Sir/Madam,

As you are aware, this Ministry has issued guidelines in pursuance of order dated29.10.2014 in W.P. No. 235 of 2012 of Hon'ble Supreme Court of India to protect the GoodSamaritans. As par Para 1 (7) and (8) of the guidelines dated 12th May, 2015, the StandardOperating Procedure for the examination of Good Samaritans by the Police or during trial hasbeen issued by the Ministry on 21st January 2016 envisaging the procedures to be followed forthe examination of an eyewitness to a road ac1lcident, so that the witness does not getharassed.

I2. The Hon'ble Supreme Court of India vide its order dated 30th March 2016 have approvedboth the guidelines dated 12.05.2015 and 21.01.2016 with slight modification and directed

Ithat guidelines, as modified, be complied wit:h by the Union Territories and all thefunctionaries of the State Governments, as law lajd down by the Court under Article 32 readwith Article142 of the Constitution of India, and the same be treated as binding as per themandate of Article 141. I

3. In brief the guidelines focus on the following two points:-

(i) The Standard Operating Procedure provides legal protection to people who give reasonableassistance to those who are, or ~ho they believe to be, injured, ill, in peril, or otherwiseincapacitated.

(ii) The Standard Operating Procedure mandate emergency medical treatment by hospitalsand medical practitioners to victims of accidents without raising any objection orobjections that the cases are medico-legal cases or any other objection and withoutdemanding any payment as a condition precernt for such treatment and to provide legalprotection to as Good Samaritan who volunt rily gives help to those in distress or needand for other matters incidental thereto.

4. However, road safety is continues to be one of the leading causes of death, disabilitiesand hospitalisation in the country despite our commitment and efforts to bring down thenumber of road accidents and fatalities. As per provisional data, more than 1.5 lakhs liveswere claimed by road accident in the calendar year 20118.

5. It is also a real fact that if someoneprovides i~mediate required assistanceto a roadaccident victim her/his life can be saved. However, eyen more than three years of issuingtheGoodSamaritansGuidelines, no significant improvement in the situation is observedand stillpeople refrain from assisting road accident victims. Hospitals also need to be made activepartners in propagatingGoodSamaritanGutdelines.

6. You can realise that it is dire need of the time to enforce the Good SamaritanGuidelines in their true spirit. As the powers to enforce the GoodSamaritansGuidelines restwith the States/UTs, you are requested to look into/Ithe matter personally at your level toensure strict compliance of the guidelines in your State/UT though the concerned fieldformations.

Justice, as stated by the learned Additional Solicitor

to the protection of Good Samaritans Until apprc'pria~-e

legislation is made by the Union Legislature. :I The

directions in terms of the present order will be issued

within a period of three months from today.

Insofar as the working of the Road Safety Co:nmittee

headed by Mr. Justice K.S. Racihakrishnan, former judge of

this Court, is concerned, on perusal of the statements made

in the additional affidavit filed on 27th October, 2014 and

the enclosures thereto, it is our considered view that we

should seek the assistance of learned Attorn_ey General for

India to make the Committee functional and more effective

in the discharge of the tasks assigned by the Court by its

previous orders. We request the learned Attorney General

to be present in Court on 11th November, 2014 on which date

further orders as may be required with regard to the

functioning of the Road Safety Committeewill be passed.
