    Instructions for Filing as a Political Body Candidate

    COMMONWEALTH OF PENNSYLVANIADEPARTMENT OF STATE

    INSTRUCTIONS FOR FILING AS A POLITICAL BODY CANDIDATE2010 GENERAL ELECTION

    The following instructions relate to the filing of nomination papers by candidates of political bodiesfor public offices filing with the Secretary of the Commonwealth in the 2010 General Election.Nomination papers should not be confused with nomination petitions, which are the forms usedby candidates to access the primary election ballot for the Democratic Party and the RepublicanParty. There are separate instructions and forms for nomination papers filed by minor politicalparty candidates.

    1. WHO MAY FILE:Individuals who wish to be candidates of political bodies must file nomination papers, Form DSBEPB-G (rev. 1/10). Candidates who have filed nomination petitions to appear on the primaryelection ballot of the Democratic or Republican parties may not file nomination papers as politicalbody candidates for the General Election.

    2. DISAFFILIATION:

    Any person who is a registered and enrolled member of a political party during any period of timebeginning with thirty (30) days before the primary and extending through the General Election isnot eligible to be the candidate of a political body in the General Election held in the same year.The Candidates Affidavit [see paragraph 9(b) below] includes a required declaration ofdisaffiliation.

    3. NAMES OF CANDIDATES:More than one candidate, and candidates for more than one office, may be nominated by one setof nomination papers, provided that all the signers on each nomination paper sheet are qualifiedto vote for all the candidates nominated on that nomination paper sheet.

    4. NAME OF POLITICAL BODY:The name of the political body must not be longer than three (3) words none of which are already

    used by or similar to that used by another political body or party.

    5. COMMITTEE TO FILL VACANCIES:A committee of three (3) to five (5) persons must be listed on the nomination paper in the spacesprovided. The names of the committee members must be listed on each nomination paper sheet.This committee is empowered to nominate persons to fill a vacancy in the nomination should itoccur. The Election Code does not specify the qualifications of the members of this committee.

    6. NUMBER OF SIGNATURES REQUIRED:

    a) Statewide The minimum number of signatures required on nomination papers forstatewide office for the 2010 General Election is 19,082. This figure is based on two percentof the vote cast for Judy Olson, a candidate for Justice of the Superior Court, who had thelargest entire vote cast for any statewide candidate elected at the November 2009 election.b) District - The minimum number of signatures required on nomination papers for candidatesnominated for any office elected by district is equal to two percent of the largest vote cast forany officer, except a judge of a court of record, elected at the last preceding election in theelectoral district for which the nomination papers are to be filed, and shall not be less than thenumber of signers required for nomination petitions of political party candidates for the sameoffice.

    7. QUALIFICATIONS OF SIGNERS:Signers of nomination papers must be qualified, registered electors of the State and district and ofthe respective county in which the nomination papers are circulated. Different sheets must becirculated for residents of different counties. Each elector must personally sign his/her name.

    Each signer must also insert his/her printed name, residence and the date of signing on thenomination papers. The electors signature and residence should match the information thatappears on his/her voter registration card. NOTE: In the case of an elector having a Rural Routeor Rural Delivery address, the township should be listed.An elector may sign as many nomination papers as there are candidates to be elected for eachoffice.

    8. FILING DATES:The first day to circulate and file nomination papers is March 10, 2010; the last day to circulateand file nomination papers is August 2, 2010.

    9. AFFIDAVITS:a) Affidavit of Qualified Elector - Each page of the nomination paper must include the affidavit of

    one qualified elector, not necessarily a signer and not necessarily the same person on eachpage, attesting to the validity of all signatures and the residences of the signers on that page.The Affidavit of Qualified Elector must be signed and notarized after all the electorssignatures have been obtained. The qualified elector signing such affidavit must be aqualified elector of the Commonwealth of Pennsylvania.

    Affidavit with his or her nomination papers. The affidavit must be signed in the presence of aperson empowered to take acknowledgments (such as a notary public). The CandidatesAffidavit is printed on a separate form, DSBE-PBCA (10/07), for use with DSBE-210A PBNomination Papers. Among other things, the form requests the candidates election district.Election District means the ward, precinct, division or district in which the candidate isregistered to vote.

    c) Statement of Financial Interests Each candidate, except candidates for the offices ofPresident of the United States, Vice-President of the United States and Representative inCongress, must submit with their nomination papers a copy of their completed Statement ofFinancial Interests (Form SEC-1). The original copy of the Statement of Financial Interestsmust be filed with the State Ethics Commission. Please contact the State Ethics Commission,309 Finance Building, PO Box 11470, Harrisburg, PA 17108-1470, (800) 932-0936, for moreinformation concerning the Statement of Financial Interests.

    10. WHERE TO FILE:Nomination papers for all state-level offices must be filed with the Secretary of theCommonwealth at Room 210 North Office Building, Harrisburg, PA 17120. All nomination papers,

    required affidavits and filing fees must be RECEIVED in Room 210 North Office Building no laterthan 5:00 P.M. on August 2, 2010.

    11. FILING FEES:Filing fees for nomination papers are the same as the filing fees required for nomination petitionsfor the same office. Filing fees must be presented with the nomination papers and must be paidby CASHIERS CHECK orMONEY ORDER payable to the Commonwealth of Pennsylvania.
