WHAT IS CPC? • CPC stands for Co-operative Patent Classification
• It is a joint effort from the EPO (European Patent Office) and the USPTO (United States Patent & Trademark Office) to unify their classification systems – It is hoped to extend this system (or a variation of it) to the
Chinese, Japanese & Korean Patent Offices at a later date as part of the IP5 project
• It is based mostly on the EPO’s ECLA (European Classification) & ICO (In-computer only) coding systems giving a total of around 251,000 codes – This is far more than the current ECLA, IPC or USPC (US
Patent Classification) systems and so will be more detailed

CPC TIMELINES – FROM THE EPO • From 1st January 2013 EPO examiners will apply CPC to EP patent data
and subset of the PCT minimum documentation data (including DE, CA, WO, etc)
– Available in the DocDb/INPADOC files – Application of ECLA and ICO codes to new documents will cease – From 1st January 2013 EPO examiners will cease to apply ECLA codes to any
documents so even older patents that they are classifying for the first time will have only CPC codes applied
– It is expected that CPC codes will be available for EP documents within 1 to 2 weeks of publication in most cases
– For patents from other authorities that are classified by the EPO examiners they could be a delay of up to 6 months in some technology areas before the CPC’s appear
– All support for ECLA / ICO withdrawn from 1st April 2013
• Certain national patent offices (Currently UK, SE, ES) will also assign CPC codes to their patents
For historical reasons, coverage is also available for BE, NL and LU, and also partial coverage is available for AT, AU and CA.
The EPO also applies CPC to a subset of The PCT Minimum Documentation

CPC TIMELINES – FROM THE USPTO • From March 2013 the USPTO will apply CPC and/or USPC
until sometime in 2015 when the USPC will be phased out – CPC codes will be printed on the front page of the document and so will
be available on the day of publication – First patent applications with CPC codes on are expected to appear on
14th March 2013 – Published US patent applications will contain both US classes and CPC
codes between 2013 and 2015 – Granted US patents will initially contain predominantly US classifications – The first US grants with CPC on will appear either in February or March – CPC classes applied by the USPTO will be propagated to all members
of the simple patent family (ones that share identical priority data)
WHAT ABOUT OLDER PATENTS? • All older patents which were classified using ECLA
codes will be re-classified using CPC by the EPO and / or USPTO – This includes all EP patents & US documents back to
1920
• USPTO will additionally re-classify any US documents for which no ECLA codes exist including pre-1920 data
• This data will be made available to search later in 2013
THE NEW CODES • On initial release the CPC codes will map onto existing
ECLA and / or ICO codes – ECLA codes are based on the IPC system but have additional sub-
divisions to give more precise coding. These will be called inventive CPC codes in the new system
– ICO codes use a mirrored ECLA hierarchy sometimes with additional granularity and describe non-inventive features of the patent – these will be described as additional CPC codes in the new system
• From 1st April 2013 the CPC system will commence a process of monthly updates at which point the systems will begin to diverge
• Notification of the updates will be made publically available

HOW WILL IT AFFECT MY SEARCHES? • As CPC is simply a replacement for USPC, ECLA & ICO
codes it will not affect any searches that do not use these – In particular IPC, Japanese National Classification and Derwent
Manual Code searches will be unaffected
• If you use ECLA and/or ICO codes any search using these codes will not pick up new patents published on or after 1st January 2013 or any older documents classified after that date – So any alerts that use these codes will need to be changed
• Searches using USPC will continue to work until 2015 when you will need to start using CPC to find new patents
WHAT DO I DO IF MY SEARCH / ALERT IS AFFECTED?
• Searches based on ECLA / ICO codes will continue to find patents published / classified up until the end of 2012
• To find patents published / classified after this date you will need to include CPC codes – For alerts replace the ECLA search term by the corresponding CPC search term – For searches that go further back OR in the CPC search term – only needed until
the back file reclassification is available

WHAT IF I USE US CLASSIFICATIONS IN MY SEARCH? • For the moment you can continue to use them as
normal
• However it would be a good idea to review the CPC codes applied to the patents in your search / alert results to identify the best ones to use
• You can switch to CPC anytime in the next 2 years – As both CPC and USPC will exist alongside each other
during this time you can run CPC and USPC alerts along side each other to check you have got the best available strategy
– CPC may become more precise than USPC as a result of updates to the system and so may be a better option
COULD CPC HELP ME DO BETTER SEARCHES?
• If you currently use IPC then you may wish to consider using CPC instead as it has the following benefits – More granular so you can drill down more precisely to the
technology area you are interested in – Codes will be applied by a much smaller group of people, it
should be more accurately and consistently applied than IPC – As it is based on IPC you could search your IPC code +NT to
search all CPC codes related to the IPC concept (e.g. S A23K0001-18+NT/CPC)
– Updated more often so it will keep up with technology trends more effectively
– You can include searches on non-inventive features to broaden your search
– Will still cover most PCT minimum documentation authorities
ANY DISADVANTAGES TO USING CPC? • The monthly updates to CPC mean that the most specific codes could
change fairly frequently in areas such as biotech and telecommunications which are rapidly evolving so you should be careful when using them in alerts
– This is not a problem for one off searches though
• Only US patents will have CPC codes available on the day of publication, for other patents they will only be available via the INPADOC file
• The EPO examiners can be quite slow applying CPC codes to patents from authorities other than EP patents, so for alerts it is best to also include other classification systems (e.g. IPC or DWPI manual codes) in your alert
– The USPTO is expected to be timely in applying CPC to US patents
• When using CPC remember to monitor your alert results for any sudden fall off in the number of hits as this could indicate a reclassification has affected your search
CPC IN DWPI ON STN • CPC data has now started to be loaded into the DWPI files
– For US patents which will include CPC as part of the front page data the CPC codes will be added when the patent record is loaded as a basic or equivalent
– For patents classified by other patent offices the CPC data will be loaded as part of the quarterly INPADOC update • The first update which includes the full back file is expected in May 2013
• Once revisions start next month the original and most up to date CPC will be available for each record or you can search all CPC
• The ECLA, ICO & USPC data for existing patents in the database will be retained
CPC data at the member level will include the following attributes • This data should be available once the backfile is
loaded
