departmental request).An emergency ordinance authoriz-

ing the purchase by one or morerequirement contracts of buildingmaterials and used paving bricks,for the various divisions of City gov-ernment.

Whereas, this ordinance consti-tutes an emergency measure provid-ing for the usual daily operation ofa municipal department; now, there-fore,

Be it ordained by the Council ofthe City of Cleveland:

Section 1. That the Director ofFinance is authorized to make oneor more written requirement con-tracts under the Charter and the Cod-ified Ordinances of Cleveland, Ohio,1976, for the requirements for periodof one or two years of the necessaryitems of building materials and usedpaving bricks, in the approximateamount as purchased during the pre-ceding term, to be purchased by theCommissioner of Purchases and Sup-plies on a unit basis for the variousdivisions of City government, Depart-ment of Finance. Bids shall be takenin a manner that permits an awardto be made for all items as a singlecontract, or by separate contract foreach or any combination of the itemsas the Board of Control determines.Alternate bids for a period less thanthe specified term may be taken ifdesired by the Commissioner of Pur-chases and Supplies until provisionis made for the requirements for theentire term. The Director of Financeis authorized to enter into one ormore contracts with a term of twoyears instead of one year when thereis a financial advantage to the City.For purposes of this ordinance, afinancial advantage shall be deter-mined by the Director of Finance bycomparing the bids received for bothterms.

Section 2. That the costs of the con-tract or contracts shall be chargedagainst the proper appropriation ac-counts and the Director of Financeshall certify the amount of the ini-tial purchase, which purchase, to-gether with all later purchases, shallbe made on order of the Commis-sioner of Purchases and Suppliesunder a requisition against the con-tract or contracts certified by theDirector of Finance. Section 3. That under Section108(b) of the Charter, the purchasesauthorized by this ordinance may bemade through cooperative agree-ments using state procedures. TheDirector of Public Utilities may signall documents with the State of Ohioor any of its political subdivisionsthat are necessary to make the pur-chases, and may enter into one ormore contracts with the vendorsselected through that cooperativeprocess.

Section 4. That this ordinance isdeclared to be an emergency mea-sure and, provided it receives theaffirmative vote of two-thirds of allthe members elected to Council, itshall take effect and be in forceimmediately upon its passage andapproval by the Mayor; otherwise itshall take effect and be in force

from and after the earliest periodallowed by law.

Whereas, this ordinance consti-tutes an emergency measure provid-ing for the usual daily operation ofa municipal department; now, there-fore,

Be it ordained by the Council ofthe City of Cleveland:

Section 1. That existing Section347.02 of the Codified Ordinances ofCleveland, Ohio, 1976, as amendedby Ordinance No. 1470-06, passedDecember 11, 2006 is hereby re-pealed.

Section 2. That the Codified Ordi-nances of Cleveland, Ohio, 1976, arehereby supplemented by enactingnew Sections 205.04 and 347.02thereof, to read as follows:

Section 205.04 Restrictions on theKeeping of Farm Animals and Bees

Anyone proposing to keep farmanimals or bees on a property in theCity of Cleveland shall apply for atwo-year license from the City ofCleveland through its Department ofPublic Health on a form provided bythat office, with payment of a feeset by the Board of Control.

(a) Application Contents. The ap-plication for such license shallinclude, at a minimum, the follow-ing information.

(1) the name, phone, phone num-ber and address of the applicant;

(2) the location of the subjectproperty;

(3) the size of the property;(4) the number of animals or bee

hives to be kept on the property;(5) a description of any proposed

cages, coops, beehives, fences orenclosures;

(6) a scaled drawing showing theprecise location of cages, coops,enclosures, beehives, stables andfences in relation to property linesand to houses on adjacent proper-ties,

(7) a description of the manner bywhich feces and other waste mate-rials will be removed from the prop-erty or will be treated so as not toresult in unsanitary conditions or inthe attraction of insects or rodents;

(8) in the case of a lot that isvacant or has no occupied residence,documentation demonstrating thatthe use will be managed in a man-ner that prevents the creation ofnuisances or unsanitary or unsafeconditions;

(9) a signed statement from theproperty owner, if the applicant isnot the property owner, granting theapplicant permission to engage inthe keeping of farm animals or beesas described in the registration; and

(10) The addresses of all proper-ties directly adjoining the subjectproperty.

(b) License Approval. The Direc-tor of Public Health shall takeaction on a license application for

the keeping of farm animals or beesin accordance with the followingprovisions:

(1) Approval Standards. In evalu-ating an application for an initiallicense or a license renewal, thePublic Health Director shall consid-er any evidence ascertained throughinspections of the property orthrough the submission of evidenceregarding nuisances or conditionsthat are unsafe or unsanitary rela-tive to the subject property and, inparticular, any recorded violations.The Director of Public Health maydeny a license on consideration ofsuch evidence.

(2) Notification in Residential Dis-tricts. Upon receipt of an initiallicense application for a propertylocated in a Residential zoning dis-trict, the Department of PublicHealth shall send a copy of thelicense application, along with acomment form, to the owner of eachproperty directly adjoining the prop-erty that is the subject of thelicense application. A copy of thesenotifications shall be transmitted tothe City Councilmember in whoseward the subject property is locat-ed. In reviewing the license appli-cation, the Director shall considerany evidence submitted by neigh-bors regarding issues pertinent tothe regulations and approval stan-dards for issuance of the license.The Director shall not take actionon such license application prior totwenty-one (21) days from the dateon which the notice was mailed tothe owners of adjoining properties.

(3) Building and Housing Ap-proval. The Public Health Directorshall not approve any initial licenseapplication for the keeping of farmanimals or bees prior to approval ofthe site plan by the Department ofBuilding and Housing in accordancewith the provisions of Section 347.02of the Zoning Code.

(c) License Expiration. Suchlicense shall expire at the end of acalendar year and shall be renewedonce every two years during Novem-ber or December before the end ofthe calendar year. The applicationfor renewal of a license need notinclude drawings and other infor-mation regarding conditions thathave not changed since submissionof such information in a priorlicense application.

(d) Lots Without a Residence. Inthe case of an application to keepfarm animals or bees on a lot thatis vacant or has no occupied resi-dence, a License shall be grantedonly if the applicant submits writ-ten documentation satisfactory tothe Public Health Director demon-strating that the use will be man-aged in a manner that prevents thecreation of nuisances or unsanitaryor unsafe conditions. Where theapplicant is not the property owner,a license shall be granted onlywhere the application is accompa-nied by a signed statement from theproperty owner granting the appli-cant permission to engage in thekeeping of farm animals or bees.

(e) Enforcement. The Director ofthe Department of Public Health orany authorized City employee shallhave the authority to inspect anyproperty to determine compliancewith the regulations of Section

347.02 of the Zoning Code regardingsanitation and nuisances and opera-tional practices in the keeping offarm animals or bees and shall havethe authority to enforce the regula-tions of that Section as they applyto such matters.

(f) Penalties. If the Director ofPublic Health determines that anindividual is in violation of the pro-visions of this Section or Section347.02 with respect to the enforce-ment responsibilities of the Depart-ment of Public Health, the Directorshall issue a violation notice to theindividual, noting the nature of theviolation(s). If the violation is notcorrected within seven (7) days ofissuance of the violation notice, therecipient of the notice shall be sub-ject to the following penalties andenforcement actions.

(1) for a first offense, a fine offifty dollars ($50);

(2) for a second offense occurringwithin four (4) months of the firstoffense, a fine of seventy-five dol-lars ($75);

(3) for a third and any subsequentoffense occurring within the periodof the current two-year license, anyfarm animals or bee hives associat-ed with the violation shall beremoved from the property by theindividual or shall be removed andimpounded by the Department ofPublic Health.

Section 347.02 Restrictions on theKeeping of Farm Animals and Bees

(a) Purpose. The regulations ofthis section are established to per-mit the keeping of farm animalsand bees in a manner that preventsnuisances to occupants of nearbyproperties and prevents conditionsthat are unsanitary or unsafe.

(b) Chickens, Ducks, Rabbits andSimilar Animals. The keeping ofchickens, ducks, rabbits and similarfarm animals, and cages, coops andenclosures for the keeping of suchanimals, shall be governed by thefollowing regulations.

(1) In Residential Districts. InResidential Districts, the followingregulations shall apply.

A. Number. No more than one suchanimal shall be kept on a parcel ofland for each 800 square feet of par-cel or lot area. For a standard resi-dential lot of 4,800 square feet, thisregulation would permit no morethan a total of six (6) such animals.

B. Setbacks. The coops or cageshousing such animals may not belocated in front yard or side streetyard areas and shall not be locatedwithin five (5) feet of a side yardline nor within eighteen (18) inchesof a rear yard line, except where therear lot line forms the side lot lineor front lot line of an abutting prop-erty, in which case the setback fromsuch rear lot line shall be five (5)feet. No animals shall be kept inrequired front yard or side streetyard areas.

C. Prohibitions. No roosters, geeseor turkeys may be kept in a Resi-dential District except on a parcelthat is at least one (1) acre in areaand only if the coop or cage hous-ing the bird(s) is at least one hun-dred (100) feet from all propertylines. For parcels greater than one(1) acre in area, one (1) additionalsuch bird may be kept for each

24,000 square feet in excess of one(1) acre. No predatory birds may bekept on any property under the reg-ulations of this Section.

D. Coops and Cages. All animalsshall be provided with a covered,predator-proof coop or cage or othershelter that is thoroughly ventilat-ed, designed to be easily accessedand cleaned, and of sufficient sizeto permit free movement of the ani-mals exclusive of areas used forstorage of materials or vehicles. Thetotal area of all coops or cages ona lot shall not be greater than thir-ty two (32) square feet for up to six(6) animals. Coops and cages, singlyor in combination, shall not exceedfifteen (15) feet in height.

E. Enclosures and Fences. Chick-ens and other birds shall haveaccess to an outdoor enclosure ade-quately fenced or otherwise bound-ed to contain the birds on the prop-erty and to prevent access by dogsand other predators and providingat least ten (10) square feet of areafor each bird.

(2) In Non-Residential Districts.In zoning districts other than Resi-dential Districts, all regulationsapplicable in Residential Districtsshall apply except that the numberof such animals shall be limited toone (1) animal for each four hun-dred (400) square feet of lot area.

(c) Goats, Pigs, Sheep and SimilarAnimals. The keeping of goats, pigs,sheep and similar farm animals, andstables and enclosures for the keep-ing of such animals, shall be gov-erned by the following regulations.

(1) In Residential Districts. InResidential Districts, no goats, pigs,sheep or similar farm animals shallbe kept on a parcel of land less than24,000 square feet in area. For a par-cel that is at least 24,000 square feetin area, a maximum of two (2) suchanimals may be kept on the proper-ty, with one (1) additional animalpermitted for each additional 2,400square feet of area. Stables or otherenclosures for such animals shallnot be permitted in front yards orin side street yards and shall be setback at least forty (40) feet fromany street and from any propertyother than a property located in anIndustrial District and shall be setback at least one hundred (100) feetfrom a dwelling on another parcelor from the permitted placement ofa dwelling on an adjoining vacantparcel.

(2) In Non-Residential Districts.In zoning districts other than Resi-dential Districts, no goats, pigs,sheep or similar farm animals shallbe kept on a parcel of land less than14,400 square feet in area. For a par-cel that is at least 14,400 square feetin area, a maximum of two (2) suchanimals may be kept on the proper-ty, with one (1) additional animalpermitted for each additional 1,200square feet of area. Stables or otherenclosures for such animals shall beset back at least forty (40) feetfrom any street and from any prop-erty other than a property located inan Industrial District and shall beset back at least one hundred (100)feet from a dwelling on another par-cel or from the permitted placementof a dwelling on an adjoiningvacant parcel.

(3) Prohibitions. No horses, cows,alpacas, llamas or similar animalsshall be kept on a property exceptin areas specifically designated forthe keeping of such animals.

(d) Bees. The keeping of bees,and associated beehives, shall begoverned by the following regula-tions.

(1) In Residential Districts. InResidential Districts, the followingregulations shall apply.

A. Number. No more than one (1)beehive shall be kept for each 2,400square feet of lot area, and no bee-hive shall be kept on a lot less than2,400 square feet in area.

B. Location and Setbacks. No bee-hive shall be kept closer than five(5) feet to any lot line and ten (10)feet to a dwelling or the permittedplacement of a dwelling on anotherparcel, and no beehive shall be keptin a required front yard or sidestreet yard. The front of any bee-hive shall face away from the prop-erty line of the Residential proper-ty closest to the beehive.

C. Fences and Shrubs. A solidfence or dense hedge, known as a“flyway barrier,” at least six (6)feet in height shall be placed alongthe side of the beehive that containsthe entrance to the hive, and shallbe located within five (5) feet of thehive and shall extend at least two(2) feet on either side of the hive.No such flyway barrier shall berequired if all beehives are locatedat least twenty-five (25) feet fromall property lines and for beehivesthat are located on porches or bal-conies at least ten (10) feet abovegrade, except if such porch or bal-cony is located less than five (5)feet from a property line.

D. Water Supply. A supply offresh water shall be maintained ina location readily accessible to allbee colonies on the site throughoutthe day to prevent bees from con-gregating at neighboring swimmingpools or other sources of water onnearby properties.

E. Prohibitions. No Africanizedbees may be kept on a propertyunder the regulations of this Sec-tion.

(2) In Non-Residential Districts.In zoning districts other than Resi-dential Districts, all regulationsapplicable in Residential Districtsshall apply except that the numberof beehives shall be limited to one(1) for each 1,000 square feet of lotarea.

(e) Lots Without a Residence.Notwithstanding the provisions ofSection 337.23 regarding AccessoryUses, farm animals or bees may bekept on a lot that is vacant or hasno occupied residence but only if theapplicant for such activity submitswritten documentation to the Direc-tor of Public Health, in accordancewith the provisions of Section 205.04,demonstrating that the use will bemanaged in a manner that preventsthe creation of nuisances or unsan-itary or unsafe conditions.

(f) Sanitation and Nuisances.Farm animals shall be kept only inconditions that limit odors and noiseand the attraction of insects androdents so as not to cause a nui-sance to occupants of nearby build-ings or properties and not to causehealth hazards. Furthermore, farm

animals shall not be kept in a man-ner that is injurious or unhealthfulto the animals being kept on theproperty.

(g) Animal or Bird Noise. It shallbe unlawful for any person or otherparty operating or occupying anybuilding or premises to keep orallow to be kept any animal or birdthat makes noise so as to habitual-ly disturb the peace and quiet ofany person in the vicinity of thepremises.

(h) Slaughtering of Animals.Chickens, ducks, rabbits and similarsmall animals may be slaughteredon site only if for consumption bythe occupants of the premises. Noother farm animal may be slaugh-tered on site.

(i) Application to Building andHousing Department. Anyone pro-posing to keep farm animals or beeson a property in the City of Cleve-land or to expand such use shallapply for approval from the Depart-ment of Building and Housing,which shall determine if the appli-cation is in compliance with regu-lations regarding construction andpermitted placement of enclosures,fences, cages, coops, beehives, fly-way barriers, stables and otherstructures used in keeping of farmanimals or bees and whether theproperty is occupied by a con-demned building.

(1) Contents of Application. Theapplication shall include the infor-mation required by the provisions ofdivision (a) of Section 205.04.

(2) Building Permits. A BuildingPermit shall be required for instal-lation of a fence or for constructionof a stable or other structure rou-tinely requiring such permit, exceptthat no Building Permit shall berequired for cages, coops or bee-hives that are not permanentlyattached to the ground or to anoth-er structure and do not exceed thir-ty two (32) square feet in area noreight (8) feet in height. No BuildingPermit shall be required for the bar-rier constituting a required enclo-sure if such barrier is not perma-nently attached to the ground anddoes not exceed three (3) feet inheight; and no permit shall berequired for a “flyway” barrier notexceeding six (6) feet in height andsix (6) feet in length.

(j) Application to Public HealthDepartment. In accordance with theprovisions of Section 205.04, anyoneproposing to keep farm animals orbees on a property in the City ofCleveland shall apply for a two-yearlicense from the City of Clevelandthrough its Department of PublicHealth on a form provided by thatoffice.

(k) Building Conditions. The keep-ing of farm animals or bees shallnot be permitted on a property occu-pied by a building that has beencondemned by the Department ofBuilding and Housing.

(l) Enforcement. The Director ofthe Department of Building andHousing or the Director’s designeeshall have the authority to inspectany property to determine compli-ance with the regulations of thisSection regarding the constructionand permitted placement of enclo-sures, fences, cages, coops, beehives,stables and other structures used in

the keeping of farm animals or beesand shall have the authority toenforce the regulations of this Sec-tion as they apply to such matters.The Department of Public Healthshall have the authority to enforceregulations of this Section in accor-dance with the provisions of Section205.04.

(m) Variances. The Board of Zon-ing Appeals may vary the regula-tions of this section as they applyto a particular property if it deter-mines that such variance will beconsistent with the stated purposeof this Section.

(n) Definitions. Terms used inthis Section shall have the meaningsassigned to them in the followingdefinitions.

(1) Farm Animal. “Farm animal”means any domestic species of ani-mal that is kept and raised for useas food or in the production of foodor in the operation of a farm and isnot an “exotic animal” as defined inSection 603A.02 and is not a housepet such as a dog, cat or similar ani-mal.

(2) Coop and Cage. “Coop” and“cage” mean a structure, not neces-sarily attached to the ground, witha top and sides and designed to pro-vide shelter and protection for smallanimals or birds.

(3) Enclosure. “Enclosure” meansa set of walls or fences designed toconfine animals or birds to a spacethat is large enough to permit theanimals and birds to roam relative-ly freely in an open yard area.

(4) Predatory Bird. “Predatorybird” means an owl, hawk, falcon,eagle or similar bird that feeds prin-cipally by catching living prey.

(5) Similar Animal. Any farm ani-mal that is similar to other animalslisted in a particular category ofpermitted animals with respect toimpacts on nearby properties, in-cluding noise, odors, safety hazardsor other nuisances.

(o) Six-Month Review. Not laterthan six (6) months after the effec-tive date of this section, the Depart-ment of Public Health and theDepartment of Building and Hous-ing shall submit a report to CityCouncil listing any public com-plaints received and any enforce-ment actions taken during the firstsix (6) months after the effectivedate of this section relative to thekeeping of farm animals or bees inaccordance with the regulations ofthis section. Upon receiving thisreport from the Director of PublicHealth, City Council members shallconduct a mobile tour of select loca-tions throughout the City wherefarm animals and bees are beingkept in connection with licensesobtained under this ordinance. CityCouncil shall use this report tomake a determination on the effec-tiveness of the regulations. This sec-tion shall expire and be of no fur-ther force and effect twelve (12)months after the effective date ofthis section.

Section 3. That this ordinance ishereby declared to be an emergencymeasure and, provided it receivesthe affirmative vote of two-thirds ofall the members elected to Council,it shall take effect and be in forceimmediately upon its passage andapproval by the Mayor; otherwise it

Be it ordained by the Council ofthe City of Cleveland:

Section 1. That the Director ofPublic Service is authorized to makeone or more written requirementcontracts under the Charter and theCodified Ordinances of Cleveland,Ohio, 1976, for the requirements forthe term of one year or two yearsfor the necessary items of the rentalof large capacity trucks with oper-ators in the approximate amount asprocured during the preceding term,procured by the Commissioner ofPurchases and Supplies upon a unitbasis for the Division of Streets,Department of Public Service. Bidsshall be taken in a manner that per-mits an award to be made for allitems as a single contract, or by sep-arate contract for each or any com-bination of the items as the Boardof Control determines. Alternatebids for a period less than the spec-ified term may be taken if desiredby the Commissioner of Purchasesand Supplies until provision is madefor the requirements for the entireterm. The Director of Public Serviceis authorized to enter into one ormore contracts with a term of twoyears instead of one year whenthere is a financial advantage to theCity. For purposes of this ordinance,a financial advantage shall be deter-mined by the Director of Public Ser-vice by comparing the bids receivedfor both terms.

Section 2. Section 183.024 Acquiring proper-ties from the Department of Hous-ing and Urban Development andFannie Mae for the Land Reutiliza-tion Program

(a) That notwithstanding and asan exception to the provisions ofChapter 181 and 183 of the CodifiedOrdinances of Cleveland, Ohio, 1976,the Commissioner of Purchases andSupplies is authorized to acquirecertain properties owned by theDepartment of Housing and UrbanDevelopment (“HUD”) and FannieMae, each for a price determined asFair Market Value, as part of theLand Reutilization Program.

(b) That HUD and Fannie Maeproperties with a fair market valueof less than $20,000 shall be ac-quired by the City at a cost of$100.00 each; properties with a fairmarket value higher than $20,000

shall be acquired by the City at 50%below HUD or Fannie Mae-estab-lished valuation;

(c) That the Commissioner of Pur-chases and Supplies, when directedby the Director of Community Devel-opment, and with the prior writtenconsent of the member or membersof Council in whose ward or wardthe property to be sold is located, isauthorized to convey these proper-ties or to assign the City of Cleve-land’s rights under purchase agree-ments for these properties withHUD or Fannie Mae to purchasersfor the public purpose of rehabilita-tion and/or redevelopment.

(d) That the Director of Commu-nity Development is authorized toenter into and execute projectagreements on behalf of the City ofCleveland with purchasers for theredevelopment and/or rehabilitationof said properties.

(e) That the consideration for theproperties to be sold shall be estab-lished by the Board of Control andshall not be sold for less than FairMarket Value taking into accountsuch terms and conditions, restric-tions and covenants as are deemednecessary or appropriate.

(f) That the Director of Commu-nity Development is authorized toexecute on behalf of the City ofCleveland all necessary documentsto acquire and to convey the prop-erties and to employ and pay allfees for title companies, surveys,escrows, appraisers, environmentalaudits, and all other costs necessaryfor the acquisition and sale of theproperties.

(g) That all costs of acquisitionof properties shall be paid fromfunds appropriated for this purpose.

(h) That the conveyances shallbe made by official deeds preparedby the Director of Law and exe-cuted by the Mayor on behalf of theCity of Cleveland. The deeds shallcontain such provisions as may benecessary to protect and benefit thepublic interest including suchrestrictive covenants and reversion-ary interests as may be specifiedby the Board of Control, the Direc-tor of Community Development orthe Director of Law.

The selection of theconcessionaire or concessionairesshall be made by the Board of Con-trol on the nomination of the Direc-tor of Parks, Recreation and Prop-erties.

Section 2. That, to the extent pro-vided by law, fifty percent (50%)of the City revenues derived fromthe vending machines shall bedeposited into the appropriate fundand subfunds for the improvementof, use of, and maintenance of Cityof Cleveland recreation centers.
