THE POLITICS OF JUDICIALCO-OPERATION IN THE EU
The European legal order is largely based on judicial co-operation betweenthe European Court of Justice and the national courts. In this book, threecase studies on Sunday trading, on equal treatment of men and womenand on good faith in contract law reveal that national courts and nationallitigants are mainly pursuing national interests by means of European law.The European Court of Justice seeks European solutions by delimiting thescope of the European legal order, by transforming the subjective rights ofmarket citizens into political rights of union citizens, and by developingEuropean remedies to enforce European rights. Micklitz contributes to thedebate on the role and function of the preliminary reference procedure inthe making of EU law, and does so on the basis of concrete examples. Heoffers an original analysis of the limits of the European legal order, and ofthe role and function of subjective rights and European remedies.
hans-w. micklitz is Jean Monnet Professor of Private and EuropeanEconomic Law at the University of Bamberg, and Head of the Institute ofEuropean and Consumer Law (VIEW) in Berlin. He was a Fellow of theEuropean University Institute, Florence, Italy, and visiting Professor at theUniversity of Michigan, Ann Arbor, and at Somerville College, University ofOxford. He has published very widely in the areas of European and consumerlaw.

While I have attempted in this book to consider, as a whole, the co-operation between the English courts and the European courts, it isnevertheless clear that there are limits to the scope of the research that Ihave undertaken. My views of the English law will always remain thoseof a German lawyer who was not educated in the common law systemand who is not fully familiar with all its nuances and implications. Thereader, it is hoped, will accept my apologies for missing those nuancesbut will nevertheless benefit from an outsider’s view of the Englishlegal system.
