Dan Jewell Trial Institute Overview This is a seminar designed to help less experienced lawyers learn and develop skills necessary to try a lawsuit. The issues presented in the selected case are (1) whether the decedent has testamentary capacity, and (2) whether the will offered was procured by undue influence. THE NEBRASKA STATE BAR FOUNDATION Hon. John M. Gerrard Judge John M. Gerrard, United States District Court for the District of Nebraska, received his law degree in 1981 from Pacific McGeorge School of Law in Sacramento, California. He then returned to Norfolk where he was in a law practice that focused on both civil and criminal litigation. He is an elected member of the American Board of Trial Advocates, and he was board certified as a civil trial specialist by the National Board of Trial Advocacy. From 1995 to 2012, Judge Gerrard served as a member of the Nebraska Supreme Court where he authored numerous opinions. Ronald E. Reagan Ronald E. Reagan is a partner in the Omaha firm of Reagan, Melton & Delaney, L.L.P. He received his law degree in 1967 from Creighton University of Law and maintained a general practice firm during the next five years. He was appointed to the District Court Bench in 1972 and served until his retirement in 2005. During his judicial career, he heard over 3,000 criminal cases and more than 12,000 civil cases. He also served several times with the Nebraska Supreme Court, publishing several opinions. Today, his law practice is focused on general civil litigation. Hon. James T. Gleason Judge James T. Gleason serves as Judge of the District Court, 4th Judicial District, in Douglas County. He earned his J.D. from Creighton University School of Law in 1969. Prior to being appointed to the bench, James Gleason was in private practice in Omaha and was also a State of Nebraska Department of Labor Administrative Hearing Officer. He is a member of the American Bar Association’s Judicial Division and the National Conference of State Trial Judges’ Executive Committee and is Chairman of the organization’s Jury Management Committee. Participants will have an opportunity to examine and impanel a six-person jury, make opening statements, call and examine witnesses, cross-examine witnesses, produce deposition evidence, offer exhibits, review instructions, and argue the case. Each trial will have a trial judge, and performance judges who will offer a constructive critique of each student’s performance. Each trial will have two attorney students representing the proponent and opponents of the will. If arrangements can be made, part of each trial will be videotaped to assist the students and performance judges. This is a two-day seminar that will be held at the Creighton University Skutt Student Center on August 12–13, 2016. The cost of the seminar is $200.00 per student. Twelve (12.0) hours of CLE credit is approved by the Nebraska Supreme Court MCLE Commission. This project has been funded through a bequest left by the late Dan Jewell, a respected attorney and trial lawyer from Norfolk and a former president of the Nebraska State Bar Association. Dan served on the Bar Foundation Board for over 20 years. Dan wanted to further the education of trial attorneys in the State of Nebraska and this Institute honors his vision.

MiscellaneousEach side will produce one or two live witnesses. Biographies are included in the seminar packet for those witnesses attorneys chose to present live. Packets have deposition excerpts from other witnesses, but each side must determine which questions and answers they wish to offer in evidence. Depositions are not

to be marked and offered as exhibits. Unavailability of deposed witnesses is assumed and need not be shown.

Each packet will have a biographical summary for each prospective juror. It is planned to have 10 prospective jurors for each trial, so it will be incumbent upon the students to question the prospective jurors

to develop any biases which may support a challenge for cause or preemption. Students should be aware that biographical information of prospective jurors is not normally available, but made so in this seminar as a time saving mechanism.

Acceptance into Institute: A letter of acceptance will be e-mailed to the address given on your application form. A maximum of 6 students will be accepted.

Institute Information: The Institute was created to further the education of trial attorneys in the State of Nebraska. The Institute will be held on the Creighton University campus. The class locations will be provided with your course materials, which you will receive electronically on July 12, 2016. Students are required to bring a laptop. Students are also required to print all materials prior to arriving on campus and to have read and studied the demonstration fact pattern.

If accepted, a payment of $200 shall be mailed to the Nebraska State Bar Foundation by July 22, 2016.
