Short title.

Interpret a- tion.

1. This Act may be cited as ‘‘ The PastomE Leuses Act qf 1900.”

2. In this Act, unless the context otherwise indicates, the following terms have the meanings set against them respectively, that is to say :-

“Minister”-The Secretary for Public Lands or other Uinister of the Crown who for the time being performs his duties ;

‘‘ Court ”-The Land Conrt constituted under the provisions of‘ (‘ The Lmd Act, 1897”* ;

‘; Pastoral tenant ”-The holder of a lease under “ Yhe PastoraZ Leuses Act qf 1869,”T or of such lease extended under “ flae Pccstomi Leases Bxtemiorz Act of 1890 ’’$ ;

“Available Area’’--In the case of land held or formerly held under the provisions of ‘‘ 2’le Pastoral Zeases A c t of 1569,”* the area deter- mined as available under the provisions of that Act, and& thecaseof land held under occupation license, the whole area comprised in the license.

(2.) Eighth Schedule to this Act or to the like effect, and when received by the Minister shall be irrevoculble ; such notice shall be published in $he Gaxette, and the clate of such publicaxion shall lie deemed to be the date of the receipt of the notice o f election by the lbllinister.

(3.) The notice of election shall be in the form in the schedule

(i.) All lands situated as aforesaid which are law- f d l y held as one station or part of one station by him at the date of the receipt of such notice, together with

(ii.) All other lands situated 8s aforesaid which have been lawfully held by hiin or any other person as part of the said station during any part of the period between the first day of July, one thousand eight hundred and eighty-eight, and ,the date of the receipt of such *notice, and which are not at such lastmentioned date in the la&-fnl occupation of any person.

No lease shall be issued under the provisions of this subsection which does not include all such lands as afore- said.

(2.) Upon the receipt by the Mirrister of such uotice o f election, ihe occupation licensee who is not a pastoral tenant shali he entitled to receive a lease from the Crown comprising the following lancts, hereinafter called a <‘ consolidated holding,” tlmt is t o say-

(i.) All lands situated as aforesaid which are law- fully held by him under occupat>ion license or licenses as one station at the date of the receipt of such notice, together with

All other lands situated as aforesaid which have been lsrvfully held by him OF any other person as part of the said statioii during any part of the period between the first day of July, one tAousand eight, Iiutidred and eighty-eight, and the date of the receipt of such notice of elec- tion, and which arc not at such lastmentioned date in the lawfir1 occupation of any person.

5. Every lease of a consolichted holding shall be for the term of twenty-one years from the first (lay of January or the first day of July nearest to the date of the receipt of the notice of eicction.

6. Every such lease shall be subject to the following eonclitions, namely :---

(1) The yearly rent payable by the lessee shall be computed according to the total number of square miles comprised in the coilsolidated holding ;

(2) The yeariv rent payable for the first period of elevk &ars of the tcrm of the lease shall he ascertained in the following manner :-

Provided, that the said Schedule shall not apply t o any run, the unexpired term of the lease of which has been purchased at auction under the provisions of '' The Pasha2 Lease*q Act of 3&69."* But the rent of every such run pagable under the provisions of this Act shall be the rent at which it was acquired at auction ;

‘c) The rent per square mile payable in respect of the consolidated holding shall be corn- puted by dividing tbe total amount of rent payable iu respect of the said available areas ascertained in manner aforesaid by the total number of square miles comprised in the consolidated holding ;

(5.) With respect to leases granted to occupation

(U> The rent pavable in respect of all lands comprised ig the consolidated holding shall be estimated according to the situation of the land or the several parts thereof as indicated in the first column of the Ninth schedule rx. (6 ) The rent per square mile payable in respect of the consolidated holding shall be com- puted by dividing the total amount of rent payable in respect of tlie land or the several parts thereof‘, ascertained in manner afore- said, by the total number of square miles comprised in the coilsolidated holding ;

(3) The yearly rent payable for the final period of ten years after the first period shall be deter- mined by the Court ;

(4) I f the lease is forfeited or otherwise deter- mined, the consolidated holding may be offered for sale for the residue of the term of the lease, computed from the nearest first day of January or first day of July, as the case may be, and t,he upset price shall be not less than five shillings per square mile of the gross area of the consolidated holding, or such less sum its may be determined by the Court.

(i.) The part which may be so resumed without compensation except for im- provements shall not comprise the head station or the principal woolshed, wasfi- pool, or reservoir upon the holding;

(ii.) Upon a first resumption, then whether the land resumed does or does not amount in area to one-third of the gross area of such holding, at least one-fourth of the external boundaries of the land resumed shall, unless the lessee other- wise agrees, coincide with the original boundaries of tlrs holding, or, if the holding consists of more than one parcel of land, with the original boundaries of one or more of such parcels;

(iii.) When the land first resumed does not amount in area t o one-third of the gross area of such holding, the following rules, unless the lessee otherwise agrees, shall be observed upon all subsequent resump- tions in pursuance of this subsection : (0) When the holdinq consistsof one

parcel of land, all lands subse- quently resumed shall aclj oin some part of the lands previously resumed ;

( 6 ) When the holding consists of more than one parcel of land, all lands resumed from any parcel thereof in which there has been a previous resumption shall adjoin some part of the lands comprised in such previous resumption.

Notwithstanding anything to the contrary in the last preceding subsection contained, the Governor in Council may from time to time by notification in the Gazette resume any portion or portions of a consolidated holding for town- ship reserves or for any of the purposes referred to in section one hundred and ninety of <' The &and Act, 1S97,"" other than for purposes of closer settlement, without compensation for such resumption except for improvements : when such land is resumed for roads the pro- visions of Part IX. of thesaid Act shall apply; In case of any resumption under either of the two last preceding subsections the lessee shall not be required to pay any rent in respect of the lands resumed from the date on which the resumption takes effect.

Begzcla tions . 11. The Governor in Council may from time to time make powertomake

Regulations for carrying into effect the provisions of this Act : Regulations. Provided that the Regulations for the time being in

force under ‘‘ The Land Act, 1897,”* which are applicable to a lessee or holding under Part 111. of that Act shall, so far as the same are not inconsistent with the provisions of this Act, and unless or until the same are varied by Regu- lations made in pursuance of this Act, be applicable to a lessee or consolidated holding under this Act respectively.
