AMCTO RESPONDS TO ANNOUNCEMENT OF THE BETTER LOCAL GOVERNMENT ACT

Dear AMCTO Members: Last week several municipal reforms with significant ramifications, were put forward by the Honourable Premier Doug Ford and Minister of Municipal Affairs and Housing, Steve Clark. While we look forward to reviewing the upcoming legislation, the announcement and several aspects of the proposed legislation has created widespread concern within our sector, regarding timing, implementation, and lack of engagement with local government professionals. Reserving any specific comment on the policy, AMCTO is concerned with how these reforms were brought forward, notably:

This legislation will be introduced on the eve of the 2018 municipal elections and will impact provisions within the Municipal Elections Act. AMCTO has long believed that senior orders of government should engage local government professionals and representative associations, early and more importantly, provide the appropriate amount of time to ensure that public policy implementation is effective at the local level. The timing of this legislation will make this extremely challenging.

This new legislation will create changes to existing election processes within the sector. Ambiguity exists with how to balance the currently enforced rules and regulations with those of the new legislation. Naturally, this ambiguity hinders the ability of local government professionals to implement provincial public policy in a fair and effective manner.

Finally, AMCTO is concerned that the lack of engagement or notice for these reforms to municipal legislation signals a step backwards in the belief that the municipal sector is recognized as a mature, responsible order of government.

AMCTO staff and members will review the legislation once it is released, and will look for ways to provide our technical expertise on how to support public policy implementation at the local level. We continue to believe this value is best served when our members and association are engaged early in the policy development process.

I'm pleased to announce that AMO's annual report on the federal Gas Tax Fund is now available. I encourage you to share this report with your local Council.

Our communities own and operate much of Ontario's infrastructure; the Fund provides permanent and stable funding to help us build and maintain it. In 2017 alone, we invested $607 million from the Fund to rebuild roads, install energy-efficient upgrades, and more.

The Township of Malahide has invested $2.8 million in 18 infrastructure and capacity-building projects worth $4.0 million since the federal Gas Tax Fund was established in 2005.

RE: Industry funding for Municipal Blue Box Recycling for the second quarter of the 2018 ProgramYear

Dear Mayor and Members of Council:

Stewardship Ontario provides payments to municipalities and First Nations equal to 50% of the total net

costs incurred by those communities as a result of the Blue Box Program. Payments are made on a

quarterly basis. The funding for these payments comes from companies that produce, import and sell

packaging and printed paper to Ontario residents.

The Resource Productivity and Recovery Authority ( RPRA) determined that 2018 payments will be based

on a funding obligation of $124, 844, 186. This represents an increase of 1% over 2017. RPRA is also

responsible for setting payments to individual communities. Further details with respect to the RPRA

Board' s determination of the 2018 obligation and the allocation to individual municipalities and FirstNations is available on the RPRA website ( www. rpra. ca/ blue- box).

Stewardship Ontario is pleased to provide payments to municipalities and First Nations in accordance

with the RPRA Board' s decision.

Over the past few months, I have heard substantial concerns about the mandatory certification regulation, which would come into force July 1, 2019. After hearing these concerns, our government has decided to repeal the Firefighter Certification regulation effective October 5, 2018. The community risk assessment and public reports regulations will come into force as scheduled. We have heard from stakeholders that the certification regulation would present significant challenges for fire services and municipalities – in particular, small, rural, and northern municipalities with volunteer fire departments. Fire departments and municipalities across the province have voiced concern with the resources and supports that were anticipated to be required to be compliant with the certification requirements, as well as the potential longer-term impacts on the ability of volunteer fire services to recruit certified firefighters.

My goal remains to ensure both firefighter and public safety and to that end, I agree in principle with the certification of all firefighters. Moving forward, however, I want to ensure that any proposals concerning fire safety balance the interests of all stakeholders. MUNICIPALITY OF CENTRAL ELGINNOTICE OF PASSING

CONCERNING PROPOSED ZONING BY- LAW AMENDMENT

509 Edith Cavell Boulevard West

TAKE NOTICE that the Council of the Corporation of the Municipality of Central Elgin passedBy- law No. 2299 on the 24th day of September, 2018 pursuant to Section 34( 18) of the

Planning Act, R. S. O. 1990 as amended.

The subject lands, which are located on the north side of West Edith Cavell Boulevard, east ofBartholomew Street, have approximately 44. 5 metres of frontage on West Edith CavellBoulevard and are approximately 16, 891 square metres in lot area ( see Key Map below). Municipally known as 509 West Edith Cavell Boulevard, they may be legally described as beingPart of Lot 8, Part Lake Beach, Plan 160, geographic Village of Port Stanley, now Municipality ofCentral Elgin.

The applicant is proposing to rezone the subject lands to permit residential use. The applicanthad applied to the Elgin County Land Division Committee ( LDC - Application E19/ 17) for aconsent to create three lots, one containing an existing house. That consent was approved andthe zoning is required in order to permit development on the lots.

The purpose of By- law No. 2299 is to place the subject lands into the Residential Zone 1 ( R1- 73, R1- 74) of the Village of Port Stanley Zoning By- law No. 1507 as amended. The effect of By- law No. 2299 will be to permit residential use and place site specific regulations on the lots topermit 1 metre side yards.

In coming to its decision Council considered the planning reports prepared by staff and thecomments received at the public meeting.

CONCERNING PROPOSED ZONING BY-LAW AMENDMENT

TAKE NOTICE that the Council of the Corporation of the Municipality of Central Elgin passedBy- law No. 2296 on the 24th day of September, 2018 pursuant to Section 34( 18) of the

Planning Act, R.S. O. 1990 as amended.

The subject lands are located north of George Street and south of the Kettle Creek Golf Coursein the Community of Port Stanley. They may be legally described as Lot 15, Range 1 South ofLake Road and Part of Lot B, Registered Plan No. 117, Geographic Township of Southwold, now Municipality of Central Elgin ( see Key Map below).

The applicant applied for zoning to implement a proposed draft plan of subdivisionencompassing 23. 6 hectares ( 58. 32 acres) of land for the development of 150 lots for single - detached dwellings and 4 blocks for apartment dwellings ( 360 units). Five new streets are

proposed, as well as blocks for public parkland, storm water management, future low- densityresidential, and natural heritage.

The purpose of By- law No. 2296 is to place the subject lands into the Residential Zone 1 ( R1- 72), the Residential Zone 2 ( R2- 1, R2- 2) and the Open Space Zone 3 ( OS3- 19) of the Village ofPort Stanley Zoning By- law No. 1507 as amended. The effect of By- law No. 2296 will be toimplement the proposed draft plan of subdivision with zoning regulations addressing permitteddwelling types, building locations, heights, density, lot frontage, lot area and setbacks, and topermit conservation and drainage uses in the natural heritage blocks and the stormwatermanagement block.

In coming to its decision Council considered the planning reports prepared by staff, writtencomments and reports received from the public, the applicant and consultants, and the

comments received at the public meeting.

AND TAKE NOTICE that any person or public body may appeal to the Local Planning AppealsTribunal with respect to the By- law by filing with the Clerk of the Corporation of the Municipalityof Central Elgin, not later than the 19th day of October, 2018, a notice of appeal, setting out thereasons for the appeal, and must be accompanied by the fee required by the Tribunal.

Only individuals, corporations and public bodies may appeal a by- law to the Local PlanningAppeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of theassociation or group on its behalf.
