PART I-Preliminary

1. These Regulations may be cited as the Dental Regulations, 1974.

2. In these Regulations, unless the context otherwise r e q u i r e s

"approved training institution" means an institution approved by the Council as a school for training dental auxiliaries;

"Board of Examiners" means the Board of Examiners established under regulation 13 ;

"Dental Auxiliary Training School" means the Dental Auxiliary Training School established by the Government;

"enrolled member" means a person enrolled under the Act as a member in any prescribed class of dental auxiliary;

"recognized university" or "recognized college" means a university or college respectively, offering courses of training, degrees, and other qualifications which is declared to be such by the Council;

"registered member" means a person registered under the Act as a dentist.

3. Subject to the provisions of subsection (3) of section 8 of the Act, no person shall be registered as a dentist unless he holds-

(a ) a degree in dental surgery fiom a recognized university or recognized college; or

(6 ) any other qualification in dental surgery considered by the Council to be of at least equivalent standard as that specified in paragraph ( 4 ; or

(c) has passed the examination refexred to in regulation 4.

4.-41) Where the Council is in doubt as to the standard ofqualifica- tion or skill of an applicant for registration, it 'shall refer the applica- tion together with all relaant documentary evidence (of the courses of study undertaken by the applicant, the institution at which such courses were undertaken and any examinations taken by the applicant) to the Board of Examiners appointed by the Council, in accordance with regulation 13 for determination.

(2) On examining such application the Board of Examiners m a y

(a) recommend to the Council that the name of the applicant be entered in the register; or

(6) conduct an examination in respect of the applicant; or

(c) recommend to the Council that the application be refused.

(3) Where an applicant fails an examination conducted pursuant to sub-paragraph (2) (b) the Board of Examiners may recommend to the Council that the applicant should not be allowed to repeat the examination unless he has obtained, over a specified period being not greater than one year, such supervised experience in clinical dentistry as may be determined by the Council.

(4) A fee of one thousand dollars shall be paid by the applicant to the Registrar in respect of an examination conducted pursuant to sub- paragraph (2) (6).

5 . 4 1) Any person who satisfies the requirements for registration may h h l k mn.4

apply to the Council in the form specified as Form A in the Schedule for registration as a dentist.

(2) Any person who applies for registration as a dentist in accordance with paragraph (1) and-

(a) furnishes such satisfactory references as to character as the Council may require; and

(b) pays the registration fee of two thousand dollars,

shall be registered as a dentist and shall, while he is so regstered, be entitled to use the title "Registered Dentist*'.

6.-41) A certificate of registration in the form prescribed as Form F~ B. B in the Schedule shall be issued by the Registrar to every person

registered as a dentist in accordance with regulation 5 or deemed to be registered as a dentist pursuant to subsection (3) of section 8 of the Act.

(2) Where a certificate of registration issued under paragraph (1) has been lost or destroyed, the person to whom it was granted may apply to the Registrar for a duplicate certificate which shall be issued only after the lapse of one year fiom the date of such application and upon payment by the applicant of a fee of five hundred dollars, and any duplicate certificate so issued shall be clearly marked "DUPLICATE.

6 A . 4 1 ) A registered dentist who practises as a dentist shall apply to the Council in the form specified as Form A1 in the Schedule, to be issued with a practising certificate.

(2) A practising certificate shall be valid for a period of twelve months from the date of issue.

(3) A practising certificate shall-

(a) be in the form prescribed as Form B 1 in the Schedule; and FWUI BI .

(b) be issued on payment of a practising fee of five thousand dollars.

7. The register shall contain in relation to every registered dentist the particulars specified in Form C of the Schedule. F O ~ I c.

8. The Registrar shall publish in the Gazette-

(a) during the period of twelve months commencing on the 19th day of September, 1974, a list of all dentists registered during that year;

(b) and thereafter on or before the last day of February of each year, a list of all persons so registered during that year,

including in respect of each dentist the particulars specified in Form C in the Schedule.

9 . 4 1 ) Any person who desires to practise dentisby in Jamaica for a limited period of time and who satisfies the requirements for registration specified in regulation 3, may apply to the Council in the form specified as Form A in the Schedule to be temporarily registered as a dentist. F m A

(2) Any such application shall be accompanied by-

(i) a certificate signed on behalf of the hospital or other institution at which the applicant intends to practise -

(a ) that the applicant bas been accepted to practise dentishy in that hospital or institution; and

(b) the period of time for which be has been accepted;

(ii) a registration fee of five hundred dollars unless the Council otherwise directs.

10.-41) The Council may, after considering the application, direct the Registrar to enter the name, address, and qualification of the applicant in the register as a temporary registered dentist, subject to such terms and conditions as it thinks fit.

( 2 ) The Registrar shall cause a note to be made next to the entry in the register of a temporary registered dentist o f

(a) the name of the hospital or institution to which the dentist is assigned;

(b) the period for which he is regmered; and

(c) the date of expiry of such registration.

PART n1-Dental Auxiliaries

1 1 . The following classes of dental auxiliaries are hereby prescribed pursuant to subsection ( 1 ) of section 10 of the Act-

(a ) dental nurses;

(b) dental hygienists; and

(c) dental technicians.

12.--(I) Subject to the provisions of subsection (2 ) of section 1 1 of the Act, m, person shall be enrolled as a member of any class of &ntai aruriliary unless-

(a) in the case of a dental nurse or a dental hygienist, bb

(ii) holds an appropriate certificate of proficiency from an approved training institution; or

(iii) holds any other qualification in dental nursing or dental hygiene considered by the Council to be of at least equivalent standard as those specified in (i) and (ii); or

(iv) has passed the examination referred to in regulation 14; or

(b) in the case of a dental technician he-

(i) holds a certificate or diploma in dental technology from an approved training institution; or

(ii) holds any other qualification in dental technology con- sidered by the Council to be of at least equivalent standard as that specified in (i); or

(iii) satisfies the requirements for registration as a dentist but is not so registered or has been registered as a dentist but whose name has been removed from the register; or

(iv) has passed the examination referred to in regulation 14.

(2) Any person enrolled by virtue of paragraph (iii) of sub- paragraph (b) of paragraph (1) shall cease to be so enrolled and his name shall be removed from the roll if-

(a) he is subsequently registered as a dentist: or

(b) in the case of a person whose name had been removed from the register, his name is restored to the register.

13. For the purpose of regulations 4 and 14, the Council shall appoint from among its members a Board of Examiners consisting of five members (one of whom shall be the Director of the Dental Auxiliary Training School), so. however, that where any member of the Board

of Examiners so appointed is not available for holding an examination. the Council may appoint any registered dentist or enrolled dental auxiliary to act in the place of that member.

14.-(1) Where the Council is in doubt as to the standard of qualifica- tion or skill of an applicant for enrolment, it shall refer the application and all relevant documentary evidence of the training of the applicant to the Board of Examiners for determination. 3

(2) On examining such application the Board of Examiners may-

(a) recommend that the applicant be enrolled; or

(b) conduct an examination in respect of the applicant; or

(c) recommend that the application be refused.

(3) A fee of five hundred dollars shall be paid in respect of any examination to be conducted pursuant to sub-paragraph (b) of paragraph (2).

15.-41) Any person who satisfies the requirements prescribed in regulation 12 for enrolment as a member of any class of dental auxiliary

Form D. may apply to the Comcil in the form specified as Form D in the Schedule for enrolment as a member of that class of dental auxiliary.

(2) Any person who applies for enrolment as a member of any class of dental auxiliary in accordance with paragraph (1) and-

(a) furnishes such satisfactory references as to character as the Council may require; and

(b) pays the enrolment fee of seven hundred and fifty dollars. 7 .-

shall be enrolled as a member of that class of dental auxiliary and shall, while he is so enrolled be entitled to use one of the titles, "Enrolled Dental Nurse" or "EnroTled Dental Hygienist" or "Enrolkd Dental Technician" as may be relevant to the class of dental auxiliary in respect of which he is enrolled.

16 .41 ) The certificate of enrolment to be issued by the Registrar to every person enrolled as a dental auxiliary pursuant to subsection (3) of section 11 of the Act shall be in the form set out as Form E FormE

in the Schedule.

(2) Where a certificate of enrolment issued under paragraph (1) has been lost or destroyed, the person to whom it was granted may apply to the Registrar for a duplicate certificate which shall be issued only after the lapse of one year from the date of such application and upon payment by the applicant of a fee of five hundred dollars, and any duplicate certificate so issued shall be clearly marked "DUPLICATE".

17. The roll of dental auxiliaries shall contain in relation to every enrolled member, the particulars specified in the form set out as Form F in the Schedule. F O ~ F.

18. The Registrar shall publish in the Gazette-

(a) during the period of twelve months commencing on the 19th day of September. 1974, a list of all enrolled members of each class of dental auxiliary; and thereafter

(b) on ar bedine the last day of Febrtmary of each year, a list of all persons so enrolled during that year.

19 .41) Any person who desires to work in Jamaica for a limited period as a dental auxiliary and who satisfies the requirement for enrolment as a member of any class of dental auxiliary specified in regulation 13, may apply to the Council in the form specified as Form D in the Schedule to be temporarily enrolled as a member of p-D.

(2) Any such application shall be accompanied by-

(i) a certificate signed on behalf of the hospital or other institu- tion to which the applicant intends to be attached, stating-

(a) that the applicant has been accepted to work in that hospital or other institution; and

(b) the period of time for which he has been engaged; (ii) a registration fee of three hundred dollars, unless the Council

otherwise directs. 3

20.41) The Council may, after considering the application. direct the Registrar to enter the name, address and qualification of the zpplicant in the roll as a temporarily enrolled member of any class of dental auxiliary, subject to such terms and conditions as the Council thinks fit.

(2) The Registrar shall cause a note to be made next to the entry in the roll in relation to any person temporarily enrolled as a member of a prescribed class of dental auxiliary, of-

(a) the name of the hospital or institution to which the dental auxiliary is assigned;

(b) the period for which he is enrolled; and

(c) the date of the expiry of such enrolment.

21. The functions of the prescribed classes of enrolled dental auxiliaries shall be as follows-

(1) An enrolled dental nurse may carry out the following treatments-

(a) extracting under local anaesthesia deciduous teeth and roots not covered by tissue;

(b) simple and compound restorations of primary and permanent teeth;

:c) cleaning and polishing teeth;

(6) scaling teeth (that is to say the removal of tartar deposits, accretions and stains from the surfaces of teeth which are exposed or are directly beneath the free margins of the gums, including the application of medicaments appropriate thereto);

(e) the application to the teeth of such prophylactic preparation as the Council may from time to time determine; including fissure sealants and topical fluorides;

(f) carry out routine examinations and charting of dental con- ditions;

(g) dispensing of such specific non-prescription drugs as the Council may from time to time determine; including aspirin and aspirin combinations or other drugs of similar pharma- cological action;

(h) the administration, whenever indicated, of conduction and infiltration anaesthesia to control pain;

(i) the taking of diagnostic dental radiographs;

(8 giving advice on matters related to oral hygiene,

so, however. that such treatments shall be carried out only in the course of his duties in the Government health service and only under the direction and supervision of a registered dentist or subject to such conditions as the Council may from time to time determine.

(2) An enrolled dental hygienist may carry out dental work ot the fnllowing kind-

(a) cleaning and polishing of teeth and fillings;

(h ) scaling teeth (that is to say. the removal of tartar deposits, accretions and stains from the surface of the teeth which are exposed or are directly beneath the free margin of the gums, including the application of medicaments appropriate thereto);

(c) the application to the teeth of prophylactic preparation as the Council may from time to time determine;

(4 giving advice on matters related to oral hygiene;

(e) the taking of diagnostic radiographs; and

(f) performing such reversible dental procedures in the oral cavity as may be directed by a registered dentist,

so, however, that such work shall be carried out only under the direction of a registered dentist who has examined the patient and has indicated to the dental hygienist the treatment to be carried out; and where such treatment is being carried out other than during the course of his duties in Government health service then only under the personal supervision of a registered dentist present at the time when such treatment is being carried out.

(3) An enrolled dental technician shall carry out dental work of the fo!lowing kind-

(a) the casting of models from impression of a patient's mouth;

(b) the construction of appliances based on these models from the dentist's prescription;

(c) repairs of broken or impaired plastic or metallic appliances for cases which do not require any procedure in the mouth on the part of the dental technician;

(4 the treatment cf metals and of the plastic materials used in the construction of these appliances;

(e) the construction of splints used in facio-maxillary surgery;

(f) the construction of orthodontic appliances in accordance with the prescriptioris of a registered dentist; and

(g) the construction of special appliances such as obturators and special prostheses.

22. An enrolled member shall carry out only such functions as may properly be carried out by members of the class of dental auxiliary of which he is enrolled and an enrolled or registered member shall not engage in activities contrary to the ethics of &is particular profession or conduct himself in a manner derogatory to the accepted standards thereof.

23. An enrolled or registered member shall not act as locum tenens for or assist any unenrolled or unregistered person in the treatment of any patient.

24. An enrolled or registered member shall not perform his duties while he is by reason of the influence of alcohol or drugs, unlikely to be able to do so efficiently.

25. Where in any disciplinary proceedings an enrolled or registered member is found guilty of having acted contrary to the provisions of regulation 22. 23 or 24 he shall be regarded as b e i i guilty of un- professional misconduct.

PART N-Dixiplinory Proceedings

%.-(I) Where an allegation is made to the Council that any re- gistered or enrolled member (in this Part referred to as "the respon- dent'') has been convicted of a criminal offence or is guilty of profes- sional misconduct, the Council shall appoint an investigation committee to decide whether the case should proceed to htaring, and any investiga- tion committee so appointed shall investigate the allegation as they think fit, and shall report thereon to the Comcil, stating whether or not the allegation made against the respondent has been substantiated.

(2) Where an investigation committee report to the Council that a prima facie case has been made out against the respondent in any case in respect of which that committee was appointed, other than one involving conviction for a criminal offence, the Council shall forthwith appoint a disciplinary committee to deal with the matter.

(3) Any investigation committee or disciplinary committee appointed in accordance with paragraph (1) or (2). as the case may be, shall consist of the chairman and four other members of the Council at least one of whom shall not be a registered dentist, so, however, that no member of an investigation committee (except the chairman of the Council) shall be appointed to be a member of the disciplinary committee in respect of the same case.

(4) A quorum of the investigation committee and the disciplin- ary committee, respectively. shall be three.

27.-41) An investigation committee appointed in accordance with the provisions of regulation 26 may, in relation to any case in respect of which they are appointed, at any stage of the investigation. take advice from any attorney-at-law appointed by the Council, and may obtain proof of evidence in support of the allegations made against the respondent, and may, in such cases as they think fit, decline to proceed with the investigation unless the evidence in support of the allegations (other than evidence of a conviction) is verified by statutory declaration.

(2) Where it is proved by the certificate of the competent officer of the court in which the proceedings took place, that the respondent has been convicted of a criminal offence and that such conviction has not been subsequently quashed on appeal and that there is no pending appeal against that conviction, the investigation committee shall so inform the Council and the Council may forthwith and without further inquiry, direct the Registrar to remove the name of the respondent from the register or roll as the case may be.

(3) In any other case in respect of which it is appointed, the investigation committee shall invite the respondent to furnish any written statement of explanation which he may wish to submit and shall consider such statement of explanation before taking a decision on the matter.

28.--(I) Where a disciplinary committee is appointed in accordance with the provisions of regulation 26, they shall iix a date for hearing the matter and may dlrect the attomy-at-law appointed by the Council to take all necessary steps for verifying the evidence to be submitted to them and for obtaining the necessary documents and attendance of witnesses at the hearing.

(2) The disciplinary committee shall send to the respondent a notice in writing, specifying the nature and particulars of the allegation against him, and informing him of the time and place of the meeting of the disciplinary committee at which the matter will be heard.

(3) A notice under paragraph (2) shall be sent to the respon- dent by registered post to his address entered in the register, or if the Registrar has reason to believe that that address is not his present

address, then to any other address which may be known to the Regis- trar, and shall be posted so as to allow at least twenty-eight days to elapse between the date of posting and the date fixed for hearing.

(4) Where there is a complaint in any matter fixed for hearing before the disciplinary committee, the Registrar shall send him a copy of the notice sent to the respondent under paragraph (2).

(5) Any party to proceedings being held under the provisions of this regulation may be represented at the hearing by an attorney-at- law or other person, so, however, that if any such party intends to be so represented at the hearing, he shall give not less than seven days' notice of that intention to the Registrar.

29.41) At the hearing of any matter the attorney-at-law. Registrar, or other person appointed by the Council for that purpose, shall state to the disciplinary committee the allegation against the respondent, the facts of the case, and submit evidence in support of the' allegation. and the respondent or his representative shall be entitled to cross- examine any witness appearing in support of the allegation against him.

(2) At the conclusion of the statement of the allegation against the respondent and the evidence in support thereof and the cross- examination of the relevant witnesses, the respondent or his repre- sentative shall be invited by the chairman to address the disciplinary committee and to tender evidence in answer to the charge, and the attorney-at-law, Registrar, or other person appointed by the Council for that purpose shall be entitled to cross-examine the respondent or any witness giving evidence on his behalf, and to reply upon the whole case after the respondent or his representative has replied.

30. If the respondent does not attend either personally or by a repre- sentative the disciplinary committee may prweed to hear and deter- mine the case in his aksence.

31.41) Upon the conclusion of the case, the disciplinary committee shall, after consideration of ad the relevant evidence, report their findings forthwith to the Council in writing.

(2) The Council shall, as soon as may be practicable after the receipt of a report from a disciplinary committee, consider such report and make its decision thereon.

(3) The Registrar shall, immediately after the pronouncement by the Council of its findings in any matter, inform the respondent by registered letter of the decision of the Council, and shall after twenty-eight days from the date of posting such letter, or where there is an appeal from the decision of the Council at the conclusion of such appeal, remove the name of the respondent from the register or roll, as the case may be, if directed so to do by the Council or carry out any other decision of the Council as may be appropriate in any particular case, and make a note beside the entry in the register or roll as the case may require relating to the respondent of the decision of the Council.

32.--(I) Any appeal to the Tribunal pursuant to section 15 of the Act shall be commenced by notice in writing addressed to the Tribunal, and such notice shall be lodged with the chairman of the Tribunal and a copy delivered to tbe Registrar within twenty-one days from the date of the decision appealed against.

(2) Every such notice of appeal shall include-

(a) the name and address of the appellant; (6) particulars of the decision of the Council gain st which the

appeal is being made;

(c) the grounds of appeal; and (d) copies of all relevant correspondence and documents.

(3) Notwithstanding anything hereinbefore contained, the Tri- bunal may hear and determine any appeal lodged after the time limit herein provided, if in all the circumstanoes of the case they think it just and proper so to do.

33. All expenses incurred by the respondent in disciplinary proceed- ings brought against him or by any person appealing to the TribmaI from any decision of the Council shall be borne by the respondent or person appealing, as the case may be.

PART V-Restoration of Name to ~ G i s t e r or Roll

34.-41) Where the name of any registered or enrolled member has been removed from the register or roll in accordance with section 13 of the Act, any application for the restoration to the register or roll of the name of that member shall be made in writing addressed to the Council and signed by the applicant stating the grounds on which the application is made.

(2) The application shall contain the names and addresses of at least three persons able and willing to identify the applicant and to give evidence as to his conduct and character since the removal of his name from the register or roll, and such other evidence as the Council may require.

(3) Not less than two of the persons mentioned in paragraph (2) shall belong to one or more of the following categories-

(a) registered dentists;

(b) enrolled dental auxiliaries;

(c) registered medical practitioners;

(d) Justices of the Peace; (e) ministers of religion.

(4) The Council may require the applicant to verify by statutory declaration any statement made in his application, or any further staterneat WW it may tbhk necawmy, and may. if it thinks fit. require the applicant to attend in person at a meeting of the disciplinary committee at which the matter is to be considered.

35. If upon consideration of the application and of the evidence furnished in s u m thereof, the disciplinary committee is satisfied that the name of the applicant should be restored to the regiskr or roll, they shall advise the Council accordingly and the Council may then direct the Registrar to restore the name of the applicant to the register or roll, as the case may require.
