TUESDAY, DECEMBI.R r6, 1879, at which time aid place the bids will be publicly opened by the head of said Department and read. The award if the contract will be made as soon as practicable after the Opening of the bids.

Any bidder for this contract mint be well prepared for the business, and the bidder to whom the award is made shall give security for the faithlui performance of the contract, in the manner prescribed and required by ,:r-dinance, in the sum of fifteen hundred dollars.

The Engineer's estimate of the quantity of material necessary to be dredged in order to secure the depth of fifteen feet of water, at mean low tide, is io,oco curie yards. But this estimate is approximate only, and form; no part of the contract, and persons bidding are cautioned that neither the Department of Docks nor the City of New York is to be held responsible that it shall strictly obtain in the work, and bidders are required to examine the premise., and tojudge for themselves of the quantity and other circumstances affecting the cost of the work.

"Clio time allowed for doing the work is thirty days from the date of signing the contract; and the damages to be paid by the contractor for each day that the contract may be unfulfilled after the time fixed for fulfillment has ex-pired, Sundays and holiliays not to be excepted, are, by a clause in time contract, fixed and liquidated at fifty dollars per day. But the Beard of Docks may extend the time for the completion of the work, if, in its judgment, the work has been delayed by ice in the river or harbor, or by very severe weather.

All the material excavated is to be removed by the con-tractor, and deposited in all respects according to law,

Bidders will state in their proposals the price per cubic yard for doing such dredging in conformity with the an-nexed specifications, by which the bids will he tested. The price is to cover all expenses of every kind involved in or incidental to the completion of the contract, including any claim that might arise through delay from any cause in the performing of the work thereunder.

Bidders will write out the amount of their estimate for doing this work, in addition to inserting the same in figures.

Should the lowest bidder neglect or refuse to ac- cept to contract within forty-eight (43) hours after written notice that the same has been awarded to his bid or proposal, or if, after acceptance, he should refuse or neglect to execute the contract and give the proper security for forty-eight hours after notice that the contract is ready for execution, he will be considered as having abandoned it, and as in default to the Corpora-tion; and the contract will be readvertised and relet, and so on until it be accepted and executed.

Bidders are required to state in their proposals their names and places of residence, the names of all persons interested with them therein ; and if no other person be so interested, the proposal shall distinctly state that fact ; also that the bid is made without any connection with any other person making any estimate for the saute purpose, and that it is in all respects fair, and without collusion or fraud : and also that no member of the Common Council, head of a department, chief of a bureau, deputy thereof, or clerk therein, or other officer of the Corporation is directly or indirectly interested therein, or in the supplies or work to which it relates, or in any portion of the profits thereof; which proposals must be verified by the oath, in writing, of the party making the estimate, that the several matters stated therein are in all respects true. Where more than one/ierson is interested. it is requisite that the ver:Jrcatron be made and subscribed by all the parties interested.

Each proposal shall be accompanied by the consent, in wn[ing, of two householders or freeholders in the City of New York, with their respective places of business or residence, to the effect that if the contract be award-ed to the person making the bid, they will, on its being so awarded, become bound as his sureties for its faithful performance; and that if said person shall omit or refuse to execute the contract, they will pay to the Corporation any difference between tt,e sum to which said person would be entitled on its com-pletion and that which the Corporation may be obliged to pay to the person to whom the contract shall be awarded at any subsequent letting ; the amount in each case to be calculated upon the estimated amount of the work by which the bids are tested. The consent above men-ironed shall be accompanied by the oath or affirmation, in writing, of each of the persons signing the same, that he is a householder or freeholder in the city of New York, and is worth the amount of the security required for the com-pletion of the contract, and stated in these proposals, over and above all his debts of every nature, and over and above his liabilities as bail, surety and otherwise; and that he has offered himself as surety in food faith, and with the intention to execute the bond required by section 5 of chapter 974, Laws of 1871, and by section 27 ofchapter VIII. of the Revised Ordinances of the City of New York, if the contract shall be awarded to the person or persons

for whom he consents to become surety. LThe adequacy and sufficiency of the sureties offered are to be approved by the Comptroller of the City of New l ork, Litter the award is made and prior to the signing of the contract.
