FOREWORDThe Cape Winemakers Guild was formed 34 years ago as a forum for its members to share knowledge, winemaking ideas and to taste the great wines of the world in order to benchmark and improve their own wine styles.

Since then, the Guild has evolved into a multifaceted organisation with a clear mission and vision to innovate and improve wine quality and to transform this great industry into something more reflective of the world that we live in today.

Our members still meet every month to taste wines from around the world and discuss and dissect the different styles in relation to what we are doing in South Africa.

Through our Oenology and Viticulture Protégé Programme we have been able to give young winemakers and viticulturists the opportunity to learn from and work alongside some of the best craftsmen in the wine industry. In recent years the Nedbank CWG Development Trust has expanded its mandate, assisting Wine Training South Africa in developing accredited training programmes for cellar workers.

The Guild’s first auction was held in 1985 with 19 wines from 15 members. The prices achieved wouldn’t even buy you a soft drink, let alone a bottle of mineral water today. Looking at last year’s record prices from 56 wines sold by 40 members, the Guild has certainly come a long way. Today’s wines stem from experimentation and innovation and reflect some of the most unique wines produced by our members.

sOuTH AFRICA’s FINEsT WINEmAKERsInnovation, benchmarking and the sharing of knowledge spanning over thirty four years of winemaking excellence, is the proud accomplishment of the Cape Winemakers Guild.

The Guild, an association of some of South Africa’s finest winemakers, has evolved into a body of 48 members who jointly represent the pinnacle of South African wine achievement.

All experts in their respective fields, Guild members have played a significant role in the development of the South African wine industry. From the making of champion port-style wines, the establishment of Méthode Cap Classique and Cape blends, to the opening up of new, cooler wine regions, the introduction of sustainable farming and environmentally responsible wines, Guild members have always been at the forefront of innovation.

AuCTIONThe annual Nedbank Cape Winemakers Guild Auction takes place on the first Saturday every October and showcases rare and unique wines produced in small quantities exclusively for this auction by Guild members.

The auction is open to the public and attracts wine collectors and local and international buyers from the retail and hospitality industries. Telephonic and Proxy bidding options are available for buyers who wish to bid but are unable to attend on the day.

The 2016 Nedbank Cape Winemakers Guild Auction, the Guild’s 32nd, will take place at Spier, Stellenbosch, on Saturday 1st October 2016 from 09:00. To bid on the auction and for access to the Bidders’ VIP Lounge, pre-registration is required before Friday 16th September 2016. mEmBERsHIpMembership, by invitation, is extended to winemakers recognised for their high standards of craftsmanship, who have been responsible for producing outstanding wines for a minimum of five years and are actively involved in operations in the cellar from harvest to bottling.

The CWG meets regularly as a technical tasting group, providing its members with an opportunity to evaluate wines from around the world and to share their knowledge and ideas – ensuring that CWG members remain leaders in the art and science of winemaking.

THE NEDBANK CApE WINEmAKERs GuILD DEVELOpmENT TRusTThe Nedbank Cape Winemakers Guild development Trust was established in 1999 to support social development through further education in the South African wine industry.

The Nedbank Cape Winemakers Guild Development Trust and Protégé Programme are funded through donations as well as proceeds raised by Guild members at charity events throughout the year.

The current projects of the Nedbank Cape Winemakers Guild Development Trust include the Guild’s Oenology and Viticulture Protégé Programmes, the AgriSeta Billy Hofmeyr Bursaries and Wine Training South Africa.

By cultivating, nurturing and empowering promising oenologists and viticulturists, the Cape Winemakers Guild Protégé Programme plays an active role in the transformation of the industry to ensure its long term health and sustainability.

The Protégé Programme was launched in 2006 to give aspirant winemakers the opportunity of working alongside and being mentored by the members of the Guild; as well as attending many life skills, wine tasting, marketing and business courses to set them on the road for success as future leaders in the South African wine industry.

In 2014, following the success of our winemaking Protégés, the CWG joined forces with VinPro and launched the CWG VinPro Protégé Programme to give recently graduated viticulturists hands on training with regards to the intricacies of cultivation practices to ensure quality grapes for the production of diverse wine types and styles.

To date, 20 Protégés have participated in the programme, with 12 having graduated and now working within the industry. A further 8 Protégés are currently participating in the Programme.

In addition to the internships, the Protégé Programme also offers Billy Hofmeyr AGRI Seta bursaries to final year Viticulture and Oenology students at Stellenbosch University and Elsenburg Agricultural College.

Old unirrigated bush vines with yields of 3-5 tons/ha were used to make this wine. The grapes were destemmed, sorted, crushed and fermented in open top “kuipe” for three days. The wine underwent malolactic fermentation in barrel and spent a total of 19 months in barrel.

Tasting Notes: Deep red, almost black colour with plum, blackberry and cake spice on the nose. Beautiful richness and balance on the palate for such a young wine, gives a glimpse of what is to come.

The wine will be ready for drinking in 2018.

The grapes for this wine were hand-picked and sorted for optimal quality and ripeness. Barrel maturation of 21 months, using 70% new and 30% second fill French oak barrels, created an elegant, ageable wine. The balance of this Cabernet was used as the foundation for our flagship red blend, the Mackenzie.

Tasting Notes: Vanilla, cassis and cedar on bouquet entry, followed by sour cherry and plum notes. The palate is crammed with crunchy black and red fruit with a richness ending in fine dry, lingering tannins.

Drink from 2018 to 2029.

This reserve Chardonnay is traditionally made using natural, wild yeast from the acclaimed Nine Yards Chardonnay vineyard. Intensely concentrated lemon-lime flavours and slow fermentation in 228 litre Burgundian oak barrels for twelve months has resulted in a classic style with a new world twist. Quartzite veins through the 600 million year old granite sub-strata provide the backbone for the mineral flavours. Regular barrel rolling accentuates the rich, leesy character in this elegantly expressive wine.

Tasting Notes: An iconic Chardonnay with intense, mineral, lemon-lime flavours and hints of butterscotch and vanilla. The full, rich mouthfeel and balanced oak integrate superbly with the tropical fruit finish.

This wine is packed in wooden boxes.

This wine will be ready for drinking from 2017 onwards.

Only two barrels were made from Syrah sourced from a tiny, unique parcel grown on decomposed schist soil at the Porseleinberg farm. Spontaneous fermentation took place in concrete fermenters with 10% whole bunches, the rest was destemmed but not crushed. The wine was matured for 18 months in older barrique.

Tasting Notes: The vibrant nose exudes violets, whiffs of pepper and dark plums. The palate is structured with layers of blue – and blackberry fruit, hints of gun flint, lithe tannins and perfume in abundance.

This wine will be ready for drinking in 5 years’ time.

The Chardonnay and Pinot Noir were whole bunch pressed and only the cuvée fraction used. A small portion of Chardonnay was fermented in Piece Champenoise barrel to promote the creamy texture and complexity. The Pinot Noir adds palate weight and length of flavour. The wine was matured for 72 months on the lees prior to disgorgement. Note: This wine was sold at the CWG Auctions of 2014 = 60 cases and 2015 = 60 cases. All with different time on the lees and disgorgement dates.

Tasting Notes: On the nose there are notes of brioche, lemon and crisp apple fruit, with hints of yeast and cashew. Ripe citrus and rich raspberry bursts onto the palate with a gentle mousse and creamy texture.

Tasting Notes: Very typical ripe cherry aromas from a great vintage with an extra savoury dimension emanating from seven years ageing in bottle under ideal conditions. The palate is clean with velvety soft tannins.

The Shiraz portion is from our oldest vineyard, fermented in open bins with hand punch-downs. Totally natural ferment. Pressed and allowed to finish malolactic fermentation in barrel. The Cabernet portion is from our own vineyards; very small berry so gentle punch-downs not to extract too much tannin. Pressed and sent to barrel. After malolactic fermentation, both wines were racked and the blend made up and returned to barrel for a further year’s maturation. Only second filled French oak barrels were used to allow the fruit to come to the fore.

Tasting Notes: Colour – deep and dark to the edge of the glass. Nose – dark cherries, hint of lavender, cloves and Dutch Speculaas biscuits. Palate – rich, juicy entry with plums, cherries, cinnamon and aniseed. Taut mid-palate showing freshness and fine tannins to polish the long finish.

Fermented in small, tight-grain French oak barriques, custom ordered from very specific Burgundian coopers, this wine was barrel aged for a further 9 months before being bottled.

Tasting Notes: This wine is Ataraxia’s terroir in a bottle! Signatured by an underlying minerality, it effortlessly manages to be simultaneously intense and subtle. An extraordinarily complex, precise Chardonnay.

To ensure maximum fruit and colour retention, the grapes were hand-picked in the cool of the night. The crushed berries were given a 48 hour cold maceration prior to fermentation. Manual punch-downs were done three times a day to extract tannin and colour. Skins were pressed at 5° Balling. Malolactic fermentation took place in barrels. Matured for 22 months in one new and one second fill French oak barrel.

Tasting Notes: Intense dark red colour. This wine has a complex and multi-layered fruit spectrum, which ranges from red fruit aromas to spicy elegance and a blackberry richness. Silky, ripe tannins on the palate.

Exquisite parcels of Bottelary Tempranillo and Piekenierskloof Grenache were vinified separately in open top fermenters. Towards the end of fermentation, the wine was racked into 100% new oak where the wine completed fermentation. After malolactic fermentation, individual components were classified and selected for inclusion into the 2013 Insignium blend. 17 months barrel maturation followed.

Tasting Notes: Deep in colour, this youthful elemental wine shows wonderful overlapping of aromas and flavours. Although oak is obvious on the nose, ripe sweet fruit is finely poised. Rich, ripe, generous soft mid-palate with a juicy impression is supported by layered complexity. Well defined fine-grained tannins will allow for continued evolving in the cellar over time.

Both the Chardonnay and the Pinot Noir were picked by hand and then gently whole bunch pressed. The Chardonnay juice was barrel fermented and aged in large old French oak barrels to enhance the creaminess and complexity and add palate weight. The Pinot Noir juice was tank fermented in order to accentuate the bright berry characters. After blending, the wine was bottle fermented and aged on the lees for 53 months. After disgorging the wine was aged for a further six months on the cork.

Tasting Notes: The Chardonnay imparts distinctive citrus and chalky characters while the Pinot Noir contributes strawberry nuances. Subtle oaking adds an extra dimension of complexity. Pure elegance is the end goal.

Best drunk from 2019 onwards.

Seadragon is a parcel sourced out of a 1ha vineyard that is the heartbeat of the Newton Johnson farm. The bunches were selectively picked by the family, along a narrow contour of broken up claystone in the granitic soil. Made without sulphur in the winemaking, it allows diverse and dynamic micro-organisms from the grape itself to flourish unrestrained in the fermentation. 11 months maturation, with a further six months élevage in larger oak. Unfiltered, it will improve over many years in bottle.

Tasting Notes: Ornate with high floral notes. Complex and lustrous red fruit core, with the prickle of spices and black cherry in the periphery. Symmetric structure, fine and taut, that leads to a long finish.

The grapes were hand-picked in the cool of early morning. Grape bunches were gently destalked and lightly crushed. On the sorting table, all excess stalks and rotten berries were carefully removed by hand. Fermentation took place in small 300 litre open top oak barrels with three weeks’ extended maturation. The wines were punched down manually five times per day ensuring maximum colour extraction from the skins. Each variety was separately vinified and blended after 18 months of maturation.

Tasting Notes: Bold and invigorating from start to finish. A balance of seamless structure and elegant generosity. Black and blueberry notes dance on the nose and with time, floral aromatics are coaxed from the glass.

Grapes hand harvested from low yielding vines grown on weathered shale soils were picked in the early morning hours, force-cooled, hand-sorted and transported by gravity to an open top fermenter. A three day cold-soak preceded fermentation which was allowed to start naturally and inoculated half way with D254 yeast. Five punch-downs were done per day. After fermentation the wine went through malolactic fermentation and was aged for 20 months in new French oak barrels. The best barrel of this vineyard was selected.

Tasting Notes: Succulent ripe fruit flavours are complimented by scents of violets and spice. The mouthfeel has depth with pure fruit clarity, integrated oak flavours, finely crafted tannins and a silky finish.

This wine was made from a selected patch of earth in our GS vineyard, where the vines have very low vigour and give low yields. The small batch of grapes was fermented in an open tank with daily punch-downs. Malolactic fermentation and barrel maturation in a 300 litre new French oak barrel followed for 24 months before egg white fining, filtration and bottling took place.

Tasting Notes: Brooding, deep red colour. Nose of crushed cassis and mulberry fruit with cinnamon spice follow onto the palate, red fruits are ensconced in fully ripe grape tannins and wood spice.

The grapes were selected from 28 year old Chardonnay vineyards, the oldest on the property in Elgin. After whole bunch pressing, the juice was settled naturally. The juice was then transferred to barrel for fermentation without inoculation. The barrels used for this wine are from selected Burgundian cooperages, one third was new wood. The wine was left on the gross lees for nine months before racking, stabilisation and bottling.

Tasting Notes: The first impression is the expressive yet elegant citrus character on the nose. The palate is bursting with flavour, lime notes and oatmeal carrying through to a concentrated mid-palate long finish.


This wine is ready for drinking now – or keep it for a special occasion 5 years from now.

Barrel maturation took place in 225 litre medium toast, tight grain oak barrels for 15 months.

Tasting Notes: The Shiraz shows great fruit intensity of mulberries and blackcurrants with a combination of sweet spice and violets on the nose. A firm, ripe tannin structure on the palate. A wine crafted to last.

Since 2010 I have been bulk filtering the solids of my Chenin juice. This is the 2015 version. I always found fascinating herbal, acidic gritty flavours in these solids. So with the help of a bulk filter I cleaned up this juice and then fermented it in barrel for about seven months. Occasionally winemaking experiments produce something amazing. I love the Afrikaans description for when something is amazing it’s, “Moerse”! This was a “moerse lekker” portion of lees (also known as “moer” in Afrikaans).

Tasting Notes: Aromatic intensity with passion fruit and herbal aromas. Bright colour. Fresh, intense entry onto the palate. Spicy herbal and fruit driven flavours that linger on a very energetic palate. Young!

This wine was made from grapes in the Helderberg region, where selected parcels were separately harvested, wild fermented, punched down and left to age in French oak barrels. The wine spent 24 months in French oak of which 50% were new.

Tasting Notes: Wild berries, ripe plum, cassis, luscious cedar and spice flavours abound on the nose of this expressive Cabernet Sauvignon/Shiraz blend. Chewy tannins and a lingering aftertaste.

Tasting Notes: Perfumed fruit, violets and hints of white pepper aromas show typical characters of the SH99 clone. Firm but fine tannins give this wine a great ageing potential. A must try for all Syrah lovers.

The grapes were hand-picked in small crates and chilled overnight before whole bunch pressing yielded only the free run juice. All three varieties were fermented in seasoned French oak using natural and cultured yeast. Fermented and matured on the primary lees with some battonage for nine months before blending and bottling. Gentle handling and minimal interference preserved the full potential of the delicate flavours.

Tasting Notes: Floral with zesty citrus rind and lime aromas. Sweeter, ripe yellow apple and nectarine fruitiness with subtle scented oak spices that add a further dimension to the silky texture on the palate.

The wine will be ready for drinking from 2017 to 2021.

The grapes were hand-picked into small shallow picking crates and placed in a cold store overnight. The following day the cold grapes (6°C) were whole bunch pressed to a stainless steel tank for overnight settling. The settled juice was moved to barrel for fermentation which took place spontaneously. The wine spent a total of 11 months in 228 litre barrels of which 33% were new. Only sulphur dioxide was used in the production of this wine, there was no fining, stabilisation or filtration.

Tasting Notes: There are intense aromas of fresh pineapple, citrus blossom and freshly baked brioche. The palate is full of flavours – white peaches, roasted almonds and lemon preserve.

Hand-picked fruit, nourished by the shale soils of the Ceres Plateau, was crushed before undergoing three days of cold maceration on the skins. It was then fermented in a stainless steel tank for approximately six days with gentle pneumatic punch-downs. The wine was then carefully basket pressed and transferred to 2nd fill French oak for malolactic fermentation on the fine lees, after which it was moved into other 2nd and 3rd fill French oak barrels for a maturation period lasting 12 months.

Tasting Notes: A lusciously classical Pinot Noir nose greets one, with perfumed dried rose petals in unison with dark maraschino cherry and cranberry fruit, aptly underscored by hints of clove and roasted almonds.

The grapes from pockets of vineyards on Nitida were hand-picked at different ripeness levels to best express the Nitida terroir. A portion of the wine was fermented in French oak barrels using only natural/wild yeasts. Thereafter the wine was left on the lees for four months to enhance the typical varietal characters. The final blend is made up of 68% barrel fermented (10% 1st fill barrels) and 32% tank fermented Sauvignon Blanc.

Tasting Notes: A true reflection of Nitida terroir. Fruity stone fruit, featuring peaches and apricots with nettles, fynbos and peas around the edges. Long, moreish, crisp palate with a light, creamy aftertaste.

The Cabernet is selected barrels from two different vineyards and the Syrah is a special vineyard growing on the slopes of the Helderberg mountain. Both varieties were pumped over and punched down 5 times a day in open top fermenters; with a total time of 15 days’ maceration on skins prior to pressing. Malolactic fermentation was in barrel. The Cabernet Sauvignon was matured in new barrels and the Syrah in a 3rd fill barrel. Blending was in June 2014 and bottling December of the same year.

Tasting Notes: The initial flavour is very spicy but changes to enticing rose petal and red cherries with aeration. The palate has lovely grainy tannins, a minerally centre core and chocolate powder finish.

The wine will be ready for drinking from 2020 through to 2023.

The most important winemaking decision happened many years before the first grape for this wine was ever harvested. It was a decision of what type of grape to plant where, and in what specific way. To this extent, this wine was conceived and dreamt about over 15 years ago. We chose specific clones of specific varieties, married them to specific rootstocks, planted them on carefully prepared soil, in particular sites on a unique farm. Many years later, this vision bore fruit and the simple, foreseen winemaking process took place. Manual punch-downs, wild yeast, unfiltered and unfined. Natural, hand-crafted wine.

Tasting Notes: A harmony of ripe plum, dark cherry and raspberry fruits on the nose, lifted by signature spice, buchu and dried herbs. The palate echoes the nose, supported with smooth, lingering tannins. The wine is complex, but balanced by freshness and vitality.

Chardonnay grown on weathered shale soil on the estate was whole bunch pressed and the cuvée was fermented in seasoned French oak. During winter only three barrels of outstanding quality were selected out of a total of more than 100. Matured for 15 months on the primary yeast lees and bottled. Cellared on the yeast sediment in the bottle for four years and disgorged in April 2012. Matured on cork for another four and a half years. Chêne means oak.

Tasting Notes: Presenting lemon meringue and roasted almond aromas with rich buttered brioche on the palate. Nine years of evolution has created an exquisite array of flavours balanced by a lingering acidity.


After maturing for 9 years, this wine is perfect to drink now.

After fermentation the wine went through malolactic and was aged for 22 months in new French oak barrels. The best barrel of the various cultivars was selected and one barrel blended. No filtration.

Tasting Notes: A deep dark colour with prominent ripe plum, red berry, floral and fynbos flavours is supported by balanced oak, firm yet accessible tannin and a full- bodied mouthfeel.

The grapes were sourced and selected from our highest lying mountain vineyards on De Rust Estate and are all new clones (667,113,115). After harvesting at night, the grapes were destemmed and transferred without pumping to four ton wooden fermenters, cold soaked for nine days with the fermentation starting without inoculation. Punched down twice a day and after fermentation only free run wine was transferred to 300 litre barrels for maturation. The wine was then left in barrel for 11 months before bottling.

Tasting Notes: “Understated”, the colour is gentle and alluring, the nose reticent but intriguing. All in all, captivating! Red stone fruit combined with sweet cherry blossom fragrance, great texture and elegance.

A blend of the best ‘Cobblers Hill’ barrels and a reserve Cabernet Sauvignon, this wine has been named ‘Sophia’ after the legendary mother of Faith, Hope and Charity. Representing the characteristics of the three Bordeaux varieties that make up this exceptional wine, the Cabernet Sauvignon, Cabernet Franc and Merlot grapes were harvested from the best hillside vineyards at Jordan, which overlook Table Mountain and False Bay. Fermented at 28°C with three pump-overs daily over the fermenting cap. After pressing, the wine was racked to barrel where it completed malolactic fermentation. The wine spent a total of 26 months in 225 litre French oak barrels to integrate the rich tannins and gain complexity.

Tasting Notes: Complex, dark chocolate, black cherry and cassis intertwine with rich blackberry fruit and hints of vanilla and spice from the integrated French oak. Densely layered ripe tannins add to the opulent finish.


Well-structured, this wine will reward careful cellaring for many years to come.

Hand-picked and sorted, the grapes were selected to be the very best. 50% new and 50% second fill French oak barrels were used to mature this wine for 21 months. This wine is a blend of our two flagship Shiraz wines, the Gravel Hill and Stork.

Tasting Notes: The wine shows a black-red coloured centre. Bouquet entry shows initial perfumed notes, then cherry, violets, spice and garrigue. The palate is polished and opulent, ending with fine lingering tannins.

1. All prospective bidders must register for the Auction by completing an Auction Purchasers Card and providing proof of identity and residence prior to making any bids during the auction.

2. A person who intends to bid on behalf of another, must produce a letter of authority expressly authorising him or her to bid on behalf of that person, and both that person and the person bidding on his or her behalf must provide a copy of proof of identity and residence.

3. 1. The Auction conditions shall govern the relationship/s between the Auctioneer, the Guild, the Seller, the Bidder and the Purchaser and / or the Product and / or any matter relating thereto or resultant there from.

2. Every sale shall be subject to the control of the Auctioneer who shall have the sole right to regulate the advance in the bidding. Every bid shall constitute an offer to purchase the product or any lot auctioned for sale at the amount bid. The Auctioneer reserves the right to withdraw any Lot or Lots or to vary the order of same.

3. The highest bidder at the Auction shall be the person indicated by the Auctioneer by the fall of the hammer or by such other means as he may select. In the event of a dispute arising between any two or more Bidders, the Auctioneer shall have the right in his sole discretion to declare the sale to be of no force or effect and to re-sell the Product in question, alternatively to select the Purchaser to whom the respective lot shall have been sold. The Auctioneer may accept or reject any bid without giving a reason. The Auctioneer’s decision in all cases is final.

4. Registration to purchase wine at the Auction implies that the Purchaser is familiar with, and fully accepts, the Auction Conditions of Sale details as contained herein.

5. Upon registration, the Purchaser will pay a refundable deposit of R5 000, either by credit card, bank guaranteed cheque or cash cheque. Such deposit payable shall be at the discretion of the Guild.

6. The Auctioneer will issue, upon request, pro-forma invoices (excluding VAT, delivery and insurance) on the day of the Auction.

7. The Auctioneer, Guild and / or Seller shall be entitled to correct any error in calculation in the pro-forma invoice and /or incorrect information that may be reflected thereon.

8. Final tax invoices (including VAT, delivery and insurance where applicable) will be presented to Purchasers by the Sellers within 14 days of the Auction.

9. Payment must be made upon receipt of the final tax invoice either by cash, cheque, and transfer into the Guild’s bank account or credit card. The Guild reserves the right to charge interest on payments not received within 30 days of receipt of invoice.

10. Ownership will not pass until the purchase price has been paid in full. No Lot or Lots may be removed until then.

11. All Purchasers are to take possession of their purchases within eight weeks from the date of Auction unless otherwise arranged. The Guild reserves the right to charge storage fees on wines not collected by 30 November 2016.

12. The price bid for any product shall not include Value Added Tax, Insurance, Transportation, Export Charges and FOBBING costs of any wines shipped overseas.

13. The risk in the product shall pass to the Purchaser upon the Product leaving the premises of the Seller. In the case of the Product being exported, the risk shall pass to the Purchaser on delivery of the Product to the shipping agent / freight forwarder.

14. Overseas Customers paying by foreign bank transfer are responsible for paying both their own (local) and beneficiary (overseas) bank charges. These charges may not be deducted before making payment to the CWG.

15. The Seller shall dispatch the Product purchased at the Auction within 60 (sixty) days from the date of the Auction provided payment by the Purchaser has been received in full by the Guild.

16. The sale is voetstoots. No warranty is given or implied by the designation in the catalogue and no allowance whatsoever will be made for misdescription or errors of whatsoever nature. A bid shall be taken as proof that bidders have made themselves acquainted with the Lot for which they have bid.

17. The Auctioneer’s Vendue Roll of Sale is final and no dispute will be taken into consideration as to the correctness of the same. All lots knocked down are at the risk of the Purchaser at the fall of the hammer.

18. The Auctioneer and / or the Guild are prepared to execute bids on behalf of buyers if instructed to do so. Notwithstanding the acceptance of a Postal Bid Mandate by the Auctioneer and/or the Guild, the Auctioneer and/or the Guild shall not be obliged to execute such a bid and the Purchaser shall have no claim in damages whether direct or indirect or consequential from whatsoever cause arising against the Auctioneer, the Guild and/or any person nominated by the Guild.

20. The Purchaser consents to the jurisdiction of the Magistrate’s Court and the Auctioneer has the sole discretion to institute an action in the Magistrate’s Court, if appropriate and applicable.

21. In the event that it becomes necessary for the Auctioneer, the Guild and / or the Seller to take any legal action to ensure performance of these conditions or any agreement concluded, pursuant thereto or in respect of any transaction which is governed by these conditions, the Purchaser shall be obliged to pay the Auctioneer, the Guild and / or the Seller as the case may be, all legal costs and expenses incurred on the sale as between attorney and own client including collection commission and the Auctioneer, the Guild and / or the Seller shall be entitled to claim the same.
