I HAVE AUDITED THE STATEMENTS OF RECEIPTS AND DISBURSEMENTS OF BOTH THE UNENCUMBERED FUNDS AND THE ENCUMBERED FUNDS FOR THE YEAR ENDED DECEMBER 31. 2002. THIS AUDIT INCLUDED AN EXAMINATION OF THE RECEIPTS AND DISBURSEMENTS RECORDS, DEPOSIT VOUCHERS, CANCELED CHECKS, BANK STATEMENTS, VENDOR INVOICES, VOUCHERS, AND OTHER SUPPORTING DATA. THIS EXAMINATION INDICATES THAT FUNDS WERE PROPERLY ACCOUNTED FOR, THAT GOOD RECORDS WERE MADE, AND THAT INVOICES OR OTHER DETAILED INFORMATION ARE ON FILE WHICH ADEQUATELY SUBSTANTIATE THESE TRANSACTIONS. BASED ON THE RESULTS OF THIS AUDIT, I CONCLUDE THAT THE RECEIPTS AND DISBURSEMENTS STATEMENTS OF BOTH THE UNENCUMBERED FUNDS AND THE ENCUMBERED FUNDS OF THE ELLER FAMILY ASSOCIATION FOR THE YEAR ENDED DECEMBER 31,2002 PRESENT FAIRLY THE CASH TRANSACTIONS FOR THE YEAR AND THE CASH BALANCE AS OF THAT DATE.

New Eller Notes from a German Connection Helen Shellenbarger Eller

My name is Helen Eller and I am a member of the EFA. My husbands line is out of Christian Eller through George and Washington Eller. I have a fellow genealogist who shared some Eller research with me and I would like to have it posted on the Chronicles. Perhaps it will aid in locating our connection to Germany.

I have a German Eller contact that lives southeast of Frankfurt. She says that her husband's grandparents lived southeast of Dusseldorf between 1850 and 1920. Arthur and Ursula Eller maintain that their family is from the nobility of Eller's at Dusseldorf, as this was told to Arthur by his father. I also noticed that there were Eller's in the Alzey area, southwest of Frankfurt, about the same time my Schollenberger's were there (1673-1742). They were members of the Reformed Church of Albig, Germany, but there was a larger church in AIzey, Germany. There should be records of this church in the LOS Library, and I am curious if they were uncovered in the latest excursion to Utah?

Anyway, here is the research that I would like to share:

"There was however another estate in noble hands. The Knight Theodorich von Elner and his wife, Beatrix, in 1270 received an income of 3 shillings from their property in Solingen. This may be connected with the Eller family in some way; however, in the documents known to Lacomblet from the 13th century the name Eller is not to be found, although it may well appear in the form "Elnere." The location of the estate is not known."

Wilhelm Eller von Reuschenberg, (1484)- Chapter IV, p 33- House Schirpenbroich

"The transfer of the fiefdom to Monich did not stand uncontested. Later in the same year, Wilhelm Eller von Reuschenberg received the house, the estate, the mill, and other properties of Schirpenbroich. Monich did not vacate the property, however, and the matter came before the main court in Porz. The Solingen Official, Caspar von Pertzdorp, instigated the trial, and after Wilhelm Eller's renunciation he received the Schirpenbroich property. The fiefdom was assigned to Casper Pertzdorp, the owner and establisher of the Caspersbroich estate, in 1479. He enforced the evacuation of Schirpenbroich and gave it to his daughter Steingen (Christine) as a dowry for her marriage to Knight Gerhard von Overheid. The Overheids held possession of Schirpenbroich from 1500 until 1678 Using it as a base of operations, they were active in the Reformation in Solingen and, toward the end of their period of ownership when they had become Catholic, in the Counter Reformation."

Solingen is located east of current day Dusseldorf, Germany.

Hope this sheds some light on the Eller Research...

Sincerely,

Helen Shollenbarger Eller

What Happened to Joseph Eller's Estate? By Susie Roberts Ray

Joseph Eller was my great grandfather. It is hard to believe that we are only three generations apart since he died in 1863, but a look at his genealogy explains it.

Joseph was born about 1792 in the far western county of Sullivan when it was a part of North Carolina, the son of John Jacob Eller Jr. and Mary Biffle. By 1800 his family had moved to Buncombe County (formed in 1791). Joseph is listed as "under ten" years old in this census.

Joseph Eller was married first to Sarah Stephens about 1810. Sarah's father, Joseph Stephens, fought with a group of Cherokees who aided the Creek nation against Andrew Jackson and the Tennessee militia at the Battle of Horseshoe Bend in Alabama, where he was killed 27 March 1814.

He and Sarah had nine children: 1) Nancy m. Joseph 1. Justice; 2) John Wesley m. Matilda Rutledge; 3) Mary Ann m. Elijah Roberts; 4) Jacob m. Nancy Wood; 5) Elizabeth m. George W. Pittman; 6) Robert Vance m. Sallie A; 7) James H. m. Sarah A. 1. West; 8) Abraham 9) Joseph Michael Franklin m. Susan Elizabeth McFerran.

Sarah died in 1846/47 and Joseph was married again in 1848 to Elizabeth Clorinda Hamilton when she was 20 and he was about 55 years old. Joseph and Clorinda had 6 children: 1) William Taylor m. Mary Jane Bowen; 2) Margaret C. married Joseph Christopher Fox; 3) Joseph Hardy m. Amanda Delia Smith; 4) Rebecca (died 1863/69); 5) Susanna Christina m. Zebulon Vance Roberts; 6) James Eller (died 1863/69).

Clorinda was my great grandmother and Susannah (for whom I am named) my grandmother. Susannah and Zebulon Vance Roberts (named after the Confederate governor). had two sons who lived to adulthood: Joseph Ervin and my dad, Alfred Fulton Roberts.

Joseph Eller's grandfather was John Jacob Eller, whose parents Casper and Maria were married in Montgomery County, Pennsylvania in 1753, after emigrating from Germany. John Jacob Jr. was born in Pennsylvania, but later moved to Rowan County, NC where he married Mary Biffle. Jacob and Mary probably left Rowan with Mary's parents, Adam and Catherine Biffle, for Sullivan County around 1778. By 1789 he obtained a land grant of 100 acres on the Holston River. Their eight children were born in Sullivan County (now Tennessee) but the family had moved to north Buncombe County by the time of the 1800 census. (Mary's sister Elizabeth had married into the Weaver family, for whom Weaverville is named).

The first land that Jacob Jr. acquired in Buncombe County was listed in the name of his son Joseph, 100 acres on a branch of Reems Creek. Eventually he accumulated 150 acres in that area, but Jacob Jr. was never completely happy in Buncombe County, as he kept going back and forth to Tennessee. Eventually he left Reems Creek and never came back. The story is told that he settled in east Tennessee and raised a second family, but it has never been verified. When her husband had been gone for six years, Mary Biffle petitioned the General Assembly of North Carolina for a divorce in 1806, an action necessary for the retention of her

property in Buncombe County. Mary died In 1837 and buried In the Old Weaverville Cemetery.

Joseph and his brother Adam were fathers of the Eller descendants in western North Carolina. By the time of the Civil War, they were large landowners with a few slaves, Joseph's holdings larger than Adam's. Blanche Robertson, a Weaverville historian and genealogist, said that at one time, Joseph owned the land that is now downtown Weaverville, but Joseph and his cousin, Montraville Weaver, agreed to swap lands with a handshake that gave Montraville the downtown area and Joseph hundreds of acres of Weaver land that became Eller Cove.

Joseph Eller served as a constable for the Reems Creek Company for several years in the 1850s, which required a bond of $4000. During the Civil War, Nicholas Woodfin set up a whiskey distillery to supply the Confederate troops for medicinal purposes. He asked Robert Brank to manage it for him. Brank did not know how to make whiskey but asked his friend, Joseph Eller, to teach him

According to family stories and census records, Joseph lived separately from both his wives at various times. In the 1830 census, Joseph and Sarah are listed in separate households. Clorinda was not well received by the children of the first family, perhaps because their father had married a woman younger than some of them. Between 1822 and 1850, according to the Buncombe County Deed Book, Joseph Eller bought 7394 acres of land in Flat CreekJReems Creek.

But he must have sold some of it, as the 1860 agricultural census for Reems Creek indicates that Joseph Eller had 200 improved acres, 1400 unimproved acres. The cash value of his farm was $8000 ($172,128 in today's money). The improvements he had made and his machinery were worth $300. The total value of his livestock was $1212 and included ten horses, five asses and mules, five milch cows, two oxen, nine cows, ten sheep and thirty swine. He also listed 400 bushels of Indian com, and fifteen pounds of wool.

His death in 1863 at age 69171 has resulted in a number of stories handed down from one generation to another. One story says that he ate a poisoned watermelon given to him by one of his slaves. Some say the first family planted the poison because they wanted to get rid of him in order to get their inheritance. (This is the story that my Dad heard). Others say the children of his second family poisoned him, but since they were minors at the time of his death, it seems unlikely. Janine Eller Porter heard that one of Joseph's children paid a slave to poison him after an argument over his land. Still others say that he did not die by poison. What really happened, we will probably never know for sure. What is sure is that he died intestate and the settlement of his estate took many years. Joseph Eller's papers can be found at the North Carolina Archives in Raleigh, NC. These estate papers and subsequent Buncombe County court records (at least 100 documents) are the sources for the following very condensed information about Joseph's estate. But because of the often illegible handwriting in the documents and the unfamiliar legal actions, there may be mistakes.

Joseph Eller died September 25, 1863. On September 28,1. R. Weaver was named the administrator of his estate, for which he was bound to the state of NC for $5,000. He was

charged with making a full inventory of Joseph's estate in order to settle any claims that might be made against it. In November R. V. Blackstock was made an additional administrator.

The Fan 1863 term of the Buncombe County Court of Pleas and Quarter Sessions heard the petition of Clarinda Eller's attorney, A. S. Merrirnon, for a writ of dower for twelve months against her husband's estate. Subsequently the court ordered four commissioners "to layoff and allot" one year's provisions for the widow and her family and report to the next term of the court. In December 1863 the commissioners gave Mrs. E. C. Eller one oat stack, 150 bushels of corn, forty bushels of wheat, nine head of hogs, nine head of sheep, three milk cows, one heifer for beef, one horse, three or four sides of leather, two plows and gears, two axes, one clock, one side saddle, all the household and kitchen furniture, three bee hives, one kettle, a large pot, the flax on hand, and $150 in cash. But Elizabeth C. Eller took exception to the commissioners' report saying that it was quite inadequate to her support. What had been promised was only partially delivered and some of it was worthless. She hoped that the request was set aside or greatly increased. The Record of Settlements in October 1863 indicates that the widow of Joseph Eller was paid $1682 toward her year's allowance. In February 1864 another commission gave her a writ of dower for that year for $1651, with particular amounts designated for livestock, hay, salt, wagons, etc. Four receipts signed by Elizabeth C. Ellar indicate that J. R. Weaver gave her at least $1241 during the year of 1864, whether or not this is in addition to the amount of her dower is unclear.

At the February 1864 session of the Buncombe County Court, A. W. Woodfin, attorney for Elizabeth C. Eller, declared again that Joseph Eller had died intestate in September 1863, leaving a large (amount of) real estate consisting of local tracts of about nine hundred acres on Flat Creek and its waters that included a good grist mill and dwelling house where Joseph resided with his family up to the time of his death and several thousand acres of adjoining tracts of mountain lands. Woodfin also listed residences of some of the heirs and their spouses, including John and Franklin Eller, who were living in Missouri; Nancy and her husband Joseph Justice, Mary and her husband Eli Roberts, and James Eller were living in Buncombe County; Abraham, Elizabeth and her husband George Pittman, and Jacob Eller were living in Tennessee. These siblings were from Joseph Eller's first family. Also living with their mother in Buncombe County were the children of the second family, the oldest fifteen, the youngest four years old. The attorney asked that twelve copies of the petition be served to the heirs at law and that the children be appointed a guardian ad litem.

In November 1864 Eliza C. Eller filed a petition in court against the heirs at law of Joseph Eller to receive her portion of the real property in her husband's estate. The court appointed twelve freeholders unrelated to any of the parties to allot to the widow one third of all lands, tenements and dwelling houses. All parties agreed that a part of her dower should be the place she lived on the waters of Reems Creek. This settlement included 640 acres, one third of the properties, and was awarded as part of her dower.

A report from the administrators, J.R. Weaver and R. V. Blackstock, sometime in 1865 indicated that the estate had assets of $16,369 from the sale of personal property, that they had made disbursements of $1688 to the widow and they had paid $1957 in other disbursements. The amount left in the estate after these transactions was $13, 917.

By December 1867 Elizabeth Clorinda had received the real property allotted to her. The court awarded the remainder to the heirs of Joseph Eller. In September 1867 the court gave 1/13 to each of Sarah's children: Mary Ann, Jacob, James, Abe (who sold his part to 1. R. Weaver, administrator), Franklin and Elizabeth. And 1/13 was awarded to Clorinda's children: William, Margaret, Joseph H., and Susanna.

Sarah's oldest daughter Nancy, who married Joseph Justice, died before the estate was settled and her part was divided among her six children: James, Jacob, Sophronia, Nicolas, Gragg, and William, each receiving 1/78. John W. Eller, Sarah's second child, died in Missouri before the estate was settled and his son John Wesley died in 1865 fighting for the Confederacy. John Wesley's children, John, William, Laura and Lilly Eller received 1/52 of the real property. Robert Eller, Sarah's sixth child, died in 1852 in Tennessee. His son John W. Eller received 1113 of the real property. 1. R. Weaver, executor of the estate, also received 1/13 (Abe's share). In the above court action, the plaintiffs, which included all of both sets of children except for Franklin Eller and Elizabeth Pittman, asked that if a partition could not be made without material injury to the respective rights of all parties that the property should be sold and the proceeds divided between all parties, after payment of court costs.

In September, 1868 a similar action involving four slaves that the family had inherited was made, i.e that they be sold and proceeds divided among the widow and all of Joseph's heirs.

In January 1869 Blackstock and Weaver were given an extension of twelve months to settle Joseph Eller's estate. In May of the same year, 1. A. Reagan was appointed guardian for Joseph H. Eller (ca.15 years), and Susan T. Eller (10), Clorinda's two minor children. A number of court actions in 1869 and thereafter involved finding the heirs who lived out of state, all of them children of Joseph and Sarah: Franklin Eller, Elizabeth and her husband George Pittman (Tennessee) and the minor children of Nancy and Joseph Justice. In an effort to find them, notice was placed in the Asheville News and Mountain Farmer, a weekly newspaper, for six weeks ending Oct 1, 1869.

In depositions sworn before 1. E. Reed, Clerk of Court and Referee in this case, Nehemiah Blackstock and 1. A. Buckner in December 1869 said that because of the great inequality of the lots both as to size and value that actual partition could not be made without manifest prejudice to the parties in interest. In the same month, the court noted that the original administrator, J.R Weaver, had died and that his children would take his place as one of the plaintiffs in the case. R V. Blackstock was appointed guardian of the five minor children.

In the years after Joseph's death, a number of people sued the estate for debts that were owed them. Conversely, RV. Blackstock got permission from the court to sell the debts to Joseph Eller that he had been unable to collect at public auction, which occurred at the courthouse on March 15, 1874. Meantime 1. A. Reagan paid the needed amount for the care of the two minor children, John H. and Susan T. (for Christina?) Eller and reported to the court annually. His final report in June 1880 (Susan was 21 years old) indicated that he had received $763.18 from the estate since 1870.

Upon the complaint of the inequity of the shares of property, in December 1869, the court ordered a sale of the property and "that such sale shall be on a credit of one and two years in equal installments with interest, required bond, and two good sureties of the purchasers." The auction was held in early March 1870 and the twelve tracts were bought by M.B. Wild (#1) Thomas M. Garrison (#2), J. e. Fox (#3), J. e. Eller (#4), N. Roberts (#5), T.R Weaver (#6), A.R. BalI and E. F. Roberts (#7), J. H. Garrison (#8), WilIiam Eller (#9), W. R. Edmonds (#10), Jacob Eller (#11), WilIiam Eller (#12). The total amount of all the sales was $7416, which in today's dollars comes to $101,632. It appears that the estate was sold to relatives and friends of Joseph Eller. J.e. Fox was probably the husband of Margaret, the second child of Joseph and Clorinda. J.e. Eller may have been Adam Eller's son. The judge of the eleventh judicial district confirmed the sale in June 1870.

But it must have taken some time for the money to be distributed to the heirs, as J.E. Reed signed an affidavit January 19, 1871 indicating that he had in his possession "six thousand dollars or more". Apparently James Eller was sued for a debt he owed and Reed indicated that his (James') share would cover it.

In 1872 R.V. Blackstock, the remaining administrator, told the probate judge that he had been unable to colIect any of the debts against the estate and got permission to sell them at public auction, which occurred March 17, 1874.

Four years after the sale of the property (1884) when all unpaid bonds were overdue, notice was given to the purchasers of four lots (3,4,6,9) and their bondsmen that they had ninety days to complete payment or the land would again be sold at public auction. In August 1886, William Eller, purchaser of Lot #9 for which he owed $326 told the Court that he had received none of his share as an heir of Joseph Eller, that his portion was worth $355.74, whereupon it was decreed that he was to be given title to the lot.

J.F. Graves, Judge of Superior Court, in March 1887 turned the Eller case over to a referee to investigate the exact amounts due to each of the heirs and owed by the purchasers of the lots, so that the money could be distributed. Once that was done, J. E. Reed, Judge of Probate, paid to all the heirs and other parties involved the amounts due (with a few exceptions pending), including the fees of the administrator, R. V. Blackstock. Having completed his duties, J.E. Reed was discharged and the case dropped from the docket.

As can be seen, the settlement of Joseph Eller's estate outlined above from estate/court documents covered 24 years. JAMES A. ELLER May 1, 1942 - April 16, 2003

BELLMEAD, Texas -- James A. Eller, 60, died Wednesday (April 16,2003) in Waco,

Texas, of complications from cancer and Lou Gehrig's disease.

He was born May 1, 1942, in Mishawaka and lived in northern Indiana until 1972.

Survivors in Elkhart include three sons Mark, Jon and James; two daughters, Denise

and Lori; seven grandchildren; 13 great-grandchildren; and one brother, Gene (Pat).

Also surviving are two brothers, George (Rita) Jr. of Jacksonville, Fla., and Bill

(Gloria) of Lorena, Texas; one sister, Marilyn Custer of Waco; and several nieces and

nephews.

A memorial will be from 2 to 4 p.m. today at Mr. Eller's Bellmead home. He wanted his

body donated for medical research.

Mr. Eller worked in the mobile home industry before taking a job with the Texas

Department of Correction in 1980. He retired six years later after being diagnosed with

ALS.

The disease made him give up traveling, woodworking and music, but he bought a

computer in 1996 and trained himself through trial and error. He became proficient in

repair and programming, earning the nickname "Jim The Computer Man."

Memorials may be given to the ALS/Lou Gehrig's Disease Foundation.

;,,,!~.

I just wanted to let you know that Jim contributed so much more to this world than was stated [in his obituary]. He was avid about anything or any subject he was interested in - which was many, many things - his love ofmusic, travel, truck driving, planes, his woodworking, his refinishing furniture, building cabinets and most ofall, in the later years, his conquer of building computers. You can tell by that accomplishment, how avid he was in any interest he had.

I can't tell you how many technical books he devoured trying to learn how to combat this feat, and he did it and was very successful. He had many friends he made during this time of accomplishment who came to him to fix their computers and really came to admire him and respect him for his knowledge.

Jim was very interesting to be with because he loved and knew so many different subjects. And this I think also came from what Mom taught us. Deserving the credit, she was the one who passed on the love ofall kinds ofmusic from classical to whatever and her love ofreading, giving us the opportunity to learn. And as she used to say, "You can do anything or go anywhere ifyou can read", and how true that is.

As one ofJim's friends said at his Memorial service, "Jim told me he has traveled the world, able to see and learn things without ever leaving his home or spending any money, through the computer".

He was an avid race fan, watching the races on Sunday, avid to the point oftelling anyone who dared to call on Sunday, "I'm watching the races, call me tomorrow!" ... and they did.

There is such a great loss with Jim being gone. He took so much talent with him and knowledge that would have been wonderful had he been able to teach us. I miss him so much...he was my best friend as well as my brother and there is such a great void now.
