fields, including guidelines on RF from

mobile phones and base stations that Telstra adheres to. These guidelines have a large safety margin

built into them.

It is Telstra’s responsibility to comply with the mandated standard (RPS3) for EMF set by ARPANSA,

which is based on the safety guidelines recommended by the WHO. The safety standard works by

limiting the network signal to a level low enough to protect all people, in all environments, 24 hours

a day. The safety limit itself has a significant safety margin built into it.

To demonstrate compliance with the safety standard, an Environmental EME Report is available via

the RFNSA website: www.rfnsa.com.au/3049004 and is also attached at Appendix C.

This report predicts that the maximum signal strength from the Proposed Facility at 1.5m above

ground level, is well within the allowable limit that it is permitted to transmit over a 24-hour period.

This is typical of Telstra’s responsible approach to network performance and environmental

compliance.

examined the scientific evidence regarding possible health effects from base

stations. Current research indicates that there are no established health effects

from the low exposure to the RF EME exposure from mobile phone base station

antennas.”

At all times in the design and operation of their facilities, Telstra complies with Commonwealth

regulations and standards and leads the telecommunications industry in terms of using the latest

available technology specifications in order to provide the best possible customer service and to

minimise environmental and community impacts.

5.2 Requirement for a Planning Permit

Permit Trigger

Clause 52.19 -2 of the Hume Planning Scheme is the permit trigger for this application. It states:

“A permit is required to construct a building or construct or carry out works for a Telecommunications

Facility”

Clause 62.01 provides that a requirement for Use is exempt for a Telecommunications Facility if the

associated buildings and works meet the requirements of Clause 52.19.

Clause 52.19-2 requires a planning permit to construct a building or to construct or carry out works

for a telecommunications facility and the decision guidelines at Clause 52.19-6 require consideration

of the principles in Section 4 of A Code of Practice for Telecommunications Facilities in Victoria, the

effect on adjacent land, and where applicable, consideration against the decision guidelines of certain

overlays and their schedules.

Therefore, there is no permit trigger under the zone or overlays that cover the site with respect to

either use of the land or buildings and works for a telecommunications facility.

Council has expressed further clarification on this assessment in their further information letter (2

August 2019). Please refer to Appendix H for a more detailed review of this assessment.

5.3 State Legislation

5.2.1 Victorian Aboriginal Heritage Act 2006

The Aboriginal Heritage Act 2006 and Aboriginal Heritage Regulations 2007 (Vic) provide for the

protection of Aboriginal cultural heritage in Victoria. Aboriginal heritage is defined in the Act as

“Aboriginal places, Aboriginal objects and Aboriginal human remains”.

The regulations are intended to provide for the effective protection and management of Aboriginal

Cultural Heritage in Victoria by, amongst other things, specifying the circumstances in which a cultural

heritage management plan (CHMP) is required and prescribing standards for the preparation of

CHMPs.

Under the regulations, Telecommunications Facilities are not considered “High Impact” activities

(Division 5, regulation 43) and therefore are exempt from the requirement to undertake a mandatory

CHMP. In certain situations, the underground power and fibre line associated with the facility may not

be exempt from the requirement to undertake a CHMP. The Act requires that underground lines

located within an area of cultural sensitivity not subject to significant ground disturbance require a

CHMP for a power line over 100m in length or a fibre line over 500m in length.

As part of the site acquisition process, Telstra assesses each site against the Cultural Heritage

Sensitivity Maps provided by the Department of State Development, Business and Innovation; Geovic.

This website provides indicative information about the location and extent of areas of Aboriginal

cultural heritage sensitivity. Areas of cultural heritage sensitivity shown on this mapping are based on

the provisions in Part 2, Division 3 of the Regulations and for the most part indicate locations where

Aboriginal activity may have occurred in the past; e.g. within 200m of a waterway, and in some cases

registered Aboriginal heritage places; e.g. within 50m of scarred trees or within 50m of where stone

artefacts have actually been found. However, it should be noted that the Regulations state that where

any such land has been subject to ‘significant ground disturbance’ then it is not an area of cultural

heritage sensitivity.

If a site is in an area of aboriginal cultural sensitivity then Telstra will undertake a register check with

AAV and consider further investigations to limit any impacts on any known or unknown heritage.

As shown in the Cultural Heritage Sensitivity Maps the facility is not within an Area of Cultural

Sensitivity, as defined by the Act.

Notwithstanding the above, the construction contractors will be notified of their obligations under

the Act should any aboriginal heritage be discovered.

5.2.2 State Planning Policy Framework

Victorian Planning Provisions (VPP) sets out the specific policies relating the environmental, social and

economic factors. The section of the VPP most relevant to this proposal is Clause 19.03-5S -

Telecommunications. The objective of this is:

“To facilitate the orderly development, extension and maintenance of telecommunications

infrastructure.”

Planning decisions should recognise that telecommunications are an essential utility service and

should:

Facilitate the upgrading and maintenance of telecommunication facilities.

Ensure that modern telecommunications facilities are widely accessible to business, industry

and the community.

Ensure the communications technology needs of business, domestic, entertainment and

community services are met.

Do not prohibit the use of land for a telecommunications facility in any zone.

Encourage the continued deployment of broadband telecommunications services that are

easily accessible by:

Increasing and improving access for all sectors of the community to the broadband

telecommunications trunk network.

Supporting access to transport and other public corridors for the deployment of broadband

networks in order to encourage infrastructure investment and reduce investor risk.

Apart from Clause 19.03-5S, there is little specific reference to telecommunications infrastructure

provision throughout the SPPF, however, it is clear through Clauses 12, 13, 15 and 17 in particular that

the emphasis is placed on the balance between providing modern infrastructure to foster community

connectivity, the efficient operation of existing business and attraction of new business, for example,

against minimising any environmental impacts on such things as the landscape, water resources and

cultural and built heritage.

In general, when considering proposals for telecommunications facilities against the VPP, the

responsible authority must seek a balance between the provision of important telecommunications

services and the need to protect the environment from possible adverse impacts (e.g. visual intrusion)

arising from telecommunications infrastructure. There is strong State policy support for improved

telecommunications facilities if, when balancing improved telecommunications services with

environmental impacts; including for example, visual impact and flood or fire hazard, a particular

proposal provides a net community benefit.

5.3 Hume City Council Planning Scheme

5.3.1 Municipal Strategic Statement

Whilst the Hume MSS and Local Policies are largely silent on telecommunications facilities there are a

number of provisions that apply to the Broadmeadows environs to be considered.

The MSS states Hume City Council is designated as one of the five growth areas in metropolitan

Melbourne and also one of Melbourne’s key gateways. It identifies that one of the implications of

rapid development in the region is strong demand for State and Federal funding toward major

infrastructure. The relevant key issues and visions in the MSS are identified as:

Broadmeadows is identified as a Metropolitan Activity Centre;

Ensuring infrastructure meets the needs of the community.

The provision of an adequate level of physical and social infrastructure is one of the major

issues facing the Hume City Council over the coming decades.

The timely provision of infrastructure is necessary to foster economic development, ensure

wellbeing of the community and protect the environment.

The relocated telecommunications facility supports the objectives of the MSS in that it responds to

the communities needs to maintain and improve infrastructure relating to reliable mobile

telecommunications.

The proposed facility will ensure reliable telecommunications are maintained to these dense civic and

community areas. It will ensure that services are not eroded from existing conditions and it will cater

for the capacity demands in the region.

Mobile communications are increasingly being seen as an essential service, and the provision and

maintenance of reliable mobile telecommunications to the Broadmeadows area supports the Councils

strategic statements in relation to growth, economic development, community benefit, industry and

the protection of the environment.

5.3.2 Local Planning Policy – 22.05 BROADMEADOWS TRANSIT CITY LOCAL POLICY and The

Broadmeadows Structure Plan 2012 (Town Centre Precinct 1).

This policy applies to land included within the Commercial 1 Zone and generally bounded by Sorrento

Street, Johnstone Street, the North-Eastern Railway Line, Riggall Street, Talgarno Street, Cavendish

Street and Dimboola Crescent, Broadmeadows.

The policy basis states that:

The Broadmeadows Transit City contains a wide range of commercial, professional, cultural,

entertainment and community services and facilities. In past metropolitan planning policy, it was

designated as a priority activity centre in which higher rates of retail activity were encouraged.

Growth as a Transit City and a principal activity centre. It is the only Transit City and principal activity

centre within the City’s activity centre hierarchy

Objective

To establish a compact, safe, viable and vibrant principal activity centre in Broadmeadows

that:

o provides a wide mix of commercial, professional, cultural, entertainment, and

community uses and facilities;

o encourages safe and convenient pedestrian and cyclist movement; and

o develops in accordance with a consistent and attractive urban design framework.

Policy

Specific to the proposal It is policy that:

New development in the Broadmeadows Transit City is designed and sited to respect the scale,

height, appearance and amenity of adjoining residential areas;

Land adjacent to roads and pedestrian paths is developed to respect function, scale, amenity

and appearance.

An attractive and cohesive landscape and urban design framework is established in the

Broadmeadows Transit City.

New uses and development are generally in accordance with the key development initiatives

outlined in the Broadmeadows Transit City Masterplan.

The proposal is located on land intended for Commercial Mixed Use and generally accords with the

objectives and policies in that:

The proposed relocation of the Telstra Telecommunications Facility will allow for the future

development of VicRoads land which is intended to be acquired by Hume City Council;

The proposal will ensure current Telstra mobile phone coverage is maintained in this central

location;

The proposal will be of a similar height and appearance to the existing site and will respect

function, scale and amenity of its surrounds;

The proposal will be located on land managed by VicRoads and will not impact on the

surrounding future development areas as identified in the Broadmeadows Transit City Local

Policy.

Council has also requested an assessment against the objectives of the Broadmeadows Structure Plan

2012 (Town Centre Precinct 1).

Precinct 1 is identified as the Town centre – the civic, commercial and retail core of Broadmeadows.

Specific to the location of the proposal, the objectives of the Plan states:

To promote infill development on government-owned land around VicRoads, the

police station, Centrelink and the Magistrates Court with vertically integrated,

mixed use activity, reducing the space between existing buildings and providing a

It is noted that Council are currently in the process of acquiring adjoining land from VicRoads known

as the Camp Road Reserve. Council have advised that this will be developed for a multi storey car park.

The proposed amended facility location is on the north east boundary of 2-8 Pearcedale Parade. This

is well set back from Gateway entry points and will not interfere with the adjoining development or

the current use of the site as a VicRoads Service Centre.

In this regard, the new amended location is consistent with the objectives of the the Broadmeadows

Structure Plan 2012 (Town Centre Precinct 1).

5.3.3 Zoning

The subject site is within a Commercial 1, pursuant to Clause 34.04-1 of the Hume Planning Scheme.

Under Clause’s 62.01-1 and 62.02-1 any requirement in the Planning Scheme relating to the use of

land or buildings and works does not apply to a telecommunications facility on the condition that the

associated buildings and works meet the requirements of Clause 52.19.

Clause 52.19-2 of the Planning Scheme requires a permit to construct a building or construct or carry

out works for a telecommunications facility. There is no permit trigger for either use or buildings and

works for a telecommunications facility under the zone.

5.3.4 Overlays

Under Clause’s 62.01-1 and 62.02-1 any requirement in the Planning Scheme relating to the use of

land or buildings and works does not apply to a telecommunications facility on the condition that the

associated buildings and works meet the requirements of Clause 52.19. Therefore, there is no permit

trigger as a result of any overlay, nor is the site contained in an overlay.

5.3.5 Particular Provisions; Clause 52.19 Telecommunications Facilities

Clause 52.19 of the Hume Planning Scheme sets out the requirements which apply to a

telecommunications facility.

The purpose of Clause 52.19 is:

To ensure that telecommunications infrastructure and services are provided in an efficient

and cost effective manner to meet community needs.

To ensure the application of consistent provisions for telecommunications facilities.

To encourage an effective statewide telecommunications network in a manner consistent

with the economic, environmental and social objectives of planning in Victoria as set out in

Section 4 of the Planning and Environment Act 1987.

To encourage the provision of telecommunications facilities with minimal impact in the

amenity of the area.

This provision applies to the construction or carrying out of works associated with the use of the land

for a Telecommunications facility. They apply to the extent permitted under the Telecommunications

Act 1997 and determinations made under that Act.

The proposed telecommunications facility will meet the purpose of Clause 52.19 in that:

It will replace the existing Telstra facility serving Broadmeadows which has been

decommissioned as a result of a proposed land acquisition of the VicRoads land by Hume City

Council.

The replacement facility will ensure that the area continues to receive reliable 3G and 4G

services and will now also have access to Telstra’s new 4GX technology and other future

network advances such as 5G.

It meets the design and siting requirements as specified in the Victorian Code of Practice,

ensuring that there is a consistent approach to the development of telecommunications

facilities within the region.

The location offers acceptable visual mitigation in that it is well set back from Gateway

locations and Pearcedale Parade, at the rear of a car park, adjoining the Broadmeadows Police

Station. The location will provide a visual buffer to residential areas to the south. It is located

in an area characterised by vertical infrastructure elements and will fit well into this

environment.

This candidate is considered the most appropriate as tenure is secured, it can be built

immediately and efficiently to ensure Telstra services are not lost in this dense community

hub and and visual impact mitigated by its siting.

Additionally, Clause 52.19-3, Land in public ownership, requires that an application for a permit on

land in a public land zone by a person other than the relevant public land manager, must be

accompanied by the written consent of the public land manager.

Before deciding on an application for the development of a Telecommunications Facility, in addition

to the guidelines of Clause 65, Council must consider as appropriate the decision guidelines contained

in Clause 52.19-6, these are as follows:

The principles for the design siting, construction and operation of a telecommunications facility as set

out in A Code of Practice for Telecommunications Facilities in Victoria

It is submitted that the proposed telecommunications tower at the application site is consistent with

the principles set out in Section 4 of A Code of Practice for Telecommunications Facilities in Victoria.

These principles have been individually addressed in Section 5.3.6 below.

The effect of the proposal on the adjacent land

As part of the assessment against the principles set out in Section 4 of ‘A Code of Practice for

Telecommunications Facilities in Victoria’ (see 5.3.6 below) and the decision guidelines of Clause 65

of the Scheme, the effect of the proposal on adjacent land is examined in detail.

It is submitted that the proposal will not unreasonably affect the development of the land directly

adjacent nor interfere with the peaceful enjoyment of the existing nearby uses. The location was

identified by VicRoads as one that would not impede development of the adjoining land and is a

location that will not by subject to change in the medium term future.

If the Telecommunications facility is located in an Environmental Significance Overlay, a Vegetation

Protection Overlay, a Significant Landscape Overlay, a Heritage Overlay, a Design and Development

Overlay or an Erosion Management Overlay, the decision guidelines in those overlays and the schedules

to those overlays.

The site of the proposed telecommunications facility is not located in any of the overlays listed above.

5.3.6 A Code of Practice for Telecommunications Facilities in Victoria

The Code is an incorporated document in all planning schemes in Victoria and the purpose of the Code

is to:

Ensure that telecommunications infrastructure and services are provided in an efficient and

cost effective manner to meet community needs.

Ensure the application of consistent provisions for telecommunications facilities.

Encourage an effective state wide telecommunications network in a manner consistent with

the economic, environmental and social objectives of planning in Victoria as set out in section

4 of the Planning and Environment Act 1987.

Encourage the provision of telecommunications facilities with minimal impact on the amenity

of the area.

Section 4 of the Code sets out principles for the design, siting, construction and operation of

telecommunications facilities. The following four principles must be applied where relevant to the

design, siting, construction and operation of any telecommunications facility that is not exempt under

Commonwealth legislation.

A telecommunications facility should be sited to minimise visual impact.

Telecommunications facilities should be co-located wherever practical.

Health standards for exposure to radio emissions will be met.

Disturbance and risk relating to siting and construction be minimised.

The following addresses how the proposed telecommunication facility will meet the four principles

identified in the Code.

PRINCIPLE 1 A telecommunications facility should be sited to minimise visual impact.

The application of this principle requires consideration of five specific items;

1. On, or in the vicinity of a heritage place, a telecommunications facility should be sited and

designed with external colours, finishes and scale sympathetic to those of the heritage place.

A heritage place is a heritage place listed in the schedule to the Heritage Overlay in the

planning scheme.

2. A telecommunications facility mounted on a building should be integrated with the design

and appearance of the building.

3. Equipment associated with the telecommunications facility should be screened or housed

to reduce its visibility.

4. The relevant officer of the responsible authority should be consulted before any street tree

is pruned, lopped, destroyed or removed.

5. A telecommunications facility should be located so as to minimise any interruption to a

significant view of a heritage place, a landmark, a streetscape, vista or a panorama, whether

viewed from public or private land.

Specific to this application are dot points 3 and 5. These items both relate to the principle of

minimising visual impact. It is important to note that the principle does not require that a facility be

completely screened from view from adjoining properties and this position has been reiterated in a

number of VCAT cases. Telecommunications Facilities by cannot be invisible in order to carry out their

purpose and function. They rely on line of sight radio transmission to achieve their coverage

objectives.

A range of factors are considered in relation to visual impact when siting a facility. This includes factors

such as the height and design of the structure, the zoning and use of the land, the distance to nearby

dwellings and surrounding land uses and the impact of the facility on the broader landscape. Any

assessed visual impact must be balanced against the general policy support within the Planning

Scheme for the widespread provision of quality, modern telecommunications infrastructure and the

wider community benefit from the development of a comprehensive telecommunications network.

Our assessment of the proposal against the relevant items of this principle is as follows:

The ground level equipment will be housed in a Colourbond Pale Eucalypt equipment shelter,

located on a cleared area neatly sited on the north east boundary of the site.

The feeder cabling required to run the proposed facility will be accommodated internally within

the new monopole, making a neat structure.

The removal of Telstra’s existing monopole structure 20m to the east of the proposed facility will

ensure there is no net increase of tall structures in the area, and that there is no significant change

from existing conditions.

In terms of clear, unimpeded near field views of the proposed facility, these will be limited to

views from within the VicRoads lands, in particular in the car park itself and from Johnstone Road

and its road reserves. These views will be within the context of numerous vertical infrastructure

elements in the immediate area from streetlight poles and power poles. Additionally, viewsheds

will also be mitigated by the background trees and elevated road embankments which will break

up views of the lower part of the tower.

The location offers acceptable visual mitigation in that it is well set back from Gateway locations

and Pearcedale Parade, at the rear of a car park, adjoining the Broadmeadows Police Station. The

location will provide a visual buffer to residential areas to the south. It is located in an area

characterised by vertical infrastructure elements and will fit well into this environment.

This candidate is considered the most appropriate as tenure is secured, it can be built

immediately and efficiently to ensure Telstra services are not lost in this dense community hub

and visual impact mitigated by its siting.

The structure will not be a dominant landscape feature when viewed from the public roads and

the major intersection at Pearcedale Parade and Johnstone Road and the entrance to

Broadmeadows Hospital. There is already significant visual clutter from the infrastructure

elements at this intersection. Due to a range of intervening structures and/ or vegetation from

most viewpoints towards the proposed facility from these roads visual impact will be further

mitigated.

The proposed facility will not result in the removal of any vegetation nor will it impede or impact

On the basis of the above, it is submitted that the visual impact on this particular area is considered

acceptable and strikes a reasonable balance between the provision and maintenance of essential,

dedicated and reliable mobile voice communication and high speed wireless broadband to

Broadmeadows and the need to minimise visual and other environmental impacts.

PRINCIPLE 2 Telecommunications facilities should be co-located wherever practical.

Telstra does not propose the installation of a new telecommunications facility without investigating

the potential for co-location on existing infrastructure. As described in Section 2.3 of this report, as

there is no viable existing tall infrastructure within the required search area to achieve a co-location,

a new structure is required. However, as this is a replacement facility, and it is located within 20m of

the Telstra monopole that has recently been removed, essentially there is no net increase in structures

in the immediate area. This ensures there is no proliferation of tall pieces of infrastructure added to

the area.

See Section 2.3 above for further detail on site selection criteria, including consideration of co-location

opportunities.

PRINCIPLE 3 Health standards for exposure to radio emissions will be met

The proposed telecommunications facility has been designed and will be installed to ensure that the

maximum human exposure levels to radio frequency emissions comply with Radiation Protection

Standard- Maximum Exposure Levels to Radiofrequency Fields- 3kHz to 300GHz, Arpansa, May 2002. This copied document is made available for the sole purpose

The proposed facility overwhelming meets the standard with a maximum level calculated at 1.5m

above ground height being 0.93% of the standard (where 100% is considered safe).

Public health concerns about electromagnetic radiation are often raised in planning cases about a

telecommunications facility. However, it is important to note that VCAT has stated in Mason v Greater

Geelong CC (Includes Summary) (Red Dot) [2013] VCAT 2057 (16 December 2013) that is bound to

apply the ARPANSA standards and is unable to consider emissions of electromagnetic radiation as a

relevant or determinative issue where the relevant Commonwealth ARPANSA standard will be met.

PRINCIPLE 4 Disturbance and risk relating to siting and construction be minimised.

The construction activity and site location will comply with state environmental protection policies

and best practice environmental management guidelines at the construction stage.

Construction activities on site will be limited to installation and intermittent maintenance. There will

be limited excavation and formwork required to install the tower. Once the facility is operational and

integrated with the Telstra network, the facility requires minimal maintenance, with maintenance

inspections typically carried out every six months.

5.3.7 General Provisions; Clause 65 Decision Guidelines

It is submitted that the proposed telecommunications facility will produce acceptable planning

outcomes in terms of the decision guidelines of this clause. An assessment against the decision

guidelines of Clause 65.01 is provided below and must be considered, as appropriate, by the

responsible authority.

The matters set out in Section 60 of the Act.

The current proposal accords with the Hume Planning Scheme and any relevant codes, policy

documents and guidelines and will have a positive public safety, social and economic effect on the

area and therefore, accords with Section 60 of the Act.

The State Planning Policy Framework and the Local Planning Policy Framework, including the Municipal

Strategic Statement and local planning policies.

The current proposal is consistent with the SPPF and LPPF as detailed in Section 5 above.

It is considered that there is strong State and local policy support for improved telecommunications

facilities if, when balancing improved telecommunications services with environmental, including

visual, impact, a particular proposal provides a net community benefit.

The purpose of the zone, overlay or other provision.

The proposal is consistent with the purposes of the zone, overlays and Clause 52.19:

Telecommunications Facilities, contained within the Particular Provisions of the Planning Scheme.

The orderly planning of the area.

The proposed facility is located and designed to ensure off-site impacts are minimised and will not

negatively affect the orderly planning of the area for other land uses. After extensive discussions with

amended to VicRoads land at 2-8 Pearcedale Parade, outside of the future Council acquisition land,

and in a location that VicRoads advised was acceptable to them now and into the future.

Furthermore, the current proposal will facilitate the orderly development, extension and maintenance

of telecommunications service provision for the area.

The effect on the amenity of the area.

The effect on the amenity of the area has been assessed against the principles in Section 4 of the VIC

Code (see Section 5.4.6).

The proposals overall effect on the amenity of the area is well mitigated by the siting and design of

the facility on a part of the lands well screened from surrounding lands by mature trees. Additionally,

as this is a replacement facility, and it is located within 20m of the Telstra monopole that has recently

been removed, essentially there is no net increase in structures in the immediate area.

The proximity of the land to any public land.

The land on which the proposed facility is sited is public land owned by VicRoads. The proposal will

not impact on the operations of the land.

Factors likely to cause or contribute to land degradation, salinity or reduce water quality.

There are no factors relating to the current application which will cause or contribute to land

degradation, salinity or reduce water quality.

Whether the proposed development is designed to maintain or improve the quality of stormwater

within and exiting the site.

The proposed development will maintain the quality of stormwater within and exiting the site.

The extent of character of native vegetation and the likelihood of its destruction.

There will be no disturbance of native vegetation as part of the proposed development. The proposal

utilises existing access from the VicRoads carpark and no native vegetation will be removed.

Whether native vegetation is to be or can be protected, planted or allowed to regenerate.

The location of the current proposal will not impact on any native vegetation.

The degree of flood, erosion or fire hazard associated with the location of the land and the use,

development or management of the land so as to minimise any such hazard.

The proposal will not contribute to any hazards such as flood, erosion or fire.

7 Conclusion

There is strong State policy support for telecommunications facilities if, when balancing improved

telecommunications services with environmental impacts including visual impact, a particular

proposal provides a net community benefit.

The site has a number of characteristics that make it suitable for the construction of a new

telecommunications facility in the manner proposed. The design responds to the principles of design,

siting, construction and operation of telecommunications facilities as specified in the Code of Practice

whilst meeting state and local planning policy objectives.

The existing site (which was decommissioned earlier this year 2019) services the main Broadmeadows

commercial and residential area. This includes important locations such as the Police Station, Hume

City Council Offices, and the Broadmeadows Hospital. As Telstra was not able to secure a new location

in time before the existing site was to be decommissioned, there is currently no permanent Telstra

coverage in the area. Due to concerns expressed by the Broadmeadows Police Station and the

Hospital, Telstra installed a temporary facility in the rear grounds of the Police Station. This has

recently been removed.

There is an immediate need for a replacement site. The proposal for a new Telstra monopole at to 2-

8 Pearcedale Road is to maintain the existing services in this dense urban area. The existing Telstra

site within the Camp Road Reserve has been removed and the new site is proposed approximately

20m to the west.

The proposal will ensure that customers in Broadmeadows and its surrounds will continue to have

access to the best possible mobile phone and mobile broadband service after the temporary site is

removed.

Telstra, together with Acquirecomm have undertaken an assessment of the relevant matters as

required by the Telecommunications Act 1997, the Aboriginal Cultural Heritage Act 2006 and the

Hume Planning Scheme. The proposal is considered appropriate in light of the relevant legislative,

environmental, technical, radio coverage and public safety requirements.

This assessment of the proposed development for a telecommunications facility indicates that the

proposal is a suitable form of development on the site. The proposed facility is considered suitable in

this location for the following reasons:

The proposed relocation of the Telstra Telecommunications Facility will allow for the future

development of VicRoads land which is intended to be acquired by Hume City Council;

The proposal will ensure current Telstra mobile phone coverage is maintained in this central

location;

The proposal will be of a similar height and appearance to the existing site and will respect

The proposal will be located on Commercial Zone 1 land managed by VicRoads and will not

impact on the surrounding future development areas as identified in the Broadmeadows

Transit City Local Policy.

Mobile communications are increasingly being seen as an essential service, and the provision

and maintenance of reliable mobile telecommunications to the Broadmeadows area supports

the Councils strategic statements in relation to infrastructure, economic development,

community benefit and the protection of the environment.

The proposal is consistent with the relevant provisions of the Hume Planning Scheme.

Emissions from the proposed facility will be significantly below the Australian

Communications and Media Authority standard.

This assessment demonstrates that the proposal achieves a reasonable balance between the provision

of essential telecommunication services and the need to protect the environment from adverse

impacts from such development. It is respectively requested that permission is granted for this permit

application.

4.1.5 (b) Minimisation of EMR exposure to public

This facility is designed and will be installed in accordance with relevant regulations relating to exposure to EME. The environmental EME level is minimised through radio network design. Adaptive power control is the network feature that automatically adjusts the power and hence minimises EME from both the base station and the handset. Another feature, called discontinuous transmission, reduces EME emissions by automatically switching the transmitter off when no speech or data is sent. The site has been designed to restrict public access to any areas that exceed the general public exposure limits.

4.1.5 (c) The likelihood of an area being a community sensitive location.

A review of community sensitive locations both at and surrounding the site has been undertaken as part of the site selection process. This assessment takes into account the environmental and community issues that have been identified.

The likelihood of the area being a community sensitive location is considered medium due to its lcoation in proximity to residences. The relocated site however, will not have an additional impact in the broader area as there will be no net increase in structures.

4.1.5 (d) The objective of avoiding community sensitive locations

Telstra seeks to avoid community sensitive locations when siting new telecommunications facilities. Telstra has selected a site that is located on VicRoads land as close as possible to the existing site that has recently been decommissioned. The proposal is necessary to meet the coverage objectives for the site, and maintain reliable services in this area.

4.1.5 (e) Relevant state and local government telecommunications planning policies

The proposed facility requires a planning permit pursuant to the Hume City Planning Scheme. All relevant state and local planning policies have been considered and addressed as part of the permit submission to Council.

4.1.5 (f) The outcomes of consultation processes with Councils and Interested and Affected parties as set out in Section 6.7

Consultation will be conducted by Hume Council in accordance with the Planning and Environment Act 1987. Telstra will also give full consideration to any comments received during Council’s consultation process.

4.1.5 (g) The heritage significance (built, cultural and natural)

A review of the heritage significance both at and around the site has been undertaken as part of the site assessment process. This assessment has taken in to account any built, cultural and natural factors that have been identified. The proposed site is not located in a heritage precinct and is not heritage listed.

4.1.5 (h) The physical characteristics of the locality including elevation and terrain

The physical characteristics of the proposed site have been considered including the elevation and terrain. The terrain is predominantly flat with a number of road infrastructure

in the immediate area including elevated embankments, light poles and power poles.

The proposed site is located within an area designated for civic uses and currently accommodates a police station, Vic Roads Service Centre and Council Car park.

This site maximises the RF performance by utilising a 25m monopole.

4.1.5 (i) The availability of land and public utilities The proposal is located on public land in a road reserve.

Radio propagation analysis has been used to select appropriate antenna tilts to meet the requirements for coverage from the facility, while minimising interference to the existing network. Due consideration has been given to control interference to other services, for example: - Transmitters are designed to comply with ACMA regulations which

minimise spurious interference to other services. - Sufficient antenna separation is maintained at co-located sites. - Detailed RF modelling has been performed to ensure that

interference into other services (such as domestic electrical equipment, medical equipment and fuel/explosive stores etc) is within acceptable limits.

4.1.5 (l) The radiofrequency interference the planned service could experience at that location from other services or sources of radio emissions

Not all species listed under the EPBC Act have been mapped (see below) and therefore a report is a general guide only. Where available datasupports mapping, the type of presence that can be determined from the data is indicated in general terms. People using this information in makinga referral may need to consider the qualifications below and may need to seek and consider other information sources.

For threatened ecological communities where the distribution is well known, maps are derived from recovery plans, State vegetation maps, remotesensing imagery and other sources. Where threatened ecological community distributions are less well known, existing vegetation maps and pointlocation data are used to produce indicative distribution maps.

Such breeding sites may be important for the protection of the Commonwealth Marine environment.

Threatened, migratory and marine species distributions have been derived through a variety of methods. Where distributions are well known and iftime permits, maps are derived using either thematic spatial data (i.e. vegetation, soils, geology, elevation, aspect, terrain, etc) together with pointlocations and described habitat; or environmental modelling (MAXENT or BIOCLIM habitat modelling) using point locations and environmental datalayers.

This report is designed to assist in identifying the locations of places which may be relevant in determining obligations under the EnvironmentProtection and Biodiversity Conservation Act 1999. It holds mapped locations of World and National Heritage properties, Wetlands of Internationaland National Importance, Commonwealth and State/Territory reserves, listed threatened, migratory and marine species and listed threatenedecological communities. Mapping of Commonwealth land is not complete at this stage. Maps have been collated from a range of sources at variousresolutions.

Where very little information is available for species or large number of maps are required in a short time-frame, maps are derived either from 0.04or 0.02 decimal degree cells; by an automated process using polygon capture techniques (static two kilometre grid cells, alpha-hull and convex hull);or captured manually or by using topographic features (national park boundaries, islands, etc). In the early stages of the distribution mappingprocess (1999-early 2000s) distributions were defined by degree blocks, 100K or 250K map sheets to rapidly create distribution maps. More reliabledistribution mapping methods are used to update these distributions as time permits.
