Medicare and Skilled Nursing Facility Coverage: How Does it Work?

On the surface, it appears relatively simple to qualify for a Medicare Covered Skilled Nursing Facility stay. The patient must have a three day stay at a hospital and must require and be receiving skilled care. There are, however, some important distinctions to make:

The three “days” are actually counted as three midnights. The patient needs to be classified as an “in-patient” for those three

midnights, not as “observation”. Both of these classifications may look the same in the hospital; same tests, treatments, etc. The classification can be changed, but you need to ask the treating physician.

Despite what the Skilled Nursing Facility says, the application of the “improvement standard” is actually illegal. Facilities may claim to have the right to end the skilled care, and thus the Medicare coverage, for a patient whose progress has plateaued. Legally, however, Medicare coverage applies as long as the patient is benefitting from the care, regardless of whether or not it is improving the patient’s status.

The patient may receive a “notice of non-coverage” if the facility decides that the patient no longer needs skilled care and then the Medicare coverage will end. The patient has the option to accept that decision or to appeal it. The appeal does not cost anything so it’s a good option to appeal. Important to remember, however, that if the appeal is lost, the patient will be responsible for the fees that have accrued during the appeal process.

For more information, self-help packets are available on Medicareadvocacy.org. For additional assistance with appeals, The Center for Medicare Advocacy can be reached by calling 860-456-7790. Our CHOICES trained staff can provide guidance as well: 860-648-6361.
