The loss prevention team is dedicated to providing initiatives to assist Members in minimising their
exposure to claims through publishing guidance materials, offering technical advice and managing the
Ship Inspection Programme. We are continually adding to our portfolio and reference should be made

With loss prevention staff located in London and Singapore working closely with underwriting and
claims teams, we are able to ensure an integrated approach that is key to effective risk management.

Passenger Claims booklet
The Club has experienced a number of claims where people have lost their lives due to a direct failure
to follow correct procedures for enclosed space entry. For the cases featured within this booklet, it is
important to highlight that the people involved were qualified and experienced in making enclosed space
entries and therefore trained in the associated dangers which, in many circumstances, is not the case.

It appears that the number and value of passenger injury claims have steadily increased over the
last few years. The most alarming aspect of this is the rise in litigation resulting from relatively minor
incidents. The actions of both Members and their crews come under very close scrutiny if an incident
occurs and the plaintiffs will do their utmost to place the blame squarely at the door of the Member.
It is important that owners and operators of passenger vessels develop and implement proper
procedures to minimise the risk of injury and guide their staff in dealing with the consequences of an
accident occurring on board. This guide provides advice on minimising exposure to passenger claims.

The Club has seen an alarming increase in the number of accidents at sea in which drugs have been a
causative factor. In some areas of the world and on certain types of vessel, drug abuse is becoming a
serious safety hazard.
Seafarers who are under the influence of drugs clearly present a safety hazard for which an employer
may find himself both civilly and criminally liable should an incident occur. This guide provides advice on
legal considerations, how to develop a screening programme and information on common drug types
including amphetamines, cannabis, cocaine, heroin and sedatives.

This booklet explains the fundamentals of stability and how it can be determined by those responsible
for loading vessels.
Over the years the Club has dealt with a number of claims involving general cargo vessels and container
ships where incidents have been caused by the vessel having inadequate stability and has been allowed to
undertake a voyage in that condition. There have also been a large number of similar incidents involving
flat top barges loaded with break bulk, containers, scrap metal or combinations of all three. In most cases
the lack of sufficient stability has not been made apparent until an external force has acted on the vessel
caused by heavy sea conditions, a sharp alteration of course or the pushing of an assisting tug.
This booklet is also available in Bahasa (Indonesian).
The Club has recently dealt with a number of claims involving the access to vessels; some of which have
resulted in fatalities. A selection of the incidents encountered by the Club have been highlighted in the
Case studies within this booklet.
This guide highlights the importance of providing a safe means of access to vessels for both crew
and passengers.

Fishing vessel safety booklet
Fishing is the most dangerous job in the world. There have been many studies carried out over the
years that show fatalities on fishing vessels were and still remain a real threat. This is reiterated by the
claims incidents advised to the Club which historically shows personal injury/illness as the area with the
most reported cases. These events are often of a nature that could have easily resulted in death.
Fishermen must remember that fishing vessels are moving; often wet platforms and therefore,
the risk associated with any task will dramatically increase. The decks of a fishing vessel are very
busy with many pieces of equipment i.e. ropes, wires, nets and shackles being utilised at once.
This publication does not seek to fully inform the skipper and their crews about all on board safety
requirements (including the safety aspects involved with different methods of fishing). Instead it hopes
to highlight areas that, from the Club’s experience, contribute to crew members becoming more safety
aware, as well as assisting to recognise the dangers for themselves.
This initiative (which has been piloted in
Singapore) was developed following claims
analysis which indicated that many claims
involving tug and tow units are the result of
collisions with fixed objects or other vessels at
anchor. It was also noted that the root cause
of these incidents could be attributed to too
little attention being paid to tides and currents
or to the movement of other vessels within the
anchorages. The ability of some tug Masters
could also be questioned.
The course includes valuable hands-on simulator training presented in English, Malay and the
Indonesian Bahasa language, with exercises to simulate real situations within the Singapore Straits.

Cargo Securing manual - sample
Following a series of claims relating to unsecured
cargo, we have introduced a requirement for
barges to be issued with a Cargo Securing
Manual. We are aware that the provision of
such a manual is a SOLAS requirement and
by definition is not a requirement for barges.
However, we have introduced a warranty for a
similar but not so detailed document, approved
by the managers or their appointed surveyor,
to be provided for all barges except those only
carrying bulk cargoes.

These are produced to raise awareness of the
causes of claims and their outcome, so that
Members can learn from the experience of

Seminars and workshops
The loss prevention team carries out presentations and workshops which can be tailored individually
for single Members or as a seminar for a group of Members in a particular geographical area.
The seminars can cover topics requested by Members including cover aspects, issues the Member
may be seeing on board their vessels and/or with their crews, a causation review and the inclusion of
interactive Case study discussions.
In addition the meetings could focus on general loss prevention matters, the ship inspection
programme and the causation system.
