AMO President, Jamie McGarvey, spoke to the Standing Committee on Justice Policy on our proposed amendments and recommendations on Bill 108. AMO's written submission speaks to municipal governments� concerns about the impacts of the Bill if passed as is.

AMO�s comments include:

• A return to de novo hearings at the Local Planning Appeal Tribunal (LPAT) is a big step backwards and is not supported. Local councils take their democratic responsibilities seriously.

• There is great municipal concern that legislation could result in lowering the development charge revenue that is needed so growth can pay for growth. Municipalities need to be able to support growth in our communities.

• There is concern that changes will increase the municipal administrative burden.

• The shortening of timelines means greater emphasis on the need for complete applications.

• The objectives of Bill 108 are worthy � to increase the mix and speed of housing development, especially affordable housing.

• Municipal governments agree with the objectives. The municipal sector will monitor whether its implementation achieves the expected outcomes.

The Standing Committee will undertake a clause-by-clause review before June 4, after which we will know whether our advice is accepted. The Legislature is expected to pass Bill 108 next week.

This timing is driven by the legislative agenda, which unfortunately has not provided for broad consultation on the many Bill 108 schedules. Bill 108 will require numerous regulations for implementation. Draft regulations generally involve public consultations. AMO will continue to advocate for municipal involvement in Bill 108 regulations.

Bill 108 Receives Royal Assent with Several Amendments

Bill 108, the More Homes, More Choice Act, 2019 has now passed third reading at Queen�s Park and received Royal Assent. It is now law in Ontario. The Act makes significant changes to the planning appeals process and to development charges. It also introduces a new Community Benefit Charges (CBC) under the Planning Act and makes changes to the planning process, conservation authorities, endangered species legislation, environmental assessments and to the Ontario Heritage Act.

AMO advocated vigorously on behalf of municipal interests throughout the legislative process, including by presenting before the Standing Committee of Justice Policy, and through our government relations work. A few amendments were introduced during the committee stage, including one that AMO and others proposed on including capital costs for ambulance services in development charges calculations.

Bill 108 will require numerous regulations for implementation. Draft regulations generally involve public consultations. AMO will continue to advocate for meaningful municipal involvement in Bill 108 regulations.

Local Planning Appeal Tribunal Act:

Despite calls from AMO and municipal governments to allow the LPAT to continue to evaluate appeals based on compliance and conformity, de novo hearings will now be re-introduced. This move will take authority away from local councils and reverts back to an appeals process known to have a legacy of delays. It is unclear how the return to de novo hearings will lead to the faster provision of affordable housing.

Development Charges:

We believe that the new changes to development charges will negatively impact municipal finances and go against the principle that growth should pay for growth. If a development is rental housing, institutional, commercial or industrial, development charge payments are now payable to the municipality as six annual installments commencing at occupancy. An amendment to Bill 108 following committee extends the repayment timeframe to 20 years for non-profit housing. Previously, development charges were payable in advance. This change will reduce the amount of revenue municipalities receive from development charges. It will also increase administrative burden for municipal governments.

On a positive note, municipal governments may now charge the full capital cost of waste diversion services as a development charge. Following ours� and others�proposed amendments at the committee stage, capital costs for ambulance services will now also be included in development charge calculations.

Community Benefit Charges:

Height and density bonusing under Section 37 of the Planning Act has been replaced with a new Community Benefit Charges framework. The CBC framework will allow municipal governments to pass by-laws covering a particular area to impose charges against land to pay for the cost of facilities, services and other matters required because of new development. Notably, costs eligible for development charges are excluded from CBCs. Eligible services and the methodology for calculating CBCs will be determined in regulation.

Other Planning Act Changes:

Timelines for making decisions related to official plans are reduced from 210 to 120 days and from 150 days to 90 days for zoning by-law amendments. Plans of subdivision are also sheltered from third party appeals. As well, the use of Inclusionary Zoning will now be limited to transit areas. This limits the utility of this affordable housing tool.

Conservation Authorities:

The mandatory �core services� of conservation authorities will now be prescribed by regulation. Conservation authorities must also now enter into agreements with municipal governments on service delivery. Municipal governments want assurance that this new regime will not only bring transparency to the financial relationship with Conservation Authorities but will continue to support reaching the �triple bottom line�.

Endangered Species:

Bill 108 also introduces a new approach to endangered species protection. Species at risk will now be considered in the broader geographic context when determining species� status. The Minister is also now able to enter into landscape agreements that authorize activities that would otherwise be prohibited in relation to listed species under certain circumstances. As per an amendment to the bill, alternative approaches will need to be considered before undertaking an activity that could adversely affect a listed species. While this direction holds potential to protect species at risk, a strong commitment from the province is required to provide leadership and tools to make this a success.

Environmental Assessment Act:

The Bill will reduce the need to undertake a lengthy justification for low risk activities. AMO looks forward to participating as further information, regulations and guidance are developed.

Ontario Heritage Act:

Ontario Heritage Act changes will require municipal councils to notify property owners if their properties or included in the register due to cultural heritage value or interest. The changes also introduce new timelines aimed at making the heritage process more transparent. A technical amendment was made at the committee stage that the Trust is included in notices. The language around erecting structures on a heritage site was also clarified to stress that the attributes that give heritage significance should not be altered or demolished.

Food Safety and Environmental Policy Branch June 6, 2019 Dear Municipalities in the Greater Golden Horseshoe, As you may know, the government recently announced the Housing Supply Action Plan. Included in this plan are changes to the Growth Plan (“A Place to Grow: Growth Plan for the Greater Golden Horseshoe”). The changes give communities more flexibility outside of the Greenbelt while continuing to encourage municipalities to develop strategies to sustain or enhance their Agricultural System. The Agricultural System approach, unique in North America, addresses both the protection of farmland and the viability of the agri-food sector. The intention is to support job creation, allow local food to flourish and create trade and economic opportunities. OMAFRA would like to collaborate with you on mapping refinements to the agricultural land base to ensure it reflects local realities. Our staff will be in touch to request an opportunity to meet with your planners and economic developers to initiate this process, if not done already. In the meantime, if you have any updated data and mapping that may not have been captured in the 2018 provincial agricultural land base map (e.g. settlement area boundaries, municipally designated prime agricultural areas), please share it with OMAFRA’s Rural Planner covering your area. We are also interested in learning about issues raised by landowners that need to be considered. Since the Greenbelt Plan has not been changed, the provincial agricultural land base mapping remains in effect in the Greenbelt. Municipalities are required to bring official plans into conformity with A Place to Grow and Greenbelt Plan by July 1, 2022. This includes refining and incorporating the agricultural land base map into official plans. OMAFRA is inviting municipalities to come forward with refinements to their agricultural land base mapping as soon as they can. OMAFRA is updating the Implementation Procedures for the Agricultural System in Ontario’s Greater Golden Horseshoe (2019) to align with A Place to Grow and will send you a link once posted.

May 31, 2019 From: Adam Redish, ADM, Infrastructure Policy Division Dear Mayor/CAO/Stakeholder: In December 2017, the province introduced the Ontario Regulation 588/17 Asset Management Planning for Municipal Infrastructure under the Infrastructure for Jobs and Prosperity Act, 2015. Given that municipalities like yours own a significant portion of public infrastructure in Ontario, the delivery of critical services like roads, bridges, water and wastewater rely on well-planned and well-maintained infrastructure. Good asset management planning helps municipalities make forward-thinking, evidence-based decisions about their assets. Through recent consultations led by the Ministry of Municipal Affairs and Housing on burden reduction, we heard from municipalities and municipal stakeholder organizations that communities are looking for proactive reminders on reporting dates. Therefore, we would like to take this opportunity to remind you that all municipalities must have a finalized strategic asset management policy in place by July 1st of this year. Further requirements are being phased in from 2019 to 2024. A summary table outlining key regulatory milestones can be found in the addendum to this letter. We also want to make sure that communities are aware that provincial funding programs for municipal infrastructure are aligned with the requirements of the regulation. For example, under the current intakes of the Investing in Canada Infrastructure Program (ICIP), successful municipal applicants will be required to:

• Complete an asset management planning self-assessment questionnaire before

entering into a transfer payment agreement with the Province; and

• Submit their strategic asset management policy and asset management plans in

accordance with the regulation for the duration of the project.

This means that if a municipality’s capital project is approved by the province under ICIP in 2020 - with a project completion date of 2022 - the municipality would be required to immediately submit a copy of its strategic asset management policy upon provincial approval of the project. The municipality would also be required to submit its asset management plan for core infrastructure by July 1, 2021 to remain eligible for funding. Additional details will be made available through transfer payment agreements.

The Ministry will be conducting random audit checks for compliance of submitted strategic asset management policies and asset management plans annually.

We also want to make sure you are aware that the province is providing tools and supports to help municipalities, particularly smaller communities, to implement the requirements of the regulation. An initial offering of tools and supports has been made available. This includes:

• A strategic asset management policy toolkit, which is available to all municipalities. It

provides valuable guidance to help municipalities meet the first set of requirements set

out in the regulation before July 1, 2019.

• Expert assessments through the AMP It Up 2.0 initiative delivered by the Municipal

Finance Officers’ Association, which is targeting municipalities with populations of less

than 25,000 to help them develop and improve their asset management plans.

• Expansion of communities of practice activities delivered by Asset Management

Ontario, including guidance materials, group seminars and online forums for public

sector asset management practitioners across Ontario.

Investing in the right infrastructure, at the right time, and in the right place will help stretch capital dollars and sustain critical services across Ontario. The province will continue to work with municipalities across Ontario to help address infrastructure challenges. Town of Midland / Midland Public Library - Inter Office Memo -

Date: June 5th, 2019 Memorandum to: Town of Midland Council From: The Midland Public Library Board & CEO Re: Provincial Funding Cuts to the Ontario Library Service

As a follow-up to the previous memo discussing the Provincial Government’s Funding Cuts to the Ontario Library Service (OLS) and subsequently the Southern Ontario Library Service (SOLS) and the Ontario Library Service North (OLSN), we wanted to provide you and update based on the Ministry’s announcements on Friday, May 30th. On Friday, May 31st at the end of the business day, the Ministry and several MPPs

announced the “restoration” of the Interlibrary Loan Service (ILLO). However, it should

be understood that this is not as restorative as the initial claims seem.

The “restoration” refers to the reinstatement of the VDX software that managed the

interlibrary loan system. All van service will still cease to exist, which is where the

primary support for ILLOs existed. The government has decided to offer a marginal

reimbursement program of approximately 33% of each book sent, up to a total value of

$340,000 for the entire system. This will fall desperately short of covering the costs for

the services for the year, and libraries and their funding municipalities will be left with

the balance. Therefore, this is not a full restoration of the interlibrary loan service.

At this time the Midland Public Library does not have the funds to participate in this new

library funded Interlibrary Loan service. The use of Canada Post is also a far more

involved process for staff, also leading to increased costs. For the 2019 budget year,

MPL will be unable to offer interlibrary loans to our community due to the cuts by the

Provincial Government and the change of this program to a library funded program.

With the loss of the van delivery service MPL also lost free delivery of all of our new

materials that are purchased from our book supplier, a cost that will come back to the

library fully in 2020 – as the book suppliers are making concessions for libraries in 2019,

as they are aware of our tight budgets.

With the current state of the interlibrary loan delivery service, and the reliance on it

being funded mostly the libraries that participate, we will have to carefully examine

Midland’s future access to this program and its related impact on the 2020 Operating

Budget and beyond. Although the Government is celebrating this as a win, in reality it is

not. It is still a huge cost back to libraries and their funding municipalities, if they are

even able to participate.

We will ensure that all changes be communicated with you, and with our users as

quickly as possible. For our patrons, who have already been voicing their concerns we

have been requesting that they communicate directly with their Provincial Government,

via their MPP, the Ministry of Tourism of Culture & Sport & the Premier’s Office. We are

very clear with our users that these cuts are not due to the funding that we receive from

our municipality.

The home owners were victim to thefts of small household items, cash and jewelry along with being victimized by the entry into their homes. As a result of these ongoing investigations the OPP wish to provide some tips and helpful advice for the detection and prevention of residential break and enters. Each year, OPP officers investigate numerous reports of break and enter to area homes and are often successful in the apprehension of the offenders responsible. Much of this success is dependent on the eyes and ears of area residents and here are some tips that can assist community involvement in the detection and prevention of residential break and entries. Detection: · Keep your eyes and ears open for suspicious vehicles and persons in the area of your residence. Do not confront possible suspects. · Record the licence numbers and description of suspicious vehicles. · Record detailed descriptions of occupants of suspicious vehicles. · Report your concerns and observations immediately to the Ontario Provincial Police Communications Centre at 1-888-310-1122 or "911" if emergent. · Make "would-be" thieves visible by installing motion lights or leave an exterior light on to illuminate entrance ways and rear yards. · Don't hide keys in secret places. Instead leave a duplicate with a friend or neighbour. Prevention: · Lock your doors and secure any open windows prior to retiring for the evening. · Borrow an engraver from your local OPP detachment to engrave your valuable belongings. This may discourage theft of valuables and will provide an easy way to identify stolen property. · Use a personal identification mark such as your driver's licence number when engraving your property. · For deterrent purposes, the identification marks should be easily identifiable. · Record the contents of your home on paper or using a video camera. · Record the serial numbers of your property. · Don't leave articles out, such as axes and tools that could be used to assist in breaking into your residence. · Establish relationships with neighbours and check on each other's property when away. · Lock and secure your property and outside belongings and if warranted inquire of the feasibility of an alarm system. · If you are away, make sure that your residence looks like it is occupied. Have the sidewalks shoveled, the mail collected, and the grass cut. Make use timers to have lights coming on and going off at different intervals. · Avoid posting on social media sites when you are away from your residence.

OPP Investigate Morning Crash in Tiny Township

(TINY TOWNSHIP, ON) - Members of the Southern Georgian Bay Detachment of the Ontario Provincial Police (OPP) were dispatched at 7:11 am May 29, 2019 to a single vehicle crash on Tiny Beaches Road South near the 5th Concession of Tiny Township. Attending officers were assisted by members of the County of Simcoe Paramedics and Tiny Fire Service at the scene treating a 85 year old male driver and his 83 year old female passenger. Investigators determined that the male driver suffered a medical emergency prior to striking a large roadside tree. Both occupants were transported to Georgian Bay General Hospital where the male passed away from complications of the medical emergency and the female was treated for minor injuries and released.

The roadway was partially closed for the investigation and tree removal by Tiny Township Roads Department.

Police remind motorists that an essential part of the enforcement job is to save lives and reduce injuries on our roadways and trails. Educating the public about safe driving practices is a priority.

Thank You to All Who Supported BBQ for Special Olympics

(Midland, ON) - Officers from the Ontario Provincial Police (OPP) Southern Georgian Bay detachment hosted a charity BBQ on Wednesday May 15, 2019 from 11:30 a.m. - 1:30 p.m. at the downtown Midland station. Although it rained through most of the event we still had a good turnout. Over $800.00 was raised and will be donated to Special Olympics in a lead up to the Local Law Enforcement Torch Run for Special Olympics on June 12, 2019.

A huge thank you to everyone who joined us for this good cause despite the weather. We would also like to thank community partners including Special Olympics Huronia, Harvey's, No Frills the Town of Midland, Crime Stoppers, Friends of the OPP Museum, Community Living Huronia and The Dock who were live to air at the event.

'Opioids and Overdoses: Impact and Strategies' Report Released

(ORILLIA, ON) - Today, the Ontario Provincial Police (OPP) Opioids Working Group released their Opioids and Overdoses: Impact and Strategies report, highlighting the alarming increase of opioid overdoses and deaths across Ontario. The report contains information relating to OPP opioid seizures, overdoses and relevant strategies.

Out of concern for the safety of all Ontarians, the OPP is sharing the data to help prevent the loss of more lives.

Key information:

• OPP has identified a 35 per cent increase in overdose deaths during the first quarter of 2019, compared to the first quarter of 2018

• Since September 2017, the OPP has administered naloxone on 79 occasions and saved 73 lives • OPP has administered the highest number of naloxone doses in March and April 2019 • The spirit of the Good Samaritan Drug Overdose Act (GSA) is embedded in all aspects of OPP

involvement with the public

(MIDLAND, ON) - With Prom Night celebrations happening at some area high schools tonight and in the near future, officers of the Southern Georgian Bay detachment of the Ontario Provincial Police (OPP) will be extra vigilant while on patrol this weekend for drivers and persons attending area celebrations.

Prom Night and graduation are a rite of passage for our students in celebrating the beginning of adulthood and making important decisions. Our members will be patrolling the area during these celebrations. Consuming drugs and/or alcohol especially underage and driving a motor vehicle is preventable. Don't succumb to peer influence and make good choices is my advice. Call a cab, family member or a friend to arrive to the destination safely. I wish all of our students an enjoyable event and all the best for the future, its challenges and opportunities!

Sign Variance Application C.3/2019 In the matter of the Municipal Act, S.O. Chapter 25, Section 99(9) and Sign By-law 2011-79, as amended, being a By-law to regulate Signs or Other Advertising Devices, please be advised that:

TAKE NOTICE that an application to the Sign Variance Committee has been submitted for a variance to the Sign By-law 2011-79, as amended, pursuant to Part 9.1.5 under the Sign By-law

2011-79, as amended, for lands known municipally as 9225 County Road 93 (Huronia Mall).

The property is designated Employment Area in the Official Plan and zoned Highway Commercial - HC in Zoning By-law 2004-90, as amended.

Joint Letter to Provincial Facilitators on behalf of the

Town of Penetanguishene, Township of Tay and Township of Tiny June 5, 2019 Dear Mr. Fenn and Mr. Seiling, On behalf of the Councils of the Town of Penetanguishene, Township of Tay and the

Township of Tiny, we are writing to convey our collective view on the future of North

Simcoe as it relates to the Regional Government Review. This letter has been prepared,

in part, to respond to the document submitted to your office from the Town of Midland

“Strategic Considerations on the Future of North Simcoe” but more importantly to

share our joint vision. Our Councils agree that all efforts must be made to ensure that

municipal services are delivered as efficiently and effectively as possible. However, as

a united group representing the majority of residents in North Simcoe, we believe that

municipal amalgamation is not the vehicle to achieve this aim.

The four municipalities of North Simcoe have a long and productive history of

collaboration and shared services. Inter-municipal partnerships in the areas of

environmental stewardship, economic development, tourism and culture, building

services, transit, emergency services, human resources, recreation, library services and

healthcare have been long standing and successful. This relationship has served our

residents across North Simcoe very well and delivered excellent value. As Mayors of

North Simcoe we firmly believe that we have, over many years, developed a highly

effective municipal model of shared services that should be encouraged, maintained

and expanded.

As representatives of our respective communities, we thank you for the earlier

opportunity to meet with you and provide our individual Councils’ view on the Regional

Government Review. As leaders of three thriving municipalities in North Simcoe, we

have now also had an opportunity to discuss our collective vision for our community.

As a group, the Town of Penetanguishene, Township of Tay and the Township of Tiny

would like to share the following thoughts with you as they relate to your ongoing

review. Penetanguishene, Tay and Tiny Councils agree that:

- The existing two-tiered structure has served North Simcoe well over the years.

However, we are open to a service delivery review to ensure the most effective

delivery of services (i.e. Water, Wastewater and Storm Water, Emergency

Services, Transit, Procurement, Information Technology, Library services, Land

use Planning and Transportation);

- We strongly believe that local representation, decision making and autonomy

must be a key consideration in your deliberations;

- We fully support expanded shared services with our municipal partners;

- We do not support the proposition that a specific critical mass or population is a

key determinate of a municipality’s ability to deliver effective and efficient

services;

- We are convinced that forced amalgamation will be counterproductive to our joint

efforts to deliver cost effective services through voluntary shared services

arrangements;

- We are concerned that forced amalgamation will add additional costs as services

and programs are harmonized across municipal boundaries;

- We recognize that minor boundary adjustments may be appropriate to ensure the

best utilization of existing resources;

- No matter what decision(s) of the Provincial Government may be made in regard

to the future of North Simcoe, additional and extensive public consultation needs

to be conducted prior to implementation of those decisions;

- A review of local and upper tier council representation, structure and size is

required;

- All decisions and findings should be evidence based to clearly demonstrate

efficiencies in service delivery and cost savings either in the short or long term;

- Your report to the Minister should be made available to the public to ensure

accountability and transparency.

The Town of Penetanguishene, Township of Tay and the Township of Tiny Councils remain fully committed to working with their municipal partners and the Province to find cost savings and improved service delivery for the benefit of our residents.
