The Alcohol and Gaming Regulation Act, 1997/ Loi de 1997 sur la réglementation des boissons alcoolisées et des jeux de hasard

BEVERAGE ALCOHOL BAN — SASKATCHEWAN PROVINCIAL PARKS AND RECREATION SITES
I hereby prohibit, pursuant to section 107.1 of The Alcohol and Gaming Regulation Act, 1997 as amended by The Alcohol and Gaming Regulation Amendment Act, 2006, the possession or consumption of beverage alcohol in all campgrounds located in Saskatchewan provincial parks and recreation sites for the period commencing at 12:00 p.m. on Thursday, may 17, 2012 and ending on monday, may 21, 2012 at 11:00 p.m.
At the request of Regional Park Authorities, I further prohibit the possession or consumption of beverage alcohol in all campgrounds in the following regional parks for the period commencing at 12:00 p.m. on Thursday, may 17, 2012 and ending on monday, may 21, 2012 at 11:00 p.m.:
Atton’s Lake, Bengough & District, Brightsand Lake, Clearwater Lake, Dunnet, Elrose, Glenburn, Jean Louis Legare, Kipabiskau, Lac Pelletier, Last mountain, LeRoy Leisureland, Little Loon, Lucien Lake, meeting Lake, moose Creek, moosomin & District, morin Lake, Nickle Lake, Palliser, Pine Cree, Sandy Beach, St. Brieux, Struthers Lake and Wakaw Lake.
This order is required for the proper management and control of these campgrounds and in the interest of public safety.

The Municipalities Act [sections 49, 52 and 61]

INCORPORATION OF THE TOWN OF PENSE1 Pursuant to section 52 of The Municipalities Act, the Council of the Village of Pense has submitted a request
to the minister of municipal Affairs to have their status changed from a Village to a Town.
2 Upon consideration of the request and pursuant to section 61 of The Municipalities Act,
I HEREBy DECLARE THAT:
(a) the Village of Pense to be incorporated as the Town of Pense;
(b) the Town of Pense shall consist of the following land:
the south-east quarter of section eight (8);
the south-west quarter of section nine (9); and
that portion of the north-west quarter of section nine (9), lying south of the northerly limit of Assiniboia St. and west of the easterly limit of Lewis St., as shown on registered Plan No. K.5669 of record in the Land Titles Office for the Regina Land Registration District;
all in Township 17, Range 22, West of the Second meridian, in the Province of Saskatchewan;

(c) the change in status from the Village of Pense to the Town of Pense shall take effect on October 24, 2012;
(d) nomination day for the election of council shall be September 19, 2012, from 9:00 a.m. to 4:00 p.m. and nominations will be received for the office of mayor and four councillors by the returning officer during regular business hours from the date of publishing the Call for Nominations to the closing of nomination day at the town’s office in Pense, Saskatchewan;
(e) Jennifer Lendvay, Administrator for Pense, Saskatchewan, is appointed to act as returning officer for the election and shall conduct the election in accordance with The Local Government Elections Act; and

TO RESTRUCTURE DIVISION BOUNDARIES IN THE RURAL mUNICIPALITy OF GRAVELBOURG NO. 104
It has been deemed appropriate to comply with a request of the Council of the Rural municipality of Gravelbourg No. 104 to alter its division boundaries. Accordingly, under the authority conferred upon the minister of municipal Affairs by section 49 and Division 3 of The Municipalities Act;
IT IS HEREBy ORDERED THAT the Rural municipality of Gravelbourg No. 104 is restructured by eliminating the existing divisions and creating four (4) new divisions which are assigned the numbers Division 1, Division 2, Division 3 and Division 4;
IT IS FURTHER ORDERED THAT the boundaries of the Divisions are established as identified and marked on Schedule A, and described in Schedule B, as attached; and
IT IS FURTHER ORDERED THAT the effective date of the restructuring and creation of Division 1, Division 2, Division 3 and Division 4 is October 24, 2012; and
IT IS FURTHER ORDERED THAT:
1 The effective date of the boundary alteration for Division 1, Division 2, Division 3 and Division 4 is October 24, 2012.
2 An election for a councillor to represent each of Division 1, Division 2, Division 3 and Division 4 as described herein will be held to coincide with the general election on October 24, 2012, for Reeve and odd-numbered divisions.
3 The term of office for the councillors for Division 2 and Division 4 shall expire at the time of the general election in 2014.
4 ms. Carolyn Bidwell shall be appointed as Returning Officer and shall conduct the general election to be held for Reeve, Division 1, Division 2, Division 3, and Division 4 on October 24, 2012, in accordance with The Local Government Elections Act.

THE SASKATCHEWAN FLAX DEVELOPmENT PLAN REGULATIONS – LEVy COLLECTIONOrder No. 19/12. The SASKATCHEWAN FLAX DEVELOPmENT COmmISSION, pursuant to the provisions
of The Saskatchewan Flax Development Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:
1 Commencing August 1, 2012 all sales of flax are subject to a levy of $0.06 per bushel or $2.36 per tonne or a fraction thereof on a prorated basis of flaxseed and $0.50 per tonne of flax straw marketed.
2 Each buyer shall deduct the levy from any proceeds payable to a producer when flax is:
(a) purchased from a producer; or
(b) acquired from a producer for sale on the producer’s behalf.
3 If the levy is not deducted by the buyer, the producer is liable for payment of the levy to the Commission.
4 All levy monies must be submitted to the Commission office within 55 days from the end of the month within which the flax was sold and the levy was collected.
5 Using the appropriate levy remittance form as provided by the Commission, each levy submission to the Commission office must include the following information with respect to each producer for whom a levy is submitted:
(a) the name and address of the producer;
(b) the amount of flax purchased from the producer;
(c) the amount of levy being paid on behalf of the producer.
6 Effective August 1, 2012 Order No. 15/09 – Check-Off Collection is hereby wholly revoked.
7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.
Order No. 19/12 is made pursuant to subsections 15(1) and (2) and clauses 7(1)(d) and (h) of The Saskatchewan Flax Development Plan Regulations and shall be effective upon the date of this Order. By order of the Saskatchewan Flax Development Commission.

Pursuant to The Certified General Accountants Act, 1994, S.S. c.C-4.11, the Regulatory Bylaws of the Certified General Accountants Association of Saskatchewan are hereby amended as follows:
Part V, Sections 500, 501, 502 and Part III, Section 335 are repealed in their entirety and replaced by the following:“PART V“500 Minimum Experience Requirements
(1) To enter the practice of public accounting, a member:
(a) shall have acquired 2750 hours of public accounting experience within the preceding five-year period; and
(b) shall have completed the Association's Public Practice Competency Assessment
“501 Education Requirements (1) Within one year after registering for the practice of public accounting, a member is required to complete the following courses administered by the Association unless the Association grants an exemption for one or more of these courses based upon relevant experience:
(a) Orientation to Public Practice; and
(b) TX2: Advanced Personal and Corporate Taxation; and
(c) AU2: Advanced External auditing (only if registered for Assurance engagements)
“502 Maintenance Requirements(1) All members engaged in the practice of public accounting must:
(a) submit annually an Annual Renewal Form along with the requisite registration fee and assessment fee;
(b) carry errors and omissions insurance with a minimum one million dollars per occurrence and three million dollars aggregate;
(c) maintain an up-to-date copy of the CGA Public Practice manual and the CICA Handbook as determined by the Association;
(d) take a CICA Handbook refresher course every 2 years as offered by the Association;
(e) submit to a practice review from time to time as required by the Association;
(f) document and report their professional development activities annually and meet the specified minimum hours requirements specified by the Association”.

“335 Remuneration(1) The members of the board, publicly appointed pursuant to section 8 of the Act, shall be remunerated from time to time in the amount of $500 per meeting for meetings greater than 6 hours, and $300 per meeting for meetings less than 6 hours.
(2) All members of the board shall be reimbursed for reasonable out of pocket expenses incurred in carrying out the duties of their office, and in attending meetings of the board”.

The Code of Ethical Principles and Rules of Conduct are amended as follows:(1) R107.4 is repealed and the following substituted:
“R107.4 use of Normal Business MethodsA firm or corporation carrying on a business or practice as described in Rule R107.1 may use normal business methods to solicit business for its own functions, but such methods may not be used, or appear to be used, for the solicitation of clients for the public accounting practice with which the member is associated”.
(2) R108 is repealed and replaced by the following:
“R108 Conduct unbecoming It shall be unethical for a member or student, while acting in a professional capacity or otherwise, to engage in misconduct of a reprehensible or serious nature which reflects on the member’s or student’s honesty, integrity, or trustworthiness or, is relevant to the person’s suitability as a member of the profession”.
(3) R303 is repealed and the following substituted:
“R303 Adherence to Acknowledged Principles and Standards members shall adhere to acknowledged principles and standards of professional practice. The phrase “acknowledged principles and standards” expresses a wide meaning, namely that body of principles and practices which have been generally adopted by the profession and which are applied in the preparation of financial statements, taken together with the requirements of any governing statutes, subject to (e) below. That is, a member shall adhere to:
(a) generally accepted accounting principles within financial reporting standards unless departure from these principles is fully disclosed;
(b) generally accepted auditing standards or general review standards in an assurance engagement;
(c) accounting and auditing practices that differ from those recommended by the Association, provided that there is substantial authoritative support for alternative treatment and the departure from the Association’s recommendations is disclosed;

(d) accounting and auditing practices not specifically dealt with by the Association but which are otherwise generally accepted;
(e) requirements of any governing act or regulation, providing, however, in the event that there is a conflict between the accounting and auditing standards of the profession and a specific statutory or regulatory requirement, the member shall make appropriate qualification in the report;
(f) accounting, auditing practices, and standards recommended by the Association, including those found in:
(i) the CICA Handbook; wherein references to the Rules of Conduct/Code of Ethics of the provincial institutes/order appear, this should be read as the CGA Code of Ethical Principles and Rules of Conduct;
(ii) the CGA Independence Standard; and
(iii) the CGA-Canada Public Practice Manual”.(4) R507 is repealed and the following substituted:
“R507 Referral Fees.(a) A member or firm engaged in the practice of public accounting may pay or receive a referral fee or commission relating to a client if such payment is paid or received for referring a client to, or from, another professional colleague engaged in the practice of public accounting. Accepting such a referral fee or commission may give rise to threats to objectivity and professional competence and due care. In such instances, a member or firm shall establish precautions that include:
(i) disclosing to the client any arrangements to pay or receive a referral fee or commission; and
(ii) obtaining advance agreement from the client for such arrangements.
(b) A member or firm engaged in the practice of public accounting may purchase or sell all or part of a firm. Payments in respect of such sale are not regarded as commissions or referral fees for the purposes of this rule”.
(5) R509.1 is repealed and the following substituted:
“R509.1 Misleading Name of Firm or Style of Practice A member shall not engage in the practice of public accounting or in any function consistent therewith, under a name or style which is misleading as to the nature of the firm or the nature of the functions performed”.
(6) R510 is repealed and the following substituted:
“R510 Name of Firm All members engaged in the practice of public accounting and pursuant to Rule R510.2 would ordinarily practice under the member’s name(s) or; if engaged in the practice of public accounting in partnership, practise under at least one of the partners’ names. Partners’ names are those who are or have been associated with the firm. Where the firm comprises of more than one partner, the firm name may consist of any combination of partners, former partners or predecessors, voting shareholders or former voting shareholders. The firm name may also be in the form of the initials drawn from the first letter of the partners’ last names. If a member wishes to practice using a firm name other than that permitted above, the member shall practice only under a name or style which:
(a) is not misleading, confusing or deceptive;
(b) is not self-laudatory;
(c) does not contravene professional good taste; and
(d) has been approved by the Association.

“R510.1 Style of Practice All members so engaged must ensure the firm name clearly identifies the style of practice and complies with Rule R509.1 as follows:
(a) if practising as a professional corporation make it clearly understood to the public that the member is practising as a professional corporation and ensure that the firm name consists of a name that is allowed under this rule and the appropriate legislation;
(b) if practising as a corporation, where the firm consists of one or more practitioners, make it clearly understood to the public that the firm is incorporated and ensure that the firm name consists of a name that is allowed under this rule and the appropriate legislation;
(c) if practising as a limited liability partnership, make it clearly understood to the public that the firm is a limited liability partnership and ensure that the firm name consists of a name that is allowed under this rule and the appropriate legislation;
(d) the addition of “& Co.” or other similar term is permitted only where the member employs staff or where the number of partners exceeds that named in the firm, or where the member is practicing with one or more professional colleagues who are not partners or employees;
(e) if a member is practising in partnership with a professional colleague who is a non-member, make it clearly understood to the public that the firm is a partnership and ensure that the firm name consists of a name that is allowed under this rule and a descriptive style permitted under Rule R510.2.
“R510.2 Use of Descriptive Style “Certified General Accountant(s)” in the Name of Firmmembers engaged in the practice of public accounting shall practice under the descriptive style “Certified General Accountants.”
(a) the plural use of the descriptive style Certified General Accountants shall only be used in a partnership of members or a corporation of members or professional corporation of members;
(b) notwithstanding R510.2 (a), if a member is engaged in the practice of public accounting with a professional colleague who is a non-member, the firm shall not use the descriptive style “Certified General Accountant(s)” if:
(i) the non-member’s name forms a part of the firm name; or
(ii) the partners who are members exercise less than 50% legal control of the firm.
“R510.3 ApplicationA firm engaged in the practice of public accounting as of September 30th, 1996, and whose name at that date included the phrase “& Co” or other similar wording as permitted by the Rules then in effect, may continue to use such name for as long as that firm is engaged in the practice of public accounting under that name.
“R510.4 Legal Change of Member’s NameA member whose name is legally changed may continue to use the former name in the name of the firm without being considered in breach of this Rule”.
(7) R512 is repealed and the following substituted:
“R512 Association of Member with Non-members in the Practice of Public Accounting A member shall not associate in any way with a professional colleague who is a non-member in the practice of public accounting unless:
(a) such association maintains the good reputation of the profession and its ability to serve the public interest;

(b) such business or practice establishes and maintains policies, procedures, and arrangements suitable for ensuring:
(i) that every such non-member professional colleague is knowledgeable of and complies with:
(A) the Association’s governing legislation, regulations, Bylaws, and Code of Ethical Principles and Rules of Conduct; and
(B) the ethical and other regulations applicable to members of a recognized professional organization or regulated body of which the non-member professional colleague is a member; and
(ii) that no style or presentation or communication is used which implies that the non-member professional colleague is a member”.
Definitions
(8) “Public Accounting” is repealed in its entirety.
“(9) “Practice of Public Accounting” Providing or offering to provide one or more of the following services to the public, whether for reward or not:
(a) an assurance engagement;
(b) a specified auditing procedures engagement;
(c) a compilation engagement;
(d) an accounting service insofar as it involves summarization, analysis, advice, counsel or interpretation but excluding an accounting service which is incidental to the provider’s primary occupation which is not public accounting;
(e) forensic accounting, financial investigation or financial litigation support services;
(f) advice, counsel or interpretation with respect to taxation matters; and
(g) the preparation of a tax return or other statutory filing.
A member who is “employed” in the practice of public accounting is not considered to be “engaged” in the practice of public accounting.”

“SCHEDULE A — TRAVEL AND OTHER EXPENSE POLICy
1. Commission members attending a regular Commission meeting or a committee meeting, including travel time will be compensated at a per diem rate of $350 per day. For meetings less than four hours in duration, a per diem rate of $50 per hour will be paid.
2. Individuals other than Commission members serving as members on a Hearing Committee will be compensated at a per diem rate of $50 per hour, including travel time, to a maximum of $350 per day.
3. The Commission Chairperson attending a regular Commission meeting, annual meeting or strategic planning meeting including travel time; will be compensated at a per diem rate of $550 per day. For meetings less than four hours in duration, a per diem rate of $75 per hour will be paid.

4. A Committee Chairperson attending a committee meeting including travel time; will be compensated at a per diem rate of $450 per day. For meetings less than four hours in duration, a per diem rate of $65 per hour will be paid.
5. Where a Commission member spends time on Commission business that is authorized by the Commission, the member will be compensated at a per diem rate of $50 per hour, including travel time, to a maximum of $350 per day.
6. A claim for meals can be made by Commission members if departure for a regular Commission meeting or a committee meeting is earlier or return time is later than the times indicated below. If meals are being provided by the Commission at the meeting, no claim will be allowed.

10. Compensation for other expenses will also be allowed as prescribed in the Commission’s annual budget”.

SACHEZ QuE: La date de tombée pour les soumissions à la Gazette de la Saskatchewan est le lundi à 5 p.m., la semaine de la parution. En cas de jour férié à l’intérieur de la semaine de parution, la date de tombée sera remise un jour avant, soit le vendredi à 5 p.m. Pour les envois de soumissions à la Gazette par la poste, veuillez prévoir une semaine au complet. La parution de tout matériel reçu en retard sera remise au numéro de la semaine suivante.
Tous les documents qui paraîtront dans la Gazette de la Saskatchewan doivent être soumis électroniquement (mS Word ou WordPerfect) et accompagnés d’une copie papier signée et envoyée au bureau de l’Imprimeur de la Reine, ministère de la Justice de la Saskatchewan, B19-3085, rue Albert, Regina SK S4S 0B1, tél. 306-787-2367, ou par courriel: [email protected].
Chaque document ou disquette doit être complet, conformément aux normes de parution, et doit être séparé de la lettre d’accompagnement. Les signatures sur les documents doivent être dactylographiées ou écrites lisiblement en lettres moulées et doivent apparaître immédiatement en dessous de la signature écrite.
Le paiement d’avance est exigé pour TOUS les avis placés dans la Gazette de la Saskatchewan par les clients non gouvernementaux. Les chèques ou les mandats doivent être établis à l’ordre du fonds renouvelable de l’Imprimeur de la Reine. Veuillez y inclure la TPS en plus des tarifs réguliers au taux de 5 % pour chaque article cité ci-dessous dans la catégorie « soumis à la TPS ».
Le prix minimal pour la parution d’avis non inclus dans la liste ci-dessous, est de 16 $ par avis. Le paiement devra accompagner le matériel envoyé aux fins de parution.
