Report against duty officer SI(UB) Sailendra Nath Dutta & Sentry HG 824 Sadhin Adhikary duly forwarded by ACP(E) ADCP (E) SMP to the effect that on 23.09.15 at 20:25 hrs OC NJP OP detected smell of ganja from the Hajat of NJP OP SMP and on enquiry he found that match Box, Biri and ganja inside the Hazat of NJP OP while duty officer & sentry did not able to reply satisfactory that how the things are entered in hazat. Thus the negligence of the officer on duty is clear. Heard him he is Censured.

SI (UB) Dipanjan Das of Siliguri Metropolitan Police, Siliguri was charged with dereliction of duty unbecoming of a member of Police Force.

After going through all the evidence on records and applying my mind very carefully and judiciously I agree with the findings of enquiry officer. I do hereby pass the Final Order as:-

“After careful consideration of all the pros & cons of the proceedings file, the charged levelled against the charged SI (UB) Dipanjan Das could not be substantiated. Hence, the Charged Officer is exonerated from the charges as levelled against him.”

RO will serve the copy of the final order to the Charged Officer.

PD /659 Pulak Chatterjee of Siliguri Metropolitan Police, Siliguri was charged with indiscipline conduct up becoming of a member of police Force.

“The pay of the Charged PD/659 Pulak Chatterjee is reduced by 01 (One) increment for 06(Six) months with immediate effect i.e. w.e.f October 2015 to March 2016 without cumulative effect.

Suspension period w.e.f 15/01/2015 A.M to 17/02/2015 P.M is confirmed which means the charged PD will not get anything apart from subsistence allowance whatever he has drawn”.

As per Rule 883 of PRB Vol-I the charged PD is at liberty to appeal against this order before the Appellate Authority within 37(thirty seven) days from the receipt of the copy of the Final Order.

RO will serve the copy of final order to the Charged PD.

C/216 Bimal Kumar Roy of Siliguri Metropolitan Police, Siliguri was charged with indiscipline conduct unbecoming of a member of Police Force.

“The pay of the charged C/216 Bimal Kumar Roy is reduced by 01 (one) increment for 06 (six) months with immediate effect i.e. w.e.f. October 2015 to March 2016 without cumulative effect.

Suspension period w.e.f 15.01.2015 A.M to 17.02.2015 P.M is confirmed which means the Charged Constable will not get anything apart from subsistence allowance whatever he has drawn”.

As per Rule 883 of PRB Vol-I the Charged Constable is at liberty to appeal against this order before the Appellate Authority within 37 (thirty seven) days from the receipt of the copy of the Final Order.

RO will serve the copy of final order to the Charged Constable.

DC/621 Subodh Ch. Biswas of Siliguri Metropolitan Police formerly of Jalpaiguri District was charged with gross negligence and dereliction of duty unbecoming of a member of Police force.

“After carefull consideration of all the pros & cons of the proceedings file, the charges levelled against the charged DC/621 Subodh Ch. Biswas could not be substantiated. Hence, the DC/621 Subodh Ch. Biswas is exonerated from the charges as level against him and the proceeding is disposed off”.

RO will serve the copy of final order to the charged constable driver.

Ref C.O No. 3020 dated 05/10/2015 of Final Order passed by Shri Indra Chakravorty, IPS, D.C.P (HQ), SMP in c/w this unit proceeding no. 04/2015 dated 28/01/2015 drawn up against C/216 Bimal Kumar Roy of SMP, it is ordered that his pay is reduced by 01 (one) increment for 06(six) months with immediate effect i.e: w.e.f. October 2015 to March 2016 without cumulative effect.

His present Basic PB-Rs.12660 + GP-Rs 3200 = Rs.15860/- PB-3(7100-37600) is reduced by 01 (one) increment for 06(six) months to PB- Rs 12190 + GP- Rs. 3200 =Rs.15390/- PB-3(7100-37600) w.e.f. October-2015 to March-2016 without cumulative effect.

The above fixation is provisional subject to revision over drawl if any that should be refunded by the govt. Employee when he called upon to do so.

Ref C.O No. 3019 dated 05/10/2015 of Final Order passed by Shri Indra Chakravorty, IPS, D.C.P (HQ), SMP in c/w this unit proceeding no. 03/2015 dated 28/01/2015 drawn up against PD/659 Pulak Chatterjee of

His present Basic PB-Rs.14970 + GP-Rs 3600 = Rs.18570/- PB-3(7100-37600) is reduced by 01 (one) increment for 06(six) months to PB- Rs 14430 + GP- Rs. 3600 =Rs.18030/- PB-3(7100-37600) w.e.f. October-2015 to March-2016 without cumulative effect.

The above fixation is provisional subject to revision over drawl if any that should be refunded by the govt. employee when he called upon to do so.

Ref. Final order passed vide this unit C.O. 2507 dated 13/08/2015 in c/w Siliguri Metropolitan Police Proceeding No. 23/2014 dated 28/08/2014 drawn up against SI(UB) Ashish Chakraborty of Siliguri Metropolitan Police, with an order that:-

“The pay of the Charged SI (UB) Ashish Chakraborty is reduced by 01 (one) increment for 06(six) months with immediate effect i.e. w.e.f. August 2015 to January 2016 without cumulative effect.”

Peruse all the document, Statement of Witness, findings and Final Order. After applying my mind judiciously I have agreed with the final order passed by the disciplining authority, Smt O.G Pal DCP (HQ), SMP. Hence the ‘Final Order’ passed by the Disciplining Authority is upheld and approved.

Whereas, the information received from the Chief Terminal Manager Siliguri TL of Indian Oil Corporation Ltd. (MD) Siliguri Terminal, P.O- Bhaktinagar , Dist. Jalpaiguri that during the festival season i.e Durga Puja and Dipawali is going to be celebrated by bursting crackers, using fireworks & decorating with temporary illumination. As Indian Oil Corporation Ltd. (NJP) area under Bhaktinagar P.S, SMP stores a huge quantity of highly inflammable petroleum products like petrol, High speed Deisel, Kerosene Oil and Turbine fuel:

Whereas, there is an apprehension of breach of peace and tranquillity during the Festival Period of Durga Puja and Dipawali within a distance of 500 (five Hundred) meters from their boundary wall (Indian Oil Corporation Ltd.) so that no untoward incident take place and smooth supply of petrol products as usual:

ANDWhereas, it is felt expedient to pass certain direction to prevent

any danger to life and property of the Indian Oil Ltd;

ANDWhereas, it is further felt expedient to arrange for speedy remedy

in case of breach of peace and public tranquillity on the aforesaid period and surrounding the said area.

Now, Therefore, in exercise of the power conferred by sub sec (1) read with sub sec (3) of Sec. 144 of the Code of Criminal Procedure, 1973 (2 of 1974) I, Manoj Kumar Verma, IPS, Commissioner of Police, Siliguri and Executive Magistrate in relation to the Metropolitan area of Siliguri and being empowered so to do by the State Govt. do hereby-

1. Prohibit assembly of five (5) or more persons with any bursting crackers and using fireworks within the radius of 500 (Five Hundred) meters of the periphery of the boundary wall of Indian Oil Corporation Ltd. On the period of festival;

In exercise of powers vested under section 26 of the Bengal Excise Act, 1909, it is hereby ordered that in order to ensure peace and order on the occasion of the upcoming festival days, i.e.

1. “Maha Astami Day” on 21 st October-2015:- All categories of retail Excise Shops in Siliguri Metropolitan Police area shall remain closed throughout the day or on the date on which the festival is to be observed.

2. “Bijaya Dashami” on 22 nd & 25 th October-2015:- All categories of retail Excise Shops in Siliguri Metropolitan Police area shall remain closed from 15:00 hours of the day.

3. “Muharram” on 23 rd & 24 th October -2015 or on the 9 (nine)th and 10(ten)th day of Muharram Festival-2015:-All categories of retail Excise Shops in Siliguri Metropolitan Police area shall remain closed.

Any deviation shall be viewed seriously and appropriate legal action shall be taken in case of any such deviation.

WHEREAS, there is apprehension of breach of public safety and security during the Kali Puja/ Deepawali in the month of November 2015 by any accident in any of the explosive fireworks and Chinese Crackers of sparkles shop in Siliguri Metropolitan area.

WHEREAS, it is felt expedient to pass certain to prevent annoyance or injury to any person in this Metropolitan area during the festival season by any unwanted regarding the sale of explosive fireworks in the market places;

WHEREAS, it is felt expedient to arrange for a spacious location to establish a centralized, isolated hub of fire crackers shop in the Metropolitan area;

NOW, THEREFORE, in exercise of the power conferred by rule 99, of Explosive Rule, 2008, I, Manoj Kumar Verma, IPS, Commissioner of Police, Siliguri do hereby-

1. Order than no sale or transport of fireworks will be allowed in the Siliguri Metropolitan area except with a temporary license issued in this regard by the Metropolitan Police by the authority empowered by law;

2. Direct and allow the dealers of fireworks to erect temporary stalls only in the three (03) places i.e. (1) Vacant Land of Sri Kabhilal Barman at SMC Ward No. 43, Barman Para, Gandhinagar, Sevoke Road, P.S.
