Whereas, the land, specifications whereof are given at Annexure“A” to this notification, is required for public purpose viz. widening of Jammu-Rajouri-Poonch road by GREF ; and
Whereas, on the basis of an indent placed by Officer Commanding,58 RCC (GREF) vide dated 09-08-2011, after completing all codalformalities, a notification under section 4 (1) was issued by Collector, LandAcquisition (Defence), Rajouri/Poonch, HQ, Rajouri vide No. Coll/Def/881-85 dated 29-10-2011 situated at Village Bathuni, Tehsil and DistrictRajouri for public purpose viz. widening of Jammu-Rajouri-Poonch road byGREF ; and
Whereas, the Deputy Commissioner, Rajouri vide No. Coll/Def/915dated 12-03-2016 reported that the notification issued by Collector, LandAcquisition (Defence), Rajouri/Poonch, HQ, Rajouri under section 4 (1) ofthe J&K State Land Acquisition Act, was served upon the land owners/interested persons for filing objections, if any, to the proposed acquisitionbut no objection was received within the stipulated period as required undersections 5 & 5-A of Land Acquisition Act ; and
Whereas, the report furnished by Deputy Commissioner, Rajouri videletter referred to above, duly endorsed by Divisional Commissioner, Jammuvide No. 502/2605/Acq/GREF/Bathuni/Raj/16/90-92 dated 06-04-2016 hasbeen examined and it has been found that the land owners did not file anyobjection within the prescribed period to the proposed acquisition ; and
Whereas, the Government is satisfied that the land particulars whereofare referred to above, is required purely for public purposes i. e. wideningof Jammu-Rajouri-Poonch road by GREF.
Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring 79 Kanals-11 Marlas situated at Village Bathuni, Tehsil and District Rajouri, details

whereof are mentioned at Annexure “A” to this notification is requiredpurely for public purposes viz. widening of Jammu-Rajouri-Poonch road byGREF. Further, the Collector, Land Acquisition (Defence), Rajouri/Poonch,HQ, Rajouri is directed under section 7 of the said Act to take order foracquisition of the said land after giving prescribed notice to the interestedperson(s) as required under the Land Acquisition Act/Rules.
However, the Collector concerned shall be personally responsible foridentification and proper title verification of all types of land involved in thecase and apportionment of compensation amongst all the interested persons/rightful claimants in accordance with the relevant laws/rules in force, whilemaking the award.

Order
Whereas, it has come to my notice that private individuals and various
Govt. agencies are transporting bovine animals like milk cattle/drought
animals through trucks and other means from District Jammu to other
districts of the State ;
Whereas, sentiments of one particular community are attached with
the bovine animals especially cow which is treated as sacred animal by one
particular community ;
Whereas, it is necessary to take some preventive measures to avoid
such law and order problem in future.
Now, therefore, I, SIMRANDEEP SINGH, IAS, District
Magistrate, Jammu in exercise of the powers vested in me under section
144 Cr. P. C. hereby direct that no bovine animals such as Cow, Oxen,
Bulls, Calves etc. be transported from Jammu to other district, except with
written permission from undersigned or Addl District Magistrate, Jammu
under certain conditions imposed by this office, from time to time.
This order shall come into force with an immediate effect and shall
remain in force for a period of two months from the date of its issue or if
the order is rescinded whichever be earlier.

THE JAMMU AND KASHMIR RIGHT TO INFORMATION(AMENDMENT) BILL, 2015
[L. A. Private Members’ Bill No. 13 of 2015.]
A Bill to amend the Jammu and Kashmir Right to InformationAct, 2009 (hereinafter referred as the Principal Act).
Be it enacted by the Jammu and Kashmir State Legislature inthe 66th Year of the Republic of India as follows :––
1. Short title and commencement.––(1) This Act maybe called the Jammu and Kashmir Right to Information (Amendment)Act, 2015.
(2) It shall come into force from the date of its publication inthe Government Gazette.
2. Amendment of section 4.––After sub-section (4) in section4 of the Principal Act, the following new sub-section (5) shall beadded :––
(5) It shall be mandatory on every public authority to notify/publish on its website and provide to the Commission aswell the name, designation, postal address, facsimile number,e-Mail ID, Credit Card Payment of Portal of its PublicInformation Officer as well as its first appellate authority.
The Commission shall display the name, designation, postaladdress, facsimile number, e-Mail ID, Credit Card PaymentPortal of the Public Information Officers as well as the firstappellate authorities on its official website. A request forobtaining information under sub-section (1) of section 6 canbe filed through e-Mail and specified fees/costs could bedeposited by him through Credit/Debit Card of Master/Visa orRupay Card payable to the Accounts Officer/Account of thePublic Authority.

3. Amendment of section 6.––Sub-section (1) of section 6 of the
Principal Act shall be substituted by the following :––
(1) Request for obtaining information.––A person, who
desires to obtain any information under this Act, shall make
a request in writing or through electronic means in English,
Urdu or Hindi accompanied by an application fee of Rupees
Ten by the way of cash against proper receipt or by Indian
Postal Order or demand draft or bankers cheque or using
Credit/Debit Card of Master/Visa or Rupay Card payable to
the Accounts Officer/Account of the Public Authority.
4. Amendment of section 15.––In Section 15 of the Principal
Act, after sub-section (4), the following new sub-sections (5), (6) and
(7) shall be added :––
(5) Every order made by the First Appellate or the State
Information Commission may be enforced by the First Appellate
Authority or the State Information Commission as the case may
be, in the same manner as if it were a decree or order made
by a court in a suit pending therein.
(6) A complaint as contemplated for compliance of orders
of the Commission shall be filed within a period of six
months from the date of accrual of cause of action to the
complaint :
Provided that the State Information Commission may admit the
complaint after the expiry of the period of aforementioned
period if it is satisfied that the complainant was prevented by
sufficient cause from filing the complaint in time.
(7) Legal Affairs of the Commission shall be primarily
responsible for all acts necessary and incidental to ensure
proper pleading/defending cases against the Commission before
the High Court and other Courts.

The Commission shall be at liberty to engage counsels for
effective representation of the Commission in the courts where
cases have been instituted against it.
5. Amendment of section 17.––After sub-section (2) in section
17 of the Principal Act, the following new sub-section (3) shall be
inserted :––
(3) Whereas State Information Commission shall monitor and
supervise compliance of sub-clauses (1), (2), (3) of section 4
and section 5(1) of the Act by the public authorities and
in case it is found that any officer is found guilty of
non-compliance of the afore-cited provisions, the Commission
shall recommend disciplinary action against the guilty Officer/
Public Information Officer/Public Authority as per the service
rules applicable to him.
6. Insertion of new section 17-A.––After section 17 of the
Principal Act, the following new section 17-A shall be inserted :––
17-A. Whereas at the time of deciding any appeal, reference
or complaint or otherwise, the Presiding Officer or member
of State Information Commission, on a motion moved by a
Public Information Officer or 1st Appellate Authority, is of the
view that information seeker has filed an application or multiple
Right to Information applications concerning the same subject
or before the same Public Information Officer seeking
information with an ulterior motive or exerting any undue
pressure/influence on the Public Information Officer/department,
the matter shall be referred to Full Bench of the Commission
and Commission may declare the information seeker as
‘unscrupulous information seeker’ and debar him from filing
an application under Right to Information Act before the same

Public Information Officer regarding the same matter and also
impose a penalty not exceeding two thousand rupees :
Provided that the unscrupulous information seeker shall be given
a fair and reasonable opportunity of being heard before anypenalty is imposed on him :
Provided further that, the burden of proving that informationseeker filed the application with ulterior motives shall be onthe Public Information Officer or 1st Appellate Authority whoalleges it :
Provided that imposing of penalty on an information seeker shallbe resorted to in very exceptional cases.

STATEMENT OF OBJECTS AND REASONS
The Jammu and Kashmir Right to Information Act enacted in
the year 2009 to provide for and facilitate greater transparency,
accountability, easy and effective and more corruption free system in
the State. But the Act had certain grey areas and it had to be brought
in line with latest techniques and practices. It is also being repeatedly
misused by certain vested interests and there is no specified legal
mechanism for dealing with unscrupulous ‘information seekers’ and there
are other plug-ins and lapses which are coming in way of proper
implementation and operationalisation of the Act.
Hence the Bill.

THE JAMMU AND KASHMIR RESERVATION OF BPLCHILDREN IN PRIVATE EDUCATIONAL INSTITUTIONS
BILL, 2015
[L. A. Private Members’ Bill No. 14 of 2015.]
A Bill to make it obligatory on the part of Private Educational
Institutions to provide reservation to Children of BPL Families.
Be it enacted by the Jammu and Kashmir State Legislature in
the 66th Year of the Republic of India as follows :––
1. Short title and commencement.––(1) This Act may
be called the Jammu and Kashmir Reservation of BPL Children in
Private Educational Institutions Act, 2015.
(2) It shall come into force from the date of its publication in
the Government Gazette.
2. Definitions.––In this Act, unless the context otherwise
requires,––
(a) “Act” means the Jammu and Kashmir Reservation of
BPL Children in Private Educational Institutions
Act, 2015 ;
(b) “Children” includes son, daughter, step son, step daughter,
adopted son or adopted daughter ;
(c) “Educational Institution” means the institution where
education up to 12th standard is imparted ;
(d) “Competent Authority” means Deputy Commissioner of the
concerned district.

3. Obligation on private educational institutions.––The private
Educational Institutions shall reserve a quota in each and every class
for the candidates belonging to BPL families :
Provided that the total percentage of reservation shall in no case
exceed 20% :
Provided further that the candidates belonging to such families
shall not be barred to apply on open merit basis.
4. Issuance of BPL Certificates.––The Competent Authority
shall issue BPL Certificates in the manner as prescribed only after
proper assessment is made at the end of every calendar year.
5. Fee structure.––The Government shall prescribe a uniform fee
structure for all Private Educational Institutions throughout the State.
6. Punishment for contravention of provisions of this Act.–
–If any Educational Institution contravenes the provisions of this Act,
it shall be de-recognized forthwith.
7. Power to make rules.––The Government may, by notification
in the Government Gazette, make rules for the purpose of carrying out
the provisions of this Act.

STATEMENT OF OBJECTS AND REASONS
The persons belonging to BPL Society hardly afford to have their
children admitted in Private Educational Institutions because of their
meager income. Thus a sizeable section of society are deprived of quality
education as against the children of well of families, causing social
barrier. The piece of legislation has been proposed as present era is
era of competition and most of other States of country are far advanced
as far as imparting quality education is concerned. It has been provided
in the Draft Bill for reservation in admission of the children belonging
to BPL families. Such a step will provide equal opportunity to the weaker
sections of society thereby ultimately uplift their status. Furthermore,
a uniform fee structure has been proposed.
Hence the Bill.

the Constitution of Jammu and Kashmir (Amendment) Act, 2016.
(2) It shall come into force from the date of its publication in
the Government Gazette.
2. Amendment of Preamble.––In Preamble to the Constitution of
Jammu and Kashmir, the words “to constitute the State of Jammu and
Kashmir into a secular State” shall be inserted between the words
“resolved” and “in pursuance of accession”.

STATEMENT OF OBJECTS AND REASONS
The Preamble of a Constitution contains the fundamental principles
and it outlines the objectives of the whole Constitution. The Preamble
gives a direction and purposes to the Constitution. The word secular
does not appear in the Preamble of the Constitution of Jammu and
Kashmir. The State of J&K is full of diversities. It is multi-religious,
multi-ethnic and multi-linguistic. The Constitution must clearly state its
commitment to establish a secular State. The Supreme Court of India
has also declared secularism as the basic feature of the Constitution.
As such, there is a need to add word “secular” in the Preamble of
the Constitution so as to reaffirm our faith in the principles of secularism.
Hence the Bill.
