The Swedish Transport Administration's business strategy for contracts and technical consultants
Introduction Since the Swedish Transport Administration was formed, the administration’s strategy as an employer has successively evolved and clarified. The overall approach was established in 2010 in the documents the Swedish Transport Administration's procurement policy (TDOK 2010:119) and the Swedish Transport Administration's procurer strategy (TDOK 2011:196). These documents have since been communicated and improved. Within this framework, control has been developed both within the respective VO/CF and business wide within e.g. the productivity group and in the Swedish Transport Administration's management team and in the Employer Council. The focus has previously been partly documented in the Swedish Transport Administration's main and support processes1 but many parts were previously only in the form of single decisions or approaches in presentations. At the same time, development projects are underway in several areas that are the basis for joint strategies for contracts and technical consultants.
This business strategy coordinates, documents, clarifies and develops, in some parts, the strategies for the procurement of contracts and technical consultants currently applied in the Swedish Transport Administration. The business strategy with appendices handles procurement where the Public Procurement Act (LOU) and the Procurement in the Supply Sector Act (LUF) apply within the category family contracts and the category family technical consultants in planning and design2. This business strategy is superordinate to category strategies.

Joint
Purpose
The main aim is to facilitate and ensure a conscious choice of business form3 in accordance with the Swedish Transport Administration's agreed goals and approaches that build on organisational learning based on best practice in the Swedish Transport Administration and externally.
The implementation of the strategy also aims to achieve the following effects:
Total cost effectiveness in each purchase of contract and technical consultant because
the strategy that is deemed to provide the best outcomes for market development
towards increased productivity, competition and innovation is implemented
consistently throughout the Swedish Transport Administration.
Financial savings at suppliers because the Swedish Transport Administration behaves uniformly and consistently.
Time savings for every employee and manager involved in the process of producing
the choice of business form for projects by clarifying, concretising and gathering
together the Swedish Transport Administration's goals and approaches.
Enables and visualises conscious deviations from best practice so as to limit risk-
taking and conscious learning of new approaches.
Application
Before an internal order and any decision to draw up an action description, the administrator shall decide on the preliminary type of contract/type of assignment. The employer must apply this strategy together with the administrator and Purchasing and Logistics.4 If necessary, Legal Matters and Plan Review shall be consulted. Preliminary type of contract/assignment and choice of Basic or High Collaboration shall be documented in the project’s action description. The strategy shall cover both contract and technical consultant.
This strategy shall be applied on a continuous basis in the selection of business form for contracts and technical consultants in the planning of projects and implementation of projects as well as before advertising decisions. "Procedure for choice of business form" is used as a support. The business form and justification for this shall be documented in the "Justification appendix, choice of business form".
Application is set out in Appendix 1 Flowchart Choice of type of contract/assignment Collaboration High and Choice of business form.
The applicable governing documents are set out in Appendix 2 Overview of governing documents and document types that shall be applied in the choice of strategy.
Established category strategies shall be applied. Deviations shall be decided according to the relevant work instructions.

Overall goals and strategic approach The Swedish Transport Administration shall, in the employer role, specifically work for market development that leads to the achievement of the goals: increased productivity, degree of innovation and competition in the construction industry. The goals shall be pursued on the basis of the conditions in the individual case.
The market will increasingly be given the opportunity to take greater responsibility for ensuring that the final product meets the requirements of the Swedish Transport Administration for function and quality.
The Swedish Transport Administration will increase the proportion of development-promoting procurements in order to contribute to the market having better conditions for achieving the Swedish Transport Administration’s goals.
For contracts, the most appropriate contract form shall be chosen based on the degree of
freedom, complexity, uncertainties and innovation needs or other benefits5. The proportion of design and construct contracts remains high and represents a significant part of both road and rail contracts.
For consultancy assignments, the most appropriate form of assignment shall be chosen based on complexity, uncertainties and innovation needs or other benefits. For consultancy assignments that are carried out with Collaboration Basic, the remuneration form fixed fee shall constitute a significant part of the remuneration.
Within the framework for its assignment, the Swedish Transport Administration shall set requirements that contribute to increased employment in society and ensure long-term skills provision in the industry.
The Swedish Transport Administration shall set social requirements in all procurement. The requirements shall create fair competition by ensuring that laws are respected and that no people are exploited or mistreated.
In procurement, the Swedish Transport Administration shall set requirements aimed at reducing the climate impact of infrastructure management.
When deciding on the individual contract, procurement legislation and long-term effects on the current and future business of the Swedish Transport Administration shall always be considered.
Sub-strategies and goals
Packaging and communication with the market Contracts and consultancy assignments respectively that are commercially suitable to implement together shall be packaged in the same procurement. Packaging should aim to promote innovation, industrial production and the life cycle costs of the objects. Combines procurement shall be considered in order to facilitate the submission of tenders by small and medium-sized suppliers.
For consultancy contracts relating to investments, the extent shall be as follows: road/rail plan + tender documents for the contract + site follow-up in the same assignment.

Where this can be justified and is appropriate with regard to calculations, e.g. due to an assignment time of more than 3 years or plan type with alternative locations, procurement may be carried out as follows: road/railway plan or localisation study is purchased in a separate assignment. Tender documents for contract and site follow-up are then procured in separate assignments.
Design, construct and maintain contracts, i.e. design and construct contracts with a long maintenance commitment (+ 10 years) shall be considered where the conditions for responsibility are clear (e.g. new road in a completely new route) during the contract period and the performance requirements are relevant and measurable.
Framework contracts for small construction works, BEST contracts and planning and/or design assignments are used up to the amount decided.
For the purchase schedule, procurements are introduced immediately after the purchase resource is allocated. Thereafter, 80% of the number of procurements calculated on a 12 month period shall be advertised within 3 months of being marked green.
In early dialogue with the market, the Transport Administration shall be involved with competence that ensures that a mutual discussion of the contract/assignment can be carried out.
Procurement and award criteria In the case of contracts/assignments above the threshold in LOU, the procurement procedure shall be open or negotiated, unless specific reasons for selective procurement or competitive dialogue exist. For procurement above the threshold according to LUF, the procurement procedure shall be negotiated.
Negotiations to adapt tenders shall be used more widely. In tenders where negotiation has been found to be possible and appropriate, the conditions for negotiation shall be formulated in the tender documents.
Qualification requirements shall be at company level.
Competency requirements for personnel shall be set as contractual requirements and not as qualification requirements in the procurement.
Qualification requirements relating to technical and professional capacity shall be easy to understand, unambiguous, proportionate and easy to assess. Requirements shall not be directed towards a particular supplier.
Most financially advantageous tender by price For award criteria, the most economically advantageous tender by price will generally be applied unless added value can be justified and can be monitored during the contract period.
For contracts TRV E1A and TRV E2 as well as contracts for BASIC Contract and contracts involving significant maintenance TRV UH1A and TRV UH2, only price shall be applied.
For consultancy assignments for TRV TK1 and TK2, only price shall be applied.

The most financially advantageous tender by the best relationship between price and quality (added value) Standard contracts TRV E1B and TRV UH1B can, if so justified, be procured with added value. The recommended level is up to 30%; if justified, the level can be increased to a maximum of 50%.
Complex and uncertain construction projects can, if justified, be procured with added value under the contract model Collaboration High.
Standard assignments TRV TK1B and TRV TK2B can, if so justified, be procured with added value. The recommended level is up to 30%; if justified, the level can be increased to a maximum of 50%.
Complex and uncertain assignments for technical consultants can, if justified, be procured with added value under the contract model Collaboration High.
Most financially advantageous tender by cost The award criterion of economically most advantageous tender by cost may only be chosen if the requirements set are possible to follow up in a life cycle perspective. When assessing the cost-effectiveness of tenders, the life cycle costs shall be included in the valuation.
Tendering periods For design and construct contracts over SEK 100 million for TRV E1A, TRV E1B and TRV E3, the tendering period shall be a minimum of 6 months. For TRV E4, TRV E5 and TRV E6, tendering period shall be according to "Contract model Collaboration High".
The tender calculation period for TRV E2 over SEK 100 million shall be minimum 2 months.
For contracts relating to BASIC Contract, the tendering period shall be a minimum of 3 months.
For consultancy assignments for TK1A, TK1B, TK2A and TK2B over SEK 20 million, the tendering period shall be a minimum of 4 months. For consultancy assignments TK 3, TK4 and TK 5, the tendering period shall be according to the contract model Collaboration High.
For the purpose of calculating the tendering period, account shall be taken of public holidays and holiday periods.
Collaboration and remuneration forms The Swedish Transport Administration’s Collaboration Basic shall be applied if Collaboration High has not been decided on at the latest when determining the action description. Collaboration High shall be considered in complex and uncertain projects. Decisions to cancel or proceed with Collaboration High shall be made at the latest before procurement of consultants for tender documents for the contract begins. Forms of remuneration shall be in accordance with Appendices 3, 4 and 5.
If bonus and/or added value for quality parameters are applied outside the contract model Collaboration High, they shall be formulated with project-adapted choices according to Routine Qualification, evaluation and remuneration form, bonus and penalties.
For procurement, maximum penalties shall always be calculated and the effect assessed at the supplier's risk level.

BIM The Swedish Transport Administration's lowest level BIM shall always be applied by VO Investments and VO Major Projects. BIM extended level shall be applied according to the established guideline.
Upplev Supplier follow-up shall take place 2 times per year in each contract and assignment that is longer than one year and once after the end of the contract with Upplev according to established levels for the contract’s size.
For BASIC Contract and other contracts with significant maintenance and that last more than one year, supplier follow-up shall be carried out at least once a year per contract and once after the end of the contract, with UPPLEV according to established levels for the contract’s size.
Business forms for types of contract commonly used in the Swedish Transport Administration
The following seven types of contract shall be used as a starting point for choice of business form with investment, regardless of VO.
If contracts are classified as standard, TRV E1A, TRV E1B or TRV E2 is chosen. If uncertainty regarding the complexity of the contract exists, the TMALL 0767 complexity assessment shall be used.
Collaboration Basic TRV E1A. Standard contracts with sufficient degrees of freedom and low uncertainty
TRV E1B. Standard contracts with sufficient degrees of freedom and an identified need for innovation or other benefit
TRV E2. Standard contracts with small degrees of freedom and low uncertainty
TRV E3. Complex contracts with a long maintenance commitment (= design, construct and maintain contract)
Collaboration High
TRV E4. Complex contracts with great degree of freedom and high uncertainty
TRV E5. Complex contracts with small degrees of freedom and high uncertainty

Technical consultants perform strategic choice of measures studies, localisation studies investigations, planning assignments and design assignments including building site follow-up.
Choice of type of assignment for technical consultants shall be made irrespective of the choice of type of contract.
If uncertainty regarding the complexity of the assignment exists, the TMALL 0767 complexity assessment shall be used.
