NOTE: If the distilled spirits is not sold under a brand name, the name of thedistiller, bottler, importer, etc., [shown on the front of the container] becomesthe brand name

•• MISLEADING BRAND NAME

A name that describes the age, origin, identity or other characteristics of thedistilled spirits is prohibited UNLESS the name, whether standing alone or incombination with other printed or graphic material:

nnAccurately describes the distilled spirits ANDnnConveys no erroneous impression about the distilled spirits

ORnnIs qualified with the word “BRAND”

Alcohol content may be expressed in degrees proof in addition to the requiredalcohol by volume statement. If the proof is shown it must appear at leastonce on the FRONT of the container with the alcohol by volume statementAND:

Contract bottling refers to the bottling, packing or filling of a distilled spiritsproduct by a domestic distilled spirits plant for an unrelated domestic distilledspirits plant

Example: A Spirits is a distilled spirits plant located in Newark, New Jersey.A Spirits currently bottles its line of spirits products only in 750 ml bottles.The company would like to expand its size offerings to include 50 ml and 1liter bottles. It is not, however, equipped to bottle in these sizes. Rather thanre-outfitting its plant, A Spirits elects to have other distilled spirits plants dothe bottling for it. A Spirits contracts with B Spirits, Cleveland, Ohio to bottlethe 50 ml size and C Spirits, Portland, Oregon to bottle the 1 liter size

The three companies are unrelated; B Spirits and C Spirits are contractbottling for A Spirits
