Agreement is reached on the future of DAT (US)The emergence of DAT (digital audio tape)recorders, which have been relentlessly op-posed by the record industry, could become areality by next year. The Recording IndustryAssociation of America (RIAA) would appearto have given the nod to the controversial andvery thorny issue of digital audio taperecorders. A deal was struck recently in NewYork that would allow Philips and Sony toproceed with their plans to introduce newdigital music formats in 1992.
Although the recorders have been on themarket in the US for more than a year, they havebeen dead in the water in view of the powerfulopposing factions within the recording indus-try that wouldn't allow pre-recorded music tobe available for DAT. Manufacturers of digitaltape recorders turned a deaf ear to the com-plaint from the record industry that DAT would
only compound the home taping problem, estimated to be costing the record industrymillions of dollars in lost royalties.
Sony, a leading manufacturer of DAT, isready to launch its Mini Disc. Philips, whichfirst introduced the compact disc, is also readyto move with its Digital Compact Cassette, asystem described as "combining the benefitsand success factors of Compact Cassette andCompact Disc into a single new sound carrier."
The US pact will allow for 2 percent of therevenues from digital recorders and 3 percentof the value of blank tapes to go to a specialfund. Monies will then be distributed by theCopyright Royalty Tribunal on the basis ofmusic sales and airplay.
"It's a modest agreement," observesBrian Robertson, President of the CanadianRecording Industry Association (CRIA). "The

Industry is "concerned"over obscenity rulingBrian Robertson, President of the CanadianRecording Industry Association (CRIA), hasexpressed concern over the July 15 convictionof London, Ontario storeowner Marc Emery forselling obscene material. The material in thiscase was the 2 -Live -Crew album, As Nasty AsThey Wanna Be.
Provincial Court Judge John Menziesruled that because the tape was "disgusting",and "repeatedly denigrated women", itexceeded community standards and he deemedit "obscene."
In his ruling Judge Menzies referred to"the very substantial use throughout of the F -word and specific use of terms for male andfemale genitalia," which he said "violated thetolerance of the average Canadian."
"It's a verdict I would rather have nothad," observed Robertson. It's the secondobscenity trial in Canada." He is referring to theBen Hoffman (The Peddlar) case, in which anot guilty verdict was returned.
Robertson elaborates, "The problem withthe obscenity laws as they are drafted, is thatthey are open for interpretation by a judge, andthere are no guidelines," continuing with,"We're obviously concerned about the verdict. We don't like it when somebody makes ajudgement on the creative process, no matterhow extreme it may be perceived."
Emery was granted a conditional dis-charge, avoiding a possible fine of $2,000 and/or six months in jail. The crown had asked fora fine of $1,500. Emery is expected to appealthe conviction.
financial compensation is not very high." How-ever, Robertson views the deal as "a stepforward in the relations between the hardwaremanufacturers and the record industry." Hegoes on to reveal that the relationship betweenthe two industries "has always been tenuous, and I think this is the first sign in improvingrelations."
Robertson is already starting discussionswith the hardware representatives in Canada to,as he suggests, "try and see if they would bewilling to jointly go with us to Ottawa to initiatea similar program."
Asked about the advantages of such a dealto the recording industry, Robertson replied,"Any deal is going to help, because, basicallythere is a compensation package from the salesof the hardware and the sales of blank tape.So it will provide some level of compensation,"concluding with "It isn't very high, and it'sonly on digital, not analog . . . but I think youhave to start somewhere, and I think it's justthe door opener to better relations with thehardware people."

No dance station for Toronto . ? Haveyou ever heard so many dumb predictionsabout who's going to a dance format comeSeptember 1st? Everyone seems to be trying tooutguess the other. Well, here's the real scoop. . . and I got it from a fairly good authority. Itwon't be a station in Toronto, which I find hardto believe. It will be a station about 35 clicksfrom Toronto, you pick the direction. And it'sbecause of another station that's about another35 clicks further on. SonyIHMV stages spectacular media promotion Rooftop Alice Cooper puts brakes on traffic
On Friday, July 5th, at precisely 12:33 pm, Sony recording artist Alice Cooper held an
impromptu concert atop Toronto's HMV Yonge Street Superstore. What was supposed
to be a simple autograph session turned out to be a three -song showcase that attracted 5,000
fans and snarled traffic for three blocks. The concert, in support of Cooper's latest
release, Hey Stoopid, was his way of saying thank you to Canada for all the support given
him over the years. The album shipped platinum on release. Canada is the first territory
in the world to react so quickly on the album. "Alice Cooper is one of the easiest artists to work with," says Lisa Zbitnew, Sony Director Artist Marketing, "He's very co-operative and
considers Toronto to be his second home. This particular album shipped platinum right out of
the box and on Trash, his last album, we were the number one selling territory in the world."
HMV initially came up with the idea of the concert and both Sony and Cooper were behind
it from the word go. "For his Trash album, Alice delivered all his records to stores on
Yonge Street personally, in a rented garbage truck," says Zbitnew, adding "He's very much
into the outrageous so, when he heard about the idea, he was very excited about it."
There were some obstacles to overcome, however. "It's not the type of thing that goes

Moodies, Lofgren, Lewis priority Polygram videos
PolyGram's Pop video releases for July include three top name acts; The Moody Blues, Huey
Lewis and The News, and Nils Lofgren. All are timely in view of the new album releases from
the trio. Legend Of A Band, the entry from The
Moody Blues, is the only video available by
this legendary band, and is released in conjunction with their new album Keys Of The
Kingdom. The first single from the album, Say It With Love, is already bulleting up the RPM
100 Hit Tracks chart. The comprehensive two-hour set features
concert footage, in-depth interviews and their
promo clips. A North American summer/
autumn tour, including a number of Canadian dates to be firmed at a later date, will be part of
a support program for both the album and the video. Track selections on the video include Your Wildest Dreams, Tuesday Afternoon,
Gemini Dream, The Other Side Of Life and
more. Huey Lewis and The News are making
chart news with their new album, Hard At Play, released on EMI, an excellent promotion vehicle for their new video, The Heart Of Rock
'N' Roll. The video is the only live program featuring Lewis and his band. Track selections
include It's All Right, Trouble In Paradise, I Want A New Drug, and more. Lewis and his band hooked up with the Tower Of Power horn
section to grab onto the '50s roots of American rock music, which fits nicely into their sounds
of the '80s. Canadian tour dates for August will include Moncton, Montreal, Ottawa and
Toronto. Described as "the guitar player's guitar
player," Nils Lofgren's 90 -minute Live video showcases his performances with Bruce
Springsteen and Ringo Starr. Also featured are Lofgren's golden oldies including No Mercy
and Moontears from his early days with Grin. Also includes Moon Tears, Lean On Me, I
Came To Dance and Code Of The Road. Lofgren is currently on release with Silver Lining.

going to stop traffic on Yonge Street for forty-five minutes. Oh ... and by the way, we'll probably throw in some noise and sound violations while we're at it'," jokes Zbitnew.
Tensions were running high a week prior to the appearance as Cooper hadn't confirmed if he could make it. His schedule was very
tight, as his Operation Rock 'n' Roll Tour was geared to start July 8th. Fortunatley, he finally
gave the go-ahead. Getting Cooper's equipment up on the
roof without word of the concert leaking out was not the easiest task. A crane hoisted the
gearup on the roof the night before. To really complicate things, the weather didn't look like
it was going to co-operate. "At 10:31 there were electrical storms. At 11:30 there was a torrential downpour," sighs Zbitnew. "But the
rain stopped and the show went on as planned. I give all the credit to Alice and his band for
going for it and having some fun," she says. The event ran like clockwork and Cooper
made his escape through the back alley in a towtruck. "The Beatles did it twenty-two years
ago. U2 did it two years ago. It was time again," boasts Zbitnew.
Cooper was awarded his platinum album prior to the show.
Canadian awards for Sharon, Lois & Bram
Regarded as one of North America's foremost family entertainers, Sharon, Lois & Bram were
recently honoured with two more awards. The Canadian Council on Children and
Youth presented the Toronto -based trio with an award appropriately titled For Canada's
Children, for "brightening the world of children through music," and for their "positive
contribution to children's lives." The Council is an advocate group based in
Ottawa, whose mandate is to speak out, educate and inform the public on issues affecting
children, such as child abuse, living with AIDS, poverty and the rights of the child.
The second honour came from NA 'AMAT, a Toronto -based organization
dedicated to maintaining vital social and humanitarian services and influencing
legislative change for human rights and equality. Sharon, Lois & Bram were recognized

"Tim and I have worked together and been friends for the last ten years," Feeney
says, "and we always thought about doing a country our affinity to country music." The idea to go country was furthered after a Don't Drink And
Ride jingle they did for CFGM actually started receiving requests from listeners. "The seed
was planted," Feeney says smiling. The album, recorded in under a month at
Toronto's McClear Place, is released on the Justin Entertainment label and "has been one of
the easiest records to work at radio," says Lou - Anne Wheaton, Director, National Promotion
at Justin. "I was receiving unsolicited quotes over the fax by major radio stations," she
continues. One of the newer breed of country artists,
Feeney hopes to bring a breath of fresh air into today's music. "I'm not a big, traditional country music fan at all and I don't think any of

to make it a bit contemporary so that maybe we could spruce up the country music market and help bring Canadian country into the 90's."
Radio programers seem to agree as Feeney's earthy sound is being favourably received.
While still contemplating the next single, Feeney has plans of showcasing his talents in
live performances and, although there are no plans to tour as of yet, Feeney says, "We're
talking about maybe just doing some acoustic guitar sets with just three or four guys."
Feeney is also planning a new album, with production starting as early as late fall but
promises, "I think this one will be a little harder sounding with more guitars and keyboards. It '11
be a little tougher," he boasts.

Warner roster booming despite weak economyIt's no secret that the economy has had an effecton the music industry and that recordcompanies aren't spending the kind of moneythey may have in the past. Despite the fact thatwe're in what some might call a depression,Warner Music Canada is one company that isbusy this summer with both international anddomestic releases.
RPM recently spoke with Warner's GregTorrington, Director of A&R, about the adverseeffects of today's economy on a label's signingability. "I'm happy to say that we're beingfrugal about our spending without being cheapor sacrificing the quality of our recordings,"Torrington says. "You have to be careful be-cause Canada isn't a big country in terms ofrecord sales. But, you can make money makingrecords if you keep things in proper perspec-tive," he adds.
Warner is currently busy with the largestroster release they've had in years. They alsoboast their domestic division is making money."It's not a matter of signing fewer bands,"Torrington remarks, "it's a matter of allocatingmoney wisely and efficiently and not fallinginto traps and extravagances that cost lots ofmoney but don't end up on a record."
One has to wonder if there is less risktaking these days. The trend in demographicsshow that the population has shifted from the18-24 year olds to 26 and over. If so, are recordcompanies gearing towards an older marketthese days in order to make a profit? "No, Idon't think so," confides Torrington, "Sure, there's a baby -boom glitch in the populationbut it's still no secret that the bulk of the recordbuying public are teens and 18-24 year olds. However, that doesn't mean that you can't

The domestic acts Warner are workingnow cover the entire spectrum of age groupsand offer something for everyone. In particular,Harem Scarem, a hard rock act firmed for amid -August release, has young -people appealbut also has the vocal delivery andmusicianship that 26-34 year olds can enjoy.
Torrington seems positive that, althoughtimes may seem tough, the quality and diversityof music will not suffer. "Throughout history, especially in times of depression, music thriveseven if the economics aren't there. It's in thesetimes that music does well, perhaps not so wellin sales, but certainly in terms of popularity."

YTV Achievement Awards moves to nation's capital After two years in Toronto, the third
annual YTV Achievement Awards will be pre- sented in a live telecast March 11, 1992 from
the National Arts Centre in Ottawa. The awards
program honours Canadian youth in a wide
range of categories ranging from Bravery to Writing. There are also several musical catego-
ries including: Vocal, Instrumental, Dance, and Band. Along with a statuette, winners also
receive a $3,000 cash honorarium. One of the reasons for the move to Ottawa
is to help celebrate the nation's 125th anniver-
sary. Another is the location's commitment to Canada's youth. According to David Langer,
the National Arts Centre's Executive Producer, Electronic Division, "programming for young audiences is one of the cornerstones of the National Arts Centre." The awards are open to

THE BOOMERS - RockWhat We DoWEA CD 74515-P
This album may turn out to be thesleeper of the summer. It is an excellentalbum that hopefully will not gounnoticed. Long-time solo artist, IanThomas has teamed up with veteransPeter Cardinal', Bill Dillon and RickGratton to form The Boomers, aptlynamed after the fact that they are all ofThirty -Something age. Produced byTim Tickner and Thomas, this albumfeatures simple yet intriguingarrangements. Thomas is a giftedwriter, having honed his craft on overthirteen previous albums, and this is hismost ambitious project to date. Theonly drawback to this album is, with onlynine tracks, the listener is left cravingmore. Love You Too much is the firstsingle. Other key tracks are Dirty love,Rise Above It and One Little Word.(CD reviewed) - PF

JOHN ARPIN - RagtimeJohn Arpin Plays GeorgeGershwinMastersound - DFCD1-011
Why John Arpin has never beennominated for a Juno Award is aburning question. His ragtime albumshave sold more than 100,000 copies.Ragtime masters like Arpin are veryrare. His fusion of ragtime and jazz andpure pop is his musical signature. Here,he has picked one of the better modernmasters to tinkle on, and revealsanother side of George Gershwin. What Arpin does to Gershwin might nothave pleased him, but Arpin's uniquekeyboard artistry adds that non -menacing ingredient of pure, listeningentertainment. From Swanee (1919) toS'Wonderful from Funny Face (1927)to Lookin' For A Boy from Tip -Toes(1925) to Embraceable You from GirlCrazy (1930) and For You For Me ForEvermore from The Shocking MissPilgrim (1946), not to mention hismedley of Gershwin favourites likeSummertime, The Man I Love, and I GotRhythm and more. Front rack this one,it's a treasure pack. Produced by Arpinand Julian Rice (CD reviewed) - WG
MOODY BLUES - RockKeys Of The KingdomPoiydor - 849 433-2-0
Old rockers never die, but unfortunatelysome of them develop a bit of an.obvious complacency that surfaces atthe worst possible time. The Moodiesstill have that rock punch that can blowaway any number of today's rockwimps, but with the Moodies, they'vesacrificed a little of theredistinguishable '80s rock edge for theirentry into the '90s. Having said that,Say It With Love, the first single takenfrom this set, has kicked open the boxand moves quickly up the charts. Thereare a couple of other tracks that shouldattract attention as well including NeverBlam e The Rainbows For The Rain andIs It Heaven, perhaps with somereservation. This is a fan release, andthere are plenty of them to guaranteegood sales. New fans might be hard toimpress. DICK DAMRON - instrumentalMirage - The Guitar CollectionATI - ATI-0322
Damron has been a sleeping giant formore than 35 years, a celebration ofsorts he is recognizing this year withRCA. However, RCA wasn't interestedin this instrumental treasure. Too bad! This album isn't just for countryprogrammers. Damron dresses up hisguitar pickin' for this finely craftedpackage of pure instrumentalentertainment that fits beautifully intothe AC and easy listening formats. From Mirage, the movie theme, to theup -tempo jazz offering of Rush Hour,Damron is in full control on this 16 -songrelease which actually comprises twoalbums, his first instrumental, NightMusic and the newer, perhaps evenclassier material on Mirage. THE CHOIR - RockCircle SlideEpic EK 47734-H
Hailing from L.A., The Choir have madean impressive debut with Circle Slide.Their music is artsy-alternative gearedtowards college radio. The album wasproduced by Derri Daugherty andSteve Hindalong, who, along with MikeSauerbrey, Dan Michaels and RobinSpurs, comprise the group. The ninetracks are hypnotic; slow and dreamywith a touch of psychedelia. RestoreMy Soul is the first single released andhas been receiving rave reviews fromcritics in both the States and Canada.Laugh Loop, A Sentimental Song andthe title track are all very strong tracksthat paint a cool soundscape.(CD reviewed) - PF
CHRISSY STEELEMagnet To SteeleCapitol C2 26583-F
Steele's Capitol debut is a strongendeavour featuring her gutsy, powerhouse vocal abilities. The albumis the brain -child of Brian 'Too Loud'MacLeod, who produced, engineeredand co -wrote the songs with the likes ofTim Feehan and Jeff Paris, amongothers. In fact, the album was recordedon MacLeod's yacht as they sailedalong the coast of British Columbia.Steele shows she can rock with thebest of them, as is evident on the firstsingle, Love You Til It Hurts. This trackis now charting at radio and it cooks.Although this is primarily hard rock, tracks like Love Don't Last Forevershow her more subtle side. Also key isTry Me and Cry Myself To Sleep. ROBBIE NEVIL - Dance/RockDay 1EMI E2 91067-F
L.A. native, Robbie Nevil has returnedwith his latest album, Day 1, his firstsince he debuted in 1986. Nevil made aname for himself with his infectiousgrooves and vocal melodies and hecontinues to take those attributes to ahigher plateau on this release. Thisalbum, however, shows a bit more of
the musician side of Nevil. He plays allthe guitars on this release and hisexpertise is quite evident. This projectalso marks his first time as his ownproducer. Just Like You is the first trackbeing worked at radio. It's a dancenumber with a hard edge. StevieWonder's Tell Me Something Good isdone well and equally stands up toChaka Khan's earlier version. Alsoworth mention is Paradise, an acappella number and the rocker,Partners In Crime. (CD reviewed) - PF
ROBIN LEE - CountryHeart On A ChainAtlantic -82259-P
Not too much has been happening forRobin Lee since her claim to famethrough the Alannah Myles cover ofBlack Velvet. Lee, however, showsthere is life after Myles. Perhaps thesuccess of Blue Velvet created a newvocal direction for her. Unlike herprevious album, this one has balls, a
real earthy sound that sets her a cutabove even some of the establishedacts now charting. This vocalconfidence has obviously impressedcountry programmers who have takento charting and playlisting Nothin' ButYou, the first single from the album. Leeis much more convincing on the heart -string type of material. Key are The EndOf The Line and When You Get A LittleLoney, but don't overlook Johnny'sAngel (Solo Sometime). Produced byJames Stroud. Hallydayhimself is no less famous in France, where he has two platinum sellingalbums and a slew of top ten singles. His North American debut, like all hismaterial, is sung entirely in English. It isan impressive mix of charged popsongs and moving ballads. Producedby Richie Wise, this album features tentracks co -written by Hallyday and LisaCatherine Cohen. Hallyday also playskeyboards, guitar and percussion onthe album. Tears Of The Earth is argua-bly the strongest track and featuresvocal support from the Peace ChildRepertory Theatre. TRISHA YEARWOOD - CountryTrisha YearwoodMCA MCAD-10297-J
One of the surprises of the year, TrishaYearwood has literally crashed thecharts with her debut single, She's InLove With The Boy. There's a warmthand an in -born confidence here withprojection and lyrical interpretationcontrol that sets her up for a very longcareer in country music. The foot in thedoor for Yearwood is her choice ofmaterial, ten tracks, written by some ofthe best from Nashville, and her guestsaren't to shabby either: Garth Brooks,
Pat Alger and Stuart Duncan. The firstsingle, She's In Love With The Boy, wasone of those treasures on a plattertypes of release. Even the recordcompany wasn't aware of the potentialof this talent. DAVID HALLYDAY -
Rock/Pop Rock 'N' Heart Scottl Bros/Attic SBD 5204-0
Paris -born Hallyday has quite a family history in music; his father Johnny
Hallyday is the famed French rock star and his mother, Sylvie Vartan, is
France's most popular singer. Hallyday himself is no less famous in France,
where he has two platinum selling albums and a slew of top ten singles.
His North American debut, like all his material, is sung entirely in English. It is
an impressive mix of charged pop songs and moving ballads. Produced
by Richie Wise, this album features ten tracks co -written by Hallyday and Lisa
Catherine Cohen. Hallyday also plays keyboards, guitar and percussion on
the album. Tears Of The Earth is argua- bly the strongest track and features
vocal support from the Peace Child Repertory Theatre. Also key is Different
Destinations and Change Of Heart. (CD reviewed) -

TRISHA YEARWOOD - Country Trisha Yearwood
MCA MCAD-10297-J
One of the surprises of the year, Trisha Yearwood has literally crashed the
charts with her debut single, She's In
Love With The Boy. There's a warmth and an in -born confidence here with
projection and lyrical interpretation control that sets her up for a very long
career in country music. The foot in the door for Yearwood is her choice of
material, ten tracks, written by some of the best from Nashville, and her guests
aren't to shabby either: Garth Brooks,
Pat Alger and Stuart Duncan. The first single, She's In Love With The Boy, was
one of those treasures on a platter
types of release. Even the record
company wasn't aware of the potential of this talent. Also key are The Woman
Before Me, Lonesome Dove and You Done Me Wrong (And That Ain't Right).
Produced by Garth Fundis. (CD reviewed)

Tembo to ship CDs by Baker and Whittaker
Ed Preston, President of Tembo Music Canada, reports the shipping to radio of new singles
from Carroll Baker and Roger Whittaker, to be followed over the next couple of weeks by CD releases.
Baker's new priority track, It's How You Make Love Good, is another original by Baker
and Bryan Way. The single, which is four -parts Cancon, was taken from her album, Her Finest
Collection. Arms That Love, her 1985 hit single which had not previously been available on CD
is the Requested -on -CD track. Baker is cur- rently charting with I Should Have Put A Hold
On Love, which was also taken from Her Finest Collection.
Whittaker's new track, Early Morning MemorieS, was taken from his album, You
Deserve The Best. The album has two bonus tracks, never released in Canada before; Love
