hereby makes the following amendment in the J&K State ElectricityRegulatory Commission (Licencing) Regulations, 2013.

CHAPTER I

1. Short title and commencement.––This regulation shall be called

the J&K State Electricity Regulatory Commission (Licensing) (Amendment)

Regulations, 2016.

2. It shall come into force on the date of its publication in the

Government Gazette.

CHAPTER II

The following proviso shall be added after sub-regulation (1) of

regulation 16 of the J&K State Electricity Regulatory Commission

(Licencing) Regulations, 2013 :––

“Provided that within 30 days or such further period as the

Commission may allow after the date of commencement of licence,

the licensee shall pay to the Commission a fee as may be

determined by the Commission from time to time in the manner as

prescribed in these regulations.”

Whereas, Parliament is not in session and the President is satisfied

that circumstances exist which render it necessary for him to take immediate

action.

Now, therefore, in exercise of the powers conferred by clause (1) of

Article 123 of the Constitution, the President is pleased to promulgate the

following Ordinance :––

1. Short title and commencement.––(1) This Ordinance may be

called the Indian Medical Council (Amendment) Ordinance, 2016.

(2) It shall come into force at once.

2. Insertion of new section 10D.––In the Indian Medical

Council Act, 1956 (102 of 1956) (hereinafter referred to as the

Principal Act), after section 10C, the following section shall be inserted,

namely :––

“10D. Uniform entrance examination for undergraduate and

postgraduate level.––There shall be conducted a uniform

entrance examination to all medical educational institutions at the

undergraduate level and postgraduate level through such

designated authority in Hindi, English and such other languages

and in such manner as may be prescribed and the designated

authority shall ensure the conduct of uniform entrance examination

in the aforesaid manner :

Provided that notwithstanding any judgment or order of any court,

the provisions of this section shall not apply in relation to the uniform

entrance examination at the undergraduate level for the academic

year 2016-2017 conducted in accordance with any regulations

made under this Act in respect of State Government seats

(whether in Government Medical College or in a Private

Medical College) where such State has not opted for such

examination.”.

2. These Rules shall come into force with effect from the 1st July,2016.

3. Applicability :

The Rules shall apply to a person who has held office either asa Chief Justice or as a Judge of the High Court, in relation to the HighCourt where she or he has held that office.

4. Definitions :

(I) ‘High Court’ means the High Court of Jammu and Kashmir ;

(II) ‘Former Chief Justice’ means a person who has held officeof the Chief Justice of the High Court ;

(III) ‘Former Judge’ means a person who has held office of a Judgeof the High Court ;

(IV) ‘Spouse’ means the wife or, as the case may be, the husbandsurviving a former Chief Justice or former Judge upon his orher death while in office or after retirement ;

(V) ‘Domestic Help’ means the assistance of a helper to beprovided to a former Chief Justice or a former Judge of theHigh Court, or to his or her spouse at the expenses of the HighCourt.

5. Eligibility :

A former Chief Justice or a former Judge of the High Court shallbe entitled to avail of the services of a Domestic Help, if :

(a) The facility of a Domestic Help is not being provided to theformer Chief Justice or, as the case may be, former Judge byany other High Court ; and

(b) No facility of a Domestic Help is attached to the office or postto which the former Chief Justice or former Judge is appointedafter retirement.

6. Selection of Domestic Help :

The former Chief Justice or, as the case may be, former Judgemay at her or his discretion select a person to be engaged as a DomesticHelp.

7. Contractual appointment :

The engagement of a Domestic Help under Rule 6 shall be on acontractual basis and will be available until the former Chief Justiceor former Judge is entitled to the benefit of the facility under Rule 5and until the Domestic Help performs duties satisfactorily subject to thecertification of the former Chief Justice or former Judge.

8. Reimbursement :

Upon engagement, the monthly remuneration payable to theDomestic Help shall be reimbursed by the High Court to the formerChief Justice or former Judge, as the case may be, at the end of everymonth.

9. Wages :

Monthly payment for one Domestic Help should be madeequivalent to the salary payable to a Class-IV employee of the HighCourt at the minimum of the scale (basic pay and dearness allowance).This shall continue during the lifetime of the Judge and a survivingspouse. The same payment must be made to a surviving spouse.

10. The High Court shall pay wages equivalent for one DomesticHelp at the rate prescribed in Rule 9.

11. Continuance and absorption :

(i) The Domestic Help engaged by a former Chief Justiceor former Judge shall continue to remain on a contractualbasis so long as he or she renders satisfactory service, ascertified by the former Chief Justice or former Judge, as thecase may be.

(ii) Upon completion of not less than ten years’ service, either withor without intermittent breaks, the service of the contractuallyengaged Domestic Help may be considered for absorption onthe regular establishment of the High Court, if the DomesticHelp is recommended for regularization by the former ChiefJustice or former Judge concerned and is found suitable forregular absorption by a Committee of Judges constituted bythe Chief Justice to adjudge suitability.

(iii) The total number of post to be filled in by way of absorptionunder clause (ii) above, shall not exceed more than fiveper cent of the total posts of Class-IV vacancies on theestablishment of the High Court.

12. Secondment of a permanent employee :

Notwithstanding anything contained in the above Rules, if a peonor equivalent holder of a Class-IV post who is borne on theestablishment of the High Court, furnishes to the Registrar General ofthe High Court, a request in writing to serve a former Chief Justiceor former Judge and the services of such an employee are acceptableto the former Chief Justice or, as the case may be, former Judge, heor she may be seconded to work as a Domestic Help until the DomesticHelp attains the age of superannuation and/or so long as the formerChief Justice or former Judge is entitled to this facility.

13. Spouses :

The facility which is extended under the aforesaid provisions toa former Chief Justice or former Judge of the High Court shall beprovided on the same terms and conditions to the surviving spouse ofa former Chief Justice or former Judge, as the case may be, during thelifetime of the spouse.

14. Interpretation :

In the event of any question or dispute arising in regard to theinterpretation of these Rules, the Chief Justice of the High Court shallbe competent to take a decision in that regard which shall be final andbinding in all respects.

AWARD

The authority identified by the State Government under the I. D Act,while having sufficient compliance with the provision of Act has made areference to this Tribunal vide SRO No. 264 of 2009 dated28th August, 2009 for adjudication and passing an appropriate order. Thereference made by the Government broadly and pointedly after havingproper consideration by the Reconciliation Officer. Government is of theopinion that an industrial dispute exists between Shri Manu Jee Saproo S/oShri P. N. Saproo R/o Janipur and Management of FIL Industries,Bari Brahmana, Jammu. So, in exercise of power conferred by clause (C)of sub-section (1) of section 10 of the Industrial Disputes Act 1947,the Government referred this dispute for adjudication on thefollowing issues :––

1. Whether the termination of the services of Sh. Manu Jee Saproois legally justified ?

2. If not, to what relief he is entitled to, on receipt of the reference,notices were issued to the parties who appeared and filed theirrespective claims/objections ?

As per statement of claim of the petitioner namely Manu Jee Saproo,he was the employee of the respondent FIL Industries, Bari BrahmanaJammu, he was working as Production Supervisor since long and theRespondent ousted the petitioner without any reason or without giving anyadvance information or serving any advance notice to the petitioner of hisunilateral decision and as such the claim assessed on the basis of the salarytogether with interest thereon to which petitioner is due to receive. Thepetitioner has claimed to Rs. 286483/- from the respondent.

Thereafter, file was posted for filing of the objections, whereuponrespondent filed their objections averting therin—

It is submitted by the respondent that petitioner was disengaged

by the company because of his repeated negligence, carelessness,

and misbehavior. Though, the petitioner was repeatedly warned,

and, even once misconduct stand proved for which petitioner

apologized also. The petitioner went on repeating grave mistakes,

which could hardly be tolerated by a pesticides manufacturing

company, and, this ultimately, compelled the management to

disengaged the petitioner from the services.

It is submitted by the respondent that petitioner joined on 20-08-1998,

and, within, two months of his joining, the petitioner resigned from the job

on 22-10-1998.

Thereafter, the petitioner again approached the management, and,

sought fresh appointment on humanitarian grounds. It is submitted that, the

petitioner was allowed to join by taking humanitarian view in the matter.

Though from November, 1998 to April, 2004, the work performance

of the petitioner was not up to mark, yet, the petitioner as allowed to continue

the job. For a grave mistake committed on 18-03-2004, besides imposing a

fine upon him, a warning was administered on him on 03-04-2004 to remain

careful in future.

It is submitted that even this had no impact on the petitioner, and,

within three days, another warning was served on him on 07-04-2004.

The conduct and bad performance of the petitioner became almost

intolerable. However, again taking humanitarian view in the matter, no action

was taken against him. The petitioner tendered a written apology

on 12-04-2004, and, represented to the management that he would be careful

in future, and, the petitioner would be personally responsible for any mistake

in future and would face any disciplinary action.

It is submitted by the respondent that again, a grave mistake of double

labeling was found, and on asking of his explanation, the petitioner accepted

the fault on 20-06-2005, and, regretted for the same.

It is on 21-06-2005, at the beginning of the office hours, an enquiry by

the General Manager regarding this episode of double labeling, the petitioner

misbehaved with the General Manager, and, even rebuked him in his office

chamber. The matter was immediately brought to the notice of the

management, who after thoroughly reviewing his attitude from the beginning

i. e. from the date of his joining the company, decided that in view of his

arrogance and misbehavior inspite of all misdeeds, his continuation in the

company would be detrimental to the interest of the company as there was

apprehension that the attitude of the petitioner would spread in other

employees also, and, accordingly, the petitioner was discharged by allowing

one month salary against “advance notice period.”

Finally on 22-06-2005, the petitioner, immediately requested for release

of his dues, and, accepted the order. On 07-07-2005, the petitioner even

applied for release of his gratuity on the prescribed form. One month notice

pay, gratuity and bonus amounting to Rs. 14791/- were immediately paid to

the petitioner on 09-07-2005. Thereafter, the petitioner also applied for refund

of his provident fund, the said claim was forwarded to the Dy. Commissioner,

Provident Fund on 26-08-2005.

The respondent finally prayed that the petition filed by the petitioner

may kindly be dismissed by rejecting all the claims of the petitioner.

Heard argument and gone through the file.

The petitioner has filed his own affidavit besides Chaman Lal. The

petitioner has not lead any additional evidence despite availing numerous

opportunities. Chaman Lal has simply stated that he knows the petitioner

since ten years being an employer of the management. He has failed to

prove the claim of the petitioner.

The perusal of the file reveals that the petitioner has received the

gratuity, bonus and notice pay on 09-07-2005. The total amount of

Rs.14791/- has been received by the petitioner as gratuity, bonus and

notice pay. Besides this the provident fund has also been withdrawn by the

petitioner from the office of Deputy Commissioner, J&K State Employees

State Provident Fund, Jammu on 26-08-2005.

The plea of the management is that the petitioner was discharged

from services being negligent, irresponsible and careless towards his duties.

The petitioner was discharged and paid one month’s notice pay, gratuity

and bonus amounting to Rs. 14791/- on 09-07-2005.

The conduct of the petitioner was not cordial and being negligent in

performance of his duties which compelled the management to discharge

the petitioner after making all the eligible dues and the petitioner has received

the same without any protest.

Before proceeding, ahead, it is necessary to reproduce the relevant

provision of section 25F of Industrial Dispute Act, which is as under :—

“25F. Condition precedent to retrenchment of workman.—

No workman employed in any industry who has been in

continuous service for not less than one year under an employer

by that employer shall be retrenched by that employer until.

(a) the workman has been given one month’s notice in writing

indicating the reasons for retrenchment and the period of

notice has expired, or the workman has been paid in lieu of

such notice, wages for the period of the notice.

(b) The workman has been paid, at the time of retrenchment,

compensation which shall be equivalent to fifteen days

average pay (for every completed year of continuous

service) or any part thereof in excess of six months ; and

(c) From bare perusal of section 25F, it is found that the workmanwho has completed 240 days in the year preceding histermination cannot be retrenched without giving one monthnotice and notice pay etc.”

The question arises whether a person who has received a notice paytowards his discharge from services can claim any benefit by filing suchtype of Iitigation. The petitioner has failed to prove that the managementwas not justified in discharging the petitioner from service. There issufficient material to justify the act of the management.

In the present matter, admittedly, notice pay etc. has been giventherefore, the termination of the workman by the respondent is justified.Once it is held that the termination was legal and justified, the workman isnot entitled to the relief claimed for.

In brief it is held that the termination of the services of the petitionerwas justified and no illegality has been committed by the management .The management has paid one month’s, notice pay to the petitioner, whohas received the same without any protest. As such it is held that thetermination of the petitioner was justified and he is not entitled to any reliefas prayed for.

Reference is answered accordingly. Copy of award be sent to theappropriate Government of J&K through its Commissioner/Secretary,Labour Department for information and its publication in the GovernmentGazette. File shall consign to records after its due completion.
