CONTROLLED SUBSTANCES ACT 1984 Prohibition of Drugs of Dependence

TAKE notice that on 29 April 2005, the Minister for Health issued an order pursuant to section 57 (1) of the Controlled Substances Act 1984 in respect of James George Cacas, Shop 33, 141 Rundle Mall, Adelaide, S.A. 5000, prohibiting him from supplying any substances of the following class: • A drug of dependence as declared by regulation 7A of the

Controlled Substances (Poisons) Regulations 1996, pursuant to section 12 (3) of the Controlled Substances Act 1984, namely any poison listed in Schedule 8 to the Standard for the Uniform Scheduling of Drugs and Poisons, No. 19, published by the National Drugs and Poisons Schedule Committee,

when such substance is supplied to any person who is dependent on a drug of dependence, including when such substance is sought to be supplied to a person in accordance with section 32 (2) of the Controlled Substances Act 1984 in connection with an Authority granted to a medical practitioner by the Minister for Health under

section 33 (1) (b) of the Controlled Substances Act 1984, that is, when the supply of a drug of dependence is sought for the purpose of maintaining or treating a person’s drug dependence. This Order takes effect on 16 May 2005 and remains in force until revoked by the Minister for Health.

CROWN LANDS ACT 1929: SECTION 5

TAKE NOTICE that pursuant to the Crown Lands Act 1929, I, JOHN HILL, Minister for Environment and Conservation, Minister of the Crown to whom the administration of the Crown Lands Act 1929 is committed DO HEREBY: 1. Resume the land defined in The First Schedule. 2. Dedicate the Crown Land defined in The Second Schedule

as an Emergency Services Reserve and declare that such land shall be under the care, control and management of the Minister for Emergency Services.

The First Schedule Portion of Park Lands, portion of Section 255 (now identified as Allotment 160 of Deposited Plan 65780) adjacent to the Town of Coulta, Hundred of Warrow, dedicated as a place for the recreation and amusement of the inhabitants of the Township of Coulta and called Park Lands, together with other land pursuant to The Waste Lands Alienation Act 1872, the proclamation of which was published in the Government Gazette of 22 November 1877 at page 1328 (amended by proclamation published in the Government Gazette of 18 May 1967 at page 1592) and subsequently placed under the care, control and management of the Council of the area (now District Council of Lower Eyre Peninsula) pursuant to Act 2156 of 1934, being portion of the land comprised in Crown Record Volume 5755, Folio 5.

ENVIRONMENT PROTECTION ACT 1993 Approval of Category B Containers

I, STEPHEN RICHARD SMITH, Senior Adviser, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 69 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby: Approval of Category B Containers Approve as Category B Containers, subject to the conditions in subclauses (i) and (ii) below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia: (a) the product which each class of containers shall contain; (b) the size of the containers; (c) the type of containers; (d) the name of the holders of these approvals. (i) Subsection 69 (3) Arrangements The holders of these approvals must ensure that the empty containers which belong to their respective class of containers

hereby approved as Category B Containers are collected from collection depots approved under section 69 of the Act by the party named in Column 5 of Schedule 1 of this Notice; and

(ii) Approved Refund Markings (a) The holders of these approvals must ensure that each container which belongs to their respective class of containers hereby

approved as Category B Containers bears the refund marking approved by the Authority in respect of that class of containers.

(b) The refund marking that appears on each container that belongs to the class of containers that is hereby approved, must be a minimum 1.5 mm for the smallest letter in the statement and a minimum 3 mm for the numeric (‘5’) in the statement.

(c) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

FISHERIES ACT 1982: SECTION 59

TAKE notice that pursuant to section 59 of the Fisheries Act 1982, Lee Baumgartner, Buckingbong Road, Narrandera, N.S.W. 2700 (the ‘exemption holder’) or persons acting as his agents, are exempt from the Fisheries Act 1982 and the Fisheries (General) Regulations 2000 but only insofar as they may conduct fish monitoring from the waters described in Schedule 1 (the ‘exempted activity’), using a dual-frequency identification sonar (DIDSON), subject to the conditions set out in Schedule 2, from 9 May 2005 until 12 May 2005, unless varied or revoked earlier.

SCHEDULE 2 1. All native fish taken pursuant to this exemption must be returned to the water after the required information is obtained. All non-native species must not be returned to the water alive. 2. Before conducting the exempted activity, the exemption holder must advise the PIRSA Fisheries Compliance Unit on 1800 065 522 with the name of the person or persons who will be conducting the exempted activity, details of the proposed locations and the dates on which the collections are to be made. 3. While engaged in the exempted activity, the exemption holder must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested. 4. The exemption holder must not contravene or fail to comply with the Fisheries Act 1982 or any regulations made under that Act, except where specifically exempted by this notice. Dated 6 May 2005.

TAKE notice that pursuant to section 59 of the Fisheries Act 1982, ECOWISE Environmental, 2-8 Harvey Street, Richmond, Vic. 3121 (the ‘exemption holder’) or persons acting as their agent, are exempt from section 41 of the Fisheries Act 1982 and the Fisheries (General) Regulations 2000 but only insofar as they may conduct sampling of fish from the waters described in Schedule 1 (the ‘exempted activity’), using a Smith-Root backpack electro-fisher, subject to the conditions set out in Schedule 2, from 1 July 2005 until 12 July 2005, unless varied or revoked earlier.

SCHEDULE 2 1. The specimens collected by the exemption holder are for scientific and research purposes only and must not be sold. 2. All native fish taken pursuant to the exempted activity must be immediately returned to the water. Any injured or killed specimens must be forwarded to the SA Museum. 3. The exempted activity may only be conducted on the exemption holder’s behalf by Cameron Amos and Denise Betts.

4. Before conducting the exempted activity, the exemption holder must advise the PIRSA Fisheries Compliance Unit on 1800 065 522 with the name of the person or person who will be conducting the exempted activity, details of the proposed locations and the dates on which the collections are to be made. 5. The exemption holder must provide a report in writing detailing the outcomes of the research and the collection of organisms pursuant to this notice along with photographic evidence of threatened fish species encountered to the Director of Fisheries, (Attention: Alex Chalupa, G.P.O. Box 1625, Adelaide, S.A. 5001) within three months of the expiry of this notice, giving the following details: • the date, time and location of collection; • the description of all species collected; and • the number of each species collected. 6. While engaged in the exempted activity, the exemption holder must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested. 7. The exemption holder must not contravene or fail to comply with the Fisheries Act 1982 or any regulations made under that Act, except where specifically exempted by this notice. Dated 4 May 2005.

National Parks and Wildlife (Brownhill Creek Recreation Park) Proclamation 2005

under sections 33(3) and 34(1) of the National Parks and Wildlife Act 1972

Preamble 1 The Brownhill Creek Recreation Park is constituted as a recreation park under the

National Parks and Wildlife Act 1972 (see Schedule 6 of the Act).

2 It is now intended that certain land be excluded from the park and an equivalent area of land be included in the park. For that purpose it is convenient to abolish the existing park and constitute a new recreation park with the adjusted area.

1—Short title This proclamation may be cited as the National Parks and Wildlife (Brownhill Creek Recreation Park) Proclamation 2005.

2—Commencement This proclamation will come into operation on 12 May 2005.

3—Abolition of recreation park The Brownhill Creek Recreation Park is abolished.

4—Constitution of Brownhill Creek Recreation Park The Crown land defined in Schedule 1 is constituted as a recreation park and is assigned the name Brownhill Creek Recreation Park.

Road Closure—Public Road, Adelaide NOTICE is hereby given that, pursuant to section 10 of the Roads (Opening and Closing) Act 1991, the City of Adelaide hereby give notice of its intent to make a Road Process Order to close and retain portion of the Public Road adjoining Flinders Street and Allotment 1 in Deposited Plan 63738, more particularly delineated and lettered ‘A’ on Preliminary Plan No. 05/0019. The closed road is to be merged with Allotment 1 in Deposited Plan 63738. Periodic Review of Elector Representation PURSUANT to the provisions of section 12 (5) of the Local Government Act 1999, notice is hereby given that the City of Charles Sturt is to carry out a review to determine whether a change of arrangements in respect to elector representation, including ward boundaries and the composition of Council, will result in the electors of the area being more adequately and fairly represented. Periodical Review of Elector Representation NOTICE is hereby given that pursuant to the provisions of section 12 of the Local Government Act 1999, the District Council of Tumby Bay has completed a review to determine whether a change to ward boundaries and/or composition would result in the electors of the area being more fairly represented.

DISTRICT COUNCIL OF TUMBY BAY ROADS (OPENING AND CLOSING) ACT 1991

Saxon Street, Tumby Bay NOTICE is hereby given, pursuant to section 10 of the Roads (Opening and Closing) Act 1991, that the District Council of Tumby Bay proposes to make a Road Process Order to close portion of Saxon Street, Tumby Bay adjoining allotment 66 in DP 55096 more particularly delineated and lettered ‘A’ on preliminary plan No. 05/0004. The closed road is to be transferred to Eyre Realty Pty Ltd and merged with allotment 66 in DP 55096. A statement of persons affected by the process together with a copy of the preliminary plan is available for public inspection at the offices of the District Council of Tumby Bay, located at the corner of Mortlock Street and West Terrace, Tumby Bay and at the Adelaide Offices of the Surveyor-General during normal office hours. Any person who may wish to object to the proposed Road Process, or any person who may wish to apply for an easement to be granted in that person’s favour over the land subject to the proposed closure must lodge with the said Council a notice of objection or an application for easement within 28 days of the date of the publication of this notice. All objections shall be in writing stating the objector’s full name and address and the reasons for the objection and whether the objector wishes to appear in person or be represented at a meeting convened by the Council for the determination of objections. An application for easement shall be in writing stating the applicant’s full name and address, the reasons for the application for the grant of easement, full details of the nature and location of the easement applied for and whether the easement will be in favour of adjoining or nearby land, and if so, specifying the land to which the easement will be annexed. Where a submission is made the Council will give notification of a meeting at which the matter will be considered so that the person making the submission or their representative may attend if desired. A copy of any notice or application shall, at the same time it is lodged with the District Council of Tumby Bay, c/o P.O.
