  • The Big Horn Country Rustler.VOLUME XVI. ASIN. Bid lIOUX COUNTY, WYO., THURSDAY, MAY 4, 1905. NUMBEB 48.

    THE DISTRICT COURT.

    Its Proceedings during the

Week Briefly Noted. Our story of the proceedings of

the court was brought down lasiweek to noon of Thursday, April27, when the Risti.kk was issued. On the afternoon of that day theattention of the court was occu-pied with the hearing of the caseof 11. L. Sweet vs. J. A. Crum, for damages arising from an irri-gating ditch located on Clark'sFork. After some discussion proand eon by the attorneys it was de-cided to take a change of venue toSheridan county.

The divorce case of IsophineHewitt vs. Frank Hewitt wasnext called and in many respectsit proved to be the most interest-ing case of the session. A largevolume of testimony of a racycharacter was introduced and thehearing was continued until a latehour in the evening. Judge Par-melee took the matter under ad-visement until the following mor-ning.

FRIDAY, Anal,2B.• " After a careful considerationof the testimony offered in theHewitt case." said Judge Parme-'ee when court was opened, " Inave decided to deny Mrs. Hew-iit's petition for a divorce."

airther legal conditions were pre-scribed for the actions of the un-litppy couple and a jury was cm-

panneled to listen to the hearingof the damage suit of .Mrs. JennieAustin vs. Milo Burke. This casetook up a large part of the day, being warmly contested by the op-posing counsel, and at a late hourin the afternoon it was given tothe jury. The verdict was a cost-ly victory for Mrs. Austin. Shewas awarded $1 damages and thecosts were equally divided be-tween the defendant and plaintiff.

The final settlement of this caseas outlined put an end. possibly,to one of the most noted suits atlaw that has ever been before thecourts of this county. It was be-gun several years ago by the lateA. S. Austin, who fought for ajudgment with all the intensity of''

-i nature. In the early inceptionthe dispute he became nearly

..ivolved in a tragedy with the latePit Dowdell, who was then in theemploy of Milo Burke. Shotswith Winchester rifles were ex-

anged between them, and allids of trouble stirred up, in

. nich the people along Tensleep>k sides as their sympathies dk-

.led. The disposal of the case?loses an unhappy chapter of liti-

    • ion in this county it is hopedever and a day.Tlic next case taken up was the»nof Cody vs. H v W. Darrab, latter being charged with 11lution ol* one of the water or-ances of that municipality. Co-was well represented by a large

Rogation of her citizens, and the. ise excited keen interest on the; art of all who were involved inn. Mr. Darrab was representedby Messrs. Widgeley & \'an Horn,

~d.v by W. U Walk. Thede-i. use maintained that the actionijjnught against Mr. Darrab had
