UVOD

Ustavni sud Srbije je ustavnovqenUstavom Socijalisti~ke RepublikeSrbije od 9. aprila 1963. godine,kao samostalni organ Republike,koji obezbe|uje za{titu ustavnostii zakonitosti na osnovu Ustava uokviru svojih Ustavom utvr|enihprava i du`nosti. Zakonom o Ustav-nom sudu Srbije, koji je progla{en25. decembra 1963. godine, bli`e jeodre|ena nadle`nost i postupakpred Ustavnim sudom Srbije i prav-no dejstvo wegovih odluka.

Ustavni sud Republike Srbije po~eoje rad 15. februara 1964. godine.Ustavni sud je, do dono{ewa UstavaRepublike Srbije 1990. godine, de-lovao u okviru sistema jedinstvavlasti, u kome je skup{tina bilanajvi{i organ dr`avne vlasti.Postojawe i delovawe Ustavnog su-da postepeno je dobijalo na zna~ajui uticaju u o~uvawu principa ustav-nosti i zakonitosti.

IINNTTRROODDUUCCTTIIOONN

The Constitutional Court of the Repu-blic of Serbia was established on 9April 1963 as an indepedent body ofthe Republic and desigated to protectconstitutionality and llegality in accor-dance with the Constitution and withinthe framework of the rights and dutiesproscribed by the Constitution of theSocialistic Republic of Serbia. TheConstitutional Law of Serbia, enactedon 25 December 1963, defined juris-diction and adjudications before theConstitutional Court of Serbia and le-gal effects of its decisions in a morespecific manner.

The Constitutional Court of the Repu-blic of Serbia commenced its work on15 February 1964. The ConstitutionalCourt has upon proclamation of theConstitution of the Republic of Serbiain 1990 acted within the framework ofabsence of division of powers, wherethe Parliament was the highest body ofstate power. The Constitutional Courtof Serbia has through its presence andwork contributed to the importanceand contribution in preservation of theconstitutional principles and legality.

Ustavom Republike Srbije, donetim1990. godine, proklamovani su i ga-rantovani principi podele vlastina zakonodavnu, izvr{nu i sudsku,nezavisnost i samostalnost sudova,vladavine prava i politi~ki plura-lizam.

Za{tita ustavnosti i za{tita zako-nitosti, prema ~lanu 9. Ustava Re-publike Srbije, pripada Ustavnomsudu.

Ustavni sud Srbije ustavno-pravnoje postavqen kao nezavisan i samo-stalan dr`avni organ, koji ima va-`nu ulogu u ostvarivawu na~elavladavine prava.

Polo`aj Ustavnog suda u sistemuorganizacije vlasti obezbe|en jeUstavom. Sud je nezavisan i samo-stalan u funkcionalnom i organi-zacionom smislu.

Odluke Ustavnog suda su op{teoba-vezne i izvr{ne.

Nezavisnost Ustavnog suda obezbe-|ena je i na~inom izbora i razre-{ewa sudija i stalno{}u sudijskefunkcije.

Sudija Ustavnog suda u`iva imuni-tet kao i narodni poslanik. O imu-nitetu sudije Ustavnog suda odlu~ujeUstavni sud.

Sudija Ustavnog suda ne mo`e vr{i-ti drugu javnu funkciju ili profesi-onalnu delatnost.

PPOOSSIITTIIOONN OOFF TTHHEE CCOONNSSTTIITTUUTTIIOONNAALL CCOOUURRTT

The 1990 Constitution of the Republicof Serbia proclaims and guaranteethe principle of the division of powersto legislative, executive and judicial;independence and autonomy of co-urts; rule of law and political pluralism.

The protection of constitutionality andlegality in terms of Article 9 of theConstitution of the Republic of Serbia,is vested with the Constitutional Court.The Constitutional Court of the Repu-blic of Serbia is constitutionally and le-gally established as an independentand autonomous state body, vestedwith an important role in exercising theprinciples of the rule of law.

The position of the Constitutional Co-urt within the system of the division ofpowers is determined by the Constitu-tion. The Court is independent and au-tonomous in respects of its functioningand organization.

The decisions of the Constitutional Co-urt are be binding and executable.

The independence of the Constitutio-nal Court is provided by the manner ofelection and dismissal of judges, andpermanency of justice’s function.

A Constitutional Court justice ewoysthe same immunity as a Member ofParliament. The immunity of a Consti-tutional Court justice is decided uponby the Constitutional Court.

A justice of the Constitutional Courtmay not engage in another public fun-ction or professional activity.

Ustavni sud ima devet sudija.

Predsednik Ustavnog suda bira seiz reda sudija na pet godina i nemo`e ponovo biti biran na istufunkciju.

Predsednika i sudije Ustavnog sudaSrbije, na predlog predsednika Re-publike Srbije, bira Narodnaskup{tina.

Funkcija sudije Ustavnog suda jestalna.

Sudiji Ustavnog suda prestaje funk-cija kad to sam zatra`i ili kad is-puni uslove za ostvarivawe pravana starosnu penziju. Sudija Ustav-nog suda se razre{ava du`nosti kadbude osu|en za krivi~no delo nabezuslovnu kaznu zatvora ili kadtrajno izgubi sposobnost za vr{e-we funkcije sudije Ustavnog suda.

Ustavni sud obave{tava Narodnuskup{tinu o postojawu razloga zaprestanak funkcije, odnosno zarazre{ewe sudije Ustavnog suda. O prestanku funkcije i razre{ewupredsednika i sudija Ustavnog sudaodlu~uje Narodna skup{tina.

Ustavni sud mo`e odlu~iti da sudi-ja Ustavnog suda protiv koga je po-krenut krivi~ni postupak ne vr{idu`nost dok taj postupak traje.

TTHHEE CCOOMMPPOOSSIITTIIOONN OOFF TTHHEECCOONNSSTTIITTUUTTIIOONNAALL CCOOUURRTT

The Constitutional Court consists ofnine justices.

The President of the Constitutional Co-urt is elected from among the justicesfor a five-year term and may not be re-elected to the same office.

The President and justices of the Consti-tutional Court of Serbia are proposed forelection by the President of the Republicof Serbia and elected by the Parliament.

The tenure of office of a justice of theConstitutional Court is for life.

A justice of the Constitutional Courtwill terminate his office at his own re-quest or after meeting the require-ments for obtaining the old age pensi-on. A justice of the Constitutional Co-urt will be dismissed from duty if he isconvicted of a criminal offence to anunconditional penalty of imprison-ment, or if he has permanently lost theability to discharge the function of a ju-stice of the Constitutional Court.

The Constitutional Court notifies the Parli-ament on the existence of grounds for thetermination of the office and/or dismissalof a justice of the Constitutional Court.

The Parliament decides on the termi-nation of the office and/or dismissal ofthe President and judges of the Consti-tutional Court.

The Constitutional Court may decidethat a justice of the Constitutional Co-urt who has been indicted in the crimi-nal proceedings should not dischargehis duty while the proceedings are inprogress.

Slobodan Vu~eti}

Ro|en je 1941. godine u Vilusima. Diplomirao je na Pravnom fakultetu u Beogradu 1964.godine. Radio je kao stru~ni saradnik i savetnik u Saveznoj skup{tini i u Predsedni-{tvu SFRJ. Bio je ~lan Predsedni{tva Republike Srbije.

Ima objavqenih pet kwiga i vi{e radova iz oblasti ustavnog prava i politi~kog sistema.

Za sudiju Ustavnog suda Srbije izabran je maja 1991. godine, a od juna 2002. godine pred-sednik je Ustavnog suda Srbije.

Slobodan Vucetic

Was born 1941 in Vilusi. President Vucetic graduated from the Faculty of Law in Belgrade in1964 and worked as a professional associate and adviser in the Federal Parliament and withthe Presidency of the Socialistic Federative Republic of Yugoslavia. He was also a member ofthe Presidency of the Republic of Serbia.

President Vucetic has published five books and several studies on the constitutional law and po-litical system.

President Vucetic was elected Justice of the Constitutional Court of Serbia on May 1991 andhas been President of the Constitutional Court of Serbia since June 2002.

Ro|ena je 1948. godine u Adi. Diplomi-rala je na Pravnom fakultetu u Beo-gradu 1971. godine. Pravosudni ispitpolo`ila je 1985. godine. Radila je napravnim poslovima u oblasti privre-de, zdravstva i prekr{ajne odgovorno-sti. Bila je predsednik Skup{tine SAPVojvodine.

Za sudiju Ustavnog suda Srbije izabra-na je maja 1991. godine.

Verona Adam BokrosWas born 1948 in Ada and graduatedfrom the Faculty of Law in Belgrade 1971to pass her judicial exam 1985. JusticeAdam Bokros worked on commercial, he-alth and misdemeanour law issues. Shewas the President of the Parliament of theAutonomous Province of Vojvodina.

In May 1991, she was elected Justice ofthe Constitutional Court of Serbia.

Ro|en je 1967. godine u Kosovskoj Mit-rovici. Diplomirao je na Pravnom fa-kultetu u Kragujevcu 1993. godine. Magi-strirao je 1997. godine na Pravnomfakultetu u Bawa Luci, na kojem je idoktorirao 2000. godine. Radio je naPravnom fakultetu u Pri{tini, u zva-wu docenta za ustavno pravo. Ima ob-javqene dve kwige i vi{e radova ustru~nim ~asopisima.

Za sudiju Ustavnog suda izabran je juna2002. godine.

Srdjan Djordjevic, Ph.D.Was born 1967 in Kosovska Mitrovica andgraduated from the Kragujevac Faculty ofLaw 1993. Justice Djordjevic defended hisM.A. in 1997 and Ph.D. in 2000 at theBanja Luka Faculty of Law. Justice Djordje-vic worked at the Pristina Faculty of Law asAssistant Professor for constitutional lawand published two books and several stu-dies in professional journals.

In June 2002, he was elected Justice of theConstitutional Court of Serbia.

Ro|en je 1948. godine u Tularu. Diplo-mirao je na Pravnom fakultetu u Beo-gradu, na kojem je i doktorirao 1986.godine. Pravosudni ispit polo`io je1978. godine. Bio je vi{e godina sudija,a obavqao je i zna~ajne funkcije u mi-nistarstvima za informisawe i Mini-starstvu spoqnih poslova.

Objavio je vi{e kwiga i ~lanaka ustru~nim ~asopisima, prete`no izoblasti radnog i krivi~nog prava.

Za sudiju Ustavnog suda Srbije izabranje u junu 2002. godine.

Milutin Djuricic, Ph.D.Was born 1948 in Tular and graduatedfrom the Belgrade Faculty of Law to defen-ded his Ph.D. in 1986. Justice Djuricic haspass his judicial exam in 1978 and workedas a judge for several years and on essen-tial functions in the Ministry for Media andCommunications and Ministry of ForeignAffairs. Justice Djuricic published severalbooks and articles in professional journalsmostly covering the topics on labour andcriminal law.

In June 2002, he was elected Justice of theConstitutional Court of Serbia.

Dr Bosa Nenadi}

Ro|ena je 1953. godine u Grkovcima, Bo-sansko Grahovo. Diplomirala je naPravnom fakultetu u Beogradu 1976. go-dine, na kojem je i doktorirala 1986.godine. Pravosudni ispit polo`ila je1991. godine. Preko 25 godina radilaje na najslo`enijim zakonodavno-prav-nim poslovima u Saveznoj skup{tini iSaveznoj vladi. Obavqala je i funkcijusaveznog sekretara za zakonodavstvo.

Objavila je vi{e kwiga i ~lanaka u stru~-nim ~asopisima u zemqi i inostranstvu,prete`no iz oblasti ustavnog prava.

Za sudiju Ustavnog suda Srbije izabra-na je u junu 2002. godine.

Bosa Nenadic, Ph.D.Was born 1953 in Grkovci, Bosansko Gra-hovo, and graduated from the Belgrade Fa-culty of Law 1976 to defend her Ph.D. in1986, followed by judicial exam in 1991.She had since worked on the most complexlegislative and legal matters in Federal Parli-ament and Federal Government and perfor-med the function of Federal Secretary for Le-gislation. Justice Nenadic has published se-veral books and articles in professional jour-nals in the country and abroad, mostly onconstitutional law.

In June 2002, she was elected Justice ofthe Constitutional Court of Serbia.

Ro|en je 1939. godine u Pe}i. Diplomi-rao je na Pravnom fakultetu u Beogradu1963. godine. Pravosudni ispit polo`ioje 1966. godine. Radio je kao pripravniku Okru`nom sudu u Pe}i; stru~ni i vi{istru~ni saradnik u Upravi za imovin-sko-pravne poslove SAPK; sudija ipredsednik Okru`nog suda u Pri{tini.

Objavio je vi{e stru~nih radova izoblasti gra|anskog prava.

Za sudiju Ustavnog suda Srbije izabranje u maju 1991. godine.

Ljubomir PopovicWas born 1939 in Pec and graduatedfrom the Belgrade Faculty of Law 1963 topass the judicial exam in 1966. Justice Po-povic worked as an apprentice at the PecDistrict Court and as professional and se-nior professional associate with the Admi-nistration for Proprietary Matters in the So-cialistic Autonomous Province of Kosovo;as judge and President of the District Co-urt in Pristina.

Justice Popovic has published several stu-dies on the civil law and was elected Justi-ce of the Constitutional Court of Serbia inMay 1991.

Mirjana Ra{i}

Ro|ena je 1939. godine u Tetovu. Diplo-mirala je na Pravnom fakultetu u Beo-gradu 1964. godine. Pravosudni ispitpolo`ila je 1967. godine. Preko 25 go-dina radila je u pravosudnim organimaod pripravnika i stru~nog saradnikado sudije op{tinskog i Okru`nog suda uBeogradu, a preko 10 godina bila jeadvokat.

Objavila je vi{e stru~nih radova izoblasti upravnog i gra|anskog prava.

Za sudiju Ustavnog suda Srbije izabra-na je u junu 2002. godine.

Mirjana RasicWas born 1939 in Tetovo and graduatedfrom the Belgrade Faculty of Law 1964 topass her judicial exam in 1964. Justice Ra-sic had been working in the judicial bodi-es for over 25 years starting from appren-tice, professional associate, municipal co-urt judge and Belgrade District Court jud-ge, followed by over 10 year of practice asa lawyer.

Justice Rasic has published several studieson administrative and civil law.

In June 2002, she was elected Justice ofthe Constitutional Court of Serbia.

Ro|ena je 1953. godine u Beogradu. Di-plomirala je na Pravnom fakultetu uBeogradu 1977. godine. Pravosudni is-pit polo`ila je 1985. godine. U Ustav-nom sudu zaposlena je od 1977. godine,prvo kao pripravnik, a zatim je steklaodgovaraju}a vi{a zvawa u stru~nojslu`bi, u kojoj je radila na najslo`eni-jim poslovima stru~ne obrade ustavno-pravnih pitawa iz razli~itih pravnihoblasti.

Za sudiju Ustavnog suda Srbije izabra-na je u junu 2002. godine.

Branka CurcijaWas born 1953 in Belgrade and gradua-ted from the Belgrade Faculty of Law 1977to pass her judicial exam in 1985. She hasbeen employed with the ConstitutionalCourt since 1977, starting as an apprenti-ce, followed by appointments to higherpositions in the administrative and profes-sional service on the most complex caseanalyses in constitutional and legal mat-ters from diverse legal fields.

In June 2002, she was elected Justice ofthe Constitutional Court of Serbia.

Mr Svetozar ^ipli}

Ro|en je 1965. godine u Novom Sadu.Diplomirao je na Pravnom fakultetu uNovom Sadu 1993. godine, na kojem je imagistrirao 1996. godine. Od 1995.godine radio je kao asistent na pred-metu Ustavno pravo Pravnog fakultetau Novom Sadu.

Objavio je kwigu i vi{e nau~nih istru~nih radova iz oblasti ustavnogprava.

Za sudiju Ustavnog suda Srbije izabranje u junu 2002. godine.

Svetozar Ciplic, M.A.Was born 1965 in Novi Sad and gradua-ted from the Novi Sad Faculty of Law 1993to defend his M.A. in 1996. Since 1995,he had been working as an Trainee Assi-stant on the subject of constitutional law atthe Novi Sad Faculty of Law. Justice Ciplichas published a book and several scienti-fic and professional studies on the consti-tutional law matter.

In June 2002, he was elected Justice of theConstitutional Court of Serbia.

Nadle`nost Ustavnog suda je u pot-punosti odre|ena ~lanom 125. Usta-va Republike Srbije.

Ustavni sud odlu~uje o:

1. saglasnosti zakona, statuta auto-nomnih pokrajina, drugih propisai op{tih akata s Ustavom;

2. saglasnosti propisa i op{tihakata republi~kih organa sa za-konom;

3. saglasnosti svih ostalih propi-sa, kolektivnih ugovora kao op-{tih akata i drugih op{tih akatasa zakonom i drugim republi~kimpropisom;

4. sukobu nadle`nosti izme|u sudo-va i drugih organa;

5. saglasnosti statuta ili drugogop{teg akta politi~ke strankeili druge politi~ke organizacijes Ustavom i zakonom;

6. zabrani rada politi~ke strankeili druge politi~ke organizacije;

7. izbornim sporovima koji nisu unadle`nosti sudova ili drugihdr`avnih organa.

Ustavni sud ocewuje ustavnost zako-na i ustavnost i zakonitosti propi-sa i drugih op{tih akata koji suprestali da va`e, ako od prestankava`ewa do pokretawa postupka nijeproteklo vi{e od jedne godine.

JJUURRIISSDDIICCTTIIOONN OOFF TTHHEE CCOONNSSTTIITTUUTTIIOONNAALL CCOOUURRTT

The jurisdiction of the Constitutional Courtof Serbia is entirely defined by Article 125 ofthe Constitution of the Republic of Serbia.

“The constitutional Court shall decide on:

1. conformity of laws, statutes of autonomo-us provinces, other regulations and gene-ral enactments with the Constitution;

2. conformity of regulations and generalenactments of the republic agencieswith law;

3. conformity of all other regulations, col-lective agreements as general enac-tments, and other general enactmentswith the law and other republic regula-tions;

4. conflict of jurisdictions between courtsof law and other agencies;

5. conformity of a statute or other generalenactment of a political party or otherpolitical organisation with the Constitu-tion and law;

6. the banning of a political party or otherpolitical organisation;

7. electoral disputes which are not withinthe competence of courts of law otherState agencies.

The Constitutional Court shall assess con-stitutionality of laws and the constitutiona-lity and legality of regulations and othergeneral enactments which are no longer inforce, if no more than one year has elap-sed after the termination of their validityand the initiating of the proceedings.“

POSTUPAK PRED USTAVNIM SUDOM

Svako mo`e dati inicijativu za po-kretawe postupka za ocewivaweustavnosti i zakonitosti. Postupakpred Ustavnim sudom pokre}u dr-`avni organi, a drugi organi i or-ganizacije mogu ga pokrenuti kadocene da su im prava i interesi ne-posredno povre|eni aktom ~ija seustavnost i zakonitost osporava.Ustavni sud mo`e i sam pokrenutipostupak za ocewivawe ustavnostii zakonitosti.

Ustavni sud odlu~uje glasawem nasednici, ve}inom glasova svih sudi-ja. Sudija Ustavnog suda koji je gla-sao protiv predloga koji je usvojen,mo`e u pismenoj formi da izlo`irazloge za stav za koji se oprede-lio i da ga prilo`i uz zapisnik sasednice. Izdvojeno mi{qewe sudijeobjavquje se u Zbirci odluka Ustav-nog suda u kojoj je objavqena i odlu-ka povodom koje je mi{qewe izdvo-jeno.

AADDJJUUIICCAATTIIOONN PPRROOCCEEEEDDIINNGGSS

Everyone may initiate the proceedingsof assessing the constitutionality andlegality. Proceedings before the Con-stitutional Court are initiated by Stateagencies, while other agencies and or-ganisations may initiate such procee-dings after finding that their rights andinterests have been directly violated bythe act whose constitutionality and le-gality are being challenged.

The Constitutional Court may itself ini-tiate the proceedings for assessing theconstitutionality and legality.

The Constitutional Court adjudicatesby majority vote cast by the justices attheir general session. A justice of theConstitutional Court who voted aga-inst the adopted proposal, may statehis reasons against the proposal inwritten form and submit it with the mi-nutes from the session. Such separateoption of a justice is published in theBulletin of the Constitutional Courtalong with the contested decision.

Redovna sednica Ustavnog suda ras-pravqa i odlu~uje o pitawima kojasu na dnevnom redu; odr`ava se popravilu jedanput nedeqno.

U postupku ocewivawa ustavnosti izakonitosti, Ustavni sud mo`e odr-`ati pripremnu sednicu, radnu sed-nicu, javnu raspravu i sednicu o ve-}awu i glasawu. Radi razja{wewastawa stvari u predmetu, Ustavnisud mo`e odr`avati konsultacije sapredstavnicima organa i organiza-cija, u~esnicima u postupku, nau~-nim, javnim i drugim stru~nim rad-nicima. Javna rasprava je obave-zna kada Sud odlu~uje o zabrani ra-da politi~ke stranke i o izbornimsporovima, a u slu~aju kada je pred-met ocewivawa zakon, drugi pravniakt ili slo`eno ustavno-pravno pi-tawe, pre kona~nog odlu~ivawa,Ustavni sud mo`e odr`ati javnuraspravu.

Sednice Ustavnog suda zakazujepredsednik Ustavnog suda po sop-stvenoj inicijativi, po zakqu~kuUstavnog suda, na zahtev radnog te-la ili sudije Ustavnog suda.

SSEESSSSIIOONNSS OOFF TTHHEE CCOONNSSTTIITTUUTTIIOONNAALL CCOOUURRTT

The working session of the Constitutio-nal Court debates and decides on theset points of the agenda; and is usuallyconvened on weekly basis.

In the procedure for assessment ofconstitutionality and legality, the Con-stitutional Court may hold a prelimi-nary session, working session, publicdebate and the majority vote session.Inorder to provide clarifications in re-spect of a particular case, the Consti-tutional Court may hold consultationswith the representatives of the bodiesand organizations, parties in the pro-ceedings, science, public and otherprofessionally qualified persons. ThePublic Debate is obligatory when theCourt decides on prohibition of workof a political party and on electoraldisputes, while in case of assessing alaw, other legal act or a complex con-stitutional and legal issue, before thefinal deliberation, the ConstitutionalCourt may hold a public debate.

The President of the Constitutional Co-urt convenes the session of the Courton his own initiative, on the basis ofconclusions drawn at a session of aConstitutional Court and upon a requ-est of a working body or a justice ofthe Constitutional Court.

Predsednik

Predsednik Ustavnog suda predstavqaUstavni sud i organizuje wegov rad. Pred-sednik predsedava sednicama i potpisu-je op{te i druge akte Ustavnog suda.

Predsednika Ustavnog suda, u slu~ajuwegove odsutnosti ili spre~enosti zarad, zamewuje sudija Ustavnog suda naperiod od {est meseci, prema azbu~-nom redu prezimena sudija.

Radna tela Suda

Ustavni sud ima tri komisije kao stal-na radna tela: Redakciona komisija,Komisija za pra}ewe propisa i pojavaod interesa za ostvarivawe ustavnostii zakonitosti i Komisija za organiza-ciona i finansijska pitawa.

Ustavni sud mo`e da obrazuje i povre-mena radna tela.

Ustavni sud ima sekretara kojeg posta-vqa na ~etiri godine i po isteku togvremena isto lice mo`e biti ponovopostavqeno na tu funkciju.
