AQUACULTURE REGULATIONS 2016 Approval for use of Chemical Substances

Pursuant to regulation 10(1)(b) of the Aquaculture Regulations 2016, I, Sean Sloan, Executive Director, Fisheries and Aquaculture as delegate of the Minister for Primary Industries and Regional Development, hereby approve the use of veterinary chemical products or substances by the holder of aquaculture licences for therapeutic or prophylactic purposes that are the subject of a current Minor Use Permit issued by the Australian Pesticides and Veterinary Medicines Authority (Commonwealth APVMA), being a permit within the meaning of the Agricultural and Veterinary Products (Control of Use) Act 2002. The use of veterinary chemical products or substances under this Ministerial approval must be consistent with the conditions on the relevant Minor Use Permit issued by APVMA. This approval is valid until revoked. Dated: 28 January 2019

Preamble 1 By notice in the Gazette (Gazette 24.2.1994 p525) the Governor authorised (among other

matters) any Minister to enter into any contract or deed on behalf of the Crown in respect of any matter within the Minister's portfolio.

2 It is now intended that in addition to the authority conferred by that notice on Ministers, the Treasurer be conferred an additional authorisation to enter into contracts or deeds on behalf of the Crown in respect of across government contractual arrangements that facilitate the procurement of goods and services by agencies or instrumentalities of the Crown for their activities or operations, and an authorisation to authorise a public servant or other person to enter into such contracts or deeds.

1—Short title This notice may be cited as the Authorisation (Treasurer to Enter into Contracts and Deeds on Behalf of Crown) Notice 2019.

2—Commencement This notice comes into operation on the day on which it is made.

3—Authorisation of Treasurer (1) The Treasurer has, in the Treasurer's personal capacity, authority to enter into any contract

or deed on behalf of the Crown in respect of across government contractual arrangements that facilitate the procurement of goods and services by agencies or instrumentalities of the Crown for their activities or operations.

(2) The Treasurer may, to the extent that the Treasurer has authority under this notice to enter into a contract or deed on behalf of the Crown, authorise a public servant or other person to enter into such a contract or deed, and any such authorisation may be given to a specified person, or persons of a specified class, and either generally or in a specific case or class of case.

(3) Nothing in this notice has the effect of limiting the ostensible authority of the Treasurer, or any person or body to enter into a contract or deed on behalf of the Crown.

(4) Nothing in this notice—

(a) affects or limits any right, obligation or limitation conferred or imposed by statute; or

(b) varies an obligation or duty imposed by the Treasurer's Instructions.

DEVELOPMENT ACT 1993 SECTION 46(4)

Port Stanvac Desalination Plant Revocation Preamble

1. Subsection (4) of section 46 of the Development Act 1993 provides that the Minister may, by notice in the Gazette, revoke a declaration previously made under subsection (1) of that section.

2. I have decided to revoke the following declaration made under section 46 of the Development Act 1993. Notice PURSUANT to subsection (4) of section 46 of the Development Act 1993, I revoke the following declaration under section 46 of the Development Act 1993:

i. The declaration as published in the Gazette on 17 April 2008 on page 1307, relating to application for development of: a) a Desalination Plant at Port Stanvac and all activities and works associated with its construction and operation. b) all activities and works associated with connection and installation of the marine intake and outfall pipelines, excluding

DEVELOPMENT ACT 1993 SECTION 48

Decision by the Delegate of the Minister for Planning Preamble

1. On 27 January 2017, notice of the Governor’s decision to grant a development authorisation under section 48 of the Development Act 1993, in respect of a proposal to establish and operate a tourist resort consisting of a 4 star hotel, 10 lodges, 20 cabins and 20 cottages, along with restaurants, bars, conference facilities and resort suites (the American River Resort) at Thomas Road, American River by City and Central Consulting Pty Ltd, was published in the South Australian Government Gazette at p 194.

2. Simultaneously, the Governor delegated his power to grant a variation to the American River Resort development authorisation to the Minister for Planning pursuant to section 48 (8) of the Development Act 1993.

3. By letter dated 9 December 2018, City and Central Consulting Pty Ltd, the beneficiary of the development authorisation, sought a variation to the authorisation for a 12 month extension of the time to the date by which ‘substantial commencement’ must occur and a 2 year extension of the time to the date by which ‘substantial completion’ must occur.

4. I am satisfied that the Development Report and Assessment Report prepared in relation to the proposed Major Development are appropriate and have had regard, when considering the proposed Major Development, to all relevant matters under Section 48 (5).

5. For ease of reference the conditions attached to the American River Resort development authorisation are republished in full hereunder.

Decision PURSUANT to Section 48 (7) (b) (ii) of the Development Act 1993; and having due regard to the matters set out in Section 48 (5) and all other relevant matters; and exercising the power of the Governor delegated by notice in the South Australian Government Gazette dated 27 January 2017 pursuant to section 48 (8),I:

(a) grant development authorisation in relation to the proposed Major Development under Section 48 (2) (b) (i), subject to the conditions set out below

(b) specify under Section 48 (7) (b) (i) all matters which are the subject of conditions herein as matters in respect of which the conditions of this authorisation may be varied or revoked, or new conditions attached, and

(c) specify for the purposes of Section 48 (11) (b) the period of 12 months from the date of this development authorisation as the time within which substantial work must be commenced on site, failing which I may cancel this authorisation under Section 48 (11).

CONDITIONS OF DEVELOPMENT AUTHORISATION General

1. The proponent shall carry out the development generally in accordance with:

2. For the purposes of Section 48 (11) (b) of the Development Act 1993, the proponent shall commence the development by substantial work on the site of the development within 12 months of the date of this authorisation, failing which the authorisation may be cancelled.

3. The proponent shall have completed the development within five years of the date of this authorisation, failing which the authorisation may be cancelled.

4. Should the project cease during the period between the commencement of earthworks and final completion the proponent will undertake all necessary steps to reinstate the land and make good.

5. That except where minor amendments may be required by other relevant Acts, or by conditions imposed by this application, the proposed Major Development for the American River Tourist Resort and associated infrastructure must be carried out in accordance with the details and following plans submitted:

Prior to the Commencement of Construction Works The following information shall be submitted for further assessment and approval by the Minister for Planning, prior to the commencement of construction works at each individual stage:

1. Building Rules compliance, following assessment and certification by a private certifier, the Kangaroo Island Council or by a person determined by the Minister for Planning, as complying with the provisions of the Building Rules (or the Building Rules as modified according to criteria prescribed by the Development Regulations 2008). For the purposes of this condition ‘building work’ does not include plant and equipment or temporary buildings that are not permanently attached to the land (refer to relevant Advisory Notes below).

2. Final detailed plans for all structures on site and of each component of the development (including site plans, floor plans, elevations, cross-sections, rendered perspectives and other relevant specifications) and car parking configuration.

3. Design development in consultation with the Associate Government Architect to provide further design details including: (a) site plan that overlays areas of environmental sensitivity to illustrate the hierarchy and strategy for the site arrangement (b) a master plan for service infrastructure provision and sustainability be developed which includes water supply and security

and energy production (c) further consideration of the proximity of the car parks and service road to the site boundary and the guest experience when

arriving by car (d) each of the building elements (courtyard hotel, each of the ten lodges, cottages and cabins) including resolution of access and

arrival experiences, servicing, fire egress, facade treatments and prefabricated construction methodologies (e) the use of high quality external materials suitable for the marine environment supported by the provision of a detailed

materials schedule and samples board (f) design development of Back of House functions and demonstration of operational management strategies for the site (g) design development of internal planning of the courtyard hotel, demonstrating outlook and provision of light and ventilation

for guests and staff, and (h) provision of visualisations of the developed design within the site context, including long views from key vantage points in

the township be provided. 4. In consultation with Kangaroo Island Council, and to the satisfaction of the Country Fire Service, a detailed Landscaping Plan and

schedule for the site in accordance with the Minister’s Code (2009) ‘Undertaking development in Bushfire Protection Areas’. Such a plan shall include details of an Asset Protection Zone, to be established and maintained, and include a vegetation management zone (VMZ) which shall be established and maintained within 20 metres of each of the buildings or to the property boundaries (whichever comes first, if relevant) as follows: (a) the number of trees and understorey plants to be established within the VMZ shall be maintained such that when considered

overall a maximum coverage of 30% is attained, and so that the leaf area of shrubs is not continuous. Careful selection of the vegetation will permit the ‘clumping’ of shrubs where desirable for diversity and privacy and yet achieve the ‘overall maximum coverage of 30%’.

(b) additional trees and shrubs shall not be planted closer to the building(s) than the distance equivalent to their mature height. The selection of appropriate fire resistant species of trees and shrubs shall determine the composition of additional plantings

(c) trees and shrubs must not overhang the roofline of the building, touch walls, windows or other elements of the building (d) no understorey vegetation shall be established within 2m of the dwelling (e) no understorey vegetation shall be established under the existing copse of trees (f) (understorey is defined as plants and bushes up to 2m in height) (g) grasses within the zone shall be reduced to a maximum height of 10cm during the fire danger season, and (h) the VMZ shall be maintained to prevent the accumulation of dead vegetation during the fire danger season.

5. Details of Class 1 buildings compliance with the National Construction Code and include any bushfire provisions contained in AS3959-2009 ‘Construction of Buildings in Bushfire Prone Areas’, Minister’s Code (2009) ‘Undertaking development in Bushfire Protection Areas’ and Minister’s Specification SA 78, in consultation with the Country Fire Service.

6. Details of Class 2-9 buildings compliance with the National Construction Code and include all Deemed to Satisfy life and safety provisions in consultation with the Country Fire Service.

7. In consultation with, and to the satisfaction of, the Country Fire Service, a Fire and Emergency Management Plan that outlines the proposed fire and emergency management procedures for the development.

8. In consultation with, and to the satisfaction of, the Country Fire Service details of management, training and funding of an employee based firefighting program to install and maintain the fire and life safety provision to AS1851.

9. In consultation with the Country Fire Service, details of passive fire systems including: (a) detailed engineering and structural designs in regards to fire safety engineering or hydraulic engineering provisions (b) details on the onsite access tracks and suitability for CFS and other emergency vehicle to approach and access to each

building (c) details on ‘Last Resort Refuge’ building and the ‘Bushfire Survival Plan’ (d) details on building materials being used and their suitability, and (e) details on construction method and construction methodology in regards to fire and other emergency incident management.

10. In consultation with, and to the satisfaction of, the Country Fire Service detailed design and layout plans for: (a) fire water and hydraulic provisions or community upgrades to ensure a suitable, reliable and accessible water supply for fire

purposes to meet the provisions of AS2419 (b) suitable communication networks to meet the provisions of AS1670 (c) additional truck turnaround points on the main road inside the development area (d) truck turnaround points suitable for an 8 metre long fire truck (Buildings 2, 6, 10) (e) fire tank siting and use (f) fire pump(s) locations (g) Fire Indicator Panel or Fire Control Room location for CFS staging (h) hydrant and hydrant line location (i) track or path widths required to be greater than 6 metres for tracks (two trucks to be able to pass) and 10 metres for paths

(two trucks to pass while one truck is working) (j) buildings are to be located within 50 metres of a fire appliance hard standing area (k) evacuation assembly points, and (l) additional path from the main ring road to the main north east car park area for additional escape route.

11. In consultation with the Environment Protection Authority a detailed noise impact assessment for the operation of the development, prepared by a suitably qualified consultant, which demonstrates compliance with the Environment Protection (Noise) Policy 2007.

12. In consultation with the Environment Protection Authority and Kangaroo Island Council a detailed Stormwater Management Plan which incorporates as part of the final stormwater treatment design a ‘Model for Urban Stormwater Improvement Conceptualisation’ (MUSIC).

13. In consultation with the Environment Protection Authority and Kangaroo Island Council a Construction Environmental Management and Monitoring Plan (CEMMP), developed in accordance with the EPA guideline ‘Construction Environmental Management Plans’ 2016—see: http://www.epa.sa.gov.au/business_and_industry/environmental_planning/position-statements-and-guidelines The CEMMP must incorporate measures to address (but not be limited to) the following matters: (a) traffic management for the duration of demolition and construction (b) construction and works noise management to ensure compliance with the Environment Protection (Noise) Policy 2007 (c) management of air quality (including odour and dust) (d) sequencing of development (including construction timelines for works on site, as well as periods and hours of construction) (e) occupational health and safety matters (f) bio-security and wash down procedures to minimise the transfer of pests and pathogens during the construction process (g) soils (including fill importation), stockpile management and prevention of soil contamination (such as from chemical use and

storage, pest plants and pathogens) (h) stormwater management, prior to implementation of a permanent solution (i) groundwater (including prevention of groundwater contamination) (j) site contamination and remediation (where required) (k) waste management for all waste streams and overall site clean-up (l) use and storage of chemicals, oil, construction-related hazardous substances and other materials that have the potential to

contaminate the environment (including proposed emergency responses), and (m) site security, fencing and safety (including the management of public access and local traffic).

14. In consultation with the Department of Environment, Water and Natural Resources a Native Vegetation Management, Rehabilitation and Revegetation Plan. The plan also should include details on how weeds and pests are to be managed following commencement of operations and during operation.

During Construction Works and Prior to Operation of the Development 15. All works shall be undertaken in accordance with the approved plans, drawings, specifications and other documentation provided

(and approved by the Minister for Planning where required) in accordance with conditions 1 to 14 listed above. 16. Fire water tanks are to be constructed and filled as the first element of works undertaken on site and to the standards outlined in the

Fire Service Policy 14 Version 1.0 dated June 2016. 17. Reticulated water supply to the site, to the satisfaction of SA Water and the Country Fire Service, shall be provided to the site

following the completion of identified stage 1 works (115 room 4 star hotel, 2 lodges (seven storeys, wine bar and activities lodges), 11 cabins – associated car parking, service and loading areas, internal roads and paths.

18. That the landscaping shown on the approved plans as required by Condition 4 shall be substantially established prior to the operation of each stage of the development and shall be maintained and nurtured at all times with any diseased or dying plants being replaced.

19. That all external lighting of the site, including car parking areas and buildings, shall be designed and constructed to conform with Australian Standards and must be located, directed and shielded and of such limited intensity that no unreasonable nuisance or loss of amenity is caused to any person beyond the site.

20. Pedestrian walkways on the subject land shall be adequately lit in accordance with Australian Standard and recognised engineering best practice to ensure safe and convenience movement. Walkways and lighting shall be maintained at all times to the reasonable satisfaction of the Minister for Planning.

21. That all vehicle car parks, driveways and vehicle entry and manoeuvring areas shall be designed and constructed in accordance with the relevant Australian Standards and be constructed, drained and paved with bitumen, concrete or paving bricks (or other such material as agreed to by the Minister for Planning), in accordance with sound engineering practice and appropriately line marked.

22. All loading and unloading, parking and manoeuvring areas shall be designed and constructed to ensure that all vehicles can safely traffic the site and enter and exit the subject land in a forward direction.

23. That all stormwater design and construction shall be in accordance with Australian Standards and recognised engineering best practice to ensure that stormwater does not adversely affect any adjoining property or public road.

24. That all Council, utility or state-agency maintained infrastructure (i.e. roads, kerbs, drains, crossovers, footpaths etc.) that is demolished, altered, removed or damaged during the construction of the development shall be reinstated to Council, utility or state agency specifications. All costs associated with these works shall be met by the proponent.

25. Recycled water (wastewater, grey water and stormwater) must be stored separately from the main water supply storage. 26. All liquids that have the ability to cause environmental harm must be stored within a bunded compound that has a capacity of at

least 120% of the volume of the largest container, in accordance with the Environment Protection Authority ‘Bunding and Spill Management Guidelines’ (2007).

27. In consultation with the Environment Protection Authority, the Country Fire Service and Kangaroo Island Council, an Operational Environmental Management and Monitoring Plan (OEMMP) be prepared by the applicant. The OEMMP must incorporate measures to address (but not be limited to) the following matters: (a) general operational noise management (such as from machinery noise), to ensure compliance with the Environment

Protection (Noise) Policy 2007 (b) a Waste Management strategy detailing the collection, storage and disposal of waste (for all waste streams) to comply with

(d) traffic management associated with the preparation of events (e) noise from live and/or recorded music and public address systems for events (f) a Native Vegetation Management, Rehabilitation and Revegetation Plan detailing the management and maintenance of native

flora and fauna, rehabilitation and revegetation of the site (g) a Weed and Pest Management Strategy detailing how weeds and pests are to be managed post construction (h) fire and emergency management and evacuation procedures (including a Fire and Emergency Management Plan prepared in

consultation with the Country Fire Service) (i) ongoing sustainability initiatives (including power, water, flora and fauna management) and details of proposed methods for

ongoing monitoring and reporting, and (j) implementation of the stormwater management plan.

During Operation of the Development 28. Operations on the site shall be undertaken in accordance with all plans and details submitted as part of the Major Development

Application, and where provided (and endorsed by the Minister for Planning where required) in accordance with conditions 15-27 as listed above.

29. That the development and the site shall be maintained in a serviceable condition and operated in an orderly and tidy manner at all times. Advisory Notes

1. Pursuant to Development Regulation 64, the applicant is advised that the Kangaroo Island Council or private certifier conducting a Building Rules assessment must: (a) provide to the Minister a certification in the form set out in Schedule 12A of the Development Regulations 2008 in relation to

the building works in question, and (b) to the extent that may be relevant and appropriate—

(i) issue a Schedule of Essential Safety Provisions under Division 4 of Part 12 (ii) assign a classification of the building under these regulations, and (iii) ensure that the appropriate levy has been paid under the Construction Industry Training Fund Act 1993. Regulation 64 of the Development Regulations 2008 provides further information about the type and quantity of all Building

Rules certification documentation for Major Developments required for referral to the Minister for Planning. 2. The Kangaroo Island Council or private certifier undertaking Building Rules assessments must ensure that the assessment and

certification are consistent with this provisional development authorisation (including any Conditions or Advisory Notes that apply in relation to this provisional development authorisation).

3. Should the applicant wish to vary the Major Development or any of the components of the Major Development, an application may be submitted, provided that the development application variation remains within the ambit of the Development Report and Assessment Report referred to in this provisional development authorisation. If an application variation involves substantial changes to the proposal, pursuant to Section 47 of the Development Act 1993, the applicant may be required to prepare an amended Development Report for public inspection and purchase. An amended Assessment Report may also be required to assess any new issues not covered by the original Assessment Report and a decision made by the Governor pursuant to Section 48 of the Development Act 1993.

4. The applicant's Construction Environmental Management and Monitoring Plan and other plans should be prepared taking into consideration (and with explicit reference to) relevant Environmental Protection Authority policies and guideline documents, including, but not limited to: (a) the Environment Protection (Air Quality) Policy 1994 (b) the Environment Protection (Noise) Policy 2007 (c) the Environment Protection (Water Quality) Policy 2015 (d) the Environment Protection (National Pollutant Inventory) Policy 2008 (e) the Standard for the Production and Use of Waste Derived Fill (if applicable) (2013) (f) the Bunding and Spill Management Guidelines (2012) (g) the Stormwater Pollution Prevention Code of Practice for the Building and Construction Industry (1999) (h) Handbooks for Pollution Avoidance, and (i) any other legislative requirements, Guidelines and Australian Standards requiring compliance.

5. All works and activities must be undertaken in accordance with the General Environmental Duty as defined in Part 4, Section 25 (1) of the Environment Protection Act 1993 (which requires that a person must not undertake any activity, which pollutes, or may pollute; without taking all reasonable and practical measures to prevent or minimise harm to the environment), relevant Environment Protection Policies made under Part 5 of the Environment Protection Act 1993 and other relevant publications and guidelines.

6. The applicant is reminded of its obligations under the Aboriginal Heritage Act 1988, whereby any ‘clearance’ work that may require permission to disturb, damage or destroy Aboriginal Sites, must be undertaken with the full authorisation of the Minister for Aboriginal Affairs and Reconciliation, according to Section 23 of the Act.

7. The applicant is reminded of its obligations under the Native Vegetation Regulations 2003 whereby any native vegetation clearance must be undertaken in accordance with a management plan that has been approved by the Native Vegetation Council that results in a significant environmental benefit on the property where the development is being undertaken, or a payment is made into the Native Vegetation Fund of an amount considered by the Native Vegetation Council to be sufficient to achieve a significant environmental benefit in the manner contemplated by Section 21 (6) of the Native Vegetation Act 1991, prior to any clearance occurring.

The applicant, and all agents, employees and contractors, such as construction crews, must be conversant with the provisions of the Aboriginal Heritage Act 1988, particularly the requirement to immediately contact the Department of Aboriginal Affairs and Reconciliation in the event that archaeological items (especially skeletal material) are uncovered during earthmoving.

Condition of Approval I, Jeffrey Todd, Delegate of the Environment Protection Authority pursuant to Section 69(6) of the Environment Protection Act 1993 (SA) (the Act) hereby:

Impose the following condition of approval, on Statewide Recycling, carrying on business as a super collector with the approval of the Environment Protection Authority pursuant to the approval under the Act and notified in the South Australian Gazette 11 December 2008:

1. If a dispute or claim arises in respect of any agreement between the Super Collector and a collection depot relating to the collection of containers that bear an approved refund marking under the Act, including but not limited to audits, payments and fees for, and handling of such containers, the following procedure applies.

2. Written notice of a dispute or claim (notice of dispute) may be served by a party alleging a dispute or claim upon any other party to the alleged dispute or claim and it must be identified as a notice of dispute pursuant to this condition.

3. If in receipt of a notice of dispute, the Super Collector must, within 14 days of receipt, serve on the other party, written acknowledgement of the notice of the dispute.

4. If not resolved in 28 days of receipt of the notice of dispute by executive negotiation, the Super Collector will if requested by the Collection depot, agree to such dispute being the subject of a conciliation administered by a conciliator appointed at the request of either party by the Resolution Institute (“RI”) conducted and held in accordance with the Conciliation Rules of the RI in force from time to time.

5. If the collection depot accepts an offer of conciliation by the Super Collector in respect of a dispute and such dispute is not resolved within 28 days after the appointment of the conciliator, the Super Collector will if requested by the collection depot agree to such dispute being submitted to arbitration administered by the RI conducted and held in accordance with the Arbitration Rules of the RI in force from time to time.

6. Any conciliation or arbitration meetings and proceedings required to be conducted pursuant to either clause 4 or 5 will be held in Adelaide and responsibility of all costs and expenses of and incidental to such meetings will be determined by the conciliator or arbitrator as the case may be.

7. The Super Collector and the collection depot may agree in writing, at any time, that a contrary agreement in writing applies to the dispute or claim between them, including without limitation to the resolution of that dispute or claim, to the effect that the procedure herein does not apply to that dispute or claim.

In this notice: Act means the Environment Protection Act 1993 (SA); Collection depot means a person operating a collection depot with the approval of the Environment Protection Authority pursuant to an approval under section 69(1) of the Act; Super Collector means Statewide Recycling and is the person carrying on business as a super collector with the approval of the Environment Protection Authority pursuant to the approval under section 69(1) of the Act and notified in in the South Australian Government Gazette 11 December 2008 and as varied by this notice.

1. Application All previous notices made pursuant to Sections 4, 5, 7, 8 and 59 of the Plant Health Act 2009 are hereby revoked.

2. Interpretation In this notice:

• “the Act” means the Plant Health Act 2009 • “fruit fly outbreak suspension area” means an area that has been declared, in accordance with the Code of Practice for

Queensland fruit fly published by the Interstate Plant Health Regulation Working Group, 1996, or in accordance with the Draft National Code of Practice for the Management of Mediterranean Fruit Fly, 2008 (as updated or amended from time to time), as a suspension area in relation to a fruit fly outbreak

• “inspector” means an inspector appointed pursuant to section 41 of the Act • “retail purchase docket” means a sales receipt provided by a retail sales outlet for fruit or fruiting vegetables sold to the public

for personal consumption, rather than for re-sale • “soil” means the upper, outermost layer of soil, usually the top 20 centimetres consisting of rock and mineral particulates that

may be mixed with organic matter and in which plants grow or are grown • “the Standard” means the document published by Primary Industries and Regions South Australia entitled the “Plant

5.3 Sub-paragraph 5.2 does not apply in relation to any item for which importation or introduction is prohibited under sub-paragraph 5.1.

6. Quarantine Areas – Pursuant to Section 8 of the Act 6.1 The following portions of the State are declared to be quarantine areas:

(1) in respect of the pest fruit flies, any area within 1.5 kilometres radius of the centre of a fruit fly outbreak (as described in the Standard), the centre being the point where eggs, larvae or adults of fruit flies have been detected.

(2) in respect of the pest fruit flies, for the purpose of excluding fruit flies from the Riverland of South Australia (i) the County of Hamley, and

(ii) the Hundreds of Bookpurnong, Cadell, Gordon, Holder, Katarapko, Loveday, Markaranka, Moorook, Murtho, Parcoola, Paringa, Pooginook, Pyap, Stuart, Waikerie, Eba, Fisher, Forster, Hay, Murkbo, Nildottie, Paisley, Ridley, and Skurray.

(3) the whole of Kangaroo Island with respect to the declared diseases of potato, namely bacterial wilt (Ralstonia solanacearum Race 3) and potato cyst nematodes (Globodera rostochinesis and Globodera pallida). This quarantine area is to be known as the ‘Kangaroo Island Protected Production Area’.

6.2 Measures to be taken in Quarantine Areas (1) The owner of any commercial premises within a portion of the State declared to be a quarantine area in respect of the pest

Onion Smut must take the measures prescribed in the Standard for eradication of that disease. (2) The owner of any commercial premises within a portion of the State declared to be a quarantine area in respect of the pest

fruit flies must take the measures prescribed in the Standard for the eradication of such flies. (3) The owner of any commercial premises within the ‘Kangaroo Island Protected Production Area’ established under sub-

paragraph 6.1(3) must take the measures prescribed in the Standard for eradication of the declared diseases of potato. 6.3 Measures for the exclusion of fruit flies from the Riverland of South Australia (“the Riverland Fruit Fly Quarantine Areas”):

(1) Host fruits of fruit flies (“host fruits”) as defined in paragraph 5.2 (1) are prohibited and must not be imported or introduced into the quarantine areas declared in paragraph 6.1 (2) (“the Riverland Fruit Fly Quarantine Areas”) unless: (i) if the host fruit was produced in a State or Territory other than South Australia: the host fruit complies with the

provisions of the Standard. (ii) if the host fruit was produced in any part of South Australia outside the Riverland Fruit Fly Quarantine Areas: the host

fruit has been certified by an inspector under the Act as having been either: • grown in an area free of fruit flies as defined by the Standard; or • treated against fruit flies by a method set out in the Standard.

(iii) if the host fruit was originally produced in the Riverland Fruit Fly Quarantine Areas, but has moved outside those areas and is now proposed to be re-introduced into those areas, the produce must either be:

• be certified by an inspector that it has been maintained in an area free of fruit flies or treated against fruit flies by a method set out in the Standard; or

• moved under an accreditation arrangement as approved by the Minister under Part 4 Division 2 of the Act and regulation 7 of the Plant Health Regulations 2009.

(2) Subparagraph (1) (ii) does not apply to host fruit grown for the purpose of sale if that fruit was grown within a fruit fly outbreak suspension area.

(3) Subparagraph (1) does not apply to host fruits that have been purchased within South Australia and are accompanied by an itemised retail purchase docket applicable to that produce.

7. Incorporation of Codes and Standards - Pursuant to Section 59 of the Act 7.1 The Plant Quarantine Standard South Australia (the Standard) as in force from time to time is hereby adopted under Section 59

of the Act and provides the basis on which declared pests under 3.1 of this notice are specified, and items listed under 5.2 of this notice may be imported into the State. In addition to being available under Section 59 (2)(a) of the Act, the Standard will be available from the PIRSA website http://pir.sa.gov.au or by phoning Biosecurity SA – Plant Health on (08) 8207 7820.

7.2 The Plant Health - Plague Locust Control Plan as maintained as part of Primary Industries and Regions South Australia’s Emergency Management Documents as in force from time to time is hereby adopted under Section 59 of the Act.

5—Variation of regulation 16—Fees payable to Registrar-General Regulation 16(2) to (4)—delete subregulations (2) to (4) (inclusive) and substitute:

(2) If the Registrar-General determines, not more than 5 years after payment of a registration fee in respect of a transfer, that the capital value of the transferred land at the time of the transfer was higher than the purported capital value used as the basis for calculating the fee, the following amounts are recoverable as a debt by the Registrar-General:

(a) an amount equal to the difference between the registration fee paid and the registration fee that would have been payable if the fee had been determined on the basis of the capital value determined by the Registrar-General;

(b) interest on the amount underpaid calculated on a daily basis from the date of lodgment of the transfer until the date on which the payment is made at the market rate applying from time to time under Part 5 Division 1 of the Taxation Administration Act 1996.

(3) If the Registrar-General determines, not more than 5 years after payment of a registration fee in respect of a transfer, that the capital value of the transferred land at the time of the transfer was lower than the purported capital value used as the basis for calculating the fee, the Registrar-General must—

(a) refund the difference between the registration fee paid and the registration fee that would have been payable if the fee had been determined on the basis of the capital value determined by the Registrar-General; and

(b) if the Registrar-General's determination is made as a result of an objection under section 82 of the Taxation Administration Act 1996 or an appeal under section 92 of that Act—pay interest calculated on a daily basis from the date of lodgment of the transfer for registration until the date on which the difference is refunded at the market rate applying from time to time under Part 5 Division 1 of that Act.

(4) The Registrar-General may, for the purposes of making a determination under this regulation, have regard to the capital value of land as determined by the Valuer-General or any other relevant information.

6—Variation of Schedule 1—Fees payable to Registrar-General Schedule 1, item 2—delete the item and substitute:

Part 1—Preliminary 1—Short title

These regulations may be cited as the Tobacco and E-Cigarette Products Regulations 2019.

2—Commencement These regulations will come into operation on 31 March 2019.

3—Interpretation (1) In these regulations, unless the contrary intention appears—

Act means the Tobacco and E-Cigarette Products Act 1997;

business name, in relation to a business, means the business name registered for the business on the Business Names Register under the Business Names Registration Act 2011 of the Commonwealth;

capsule cigarette means a cigarette that contains a capsule designed to release flavour into the cigarette;

company name, in relation to a business that is a company, means the company name registered in relation to the business under the Corporations Act 2001 of the Commonwealth;

fruit or confectionary flavoured cigarette means a cigarette—

(a) that possesses, or the smoke of which possesses, a distinctive fruity, sweet or confectionary-like character; and

(b) that is advertised in a way that might encourage young people to smoke,

but does not include a cigarette the flavouring of which is primarily of a menthol character;

outdoor dining area means an unenclosed public area in which tables, or tables and chairs, are permanently or temporarily provided for the purpose of public dining in the area, but does not include a part of the unenclosed public area that is separated from the part in which dining occurs by a wall or other solid barrier of not less than 2 m in height;

packet includes a tin or other container;

product line, in relation to a tobacco product or an e-cigarette product, means a particular retail line of the product, distinguishable from similar products by 1 or more of the following characteristics:

(a) the brand name, trade mark or other description of the product;

(b) the flavour of the product;

(c) in the case of a packet of cigarettes, cigars or cigarillos—the number or size of cigarettes, cigars or cigarillos in the packet;

(d) in the case of cigarette or pipe tobacco—the weight of the packet in which the tobacco is sold;

registered trade mark, in relation to a business, means the trade mark registered for the business under the Trade Marks Act 1995 of the Commonwealth;

road means an area that is open to or used by the public and is developed for, or has as one of its main uses, the driving or riding of motor vehicles, and includes—

(a) the carriageway of the road; and

(b) the footpaths (if any) of the road; and

(c) a median strip, traffic island or other land separating carriageways of the road; and

(d) any other land adjoining or adjacent to the carriageway of the road that is land that has been reserved for the purposes of the road.

(2) For the purposes of these regulations—

(a) a reference to a tobacco product includes a reference to a part of a tobacco product; and

(b) text appearing on a sign, price board or price ticket will be taken to be in a standardised font if it is of a single style and size (whether or not handwritten).

Part 2—Restrictions on supply or promotion of tobacco products and e-cigarette products

Division 1—Sale or supply of tobacco products or e-cigarette products to children

4—Sale or supply of tobacco products or e-cigarette products to children (1) For the purposes of section 38A(2) of the Act, the following kinds of evidence of age are

prescribed:

(a) a current photographic driver's licence issued under the Motor Vehicles Act 1959 or under a corresponding law of another State or a Territory;

(b) a current photographic Proof of Age card issued by the Registrar of Motor Vehicles or by a corresponding public authority of the Commonwealth or another State or a Territory;

(c) a current passport issued by the Commonwealth or under the law of another country, bearing a photograph of the person and enabling the age of the person to be determined;

(d) a current photographic Keypass identification card issued by—

(i) if the card was issued before 23 November 2013—Alfa Omega Nominees Pty Ltd, trading as Commonwealth Key and Property Register; or

(ii) if the card was issued on or after 23 November 2013—Australian Postal Corporation.

(2) For the purposes of section 38A(5) of the Act, the form of the notice set out in Schedule 1 is prescribed, subject to the following requirements:

(a) the notice must be A4 size;

(b) the dimensions of the letters, figures and symbols on the notice must be no smaller than they appear in the form in Schedule 1 (as if the form were A4 size);

(c) the following parts of the notice must be printed in red:

(i) the words "18 years of age" and "proof of age";

(ii) the circle and diagonal of the "under 18" symbol;

(iii) the lines under the following headings:

(A) SALE OF TOBACCO PRODUCTS AND E-CIGARETTE PRODUCTS;

(B) MAXIMUM PENALTY $40 000.

Division 2—Certain advertising prohibited

5—Preliminary Section 40 of the Act prohibits certain advertising in relation to tobacco products and e-cigarette products, however, this Division sets out, for the purposes of section 40(3) of the Act, specific circumstances in which the prohibition will not apply.

6—Permitted signs outside premises (1) For the purposes of section 40(3)(a) of the Act, signs outside premises of a business where

tobacco products or e-cigarette products are sold by retail will only be displayed in accordance with the regulations if—

(a) the signs comprise 1 or both of the following:

(i) a sign or signs displaying—

(A) the business name or company name of the business; or

(B) the registered trade mark of the business (whether or not together with the business name or company name); and

(ii) either—

(A) a single sign outside the premises with only the words, in black text no larger than 40 mm high on a white background—

• tobacco products sold here; or

• cigarette cartons sold here; or

• cigarettes sold here; or

• e-cigarette products sold here; or

• e-cigarettes sold here; or

• tobacco products and e-cigarette products sold here; or

(B) no more than 1 such sign on each external wall of the premises that is visible to the public (or a window in such a wall); and

(b) each such sign is erected or displayed in accordance with any other Act or law relating to such signage.

(2) In this regulation—

sign includes every painted sign, mural or other sign, signboard, visual display screen, visual display image, visual display or projection device, other advertising device, lamp, globe, floodlight, banner, bunting, and streamer, including any background as well as any lettering and any advertising structure.

7—Permitted advertising (other than on or in vending machines) (1) For the purposes of section 40(3)(c) of the Act, the following action is prescribed:

(a) the display of a single sign inside premises where tobacco products or e-cigarette products are sold by retail, provided that the sign contains only, in black text no larger than 40 mm high on a white background, the words—

(i) tobacco products sold here; or

(ii) cigarette cartons sold here; or

(iii) cigarettes sold here; or

(iv) e-cigarette products sold here; or

(v) e-cigarettes sold here; or

(vi) tobacco products and e-cigarette products sold here;

(b) the advertisement of a tobacco product or e-cigarette product in or on a periodical—

(i) that is printed outside Australia; and

(ii) that is not principally intended for distribution or use in Australia; and

(iii) in relation to which there is no notice in force under section 17(2) of the Tobacco Advertising Prohibition Act 1992 of the Commonwealth;

(c) the advertisement of a tobacco product or e-cigarette product that is an accidental or incidental accompaniment to the publication of other matter;

(d) the sale or delivery of a product containing an advertisement—

(i) of a kind referred to in paragraph (b) or (c); or

(ii) of a tobacco product or e-cigarette product in or on a package containing the product (being a package in which the product is offered for sale in the ordinary course of business);

(e) the advertisement of a tobacco product or e-cigarette product consisting of, or reasonably incidental to, the display, at the request of a customer, of the product to the customer inside premises where the products are sold by retail;

(f) the advertisement of a tobacco product or e-cigarette product that is reasonably incidental to—

(i) the sale or delivery of the product;

(ii) the genuine restocking of an area in which the products are stored in accordance with the Act pending their sale;

(g) the advertisement of a tobacco product in premises where tobacco products are only sold by retail in cartons consisting of a single sign attached to or adjacent to a point of sale containing only, in black standardised font no larger than 40 mm high on a white background, the words "cartons only sold here";

(h) the advertisement of a tobacco product or an e-cigarette product on the premises of the business of a distributor or manufacturer of those products consisting of a sign or signs displaying—

(i) the business name or company name of the business; or

(ii) the registered trade mark of the business (whether or not together with the business name or company name),

(i) the advertisement of a tobacco product or e-cigarette product to a group of people all of whom are involved in the manufacture, distribution or sale of those products;

(j) the advertisement of a tobacco product or e-cigarette product on a price board in premises where such products are sold by retail, provided that—

(i) there is only a single such price board in the premises; and

(ii) the total surface area of the visible parts of the board does not exceed—

(A) if the price board is in the premises of a specialist tobacconist or specialist e-cigarette retailer—1 m²; or

(B) in any other case—0.5 m²; and

(iii) the board consists of black text on a completely white background; and

(iv) the text on the board is a standardised font not exceeding 20 mm in height; and

(v) the information on the board does not relate to—

(i) fruit or confectionary flavoured cigarettes; or

(ii) capsule cigarettes; and

(vi) the information on the board is limited to any 1 or more of the following details:

(A) the names of particular product lines;

(B) the prices of particular product lines (displayed in a way that does not indicate that a particular product line has been discounted);

(C) the country of origin of particular product lines;

(D) a bar code or similar identification code used in the point of sale system of the retailer's business;

(E) in addition, in the case of e-cigarette products—

• the volume of liquid used in such products; or

• the wattage of such products;

(F) in addition, in the case of tobacco products—the packet size of particular product lines (by weight or number of tobacco products contained in the packet or carton);

(k) the advertisement of tobacco products or e-cigarette products by price tickets relating to particular product lines in premises where such products are sold by retail, provided that—

(i) all price tickets in the premises are of an approximately equal size (but in any case not exceeding 80 mm × 40 mm); and

(ii) each price ticket consists of black text on a completely white background; and

(iii) the text on each price ticket is a standardised font not exceeding 15 mm in height; and

(iv) the price ticket does not relate to—

(v) the information on each price ticket is limited to any 1 or more of the following:

(A) the name of the product line;

(B) the price of the product line (displayed in a way that does not indicate that the product line has been discounted);

(C) the country of origin of the product line;

(D) a bar code or similar identification code used in the point of sale system of the retailer's business;

(E) any other information reasonably required for the efficient conduct of the retailer's business;

(F) in addition, in the case of e-cigarette products—

• the volume of liquid used in such products; or

• the wattage of such products;

(G) in addition, in the case of tobacco products—the packet size (by weight or by number of tobacco products contained in the packet or carton).

(2) This regulation does not apply to advertisements on or in a vending machine.

(3) For the purposes of this regulation, premises will be taken to be the premises of a specialist e-cigarette retailer if—

(a) a person sells e-cigarette products by retail in the premises in the ordinary course of business; and

(b) during—

(i) in the case of a business that has been trading for a period of more than 1 financial year—the immediately preceding financial year; or

(ii) in any other case—the period for which the business has been trading,

the gross turnover of all e-cigarette products sold at the premises constitutes 80% or more of the gross turnover of all products sold at the premises during the relevant period; and

(c) in the case where the premises are situated within another shop—

(i) the premises are separated from the other shop by means of internal walls or doors; and

(ii) a person is not able to use the premises as a thoroughfare to gain entry to the other shop from outside the premises.

(4) For the purposes of this regulation, premises will be taken to be the premises of a specialist tobacconist if—

(a) a person sells tobacco products by retail in the premises in the ordinary course of business; and

(b) during—

the gross turnover of all tobacco products sold at the premises constitutes 80% or more of the gross turnover of all products sold at the premises during the relevant period; and

(c) in the case where the premises are situated within another shop—

(i) the premises are separated from the other shop by means of internal walls or doors; and

(ii) a person is not able to use the premises as a thoroughfare to gain entry to the other shop from outside the premises.

(5) In this regulation—

periodical means an issue (however described) of a newspaper, magazine, journal, newsletter, or other similar publication, issues of which are published at regular or irregular intervals.

8—Permitted advertising of tobacco products on or in vending machines (1) For the purposes of section 40(3)(c) of the Act, an advertisement of a tobacco product

consisting of the display in accordance with this regulation of any 1 or more of the following details on or in a vending machine is prescribed:

(a) the name of the product;

(b) the price of the product;

(c) the packet size of the product (by weight or by number of products contained in the packet);

(d) the country of origin of the product.

(2) An advertisement will only be taken to be in accordance with this regulation if it complies with the following provisions:

(a) if the information referred to in subregulation (1) is displayed on price tickets—

(i) all price tickets must be of an approximately equal size (but in any case not exceeding 80 mm × 40 mm); and

(ii) each price ticket must consist of black text on a completely white background; and

(iii) the text on each price ticket must be in a standardised font not exceeding 15 mm in height;

(b) the advertisement must not be an advertisement for, or in relation to—

(i) fruit or confectionary flavoured cigarettes; or

(ii) capsule cigarettes;

(c) the number of product lines advertised in relation to a particular vending machine must not exceed 40;

(d) there must be no more than 1 price ticket in respect of a particular product line displayed in or on the vending machine;

(e) there must be no internal lighting in the vending machine;

(f) there must be no highlighting of the vending machine or a price ticket displayed in or on the vending machine in any way (for example, by the use of a sign or other device not forming part of the vending machine).

Part 3—Restrictions on smoking 9—No smoking signs in enclosed public places (1) The occupier of an enclosed public place (being a place in which smoking is banned under

section 46 of the Act) must display signs that contain—

(a) —

(i) the phrase "no smoking" or "smoking prohibited" in letters that are at least 20 mm in height; and

(ii) the smoking prohibited symbol with a diameter of at least 70 mm; or

(b) other words or symbols that indicate clearly that smoking (whether of tobacco products or e-cigarettes) is not permitted,

in such numbers and in positions of such prominence that the signs are likely to be seen by persons at any public entrance to the place and within the place. Maximum penalty: $2 500. Expiation fee: $210.

(2) A sign required to be displayed under this regulation must be displayed in such a way that a person (other than the occupier or an employee of the occupier) cannot readily remove or relocate the sign.

Part 4—Smoking bans in public areas—longer term 10—Bowden Town Square (1) For the purposes of section 52 of the Act, smoking is banned in the public area shown on the

map in Schedule 2 Part 1 as the "declared public area", being the area in Bowden comprised of Lots 40, 42, 400 and 453, but excluding the car park.

(2) In this regulation—

car park means the area shown on the map in Schedule 2 Part 1 as the "car park", being the area within Lot 42 bounded by a line commencing at the intersection of the north-eastern and south-eastern boundaries of Lot 42, then north-westerly along the north-eastern boundary of Lot 42 to its intersection with the prolongation in a north-easterly direction of the south-eastern boundary of Plant 4, then south-westerly along that boundary to the point at which that boundary (or its prolongation) intersects the south-western boundary of Lot 42, then beginning south-easterly following the boundary of Lot 42 to the point of commencement;

Lot 40 means Lot 40 Deposited Plan 113083;

Lot 42 means Lot 42 Deposited Plan 112982;

Lot 400 means Lot 400 Deposited Plan 112982;

Lot 453 means Lot 453 Deposited Plan 112982;

Plant 4 means the built structure on Lot 42 commonly known as Plant 4;

prolongation means prolongation in a straight line.

11—Henley Square (1) For the purposes of section 52 of the Act, smoking is banned in all public areas in Henley

Square.

(2) In this regulation—

Henley Square means the following areas (being the area commonly referred to as Henley Square):

(a) the whole of Allotment 101 Deposited Plan 45601 (excluding any area used as a car park by members of the public and any premises);

(b) the area bounded as follows:

(i) on the north by Allotment 101 Deposited Plan 45601;

(ii) on the east by the western boundaries of the properties adjacent to the Esplanade, Henley Beach;

(iii) on the south by a line extending generally east from the south east corner of the Henley Surf Life Saving Club;

(iv) on the west by the sea wall.

12—Moseley Square Glenelg (1) For the purposes of section 52 of the Act, smoking is banned in all public areas in Moseley

Square, Glenelg, other than an area (not being an enclosed public place, workplace or shared area) to which an Outdoor Dining Permit issued by the City of Holdfast Bay pursuant to section 200 of the Local Government Act 1999 applies. Note—

Smoking is banned in enclosed public places, workplaces or shared areas under section 46 of the Act.

(2) In this regulation—

Moseley Square, Glenelg means the area in Glenelg bounded as follows: commencing at the point at which the southern boundary of Section 1510 Hundred of Noarlunga meets the eastern boundary of the Section (the western boundary of Colley Terrace), then southerly along the prolongation in a straight line of the eastern boundary of the Section to the point at which that prolongation intersects the prolongation in a straight line of the southern boundary of Lot 100 DP 76687, then westerly and southerly along that prolongation and boundary of Lot 100 to the point at which it meets the north-eastern boundary of Piece 102 DP 76687, then generally north-westerly, northerly and north-easterly along the western boundary of Lot 100 DP 76687 to the point at which it meets the southern boundary of Lot 107 DP 71400, then in a straight line by the shortest route to the south-western corner of Lot 106 DP 71400, then easterly along the southern boundary of Lot 106 and the adjoining Lots (the northern boundary of Lot 100 DP 76687) to the point of commencement.

13—Royal Adelaide Show (1) For the purposes of section 52 of the Act, smoking is banned in the following public areas

for the period each year during which the annual Royal Adelaide Show is being held:

(a) all public areas within the Adelaide show grounds, other than—

(i) an area (not being an enclosed public place, workplace or shared area) in respect of which a licence is in force under the Liquor Licensing Act 1997; or

(ii) an area used as a car park by members of the public (other than an area designated under paragraph (b) as an area in which smoking is not permitted); or

(iii) any other area designated by the Society as an area in which smoking is permitted;

(b) any public area in the vicinity of a public entrance to the Adelaide show grounds designated by the Society as an area in which smoking is not permitted.

(2) In this regulation—

Adelaide show grounds has the same meaning as in the Adelaide Show Grounds (Regulations and By-laws) Act 1929;

Society means the Royal Agricultural and Horticultural Society of South Australia Incorporated.

14—The Parade Norwood (1) For the purposes of section 52 of the Act, smoking is banned in the following public areas of

Norwood:

(a) the public area bounded—

(i) on the north by the building line on the northern side of The Parade; and

(ii) on the south by the building line on the southern side of The Parade; and

(iii) on the east by the western edge of Portrush Road; and

(iv) on the west by the eastern edge of Osmond Terrace;

(b) the laneway adjacent to the Norwood Town Hall,

(being the area shown on the map in Schedule 2 Part 2 as the declared area).

(2) In this regulation—

building line, in relation to the Parade, means the line formed by the facades of the buildings on the relevant side of The Parade (and includes, where 2 buildings are not contiguous, a straight line running between the closest points of the facades of the buildings);

laneway adjacent to the Norwood Town Hall means the laneway forming the whole of the land comprised in Certificate of Title Volume 6037 Folio 165.

15—Outdoor dining areas (1) For the purposes of section 52 of the Act, smoking is banned in a public area consisting of

an outdoor dining area at any time that food is being offered for purchase, or otherwise provided, by or on behalf of the occupier of the outdoor dining area for the purpose of consumption in the area (whether or not a person is, in fact, dining in the area). Note—

For example, if a hotel offers meals between 12pm and 2pm in an outdoor dining area, then smoking will be banned in the area during that period, regardless of whether anyone is actually eating in the area.

(2) For the purposes of this regulation a person will be taken to be in an outdoor dining area if any part of the person is within the outdoor dining area.

(3) In this regulation—

food does not include snack food;

snack food means prepackaged food of a kind generally intended to be consumed between meals. Example—

This would include foods such as potato crisps, nuts and chocolate bars, but would not include, for example, sandwiches or hot chips.

16—Further offence where smoking occurs in outdoor dining area (1) If smoking occurs in an outdoor dining area in contravention of section 52(2) of the Act, the

occupier of the outdoor dining area is guilty of an offence. Maximum penalty: $2 500. Expiation fee: $210.

(2) It is a defence to an offence against subregulation (1) if the defendant proves that—

(a) he or she was not aware, and could not reasonably be expected to have been aware, that the contravention was occurring; or

(b) he or she requested the person smoking to stop smoking and informed the person that the person was committing an offence.

Schedule 1—Notice (regulation 4)

SALE OF TOBACCO PRODUCTS AND E-CIGARETTE PRODUCTS

It is against the law to sell or supply tobacco products or e-cigarette products to persons under 18 years of age.

Retailers may require proof of age for purchase of these products.

MAXIMUM PENALTY $40,000
