The Office of Residence Life Housing Contract 1 The Office of Residence Life Housing Contract This is a legal agreement between you and the university. It is written in legal language that may be unfamiliar to you. However, we encourage you to read it carefully, and acquaint yourself with its provisions. This Office of Residence Life Housing Contract (herein Housing Contract) applies in all instances where a student lives in housing provided by CMU, whether that housing is in a residence hall, apartment, or other type of housing. Please note that MICHIGAN LAW DOES NOT ALLOW A MINOR TO VOID A CONTRACT FOR HOUSING. If you sign this Housing Contract and are under the age of 18, you cannot cancel it merely for that reason. CAMPUS RESIDENCY POLICY Central Michigan University's campus residency policy requires that freshmen and second- year students live in a residence hall or Northwest Apartment. Those who reach the four- semester requirement at midyear are still required to complete the full term of the contract for the academic year (fall and spring semester). CMU may waive the second-year requirement in years when space is not available on campus. Enrollment 1. Undergraduate residents are expected to maintain at least 12 credit hours per semester. 2. Graduate residents are expected to maintain at least 9 credit hours per semester. Graduate students may live in CMU's Graduate Student housing or Kewadin Village, if the relevant criteria are met and any required approvals are obtained. CMU maintains apartment-style communities located at Graduate Housing, Kewadin Village, and Northwest Apartments University housing is available only to students; faculty and staff (other than Residence Hall Directors or other staff whose job responsibilities require it) are NOT permitted to live in university housing, except for short-term housing approved by the Office of Residence Life. Residency Policy for students admitted Fall 2018 The residency requirement for second-year students will be waived for the 2019-2020 academic year, with these exceptions: o Students who have not completed 24 credit hours by the end of spring 2019 o Students on CMU merit and talent based scholarships of $2500 or greater These students are required to live on campus their second year.

CAMPUSRESIDENCYPOLICYCentralMichiganUniversity'scampusresidencypolicyrequiresthatfreshmenandsecond-yearstudentsliveinaresidencehallorNorthwestApartment.Thosewhoreachthefour-semesterrequirementatmidyeararestillrequiredtocompletethefulltermofthecontractfortheacademicyear(fallandspringsemester).CMUmaywaivethesecond-yearrequirementinyearswhenspaceisnotavailableoncampus.

Enrollment

1. Undergraduateresidentsareexpectedtomaintainatleast12credithourspersemester.

GraduatestudentsmayliveinCMU'sGraduateStudenthousingorKewadinVillage,iftherelevantcriteriaaremetandanyrequiredapprovalsareobtained.CMUmaintainsapartment-stylecommunitieslocatedatGraduateHousing,KewadinVillage,andNorthwestApartments

Universityhousingisavailableonlytostudents;facultyandstaff(otherthanResidenceHallDirectorsorotherstaffwhosejobresponsibilitiesrequireit)areNOTpermittedtoliveinuniversityhousing,exceptforshort-termhousingapprovedbytheOfficeofResidenceLife.

ResidencyPolicyforstudentsadmittedFall2018

Theresidencyrequirementforsecond-yearstudentswillbewaivedforthe2019-2020academicyear,withtheseexceptions:

o Studentswhohavenotcompleted24credithoursbytheendofspring2019o StudentsonCMUmeritandtalentbasedscholarshipsof$2500orgreater

Thesestudentsarerequiredtoliveoncampustheirsecondyear.

Exceptionstothepolicywillusuallybegrantedifspecialcircumstancesareoutlined,andapprovalisobtained,priortothesigningoftheHousingContract.Someoftheseexceptionsinclude,butarenotlimitedto,thosestudentswhoare:

1. Livingathomewithparentsandcommutingwithina60-mileradius.2. Marriedandlivingwithaspouse.3. Veteranswithoneormoreyearsofactiveservice.4. Specialorgueststudent.5. 21yearsofageorolder.

ResidencyPolicyforstudentsadmittedforFall2019

CMUrequiresstudentstoliveoncampustheirfirsttwoyearsunlessgrantedanexception.

AllOfficeofResidenceLifeHousingContractsareforoneacademicyear.Ifastudentdoesnotqualifyforanexceptiontothepolicyatthebeginningoftheyear,thestudentmustfulfillthecontracteventhoughheorshemaybecomeeligibleforanexceptionduringtheyear.RequestsforexceptionmustbesubmittedinwritingtotheOfficeofResidenceLife.

Eachstudentmustabidebythison-campusresidencypolicy.Thosewhofailtodosowillnotbeconsideredofficiallyregisteredandwillbedematriculated.

TERMOFCONTRACTResidentsarerequiredtosignaHousingContracttoliveinthehallorapartmentfortheentireacademicyear,orremainderofyear,andmustupholdallconditionsoftheHousingContract.Academicyearisdefinedasfallandspringsemester.

Residencehallsandapartmentsareopenforstudentoccupancyonlywhentheuniversityisinsession(SpringandFallsemesters).Attheendofthefallandspringsemesters,youmustvacateyourroomassoonwithin24hoursofyourlastscheduledexamination.Asmallnumberofapartmentsandresidencehallsremainopenduringthesummerterms,andwillbeavailabletoresidentswhofulfillthecriteriaformaintainingresidencytherein.

ThisdocumentsetsforththetermsandconditionsuponwhichspaceintheCMUresidencehallsandapartmentsisleasedbytheuniversity´sBoardofTrustees,beingtheconstitutionalandstatutoryboardofcontrolofCentralMichiganUniversity(hereincalleduniversity),toaperson(hereincalledresident)signingaHousingContractwiththeuniversity.

Theuniversityleasestotheresidentandtheresidenthiresfromtheuniversityaspacedesignatedbytheuniversityinoneofitsresidencehallsorapartments(asindicatedabove),andtheuniversitywillfurnishboardtotheresident,subjecttothefollowingtermsandconditions.

RESIDENTAGREES

1. TohirefromtheuniversityroomandboarddescribedabovefortheperiodsetforthinthisOfficeofResidenceLifeHousingContractsignedbytheresidentandtomaketimelypaymentsofthefeesthereforeassetforthintheuniversityroomandboardschedule.

2. Touseandoccupythepremisesleasedinacarefulandlawfulmanner,forresidentialpurposesonly,withitbeingexpresslyunderstoodthattheresidentwillnotusethepremisesinanymannerthatwillcauseanuisancetootherpersonshousedbytheuniversity.Entertainmentbytheresidentonthepremisesshallbeallowed.However,loud,noisyparties,oranyotheractivitiesoractionsthataredisturbingtootherresidents,areprohibited.Violationofthisprohibitionshallbeconsideredamaterialbreachofthiscontract,therebyallowingtheuniversity,initssolediscretion,todeclarethecontractforfeitedforanyoneormoresuchbreaches.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

3. ToobeyallregulationspromulgatedbytheuniversityandbythegoverningbodiesoftheOfficeofResidenceLifethathavebeenenactedorthatmayhereafterbeenacted.Violationofanyoftheserulesorregulationsshallbeconsideredamaterialbreachofthiscontractandshallresultinitsimmediatetermination.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

4. Nottoparticipateinanyfund-raisingorsalesactivitywithinaresidencehall/apartmentoradjacentgroundswithoutfirstobtainingasolicitationpermitfromtheOfficeofResidenceLifeforeachpersonparticipatinginthefundraisingorsalesactivity.Eachareacouncil/hallcouncilshallestablishtime,placeandmanner

forsolicitation,andallsolicitorsmustobservethesehours.Noindividualorgroupmayactasavendor,salesagent,orinanymannersetupabusinessenterpriseinanytypeofuniversityhousing.

5. Tokeeptheleasedpremisescleanandfreefromdirt,garbage,andtrash,andtoberesponsiblefortherepairandreplacementofanyitemdamagedbytheresidentortheresident´sguests,invitees,oragents.Ifrepairsaremadenecessarybecauseofbreachofthiscontractorbecauseofactsoromissionsoftheresidentortheresident´sguests,invitees,oragents,therepairswillbemadebytheuniversityandpaidforbytheresident.

6. NottopossessorconsumeintoxicatingbeveragesinaresidencehallorapartmentexceptasallowedbylawandpursuanttoregulationspromulgatedbytheOfficeofthePresident,includingbutnotlimitedtotheStudentCodeofConductandCMU'sAlcoholPolicy.Violationofthissectionshallbeconsideredamaterialbreachofthiscontractandshallresultinitsimmediatetermination.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

7. Nottopossess,use,manufacture,produceordistributeoraidintheuse,manufacture,production,ordistributionofanycontrolledsubstanceexceptasexpresslypermittedbythelaw.Notwithstandingtheforegoing,residentagreesandacknowledgesthatanyuseorconsumptionofmarijuana(oranyothercontrolledsubstance)ontheleasedpremisesisaviolationoftheDrugFreeSchoolsandCommunitiesActandistherebyprohibitedbylaw.Violationofthissectionshallbeconsideredamaterialbreachofthiscontractandshallresultinitsimmediatetermination.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

8. Tokeepfirearms,firecrackers,gunpowder,orothermaterialsorsubstancesthatmightendangerthehealthandsafetyofanypersonintheresidencehallorapartmentcommunity,registeredandstoredwiththeCMUPoliceDepartment.Theuniversityreservestherighttorefusethekeepingofanyitemorsubstancethatitfeelsunreasonablyendangerspersonsintheresidencehallorapartmentcommunity.Fireworks,gasoline,andothercombustiblematerialsarestrictlyprohibited.Michiganlawforbidsthepossessionoruseofotherpyrotechnics.Violationofthissectionshallbeconsideredamaterialbreachofthiscontractandshallresultinitsimmediatetermination.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

9. Nottoparticipateinillegalgamblingofanysortonpremisesleasedorcontrolledbytheuniversity.

10. Nottokeeporpermitintheresidencehallanydog,cat,mouse,bird,orotheranimal,exceptfish.Exceptionstothissectioncanbemadeforserviceoremotionalsupportanimals.AllsuchaccommodationsmustbemadethroughandapprovedbytheOfficeofStudentDisabilityServices.

11. Tocarefortheroomorapartmentinwhichtheresidentlivesandtoexercisereasonablecareintheuseofcommonfacilitiesintheresidencehallorapartmentcommunity.

12. Nottotamperwithormisusethefirealarmsystemorfirefightingequipment.13. Attheterminationofthiscontract,tosurrendertheleasedpremisestothe

universitycleanandinasgoodconditionaswhentaken,reasonableuse,wear,andtearexcepted,itbeingunderstoodtheresidenthasexaminedtheleasedpremisesandfoundthesametobecleanandingoodconditionatthecommencementofthecontract.Ifresidentshouldfindthepremisesatthecommencementofthecontractinaconditionnotcleanandnotingoodcondition,residentmustmakethisknowninwritingtotheresidencehalldirectorofthefacilitywithin10daysafterthebeginningofthesemester.Residentsmovingintoaroomlaterthan10daysafterthecommencementofasemestershallmakeexceptionstofindingthefacilitycleanandingoodconditionknowninwritingtotheresidencehalldirectorofthefacilitieswithinthreedaysaftertakingpossessionoftheleasedpremises.

14. Topermittheuniversity,itsagents,andemployeesaccesstotheleasedpremisesasoutlinedintheuniversityresidentialfacilityentranceandsearchprocedures(see:ResidenceLifeHousingEntranceandSearchProcedurefoundlaterinthiscontract).

15. Topromptlypayuponbillingbytheuniversitytheamountofdamageresultingfromanyoneormorebreachesofthiscontractorbecauseofdamagestotheleasedpremises,exceptreasonablewearandtear.Allpersonsresidinginanyroom,suite,orapartmentareindividuallyandjointlyliableforanydamage.

16. Residentsshallabidebytheuniversitydamagecontrolpolicyandshallpayfordamagewhenbilledfordamagetopublicorcommonsareas.

17. Theuniversityisnotliableforthelossofordamagetomoney,propertyorothervaluablesbelongingtoresidentoranyotherperson.Universitystronglyrecommends,andresidentisresponsibleforacquiring,anyinsurancethatresidentmaydesireforresident´sprotectionfromliabilityandpropertydamages.

18. Thatresidentsaresubjecttoandshallabidebytheuniversity'spolicy(whereapplicable)withrespecttopaymentsandmakingofpayments,refunds,changesinrates,penalties,timeswhenresidencehallsareopenandfoodservicescheduled.

19. Tovacateandremovepersonalbelongingsfromroomsorapartmentsandtoceaseusinginstitutionaldiningfacilitiesimmediatelyuponwithdrawal(officialorunofficial)fromtheuniversityorterminationorcancellationoftheHousingContract.

20. Compliance:Acceptanceofnewroommates:residentswhorefusetoacceptaroommate,orwhoimpedetheuniversity´sefforttomakeanassignmentintoavacantspace,willbesubjecttodisciplinaryaction.Outcomesmayinclude,butarenotlimitedto,requiringresponsibilityforpaymentoftotalhousingcharges(lessfoodcosts)orremovalfromtheroom.

21. FailuretocomplywithverbalorwritteninstructionbyResidenceLifestaff,whensuchofficialisworkingwithintheappropriateperformanceoftheirduties,isprohibited.Abusivelanguageorotherbehaviorwhichisthreateninganddirectedtowarduniversitystaff,includingresidentstaff,isprohibitedandmaypromptdisciplinaryaction.Violationofthissectionshallbeconsideredamaterialbreachofthiscontractandshallresultinitsimmediatetermination.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

22. Failuretorespondtoanotificationtoscheduleand/ormaintainanappointmentwithResidenceLifeStaffregardinginvestigationofallegedviolationsisprohibited.Failuretomeetwithstaffwillnotprecludethecontinuationofthejudicialprocessanddisciplinaryactionmaybeinitiated.Studentsareexpectedtocontactresidentstaffandrescheduleifaconflictoccurs.

23. Failuretocomplywiththesanction(s)imposedbyahearingbodyorResidenceLifeStaffisprohibitedandmayresultinmoreseveredisciplinaryactionincludingbutnotlimitedto,disciplinaryhandlingunderthePolicyandProceduresRelatingtoStudentRightsandResponsibilities.Violationofthissectionshallbeconsideredamaterialbreachofthiscontractandshallresultinitsimmediatetermination.Iftheuniversitydeterminesthattheresidenthascarriedonsuchactivitiesforthepurposeofhavingthecontractforfeited,theuniversitymayelectthattheresidentshallimmediately:

o Losetherighttoliveintheleasedpremises,o Vacatesame,ando PayallfeesdueandowinginaccordancewiththisHousingContract.

UNIVERSITYAGREES

1. TofurnishtoresidentunderthetermsofthiscontractlivingaccommodationsinaCMUresidencehallorapartment.

2. Tosupplyresidentwithboardaccordingtothemealoptionelectedbytheresident(ifany)forthetimesspecifiedinthefoodservicescheduleannouncedbytheuniversity.

3. TogranttheuseofthefacilitiesoftheresidencehallorapartmentexceptduringstatedorspecifiedrecessesoftheuniversityorasotherwisestipulatedinthisHousingContract.

ADDITIONALPROVISIONSTOWHICHBOTHTHEUNIVERSITYANDTHERESIDENTAGREE

1. Iftheresidentfailstopaythehousingchargesprovidedforordefaultsintheperformanceofanyoftheagreementsmadehereinbytheresident,theuniversity,withoutnoticetoquitordemandforpaymentofhousingcharges,mayterminate

thiscontractand,immediatelyupontermination,repossesstheleasedpremises.Residentstillremainsliablefordamagesasaresultofbreachofanyoftheagreementshereincontained,andinaddition,universityshallhaveanyandallotherrightspermittedtoitelsewhereinthiscontractandbylaw,whethercumulativeoralternative.

2. Timeisoftheessenceinperformanceofallpartsofthiscontract.Nowaiverofanybreach,condition,orcovenantofthiscontractshallwaivesuchbreach,condition,orcovenantoranypartofthiscontractastofutureperformanceofanyoralloftheconditionsofcovenantsofthiscontract.

3. Inadditiontoothercausesforterminationofthiscontract,thiscontractisautomaticallyterminatedwhenaresidentwithdrawsfromtheuniversityorstopsattendingallclasses(unofficialwithdrawal),orwhentheresidenthasreceivedwrittennoticefromtheuniversitythatthecontractiscancelledbecauseofabreachofthiscontract.Residentremainsliableforroomandboardchargesbeyondlastdateofattendanceifresidencehall/apartmentisnotvacatedimmediatelyuponterminationofthiscontract.Ifthiscontractisterminatedpursuanttothissubsection,theprovisionalcontainedinthesectionlabeled"CANCELLATIONOFTHEHOUSINGCONTRACT"shallnonethelessapply.

4. lftheleasedpremisesaredestroyedordamagedbyfireorothercasualty,thiscontractshallautomaticallyterminateunlessrepairedorrestoredbytheuniversitywithin30daysfollowingsuchfireorcasualty,orunlesstheuniversityprovidesotherfacilitiesinwhichtheresidentcanobtainroomandboard.Inthemeantime,totheextentthepremisesarenottenableandtotheextenttheuniversitydoesnotprovideotherfacilities,thehousingandboard(ifapplicable)shallabate.

5. Theresidentwillnotallowanypersonotherthananotherresidentassignedtotheroomtosleeporresideintheroomwithoutthepermissionoftheresidencehalldirectoroftheresidencehallorapartmentinwhichtheroomislocated.Theuniversitymayrequiresuchpermissiontobeinwritingandmayrevokethispermissionatanytimeinitssolediscretion.

6. Noresidentshallsubletorassigntheirleasedspacetoanotherperson.7. Thiscontractandtimessetforperformanceofthiscontractaresubjecttochange

becauseofstrikes,lockoutorotherlabordisputesanddisordersorcircumstancesbeyondtheuniversity´scontrolthatmayaffectthehealthorsafetyofstudentsoraffecttheeducationalfunctionoftheinstitution.Theuniversityreservestherighttocloseresidencehalls/apartmentsandfoodservicescontractedforatdifferentdatesandtimes,providedthatwhenservicesareofferedondifferentdates,thesedateswillbeinconformitywiththepurposeforwhichresidententeredintothecontract;forexample:duringtheacademicyear,springsession,summerschool,conferencesandsoon.

8. Theuniversityreservestherighttomakereassignmentsofaccommodationswithinitsdiscretion.

CONDITIONSOFHOUSINGPLACEMENT1. Uponcompletingyourapplicationandthiscontract,CentralMichiganUniversity

agreestoprovidelivingaccommodationsandmealsasoutlined(providingspaceisavailable)fortheacademicyearorremainderthereofandtogranttheuseoffacilitiesofthebuilding.

2. AsofMay1(December1forspringapplications),onlythosepeoplewhohavepaidthefirstroomandboardpaymentwillbeassignedspaceintheresidencehallorapartment.

3. IfyoufailtomakethefirstroomandboardpaymentbyMay1(December1forspringapplicants)youloseallchoiceofselectionofspaceandwillhaveyourapplicationcancelled.

4. IfyouapplyforhousingforthefallsemesterafterMay1(December1forspringapplicants)thefirstroomandboardpaymentmustbemadeatthesametimeyouapply.

5. Youmayberequiredtoshowproofthatyouhavebeenfullyacceptedasastudent.

LATEPAYMENTIfyoufailtomeetanyscheduledpaymentsyouwillbeassessedalatecharge.Ifunpredictablefinancialcircumstancesoccurandapaymentcannotbemadeontime,youshouldcontacttheStudentAccountServicesandUniversityBillingOfficepriortotheduedatetoseeifotherarrangementscanbemade;however,thepaymentisstilldue.

Youmayberequiredtovacateyourroomintheresidencehallorapartmentanddiscontinueeatinginthefoodunitifdelinquentroomandboardchargesarenotpaidaftertheduedateforpayment,otherthanthefirstscheduledpaymentdueMay1(December1forspringapplicants).

REFUNDAtthediscretionoftheuniversity,refundsmaybemadeforboardonlyforanyperiodoversevendaystemporaryabsencefromtheresidencehallorapartment,excludingofficialuniversityvacationperiods,duetoillnessasverifiedbyaphysician´sstatement.Youmayapplyforarefundbyfilingawrittenrequest.

CHANGESINRATESTheuniversityreservestherighttochangeroomandboardratesif,initsopinion,suchachangeisnecessary.

CANCELLATIONOFTHEHOUSINGCONTRACTTheOfficeofResidenceLifeHousingContractisfortheentireacademicyear,orremainderoftheyear,providedthestudentisenrolledattheuniversity.Theresidencyandfinancialconditionsofthiscontractshallnotbeterminatedtomovetoaprivatehome,fraternityorsororityhouse,orotherhousing,ortocommuteduringtheperiodcoveredbythiscontract.StudentswhobreaktheirHousingContractwithoutapprovalfromResidenceLifeofficialswillowefullroomandboardchargesfortheentireacademicyear.

Studentswhoareapprovedforreleasefromtheircontractforanyreasonaresubjecttothefollowingscheduleofcancellationcharges:

CANCELLATIONPOLICY

NewApplicantsOnly

CancellationofthiscontractafterMay1butbyAugust1willresultina$300cancellationfee.

CancellationofthiscontractafterAugust1(November1forspring)butpriortosemesteropeningshallresultina$500cancellationfee.

ReturningStudentsOnly

Priortoeachsemesteropening:

Duringtheacademicyear:

• Cancellationofthiscontractatthesemesteropening,butpriortoNovember1,shallresultinuptoa$900cancellationfee.

• CancellationofthiscontractafterNovember1,butpriortotheendofthesemestershallresultinuptoa$600cancellationfee.

• CancellationofthiscontractfromtheendofthefallsemesterbutbeforeApril1shallresultina$300cancellationfee.

• CancellationofthiscontractafterApril1shallresultina$100cancellationfee.

Allcancellationrequestsmustbeinwriting.

Otherchargesanddamagesmayapplyundertheprovisionoftheircontractsuchasdamagetoroom.IfastudentisnotapprovedforreleasefromtheirOfficeofResidenceLifeHousingContractandtheychoosetomoveanyway,theyarestillfinanciallyresponsiblefortheentirecontract.

RESIDENCELIFEHOUSINGENTRANCEANDSEARCHPROCEDURESCentralMichiganUniversityrecognizesandrespectsthestudents´desireforprivacy,especiallywithinthecontextofacommunitylivingenvironment.Theuniversityalsorecognizesitsresponsibilitytoencourageandpreserveawholesomelivingandlearningenvironmentonthecampus,toprovideadequatemaintenanceandprotectionofpublicproperty,andtoprotectthehealthandsafetyofallpersons.Thesefundamentalassumptionsareembodiedinthefollowingcommitmentsandproceduresconcerningtheentryorsearchofuniversityresidencehallroomsorapartments.

Theuniversityrecognizesthatitisdifficulttobalancetheneedtoencourageandpreserveawholesomelivingandlearningenvironmentandtheexpectationsofprivacyofstudentslivinginaresidencehallorapartment.Asaresult,thefollowingprocedureshavebeendevelopedtohelpdefinethereasonableexpectationsofprivacythatapersonshouldhaveinthesecircumstances,bearinginmindtheneedfortheuniversity,staff,anditsresidentstohelpcreateandmaintainaneducationallearningenvironment.Theseproceduresalsoprovideaguideforuniversitystafftoenablethemtoperformtheirdutiesandtomaintaincertainstandardsnecessarytosupporttheeducationalmissionoftheuniversityanditsresidentialcommunity.

A.ENTRANCEOFRESIDENCEHALLROOMSANDAPARTMENTS

Theuniversityreservestherighttoenterresidencehallroomsorapartmentsunderthefollowingcircumstances:

1. Byauniversityemployeewiththepermissionofaresidentoroccupant.2. Byauniversityemployeewhenthereexistsanimmediatethreattothehealthor

safetyoftheoccupants,individuals,oruniversityproperty.3. Byaresidencehalldirector(orsuperior)whenthereisareasonablebeliefthata

universityregulationhasbeenorisbeingbroken.4. Byaresidencehalldirector(orsuperior),ormaintenancepersonnelforrepair,

replacement,orinspectionofuniversityproperty.5. ByanOfficeofResidenceLifestaffmemberinordertocompletetheopeningand

closingoftheresidencehallorapartmentasapartofthecheck-inorcheck-outprocedures.

6. Byapoliceofficerwheneveritwouldbelegallypermissible.

B.SEARCHOFRESIDENCEHALLROOMSORAPARTMENTS

Theuniversityreservestherighttoenterorsearchresidencehallroomsorapartmentsunderthefollowingcircumstances:

1. Byauniversityemployeewiththepermissionofaresidentoroccupant.2. Byauniversityemployeewhenthereisanimmediatethreattothehealthorsafety

oftheoccupants,otherindividuals,oruniversityproperty.3. Byaresidencehalldirector(orsuperior)afterpermissionhasbeenobtainedfrom

anAssistantDirectorofResidenceLifeorhigher,whenthereisareasonablebeliefthatauniversityregulationhasbeenorisbeingbroken.

4. ByanOfficeofResidenceLifestaffmemberinordertocompletetheopeningandclosingoftheresidencehallorapartmentasapartofthecheck-inorcheck-outprocedures.

5. Byapoliceofficerwheneveritwouldbelegallypermissible.

C.USEOFEVIDENCE

Ifduringtheentranceorsearchofaresidencehallroomorapartment,evidenceofaviolationofuniversityregulationsisfound,theuniversitymayreferthestudentand/oroccupantfordisciplinaryaction.Theuniversitymayuseevidenceobtainedduringtheentranceand/orsearchduringtheuniversitydisciplinaryproceedings.Inaddition,ifotherwisepermittedbylaw,evidencesoobtainedmaybeusedincriminalproceedings.
