Shantona Chaudhury – Bio – 2017

Shantona Chaudhury is a partner at Pape Barristers. Her civil litigation practice includes tort, class actions, commercial litigation, civil procedure, professional discipline, administrative, and constitutional law. She has extensive experience in appellate litigation, having been counsel in over 20 cases at the Ontario Court of Appeal, several Divisional Court appeals, and also having argued at the Supreme Court of Canada.

Shantona is ranked in the Chambers Guide to Canada’s Leading Lawyers 2016, which describes her as follows: “Shantona Chaudhury is building an impressive reputation for herself in the appellate litigation space. One peer noted: ‘She is fantastic. She is one of the smartest lawyers out there right now. Her written work is outstanding.’ Clients describe her as a "brilliant advocate.’”

Shantona is also listed in the 2017 Guide to the Best Lawyers in Canada, and was named a litigation Future Star by Benchmark Canada in 2014, 2015, and 2016. In 2013, Shantona was recognized with a ‘Precedent Setter’ award by Precedent Magazine.

Prior to starting practice, Shantona clerked for Justice Ian Binnie at the Supreme Court of Canada, trained as a Fox Scholar pupil barrister in England, and obtained a master’s degree in law from the University of Oxford. Her early experience also includes internships at the International Criminal Tribunal for Rwanda and at the Parliament of Canada.

Shantona is fluently bilingual and was called to the bars of both Ontario and Québec in 2007. She holds a B.C.L. (Oxon.), a B.C.L./LL.B (McGill), a B.A.(Hons.) in French Studies and an M.A. in 18th century French Literature (Queen’s).

The Honourable Mr. Justice Grant Dow is a graduate of Brock University, receiving a Bachelor

of Arts degree (with distinction) in 1978 and of the University of Western Ontario with a Bachelor of Laws in 1981. Justice Dow was called to bar in 1983 and began practise with Gilbert, Wright and Flaherty specializing in personal injury and insurance litigation, becoming a partner in 1988. In 1994, Justice Dow co-founded the firm of Flaherty Dow Elliott, now Flaherty McCarthy LLP, and was its managing partner until appointed to the Superior Court of Justice on December 11, 2014. Justice Dow has previously presented papers and appeared on panels for continuing education at the request of The Law Society of Upper Canada, The Advocates Society and other organizations both while in practise and as a Superior Court Justice.

The Honourable Mr. Justice Stephen E. Firestone is a justice of the Ontario Superior Court of Justice. He is a past director of the Advocates Society and past president of the Ontario Trial Lawyers Association. He is the co-author with the Honourable A.M. Linden of Ontario Motor Vehicle Insurance Practice Manual, author of Halsbury’s Laws of Canada – Motor Vehicles (2015) and Ontario Motor Vehicle Insurance Law & Commentary published by LexisNexis Canada Inc. NIMALI D. GAMAGE is a partner at the law firm Goddard Gamage Stephens LLP in

Toronto. She is recognized in The Best Lawyers in Canada (2013-2017) in the field of Trusts and Estates. Nimali was called to the bar in 2001 and worked as a lawyer for the Walkerton Inquiry with then Associate Chief Justice Dennis O’Connor and commission counsel. In 2002, she joined the firm of Jan Goddard and Associates which became Goddard Gamage Stephens LLP in 2012. Susan E. Gunter, B.A., LL.B., LL.M. Dutton Brock, LLP Susan has been a partner at Dutton Brock since 2002. She holds a Masters of Law in Civil Litigation from Osgoode Hall Law School. Susan is a Past President of Canadian Defence Lawyers (2009-2010), the only national association of insurance defence litigators, and was a Board Member of CDL from 2004 to 2011. She acted as Chair of CDL's Insurance Roundtable Committee which liaises with the industry on common issues. Susan now serves as the DRI's General Council/State Representative for Canada and attends its regular meetings in the U.S.A. She was appointed to the Board of The Advocates' Society in Spring, 2012 and is currently the Vice-Chair of the Education Committee. Susan represents corporations and insurers in defence of civil liability claims. Her specialization is in the defence of professional liability, products, occupiers and motor vehicle liability matters. She has tried motor vehicle, regulatory negligence, insurance coverage, sexual assault, occupier's liability, marine law, disability insurance and medical malpractice cases. Susan has appeared several times in the Ontario Court of Appeal. Susan has chaired many continuing legal education programs, seminars and audio-conferences on insurance and civil litigation issues. She has lectured for the Canadian Defence Lawyers, the Advocates' Society, the Ontario Bar Association, the Law Society of Upper Canada Continuing Legal Education Program, the Osgoode Professional Development Program, the Toronto Lawyers Association, the Canadian Institute and the Canadian Society of Medical Evaluators. Susan has also chaired programs for and lectured to the Ontario Risk and Insurance Managers Society, the Ontario Insurance Adjusters Association, and has presented to the Risk and Insurance Managers Society (Canada) National Conference and the Canadian Insurance Claims Managers Association Ontario Branch. Naomi Horrox is Counsel and Team Manager, Practice Management at the Law Society of Upper Canada, where she provides leadership and oversight to the Practice Management Helpline, Practice Resources, and CPD Accreditation teams. She regularly speaks at conferences on practice management and ethical issues.

Naomi previously held the position of Counsel, Practice Management at the Law Society. In this role, Naomi provided confidential guidance to lawyers and paralegals who contacted the Practice Management Helpline on a broad range of ethical, professional responsibility, and practice management matters relating to the Law Society By-laws, Rules of Professional Conduct, and Rules of Conduct.

Prior to joining the Law Society, Naomi practised employment, labour, and human rights law at a national law firm. In this position, she provided practical and strategic advice to employers and represented them in all levels of Ontario courts and before various administrative tribunals. Naomi co-authored a book on employment standards and frequently published articles on employment and labour law topics. She was also an Instructor at the University of Toronto’s School of Continuing Studies and an Adjunct Professor at the University of Western Ontario.

Biography

Frank McLaughlin is a litigation partner in our Toronto office. Mr. McLaughlin’s practice focuses on the defence

of pharmaceutical product liability class actions, medical malpractice claims and various types of commercial

litigation. Mr. McLaughlin has represented clients at all levels of court in Canada. As a leading trial lawyer in the

field of medical malpractice, Mr. McLaughlin is particularly skilled in cases which involve medical/scientific

evidence. Frank has an exceptional record of success as lead counsel at trial and at the appellate level in a

broad range of cases. He has conducted over 30 trials, both jury and non-jury, and has appeared as lead

counsel in many appeals before the Ontario Court of Appeal, the Federal Court of Appeal, and the Supreme

Court of Canada.

In a ground-breaking case, Mr. McLaughlin was lead counsel for AstraZeneca in a proposed national

pharmaceutical class action (Martin v. AstraZeneca) regarding the atypical anti-psychotic medication Seroquel.

Mr. McLaughlin and his team succeeded in defeating class certification, which was the first successful defence

of a contested certification hearing for a prescription pharmaceutical medication in Ontario. Mr. McLaughlin

currently represents a number of innovator pharmaceutical manufacturers in the defence of putative

pharmaceutical product liability class actions across the country.

Mr. McLaughlin appears in the current edition of the Canadian Legal Lexpert Directory, a guide to the leading

law firms and practitioners in Canada, as a leading lawyer in the areas of medical negligence and personal

injury.

Mr. McLaughlin received his LL.B. from the University of Toronto in 1988, and was called to the bar in Ontario

in 1990. Frank developed his competitive drive as an athlete. Frank competed in three summer Olympic games

for Canada in 1984, 1988 and 1992 and won a bronze medal at the Olympics in Seoul, South Korea in 1988.

Frank was also a bronze medallist at the 1983 Pan American Games in Caracas, Venezuela and the 1986

Goodwill Games in Tallinn, Estonia.

Jerome Morse is a Fellow of the American College of Trial Lawyers and was certified as a Specialist in Civil Litigation in August 1990. Jerome was named the Best Lawyers’ 2014 Toronto Personal Injury Litigation “Lawyer of the Year”. Rikin Morzaria Overview Rikin Morzaria is a partner with McLeish Orlando LLP in Toronto. Since his call to the Bar in 2003, he has dedicated his legal career to serious personal injury and wrongful death cases, including medical malpractice, disability insurance, and products liability cases. Roger G. Oatley was called to the Bar in 1972. As a certified civil litigation specialist,

Roger restricts his practice to serious personal injury and wrongful death cases on behalf

of injury victims and their families. He has been a frequent speaker and demonstrator at

continuing education programs from coast to coast in Canada and in the United States,

including for the Law Society of Upper Canada, the Canadian Bar Association, the

Canadian Institute, Insight, Lexpert, the Canadian Trial Lawyers Association, the Ontario

Trial Lawyers Association, the Continuing Education Society of British Columbia, the

Advocates' Society, and the American Association for Justice. The Advocates' Society

and The Ontario Trial Lawyers Association have acknowledged his success as a jury

lawyer and his efforts to better the skills of advocates before juries. Roger has written

extensively on trial advocacy and personal injury law. He is the author of Addressing the

Audrey P. Ramsay

Audrey was called to the Ontario bar in 1995. She received a double Honours Bachelor of Arts degree (Political Science and French) from Wilfrid Laurier University in 1989 and her Bachelor of Laws degree from Ottawa University in 1993. Since her call to the Bar, she has handled a broad range of insurance defence work including commercial, professional negligence, property and casualty, and automobile insurance (both tort and accident benefits). She is a member of the Civil Rules Committee is currently Chair of the Ontario Bar Association (OBA) Awards Committee, and a member of the OBA Council. Audrey has served as Chair of the OBA Insurance Law Executive, Chair of OBA Civil Litigation Section, Chair of Sections (OBA), Chair of Professional Development and member of the Board of Directors of the OBA, and Chair of Counsel Forum at the Financial Services Commission of Ontario (FSCO). Audrey was awarded the Linda Adlam Manning Award in 2010 for volunteerism by the OBA. She has written articles, presented and chaired continuing legal education seminars organized by the Ontario Bar Association, the Law Society of Upper Canada, the Canadian Defence Lawyers, and the Canadian Association of Black Lawyers. Audrey is a past newsletter editor for both the OBA Insurance and Civil Litigation section newsletters. Stephen G. Ross, Rogers Partners LLP

Stephen G. Ross is a partner at the Toronto based law firm of Rogers Partners LLP.

Stephen Ross is a graduate of the University of Western Ontario where he received both his

B.A. (Dean’s Honour List) and LL.B., and was called to the Bar in 1993. Mr. Ross’ practice

includes civil litigation matters related to insurance law, personal injury actions, and

medical-legal issues. Mr. Ross has written numerous articles, including a comparison of

automobile insurance compensation legislation since 1990. He is a former Chair of the

Insurance Law Section of the OBA, and has co-chaired and lectured at conferences held by

The Advocates’ Society, the OBA, and other profit and not-for-profit organizations. Mr.

Ross has frequently been asked to consult with the government with respect to the

proposed changes to insurance legislation, and has appeared as guest lecturer at Osgoode

Hall on insurance law issues. Mr. Ross has been selected by his peers for inclusion in Best

Lawyers in Canada (2013 - 2016) in the area of insurance law.

Philippa G. Samworth is a partner at Dutton Brock and her area of practice is exclusively insurance defence with a specialty in Accident Benefits. Miss Samworth has a number of achievements and was retained by the Ministry of Finance of Ontario as a consultant to provide analysis and technical advice to the Ministry on its preparation and drafting of the new Automobile Insurance Legislation: Bill 59 and its regulations.

In May 1997, Philippa was appointed to the Minister’s Committee for Designated Assessment Centres as Chair from September 1998 - September 2000, and again from December, 2001 to February 2004.

In 2000, she was asked by the Government of Ontario to Chair on Advisory Committee to make recommendations regarding the definition of Catastrophic Impairment. In March of 2004 Miss Samworth was again retained by the Minister of Finance to conduct stakeholder consultations and provide advice and recommendations on proposals to replace the DAC system.

In October of 2007 Philippa was inducted into the American College of Trial Lawyers.

EducationPhilippa received her B.A. and LL.B. from Queen's University and was called to the Bar of Ontario in 1979. In 1990, she was certified by the Law Society of Upper Canada as a Specialist in Civil Litigation. In October of 2007, Miss Samworth was inducted into the American College of Trial Lawyers.

AwardsIn 2002 Philippa was the first recipient of the prestigious Canadian Defence Lawyers' Lee Samis award for excellence.

Philippa is a past President of the Advocates Society, a founding member of the Canada Defecnce Lawyers and a past President of the Medical Legal Society.

On April 27, 2006 she became the first recipient of the OBA Award of Excellence in Insurance Law.

Philippa has also been recognized in "Best Lawyers in Canada" annually since 2008.

Andrew Sanfilippo has practised in Ontario for 32 years, throughout in the defence of insured interests and in the defence of insurers. Andrew is routinely appointed as defence counsel in complex litigation, including cross-border, in several areas: including professional liability, products liability, mass tort, class actions and personal injury. Andrew has extensive experience as insurance coverage counsel, across all lines of insurance, providing advice in policy interpretation, litigating coverage disputes and acting as advisory, monitoring or settlement counsel.

Mr. Sanfilippo received degrees in law from the University of Windsor (LL.B, 1981) and from New York University (LL.M., 1982). Andrew has extensive continued study in alternate dispute resolution including as a Fellow of the Chartered Institute of Arbitrators (FCIArb) and study in mediation and negotiation at Harvard University. Andrew has experience as both counsel and as sole arbitrator in arbitrations involving insurance coverage disputes. He has acted as mediation counsel in over 550 mediations; in Canada across four provinces, and in the United States across six states.

Since 2006, Mr. Sanfilippo has been peer-rated by the Financial Post as one of the ‘Best Lawyers in Canada’ and is rated by LEXPERT Canada as "Repeatedly Recommended" in the areas of Commercial Insurance Litigation and Professional Liability. James L. Vigmond

Former president of the Ontario Trial Lawyers Association, Jim Vigmond continues to be a leading

figure of Ontario’s personal injury trial bar. At Oatley, Vigmond, Jim leads a team of lawyers and

support staff with broad expertise in spinal cord, brain injury and serious orthopedic

cases. Frequently called upon to help further the education of other trial lawyers, he has travelled

across the country, speaking on matters of trial advocacy and trial practice. Jim designed the course

‘Personal Injury Advocacy’ which he teaches at Queen’s University Law School. His students have

BIOGRAPHY – MAIA L. BENT

Maia obtained a BA from the University of Alberta in 1989 and an LLB from the University of Western Ontario in 1996. She was called to the Bar in 1998 and is a partner at Lerners, LLP in London, Ontario.

Maia practices exclusively in the area of plaintiff personal injury. Her primary focus is on motor vehicle collisions, but she also handles cases of physical and sexual assault, wrongful death, nursing home litigation, falls on property, product liability, and disability and life insurance litigation.

In 2012, the Ontario Brain Injury Association recognized her contributions with the Professional of the Year Award. She is a 2014 “Consistently Recommended” Lexpert ranked lawyer and is proud to have been selected by her peers for inclusion in the 2015 Best Lawyers in Canada in the area of Personal Injury Litigation.

Maia is currently President-Elect of the Ontario Trial Lawyers Association and is excited take the “big chair” in June of 2015.

Lindsay is a lawyer on John McLeish’s team. Lindsay received her undergraduate degree from McMaster University, where she was captain of the varsity swim team. Lindsay obtained two law degrees – one from the University of Windsor, and the other from the University of Detroit Mercy School of Law. Lindsay is a member of the Ontario Bar. Since being called to the bar, Lindsay has dedicated her practice to representing people who have been seriously injured or who have lost a loved one. Lindsay has published articles in Lawyers’ Weekly and is a contributor to Lexis Nexis’ Practice Advisor’s Personal Injury (Ontario) module. In addition, Lindsay has been invited to give lectures to other lawyers at the Law Society of Upper Canada and to health care professionals within the rehab community on issues related to personal injury law. Lindsay enjoys volunteering her time in the community. In 2016, Lindsay was appointed to the Board of Directors of the Brain Injury Association of Durham. She is also on the Steering Committee at Heads Up Durham, a local head injury awareness association. Lindsay is also a member of the Ontario Trial Lawyers Association and Advocates’ Society, the Ontario Bar Association and the Canadian Bar Association. In her free time, Lindsay enjoys working out, playing beach volleyball and ultimate frisbee, swimming, skiing, and golfing.

Jim Davidson is a Certified Specialist in Civil Litigation and head of the Insurance Defence Practice

group at Will Davidson LLP. Jim was called to the Alberta Bar in 1992 and to the Ontario Bar in 1993. Jim practices exclusively in the area of insurance law with a focus on personal injury and property claims. Jim is a current director of the Ontario Bar Association’s Insurance Law Section and a former director of Canadian Defence Lawyers. In addition to having represented individual and insurance clients as lead counsel in numerous jury and non-jury trials, Jim is also an extremely experienced negotiator. He is regularly retained by some of Canada’s leading insurers to resolve complex and multi-party disputes. Jim has a Masters of Law in Dispute Resolution from the University of Sydney, Australia. He is frequently asked to speak at legal conferences in the area of insurance law and has written a number of articles for legal and insurance related publications.

Eric Grossman Eric was called to the Ontario Bar in 1989 and has been certified as a Specialist in Civil Litigation by the Law Society of Upper Canada since 1999. Eric has been named by Best Lawyers International as one of Canada’s best lawyers in personal injury and insurance law in 2015. Eric continues to be recognized by Lexpert as a leading practitioner in personal injury law. He has been peer rated by Martindale-Hubbell for nineteen consecutive years. His entire legal career has been spent acting for insurers in litigation matters, both in defence and in subrogation matters, for a number of property and casualty insurers. Eric and his partners founded the firm Zarek Taylor Grossman Hanrahan LLP in 1997, as a six lawyer firm, and today it is 45 lawyers strong. Josh Nisker is a partner at McLeish Orlando LLP.

Josh was admitted to the Law Society of Upper Canada in 2007. He obtained his law degree from the University of Western Ontario in 2006 (With Distinction), and subsequently completed his Master of Laws (LL.M.) at Trinity Hall, at the University of Cambridge, in 2008.

Josh’s practice is devoted exclusively to plaintiffs’ personal injury and wrongful death cases, including occupiers’ liability and disability benefits claims. Prior to becoming a personal injury lawyer Josh practiced commercial real estate law at a leading Canadian law firm.

Josh has published on Canadian privacy law, American criminal justice, and Shakespeare. His article “Only God Can Judge Me: Tupac Shakur, the Legal System, and Lyrical Subversion” has been taught as part of the curriculum at a number of Canadian universities.

Joseph Y. Obagi, Connolly Obagi LLP Joseph Obagi is a partner with the Ottawa law firm of Connolly Obagi LLP, which he founded together with Thomas P. Connolly in 2008 with the purpose of focusing their respective practices on personal injury law, medical malpractice and disability law. Joseph is a graduate of York University's Osgoode Hall Law School and was called to the Ontario Bar in 1995. In 2006, he was certified by the Law Society of Upper Canada as a Specialist in Civil Litigation. He practices primarily in the Superior Court of Justice and the Court of Appeal for Ontario, although he has also acted as lead counsel in arbitration and administrative proceedings. Joseph's outstanding contribution as a litigator earned him the Regional Senior Justice Award in 2004, an award sponsored and presented by the County of Carleton Law Association. He was the award's inaugural recipient. In 2015, Joseph was named the Best Lawyers’ 2015 Ottawa Personal Injury Litigation “Lawyer of the Year”. Paul Tushinski, C.S., is a civil litigator. He was called to the Bar over 30 years ago and is the managing partner of the firm. He was admitted to the Ontario bar in 1985 after receiving his LL.B from the University of Windsor – Dean’s Honour List. He has received special calls to the bars of Nova Scotia and Nunavut. Adam Wagman is a Senior Partner, and the former Managing Partner at Howie, Sacks & Henry LLP. He was admitted to The Law Society of Upper Canada in 1996. He graduated from the University of Western Ontario with a B.A. (Mathematics) in 1991 and from the University of Toronto Faculty of Law. Adam is the proud recipient of the Ontario Brain Injury Association Professional Award.
