Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Military Service Integ-4

rity Act of 2012’’. 5

SEC. 2. MILITARY MEDALS OR DECORATIONS. 6

Section 704 of title 18, United States Code, is 7

amended to read as follows: 8

‘‘§ 704. Military medals or decorations 9

‘‘(a) IN GENERAL.—Whoever knowingly purchases, 10

attempts to purchase, solicits for purchase, mails, ships, 11

imports, exports, produces blank certificates of receipt for, 12

manufactures, sells, attempts to sell, advertises for sale, 1

trades, barters, or exchanges for anything of value any 2

decoration or medal authorized by Congress for the Armed 3

Forces of the United States, or any of the service medals 4

or badges awarded to the members of such forces, or the 5

ribbon, button, or rosette of any such badge, decoration, 6

or medal, or any colorable imitation thereof, except when 7

authorized under regulations made pursuant to law, shall 8

be fined under this title, imprisoned for not more than 9

6 months, or both. 10

‘‘(b) FALSE CLAIMS TO THE RECEIPT OF MILITARY 11

DECORATIONS, MEDALS, OR RIBBONS IN ORDER TO SE-12

CURE A TANGIBLE BENEFIT OR PERSONAL GAIN.— 13

‘‘(1) IN GENERAL.—Whoever, with the intent of 14

securing a tangible benefit or personal gain, know-15

ingly, falsely, and materially represents himself or 16

herself through any written or oral communication 17

(including a resume) to have served in the Armed 18

Forces of the United States or to have been awarded 19

any decoration, medal, ribbon, or other device au-20

thorized by Congress or pursuant to Federal law for 21

the Armed Forces of the United States, shall be 22

fined under this title, imprisoned for not more than 23

6 months, or both. 24

‘‘(2) TANGIBLE BENEFIT OR PERSONAL GAIN.— 1

For purposes of this subsection, the term ‘tangible 2

benefit or personal gain’ includes— 3

‘‘(A) a benefit relating to military service 4

provided by the Federal Government or a State 5

or local government; 6

‘‘(B) employment or professional advance-7

ment; 8

‘‘(C) financial remuneration; 9

‘‘(D) an effect on the outcome of a crimi-10

nal or civil court proceeding; and 11

‘‘(E) an impact on one’s personal credi-12

bility in a political campaign.’’. 13
