The Minutes of the 214th Meeting of the NRC held from April, 24th to 25th, 2013

The 214th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 24th April, 2013 to 25th April, 2013 at NRC, NCTE, Jaipur.

The Regional Director, NRC apprised the members of Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

orders of the Hon’ble High Court. NRC in its 210th Meeting decided to direct the institution to inform NRC about its willingness to get any one of the applications processed further. Hence, the application for B.T.C. Course is closed, because the reply of institution dated 19.02.2013 has not specified any one application for further processing.

Hence, NRC decided that VT be constituted with reference to File No. UP-3338 for B.Ed. Course and file No.NRCAPP-2104 for D.EL.Ed. Course be closed as per clause 8 (2) & 8 (3) of NCTE Regulations.

Hence, NRC decided that Show Cause Notice under section 14/15 (3) (b) of NCTE Act, 1993 be issued to the Institution on the above point and direct the Institution to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 21 days from the date of issue of Show Cause Notice.

The institution has enclosed the teachers list as approved by the affiliating university i.e. C.S.J.M. University, Kanpur vide letter no. CSJM University/Samb/974/2012 dated 22.03.2013. It appears that the letter’s dated is overwritten. This is distinctly stated in the letter that the name of Dr.Asha Shukla as recommended by the Selection Committee has not been approved by the University authorities because of certain authorities because of certain specific reasons. In the enclosure-I, the institution has stated about Dr. Ram Prasad Singh continuing as Principal of the College. The University has stated categorically that Dr. Ram Prasad Singh’s selection as Principal shall remain valid upto attainment of the age of 65 years (which completed on 9.01.2013) vide letter No. 4187/2011 dated 07.12.2011. In this context, it is presumed that the B.Ed. College runs without a Principal. The recognition for additional intake of B.Ed. cannot be given without appointment of a Principal duly approved by the affiliating university.

The Hon’ble Supreme Court vide its judgment dated 31.01.2011 I SLP No. 17165-168/2009, has held that the provisions contained in Section 14 of the NCTE Act 1993 and the Regulations framed for grant of recognition including the requirement of recommendation of the State Government/Union Territory Administration are mandatory and an institution is not entitled to recognition unless it fulfils the conditions specified in various clauses of the Regulations.Further, the Hon’ble Supreme Court in its judgment dated 06.01.2012 in SLP (C) No. 14020/2009, has held that the State Government/UT Administration, to whom a copy of the application made by an institution for grant of recognition is sent in terms of Regulation 7(2) of the Regulations of the NCTE, is under an obligation to make its recommendation within the time specified in the Regulations 7(3) of the Regulations.

The NRC noted that the NCTE Committee vide letter dated 20.3.2013 made it is clear that the general recommendations of the State Government were applicable in each individual case, since in view of the Hon’ble Supreme Court’s orders, it is mandatory to obtain the recommendation of the State Government.

In view of the above judgement of the Hon’ble Supreme Court and the decision taken by the NCTE Committee, the NRC decided that the recommendations of the State Govt. of Rajasthan i.e. not to allow setting up of new D.El.Ed. institutions in the State be accepted and the applications so received be returned to the respective institutions. Also the application fees be refunded to the applicants.

“Regarding, Minority Institution, the State Government be asked to give specific recommendation for the Minority Institution. Keeping in view of the Public Notice issued by the NCTE mentioning that the restiriction will not appliy in case of Minority Educational institutions estasblisment under Artical 30 of the constitution.

The Hon’ble High Court of Punjab & Haryana at Chandigarh while disposing of the writ petition in the light of the directions of the Hon’ble Supreme Court of India in the Civil Appeal No. 3505/2012 arising out of SLP (C) No. 233/2011 vide order dated 12.4.2012 directed the NCTE to continue with its exercise regarding verification of infrastructure available with the colleges as has been mentioned in affidavit placed on record and also directed to take action against the colleges violating the norms laid down by it after proper verification as per the provisions of the NCTE ACT, Rules and Regulations.

The Northern Regional Committee considered the case of the institution in detail. The Committee after going through the Reports of the affiliating University, VT report alongwith all other related documents submitted by the institution viz a viz provisions of the NCTE Act, Rules & Regulations observed the following:-

(i) The VT report states that five teachers were recruited for D.El.Ed. programme. This is not fulfilling NCTE norms for seven teachers with a full-fledged Principal for D.El.Ed. Course. The list of D.El.Ed. teachers has not been given in prescribed format. The lists of faculty members of B.Ed. have not been approved by the affiliating university. The university team has noted shortage of teachers in B.Ed. Programme. The list of D.El.Ed. Teachers has not been approved by SCERT of concerned State. The salary is paid in consolidated form.

(ii) The land of the institution is on private lease for 30 years. As per NCTE Regulation, 2009, the institution must own the land with registration in its own name.

(iii) The size of the multipurpose hall is of 1550 S. Ft., it should be of 2000 Sq. Ft. as per revised norms. The total sitting capacity in the library is for 50 students only, which is insufficient for the intake of two batches of B.Ed. and one D.El.Ed. Programme intake. The sitting arrangement in Psychology Laboratory is meant for 15 students which is insufficient for B.Ed. (2 batches) and D.El.Ed.

(iv) The institution did not submit details of salary paid to teachers as per clause 4(v)(d)/4(a) (d) of NCTE norms for respective teacher training course with supporting.

Hence, the NRC decided to issue Show Cause Notice under section 17 of the NCTE Act, 1993 before withdrawal of recognition of the institution on the above points and directs the institution to submit its reply accompanied with an affidavit within 21 days.

(ii) There is no classroom demarcated for D.El.Ed. programme on the building map. The building plan does not mention plot number and other details of the land document.

(iii) The total teaching faculty list must be approved by the affiliating university. There is no separate Principal appointed for D.El.Ed. Programme. There are no lecturers for music and physical education teaching at D.El.Ed. level. The list of D.El.Ed. teachers has not been approved by competent authority of State Level. The Professor did not possess at least 5 years teaching experience at M.Ed. Level at the time of his selection. He possessed only four years six months M.Ed. teaching experience before his appointment. The readers’ teaching experience of M.Ed. Level (at least 3 years) has not been substantiated by supportive evidences. The salary is not paid to teaching and non-teaching staff by Bank transfer.

Another application of the institution for B.Ed (Addp.) (NRCAPP 1857) for the academic session 2012-13 is under process in NRC. As per clause 8(3) of the NCTE Regulations, 2009, the maximum intake capacity of the institution taking into consideration all courses, along with

additional intake, shall not exceed 300.

As per clause 8(7)(i), No. institution shall be granted recognition under these Regulations unless the institution or society sponsoring the institution is in possession of required land on the date of the application. The land free from all encumbrances could be either on ownership basis or on lease from Government or Government institution for a period of not less than 30 years. In cases where under relevant state or Union Territory laws the maximum permissible lease period is less than 30 years, the State Government or Union Territory Administration law shall prevail. However, no building shall be taken on lease for running any teacher training course. Thus, the institution does not possess valid land on the date of application.

As per clause 8(7)(i), No. institution shall be granted recognition under these Regulations unless the institution or society sponsoring the institution is in possession of required land on the date of the application.
