-1. The *orms set *orth "n the a''en%"ces to these rules, ("th such var"at"ons

as the c"rcumstances o* each case may re/u"re, may $e use% *or the

res'ect"ve 'ur'oses there"n ment"one%, an% "* use%, shall $e su0c"ent, $ut a

%ev"at"on *rom such *orms shall not, $y reason only o* such %ev"at"on, ren%er

"nval"% any char)e, (arrant, or%er, 'rocee%"n)s or any other %ocument

relevant to these rules!

-. Any om"ss"on o* any such *orm shall not, $y reason only o* such om"ss"on,

ren%er any act or th"n) "nval"%!

-&. The %"rect"ons "n the notes to, an% the "nstruct"ons "n, the *orms shall %ulycom'l"e% ("th "n all cases to (h"ch they relate, $ut any om"ss"on to com'ly

("th any such %"rect"ons "n the notes o* "nstruct"ons shall not, merely $y

reason o* such om"ss"on, ren%er any act or th"n) "nval"%!

2ur"s%"ct"on to, an% any act or th"n) to $e %one $y, to or $e*ore any 'erson

3! Cases un'rov"%e% *or!#n re)ar% to any matter not s'ec"cally 'rov"%e% *or

7! Enroll"n) o0cers!#The *ollo("n) 'ersons shall $e the 8enroll"n) o0cers

*or the 'ur'ose o* sect"on 1&, namely:#

-a. all recru"t"n) an% ass"stant recru"t"n) o0cers "nclu%"n) o0cers o* the

n%"an ;avy or o* the A"r orce, (ho may $e a''o"nte% as such,

-$. the o0cer comman%"n) a re)"ment, $attal"on or tra"n"n) or re)"mental

centre, an%

-c. any e+tra ass"stant recru"t"n) o0cer or other 'erson (ho may $e

a''o"nte% as an 8enroll"n) o0cer $y the A%2utant General!

-1. Every 'erson re/u"re% to $e atteste% un%er sect"on 13 shall ma6e an%

su$scr"$e an oath or a0rmat"on "n one o* the *ollo("n) *orms or "n such other

*orm to the same 'ur'ort as the attest"n) o0cer ascerta"ns to $e "n

accor%ance ("th the rel")"on o* the 'erson to $e atteste%, or other("se

$"n%"n) on h"s consc"ence! orm o* ?ath , !!!!!!!!!!!!!!!!!!!!!!!!!!, %o s(ear "n name

o* Go% that ("ll $ear true *a"th an% alle)"ance to the Const"tut"on o* n%"a as$y the la( esta$l"she% an% that ("ll, as "n %uty $oun%, honestly an%

11! "schar)e not to $e %elaye%!#

-1. Every 'erson enrolle% un%er the Act shall, as soon as he $ecomes ent"tle%

un%er the con%"t"ons o* h"s enrolment to $e %"schar)e%, $e so %"schar)e% ("th

all conven"ent s'ee%: =rov"%e% that no 'erson shall $e ent"tle% to such

%"schar)e, "* the Central Government has, $y not"cat"on sus'en%e% the sa"%

ent"tlement to %"schar)e *or the (hole or a 'art o* the re)ular Army!

-. The %"schar)e o* a 'erson, val"%ly sanct"one% $y a com'etent author"ty,

may, ("th the consent o* the %"schar)e% 'erson, $e cancelle% $y any

author"ty su'er"or to the author"ty (ho sanct"one% the %"schar)e e"ther

("thout any con%"t"ons or su$2ect to such con%"t"ons as such %"schar)e%

'erson acce'ts!

serv"ce on 'ens"on or )ratu"ty, "* any, a%m"ss"$le to h"m!F


1D14! Term"nat"on o* serv"ce $y the Central Government on account o*

m"scon%uct!#

-1. hen "t "s 'ro'ose% to term"nate the serv"ce o* an o0cer un%er sect"on 19

on account o* m"scon%uct, he shall $e )"ven an o''ortun"ty to sho( cause "n

the manner s'ec"e% "s su$>rule -. a)a"nst such act"on# =rov"%e% that th"ssu$>rule shall not a''ly#

-a. (here the serv"ce "s term"nate% on the )roun% o* m"scon%uct (h"ch has

le% to h"s conv"ct"on $y a cr"m"nal court or

-$. (here the Central Government "s sat"se% that *or reasons, to $e recor%e%

"n (r"t"n), "t "s not e+'e%"ent or reasona$ly 'ract"ca$le to )"ve to the o0cer

an o''ortun"ty o* sho("n) cause!

-. hen a*ter cons"%er"n) the re'orts on an o0cers m"scon%uct, the Central

Government or the Ch"e* o* the Army ta "s sat"se% that the tr"al o* the

o0cer $y a court>mart"al "s "ne+'e%"ent or "m'ract"ca$le, $ut "s o* the o'"n"on,

that the *urther retent"on o* the sa"% o0cer "n the serv"ce "s un%es"ra$le, the

Ch"e* o* the Army ta shall so "n*orm the o0cer to)ether ("th all re'orts

a%verse to h"m an% he shall $e calle% u'on to su$m"t, "n (r"t"n), h"s

e+'lanat"on an% %e*ence: =rov"%e% that the Ch"e* o* the Army ta may

("thhol% *rom %"sclosure any such re'ort or 'ort"on thereo* "*, "n h"s o'"n"on,

"ts %"sclosure "s not "n the "nterest o* the secur"ty o* the tate! n the event o*

the e+'lanat"on o* the o0cer $e"n) cons"%ere% unsat"s*actory $y the Ch"e* o*

the Army ta, or (hen so %"recte% $y the Central Government, the case

shall $e su$m"tte% to the Central Government, ("th the o0cers %e*ence an%

the recommen%at"on o* the Ch"e* o* the Army ta as to the term"nat"on o*

the o0cers serv"ce "n the manner s'ec"e% "n su$>rule -4.!

-&. here, u'on the conv"ct"on o* an o0cer $y a cr"m"nal court, the Central

Government or the Ch"e* o* the Army ta cons"%ers that the con%uct o* the

o0cer (h"ch has le% to h"s conv"ct"on ren%ers h"s *urther retent"on "n serv"ce

un%es"ra$le a cert"e% co'y o* the 2u%)ment o* the cr"m"nal court conv"ct"n)

h"m shall $e su$m"tte% to the Central Government ("th the recommen%at"on

o* the Ch"e* o* the Army ta as to the term"nat"on o* the o0cers serv"ce "n

the manner s'ec"e% "n su$>rule -4.! D-4. hen su$m"tt"n) a case to the

Central Government un%er the 'rov"s"ons o* su$>rule -. or su$>rule -&., the

Ch"e* o* the Army ta shall ma6e h"s recommen%at"on (hether the o0cers

serv"ce shoul% $e term"nate%, an% "* so, (hether the o0cer shoul% $e#

-a. %"sm"sse% *rom the serv"ce or

-$. remove% *rom the serv"ce or

-c. Com'ulsor"ly ret"re% *rom the serv"ce!

-5. The Central Government a*ter cons"%er"n) the re'orts an% the o0cers

%e*ence, "* any, or the 2u%)ment o* the cr"m"nal court, as the case may $e,

an% the recommen%at"on o* the Ch"e* o* the Army ta, may#

-a. %"sm"ss or remove the o0cer ("th or ("thout 'ens"on or )ratu"ty or

-$. com'ulsor"ly ret"re h"m *rom the serv"ce ("th 'ens"on an% )ratu"ty, "* any,

a%m"ss"$le to h"m!FF


1D15! Term"nat"on o* serv"ce $y the Central Government on )roun%s other

than m"scon%uct!#

-1. hen the Ch"e* o* the Army ta "s sat"se% that an o0cer "s unt to $e

reta"ne% "n the serv"ce %ue to "ne0c"ency, or 'hys"cal %"sa$"l"ty, the o0cer#

-a. shall $e so "n*orme%,

-$. shall $e *urn"she% ("th the 'art"culars o* all matters a%verse to h"m, an%

-c. shall $e calle% u'on to ur)e any reasons he may ("sh to 'ut *or(ar% "n

*avour o* h"s retent"on "n the serv"ce: =rov"%e% that clauses -a., -$. an% -c.

shall not a''ly "* the Central Government "s sat"se% that *or reasons, to $e

recor%e% $y "t "n (r"t"n), "t "s not e+'e%"ent or reasona$ly 'ract"ca$le to

com'ly ("th the 'rov"s"ons thereo*: =rov"%e% *urther that the Ch"e* o* the

Army ta may not *urn"sh to the o0cer any matter a%verse to h"m, "* "n h"s

o'"n"on, "t "s not "n the "nterest o* the secur"ty o* the tate to %o so!

-. n the event o* the e+'lanat"on $e"n) cons"%ere% $y the Ch"e* o* the Army

ta unsat"s*actory, the matter shall $e su$m"tte% to the Central Government*or or%ers, to)ether ("th the o0cers e+'lanat"on an% the recommen%at"on o*

the Ch"e* o* the Army ta as to (hether the o0cer shoul% $e#



-&. The Central Government a*ter cons"%er"n) the re'orts, the e+'lanat"on, "*

any, o* the o0cer an% the recommen%at"on o* the Ch"e* o* the Army ta,

may call u'on the o0cer to ret"re or res")n, an% on h"s re*us"n) to %o so, the

o0cer may $e com'ulsor"ly ret"re% or remove% *rom the serv"ce on 'ens"on

or )ratu"ty, "* any, a%m"ss"$le to h"m!F


1D15A! Release on me%"cal )roun%s!#

-1. An o0cer (ho "s *oun% $y a Me%"cal Ioar% to $e 'ermanently unt *or any

*orm o* m"l"tary serv"ce, may $e release% *rom the serv"ce "n accor%ance ("th

the 'roce%ure la"% %o(n "n th"s rule!

-. The =res"%ent o* the Me%"cal Ioar% shall, "mme%"ately a*ter the Me%"cal

Ioar% has come to the conclus"on that the o0cer "s 'ermanently unt *or any*orm o* m"l"tary serv"ce, "ssue, a not"ce s'ec"*y"n) the nature o* the %"sease or

%"sa$"l"ty he "s suer"n) *rom an% the n%"n) o* the Me%"cal Ioar% an% also

"nt"mat"n) h"m that "n v"e( o* the n%"n) he may $e release% *rom the

serv"ce every such not"ce shall also s'ec"*y that the o0cer may, ("th"n

*teen %ays o* the %ate o* rece"'t o* the not"ce, 're*er a 'et"t"on a)a"nst the

n%"n) o* the Me%"cal Ioar% to the Ch"e* o* the Army ta throu)h the

=res"%ent o* the Me%"cal Ioar%: =rov"%e% that (here "n the o'"n"on o* the

Me%"cal Ioar% the o0cer "s suer"n) *rom a mental %"sease an% "t "s e"ther

unsa*e to commun"cate the nature o* the %"sease or %"sa$"l"ty to the o0cer or

the o0cer "s unt to loo6 a*ter h"s "nterests, the nature o* the %"sease or

%"sa$"l"ty shall $e commun"cate% to the o0cers ne+t>o*>6"n (ho shall havethe l"6e r")ht to 'et"t"on!

-&. * no 'et"t"on "s 're*erre% ("th"n the t"me s'ec"e% "n su$>rule -., the

o0cer may $e release% *rom the serv"ce $y an or%er to that eect $y the

Ch"e* o* the Army ta Dor the A%2utant GeneralF!

-4. * a 'et"t"on "s 're*erre% ("th"n the t"me s'ec"e% "n su$>rule -., "t shall $e

*or(ar%e% to the Central Government to)ether ("th the recor%s thereo* an%

the recommen%at"on o* the Ch"e* o* the Army ta Dor the a%2utant General!

The Central Government may, a*ter cons"%er"n) the 'et"t"on an% the

recommen%at"on o* the Ch"e* o* the Army ta Dor the A%2utant General

'ass such or%er as "t %eems t!F


1D13! Release!#A 'erson su$2ect to the Act may $e release% *rom the serv"ce

"n accor%ance ("th the Release Re)ulat"ons *or the Army or "n accor%ance

("th any other re)ulat"ons, "nstruct"ons or or%ers ma%e "n that $ehal*!F


1D13I! Ret"rement o* an o0cer at h"s o(n re/uest!# The ret"rement o* an

o0cer at h"s o(n re/uest $e*ore he $ecomes l"a$le to DJJJFret"rement un%er

rule 13A shall re/u"re the sanct"on o* the Central Government!

-. An o0cer (hose re/uest to ret"re "s )rante% may, $e*ore he "s ret"re%,

a''ly to the Central Government *or ("th%ra(al o* h"s re/uest! The Central

Government may, at "ts %"scret"on, )rant such ("th%ra(al o* h"s a''l"cat"on!


13C! Re)"strat"on o* Comm"ss"on!#

-1. An o0cer shall have no r")ht to res")n h"s comm"ss"on $ut may su$m"t an

a''l"cat"on to the Central Government to res")n h"s comm"ss"on! He shall not

$e rel"eve% o* h"s %ut"es unt"l the Central Government has acce'te% h"sres")nat"on!

-. An o0cer (hose a''l"cat"on to res")n h"s comm"ss"on has $een acce'te%

may, $e*ore he "s rel"eve% o* h"s %ut"es, a''ly to the Central Government *or

("th%ra(al o* the sa"% a''l"cat"on! The Central Government may, at "ts

%"scret"on, )rant ("th%ra(al o* h"s a''l"cat"on!F


1D17! "sm"ssal or removal $y Ch"e* o* the Army ta an% $y other o0cers!#

ave "n the case (here a 'erson "s %"sm"sse% or remove% *rom serv"ce on the

)roun% o* con%uct (h"ch has le% to h"s conv"ct"on $y a cr"m"nal court or acourt>mart"al, no 'erson shall $e %"sm"sse% or remove% un%er su$>sect"on

-1. or su$>sect"on -&. o* sect"on @ unless he has $een "n*orme% o* the

'art"culars o* the cause o* act"on a)a"nst h"m an% allo(e% reasona$le t"me to

state "n (r"t"n) any reasons he may have to ur)e a)a"nst h"s %"sm"ssal or

removal *rom the serv"ce: =rov"%e% that "* "n the o'"n"on o* the o0cer

com'etent to or%er the %"sm"ssal or removal, "t "s not e+'e%"ent or reasona$ly

'ract"ca$le to com'ly ("th the 'rov"s"ons o* th"s rule, he may a*ter cert"*y"n)

to that eect, or%er the %"sm"ssal or removal ("thout com'ly"n) ("th the

'roce%ure set out "n th"s rule! All cases o* %"sm"ssal or removal un%er th"s rule

(here the 'rescr"$e% 'roce%ure has not $een com'l"e% ("th shall $e re'orte%

to the Central Government!F


1mart"al ta6es eect!#

-1. The %"sm"ssal o* an o0cer un%er sect"on 19 or the ret"rement, res")nat"on,

release or removal o* such o0cer shall ta6e eect *rom the %ate s'ec"e% "n

that $ehal* "n the not"cat"on o* such %"sm"ssal, ret"rement or removal "n the

?0c"al GaBette!

-. The %"sm"ssal o* a 'erson su$2ect to the Act, other than an o0cer (hose

%"sm"ssal other("se than $y sentence o* a court>mart"al "s %uly author"se% orthe %"schar)e o* a 'erson so su$2ect (hose %"schar)e, "* %uly author"se%, shall

$e carr"e% out $y the comman%"n) o0cer o* such 'erson ("th all conven"ent

s'ee%! The author"ty com'etent to author"se such %"sm"ssal or %"schar)e

may, (hen author"s"n) the %"sm"ssal or %"schar)e, s'ec"*y any *uture %ate

*rom (h"ch "t shall ta6e eect: =rov"%e% that "* no such %ate "s s'ec"e% the

%"sm"ssal or %"schar)e shall ta6e eect *rom the %ate on (h"ch "t (as %uly

author"se% or *rom the %ate on (h"ch the 'erson %"sm"sse% or %"schar)e%,

cease% to 'er*orm m"l"tary %uty, (h"chever "s the later %ate!

-&. The ret"rement, removal, res")nat"on, release, %"schar)e or %"sm"ssal o* a
