TAKE NOTICE that pursuant to the Crown Lands Act 1929, IJOHN HILL, Minister for Environment and Conservation,Minister of the Crown to whom the administration of the CrownLands Act 1929 is committed DO HEREBY:

DEVELOPMENT ACT 1993, ALTERATION TO THEBUILDING CODE OF AUSTRALIA

Preamble

1. The Building Code of Australia as in force from time to timeis adopted by the Development Regulations 1993 as part of theBuilding Rules under the Development Act 1993.

2. The Code has been altered.

3. The Development Act 1993 requires that notice of thealteration must be published before the alteration can take effect.

4. In a notice published in the South Australian GovernmentGazette of 9 December 1999, notice was provided that the SouthAustralian Addition to Volume 2 Clause SA 2 Energy Efficiencywould take effect on a date to be gazetted. The date has not beengazetted. The South Australian Addition to Volume 2 Clause SA 2Energy Efficiency has been altered by Amendment 12 to deleteClause SA 2 Energy Efficiency.

NOTICE

PURSUANT to sections 4 (7) and 108 (7) of the Development Act1993, notice is given of an alteration to the 1996 Edition of theBuilding Code of Australia, that alteration being Amendment No.12, published by the Australian Building Codes Board, asmodified by the variations and additions for South Australiacontained in the appendix to that Code.

The alterations made by Amendment No. 12 to the BuildingCode of Australia will take effect for the purposes of theDevelopment Act 1993 on 1 January 2003.

DEVELOPMENT ACT 1993, ALTERATION TO THE SOUTHAUSTRALIAN HOUSING CODE

Preamble

The Development Act 1993 requires that where a Code isadopted by the Regulations, notice of the alteration must bepublished before the alteration can take effect.

NOTICE

PURSUANT to section 108 (7) of the Development Act 1993,notice is given of an alteration to the South Australian HousingCode 1998, which is called up in the South Australian Appendixto Volume Two of the Building Code of Australia 1996 edition,that alteration being Amendment No. 9, as published by PlanningSA.

The alterations made by Amendment No. 9 to the SouthAustralian Housing Code will take effect for the purposes of theDevelopment Act 1993 on 1 January 2003.

PreambleIt is necessary to amend the Adelaide Hills Council Development Plan dated 5 December 2002.

NOTICE

PURSUANT to section 29 (2) (a) of the Development Act 1993, I, Jay Weatherill, being the Minister administering the Act, amend TheAdelaide Hills Council Development Plan dated 5 December 2002, as follows:

(a) delete MapAdHi/1 (Overlay 2) and Parts A, B, C and D and Map AdHi/1 (Overlay 2) Enlargements A, B, C, D and E;

(b) renumber Map AdHi/1 (Overlay 3) as Map AdHi/1 (Overlay 2), renumber Map AdHi/1 (Overlay 4) Parts A and B as MapAdHi/1 (Overlay 3) Parts A and B, and amend the associated cross-references in the text;

(c) under Council-wide Bushfire Protection Introduction delete the wording ‘Maps MapAdHi/1 (Overlay 2) and Parts A, B, C andD and Map AdHi/1 (Overlay 2) Enlargements A, B, C, D and E’ and insert the wording ‘Figures AdHiBPA/1 to 17’;

ELECTRICITY ACT 1996

Proposed Variation to Electricity Pricing Order

THE MINISTER FOR ENERGY proposes to vary the electricitypricing order notified in the Gazette on 11 October 1999 at page1471 in the manner set out below:

Delete clause 8.2 and replace with the following:

8.2 Country Equalisation Scheme

(a) The purpose of this clause 8.2 is to require that aRetailer not charge a small country customer forprescribed retail services more than 101.7% of theprice for the same prescribed retail services offered bythe Retailer to a small city customer.

(b) A Retailer must not sell electricity to small countrycustomers unless the Retailer ensures that each tarifffor prescribed retail services offered to small citycustomers is also offered to small country customerswithout addition or variation, except that the price(including any discount, allowance, rebate or credit)specified in any tariff component charged to a smallcountry customer may exceed the price specified in thesame tariff component charged to a small citycustomer by not more than 1.7%.

FISHERIES ACT 1982: SECTION 59

TAKE notice that, pursuant to section 59 of the Fisheries Act1982, SA Abalone Developments Pty Ltd (hereinafter referred toas the ‘exemption holder’), c/o P.O. Box 1579, Port Lincoln, S.A.5606 is exempt from Section 34 of the Fisheries Act 1982, butonly insofar as it may take greenlip abalone (Haliotis laevigata)for the purpose of aquaculture broodstock (hereinafter referred toas the ‘exempted activity’) in the waters specified in Schedule 1subject to the conditions in Schedule 2.

SCHEDULE 1

South Australian coastal waters south and east of a line drawndue south through Point Brown (latitude 32°32.6′S, longitude133°50.8′E) and west of the meridian of longitude 136°30′E.

SCHEDULE 2

1. The exemption holder may take a maximum of 100 greenlipabalone (Haliotis laevigata). All abalone taken pursuant to thisnotice may not be sold or transferred to another party.

2. All abalone taken pursuant to this notice must be delivered toand retained on the registered aquaculture site of landbasedAquaculture Licence No. FT00158.

3. The exemption holder may engage in the exempted activityfrom the date of gazettal of this notice until 30 June 2003, unlessvaried or revoked earlier.

4. The exempted activity may only be conducted by DominicHenderson, Tony Kingdom, Milton Hunt, Darcy Eldridge, JonasWoolford, Tobin Woolford or Douglas Graske.

5. The exemption holder shall notify the PIRSA FisheriesCompliance Unit on 1800 065 522 at least 24 hours prior toconducting the exempted activity with the following information:

• details of the boat that will be used to engage in theexempted activity;

• the name of the person who will be conducting theexempted activity;

• the intended place and time of launching and retrieval ofthe nominated boat for that day; and

• the intended area of conducting the exempted activity.

6. The exemption holder must, within 50 m of the point oflanding of any abalone taken pursuant to this notice, complete thePIRSA Fisheries form ‘Abalone Broodstock CollectionStatement’. Immediately upon arrival at the exemption holder’sregistered aquaculture site, this form must be faxed to PIRSAFisheries on (08) 8347 6150. Prior to release into the registeredaquaculture site, all abalone taken pursuant to this notice must betagged so as to be clearly identified as wild broodstock.

7. The exemption holder shall record the number of wildbroodstock held pursuant to this notice in a register to bemaintained at the registered aquaculture site, which must be madeavailable for inspection by a PIRSA Fisheries Compliance Officerupon request.

8. PIRSA Fisheries Compliance Unit retains the right for adepartmental officer to accompany the exemption holder at anytime during the exempted activity.

9. While engaged in the exempted activity the exemption holdershall carry or have about or near his person a copy of this notice.Such notice must be produced to a PIRSA Fisheries ComplianceOfficer upon request.

10. The exemption holder shall not contravene or fail to complywith the Fisheries Act 1982 or any regulations made under thatAct, except where specifically exempted by this notice.

• South Australian full retail competition and systemplanning derogation (Nos A90838, A90839, A90840)

• Queensland technical standards derogation (Nos A90841,A90842, A90843)

• Safety net provisions and reserve contracting derogation(Nos A90844, A90845, A90846)

The Australian Competition and Consumer Commission (Com-mission) received applications for authorisation of derogationsfrom the National Electricity Code (code) for the above matters on16 August, 26 August and 10 September 2002, respectively.

The South Australian full retail competition derogation amendsthe existing derogation to delay the introduction of competition formetering services for a transitional period of two and a half years.This is intended to facilitate a smooth transition to full retailcompetition. The system planning derogation amends the existingderogation to ensure it is consistent with the code as amended bythe Network and Distributed Resources code changes. It is alsointended to enhance the information available to the ElectricitySupply Industry Planning Council.

The Queensland technical derogation extends the existingtechnical derogation for a further two years. This will bring theexpiry date in line with those of the recently extended technicalderogations of New South Wales, South Australia and Victoriaand will allow a managed transition to the new technical standardsregime which is part of an application for authorisation that iscurrently being assessed by the Commission.

The safety net provisions and reserve contracting derogation isaimed at widening the scope of the existing reserve traderprovisions to allow National Electricity Market ManagementCompany to enter into reserve contracts with non-scheduledgenerating units and loads.

Interim authorisation of this derogation was granted on 6November 2002 and has been extended until the final authori-sation takes effect.

Please find enclosed copies of the determinations outlining theCommission’s decisions to grant authorisation and any conditionsof authorisation. Further copies may be obtained from theCommission’s website at www.accc.gov.au.

In accordance with s.101 of the Trade Practices Act 1974 aperson dissatisfied with the Commission’s determination mayapply to the Australian Competition Tribunal for a review of thedetermination. Each application must be lodged on the approp-riate form within 21 days of the date of the determination, with theRegistrar of the Tribunal. The Tribunal is located in the Office ofthe Registrar of the Federal Court in each State.

A copy of this letter together with the determinations will beplaced on the Public Register kept by the Commission.

Restrictions on the Use of Water

PURSUANT to section 33A of the Waterworks Act 1932 and being of the opinion that water available for supply under the Act is likelyin the future to be insufficient to meet demand, the South Australian Water Corporation with the approval of the Minister forGovernment Enterprises hereby restricts from, 6 December 2002 until further notice, the purposes for which water may be used, themanner in which water may be used, and the means by which water may be used, as set out in the Schedule within the following WaterDistricts (“WD”) and Country Lands Water Districts (“CLWD”) on the Eyre Peninsula: Arno Bay WD, Ceduna WD, Cleve WD, CoffinBay WD, Cowell WD, Cummins WD, Haslam WD, Kimba WD, Lipson WD, Lock WD, Louth Bay WD, Minnipa WD, Poochera WD,Port Lincoln WD, Port Neill WD, Rudall WD, Smoky Bay WD, Streaky Bay CLWD, Streaky Bay Township WD, Tod River CLWD,Tumby Bay WD, Ungarra WD, Warramboo WD, Wirrulla WD, Wudinna WD, Yaninee WD and Yeelanna WD.

WATER RESTRICTIONS—EYRE PENINSULA

WATER USE Purpose WATER RESTRICTION

Gardens and Lawns A watering system or sprinkler for gardens and lawns can only be used betweenthe hours of 9 p.m. and 7 a.m. Buckets, watering cans and hand held hosesmay be used at any time to water gardens and lawns.

Cars, Boats and OtherVehicles

Vehicles can only be cleaned using automatic washing systems that recyclewater, commercial car washing facilities using trigger hoses, or on domesticpremises using trigger hoses, buckets or watering cans.

Paved Areas Water must not be used to clean a paved area unless it is necessary to do so as aresult of accident, fire, health hazard or other emergency.

Window Cleaning Water can only be used to clean windows by means of a bucket or watering can(and not by means of a hose) filled directly from a tap.

Garden Ponds, SwimmingPools or Spas

A garden pond, swimming pool or spa that has not previously been filled, or hasbeen emptied, must not be filled without SA Water’s written authority. Thelevel of water in a garden pond, swimming pool or spa that has beenpreviously filled with water may only be topped up or maintained with waterfrom a hand-held hose, bucket or watering can.

Fountains A fountain that does not recycle water must not be operated. Water must not beused to top up or maintain the water level in any fountain.

Domestic

Any other Purpose Water may only be used for general domestic purposes inside domestic premises,for domestic animals and for the purposes set out above.

Water must not be used for any other purpose without SA Water’s writtenauthority.

Farms Dams andTanks

A farm dam or tank must not be topped up, maintained or filled with watersupplied by SA Water without SA Water’s prior written approval, except for atank that provides for firefighting, domestic purposes or stock watering.

Irrigation Sprinkler irrigation can only be used between the hours of 9 p.m. and 7 a.m.Dripper irrigation—no restriction.

Construction Industry Without SA Water’s prior written approval water can only be used by means of atrigger hose.

Food Transport Vehicles Water can only be used to clean vehicles by means of a trigger hose, a bucket orwatering can filled directly from a tap or by an automatic washing systemwhich recycles water.

Commercial

Mobile Water Tankers A mobile water tanker must only be used to supply water to domestic premisesor for construction, firefighting or stock watering purposes. Any otherpurpose requires SA Water’s prior written authority.

By-law No. 5—Dogs

FOR the management and control of dogs within the Council’sarea.

1. Definitions

In this by-law unless the context otherwise requires:

1.1 ‘Act’ means the Dog and Cat Management Act 1995;

1.2 ‘approved kennel establishment’ means a building,structure or area approved by the relevant authority,pursuant to the Development Act 1993 for the keeping ofcats and/or dogs on a temporary or permanent basis;

1.3 ‘council land’ means all parklands, reserves, ornamentalgrounds, streets, roads, jetties, bridges, foreshore, publicplaces and other land vested in or under the control of theCouncil;

1.4 ‘dog’ means an animal of the species canis familiaris butdoes not include a dingo or cross of a dingo;

1.5 ‘premises’ means any domestic and non-domesticpremises, except a kennel establishment in respect ofwhich a development authorisation is in force under theDevelopment Act 1993.

2. Dog free Areas

No person shall on any Council land to which this paragraphapplies, in accordance with paragraph 6 of this by-law causesuffer or permit any dog under that person’s control, charge orauthority to be, or remain in that place.

3. Dogs on leash areas

No person shall on any Council land to which this paragraphapplies, in accordance with paragraph 6 of this by-law, cause,suffer or permit any dog under that person’s control, charge orauthority to be or remain in that public place unless such dog isrestrained by a strong leash not exceeding 2 m in length and eithertethered securely to a fixed object or held by a person capable ofcontrolling the dog and preventing it from being a nuisance or adanger to other persons.

4. Dog exercise areas

4.1 Any person may enter upon any part of Council land towhich this paragraph applies in accordance withparagraph 6 of this by-law, for the purpose of exercisinga dog under his or her control;

4.2 Where a person enters upon such part of Council land forthat purpose, he or she shall ensure that the dog or dogsunder his or her control remain under effective control(within the meaning of the Dog and Cat Management Act1995) while on the land;

4.3 Signs shall be erected to denote the land to which thisparagraph applies, and information shall be provided tothe public in a manner determined by the Council’s ChiefExecutive Officer to inform the public about such land.

5. Limit on dog numbers

5.1 The limit on the number of dogs on any premises shall betwo.

5.2 No person shall, without obtaining the writtenpermission of the Council, keep any dog on any premiseswhere the number of dogs on those premises exceeds thelimit unless the premises are an approved kennelestablishment.


5.3 Any person who, according to the Council’s dogregistration records, keeps more than two dogs on anypremises, as at the date this by-law comes into operation,will be entitled to continue keeping that number of dogsprovided that there is no contravention of the Act or anyother legislation.

6. Application of paragraphs

Any of paragraphs 2, 3 and subparagraph 4.1 of this by-lawshall apply only in such portion or portions of Council land as theCouncil may by resolution direct in accordance with Section246 (3) (e) of the Local Government Act 1999.

7. Construction

This by-law is subject to any Act of Parliament and Regulationsmade thereunder.

The foregoing by-law was duly made and passed at a meeting ofthe City of Campbelltown held on 2 December 2002 by anabsolute majority of the members for the time being constitutingthe Council, there being at least two-thirds of the memberspresent.
