A BILL To regulate assault weapons, to ensure that the right to

keep and bear arms is not unlimited, and for other purposes.

Be it enacted by the Senate and House of Representa-1

tives of the United States of America in Congress assembled, 2

SECTION 1. SHORT TITLE. 3

This Act may be cited as the ‘‘Assault Weapons Ban 4

of 2021’’. 5

SEC. 2. DEFINITIONS. 1

(a) IN GENERAL.—Section 921(a) of title 18, United 2

States Code, is amended— 3

(1) by inserting after paragraph (29) the fol-4

lowing: 5

‘‘(30) The term ‘semiautomatic pistol’ means any re-6

peating pistol that— 7

‘‘(A) utilizes a portion of the energy of a firing 8

cartridge to extract the fired cartridge case and 9

chamber the next round; and 10

‘‘(B) requires a separate pull of the trigger to 11

fire each cartridge. 12

‘‘(31) The term ‘semiautomatic shotgun’ means any 13

repeating shotgun that— 14



chamber the next round; and 17


fire each cartridge.’’; and 19

(2) by adding at the end the following: 20

‘‘(36) The term ‘semiautomatic assault weapon’ 21

means any of the following, regardless of country of manu-22

facture or caliber of ammunition accepted: 23

‘‘(A) A semiautomatic rifle that— 24

‘‘(i) has the capacity to utilize a magazine 25

that is not a fixed magazine; and 26

‘‘(ii) does have any 1 of the following: 1

‘‘(I) A pistol grip. 2

‘‘(II) A forward grip. 3

‘‘(III) A folding, telescoping, or de-4

tachable stock, or is otherwise foldable or 5

adjustable in a manner that operates to re-6

duce the length, size, or any other dimen-7

sion, or otherwise enhances the 8

concealability, of the weapon. 9

‘‘(IV) A grenade launcher. 10

‘‘(V) A barrel shroud. 11

‘‘(VI) A threaded barrel. 12

‘‘(B) A semiautomatic rifle that has a fixed 13

magazine with the capacity to accept more than 10 14

rounds, except for an attached tubular device de-15

signed to accept, and capable of operating only with, 16

.22 caliber rimfire ammunition. 17

‘‘(C) Any part, combination of parts, compo-18

nent, device, attachment, or accessory that is de-19

signed or functions to accelerate the rate of fire of 20

a semiautomatic firearm but not convert the semi-21

automatic firearm into a machinegun. 22

‘‘(D) A semiautomatic pistol that— 23

‘‘(i) has the capacity to utilize a magazine 24

that is not a fixed magazine; and 25

‘‘(I) A threaded barrel. 2

‘‘(II) A second pistol grip. 3

‘‘(III) A barrel shroud. 4

‘‘(IV) The capacity to accept a de-5

tachable magazine at some location outside 6

of the pistol grip. 7

‘‘(V) A semiautomatic version of an 8

automatic firearm. 9

‘‘(VI) A manufactured weight of 50 10

ounces or more when unloaded. 11

‘‘(VII) A stabilizing brace or similar 12

component. 13

‘‘(E) A semiautomatic pistol with a fixed maga-14

zine that has the capacity to accept more than 10 15

rounds. 16

‘‘(F) A semiautomatic shotgun that— 17

‘‘(i) does not have a fixed magazine; and 18


‘‘(I) A folding, telescoping, or detach-20

able stock. 21

‘‘(II) A pistol grip or bird’s head grip. 22

‘‘(III) A fixed magazine with the ca-23

pacity to accept more than 5 rounds. 24

‘‘(B) does not include an attached tubular de-1

vice designed to accept, and capable of operating 2

only with, .22 caliber rimfire ammunition.’’. 3

(b) RELATED DEFINITIONS.—Section 921(a) of title 4

18, United States Code, as amended by this Act, is 5

amended by adding at the end the following: 6

‘‘(38) The term ‘barrel shroud’— 7

‘‘(A) means a shroud that is attached to, or 8

partially or completely encircles, the barrel of a fire-9

arm so that the shroud protects the user of the fire-10

arm from heat generated by the barrel; and 11

‘‘(B) does not include— 12

‘‘(i) a slide that partially or completely en-13

closes the barrel; or 14

‘‘(ii) an extension of the stock along the 15

bottom of the barrel which does not encircle or 16

substantially encircle the barrel. 17

‘‘(39) The term ‘detachable magazine’ means an am-18

munition feeding device that can be removed from a fire-19

arm without disassembly of the firearm action. 20

‘‘(40) The term ‘fixed magazine’ means an ammuni-21

tion feeding device that is contained in and not removable 22

from or permanently fixed to the firearm. 23

‘‘(41) The term ‘folding, telescoping, or detachable 24

stock’ means a stock that folds, telescopes, detaches or 25

otherwise operates to reduce the length, size, or any other 1

dimension, or otherwise enhances the concealability, of a 2

firearm. 3

‘‘(42) The term ‘forward grip’ means a grip located 4

forward of the trigger that functions as a pistol grip. 5

‘‘(43) The term ‘grenade launcher’ means an attach-6

ment for use on a firearm that is designed to propel a 7

grenade or other similar destructive device. 8

‘‘(44) The term ‘permanently inoperable’ means a 9

firearm which is incapable of discharging a shot by means 10

of an explosive and incapable of being readily restored to 11

a firing condition. 12

‘‘(45) The term ‘pistol grip’ means a grip, a thumb-13

hole stock or Thordsen-type grip or stock, or any other 14

characteristic that can function as a grip. 15

‘‘(46) The term ‘threaded barrel’ means a feature or 16

characteristic that is designed in such a manner to allow 17

for the attachment of a device such as a firearm silencer 18

or a flash suppressor. 19

‘‘(47) The term ‘qualified law enforcement officer’ 20

has the meaning given the term in section 926B. 21

‘‘(48) The term ‘grandfathered semiautomatic as-22

sault weapon’ means any semiautomatic assault weapon 23

the importation, possession, sale, or transfer of which 24

would be unlawful under section 922(v) but for the excep-1

tion under paragraph (2) of such section. 2

‘‘(49) The term ‘belt-fed semiautomatic firearm’ 3

means any repeating firearm that— 4



chamber the next round; 7


fire each cartridge; and 9

‘‘(C) has the capacity to accept a belt ammuni-10

tion feeding device.’’. 11

SEC. 3. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE 12

CAPACITY AMMUNITION FEEDING DEVICES. 13

(a) IN GENERAL.—Section 922 of title 18, United 14

States Code, is amended— 15

(1) by inserting after subsection (u) the fol-16

lowing: 17

‘‘(v)(1) It shall be unlawful for a person to import, 18

sell, manufacture, transfer, or possess, in or affecting 19

interstate or foreign commerce, a semiautomatic assault 20

weapon. 21

‘‘(2) Paragraph (1) shall not apply to the possession, 22

sale, or transfer of any semiautomatic assault weapon oth-23

erwise lawfully possessed under Federal law on the date 24

of enactment of the Assault Weapons Ban of 2021. 25

‘‘(3) Paragraph (1) shall not apply to any firearm 1

that— 2

‘‘(A) is manually operated by bolt, pump, lever, 3

or slide action; 4

‘‘(B) has been rendered permanently inoperable; 5

or 6

‘‘(C) is an antique firearm, as defined in section 7

921 of this title. 8

‘‘(4) Paragraph (1) shall not apply to— 9

‘‘(A) the importation for, manufacture for, sale 10

to, transfer to, or possession by the United States 11

or a department or agency of the United States or 12

a State or a department, agency, or political subdivi-13

sion of a State, or a sale or transfer to or possession 14

by a qualified law enforcement officer employed by 15

the United States or a department or agency of the 16

United States or a State or a department, agency, 17

or political subdivision of a State, for purposes of 18

law enforcement (whether on or off duty), or a sale 19

or transfer to or possession by a campus law en-20

forcement officer for purposes of law enforcement 21

(whether on or off duty); 22

‘‘(B) the importation for, or sale or transfer to 23

a licensee under title I of the Atomic Energy Act of 24

1954 for purposes of establishing and maintaining 25

an on-site physical protection system and security 1

organization required by Federal law, or possession 2

by an employee or contractor of such licensee on-site 3

for such purposes or off-site for purposes of licensee- 4

authorized training or transportation of nuclear ma-5

terials; 6

‘‘(C) the possession, by an individual who is re-7

tired in good standing from service with a law en-8

forcement agency and is not otherwise prohibited 9

from receiving a firearm, of a semiautomatic assault 10

weapon— 11

‘‘(i) sold or transferred to the individual by 12

the agency upon such retirement; or 13

‘‘(ii) that the individual purchased, or oth-14

erwise obtained, for official use before such re-15

tirement; 16

‘‘(D) the importation, sale, manufacture, trans-17

fer, or possession of a semiautomatic assault weapon 18

by a licensed manufacturer or licensed importer for 19

the purposes of testing or experimentation author-20

ized by the Attorney General; or 21

‘‘(E) the importation, sale, manufacture, trans-22

fer, or possession of a firearm specified in Appendix 23

A to this section, as such firearm was manufactured 24

on the date of introduction of the Assault Weapons 1

Ban of 2021. 2

‘‘(5) For purposes of paragraph (4)(A), the term 3

‘campus law enforcement officer’ means an individual who 4

is— 5

‘‘(A) employed by a private institution of higher 6

education that is eligible for funding under title IV 7

of the Higher Education Act of 1965 (20 U.S.C. 8

1070 et seq.); 9

‘‘(B) responsible for the prevention or investiga-10

tion of crime involving injury to persons or property, 11

including apprehension or detention of persons for 12

such crimes; 13

‘‘(C) authorized by Federal, State, or local law 14

to carry a firearm, execute search warrants, and 15

make arrests; and 16

‘‘(D) recognized, commissioned, or certified by 17

a government entity as a law enforcement officer. 18

‘‘(6) The Attorney General shall establish and main-19

tain, in a timely manner, a record of the make, model, 20

and, if available, date of manufacture of any semiauto-21

matic assault weapon which the Attorney General is made 22

aware has been used in relation to a crime under Federal 23

or State law, and the nature and circumstances of the 24

crime involved, including the outcome of relevant criminal 25

investigations and proceedings. The Attorney General 1

shall annually submit a copy of the record established 2

under this paragraph to the Congress and make the record 3

available to the general public. 4

‘‘(w)(1) It shall be unlawful for a person to import, 5

sell, manufacture, transfer, or possess, in or affecting 6

‘‘(2) Paragraph (1) shall not apply to the possession 9

of any large capacity ammunition feeding device otherwise 10

lawfully possessed on or before the date of enactment of 11

the Assault Weapons Ban of 2021. 12

‘‘(3) Paragraph (1) shall not apply to— 13

‘‘(A) the importation for, manufacture for, sale 14

to, transfer to, or possession by the United States 15

or a department or agency of the United States or 16

a State or a department, agency, or political subdivi-17

sion of a State, or a sale or transfer to or possession 18

by a qualified law enforcement officer employed by 19

the United States or a department or agency of the 20

United States or a State or a department, agency, 21

or political subdivision of a State for purposes of law 22

enforcement (whether on or off duty), or a sale or 23

transfer to or possession by a campus law enforce-24

er on or off duty); 2

‘‘(B) the importation for, or sale or transfer to 3

a licensee under title I of the Atomic Energy Act of 4

1954 for purposes of establishing and maintaining 5

an on-site physical protection system and security 6

organization required by Federal law, or possession 7

by an employee or contractor of such licensee on-site 8

for such purposes or off-site for purposes of licensee- 9

authorized training or transportation of nuclear ma-10

terials; 11

‘‘(C) the possession, by an individual who is re-12

tired in good standing from service with a law en-13

forcement agency and is not otherwise prohibited 14

from receiving ammunition, of a large capacity am-15

munition feeding device— 16

‘‘(i) sold or transferred to the individual by 17

the agency upon such retirement; or 18

‘‘(ii) that the individual purchased, or oth-19

erwise obtained, for official use before such re-20

tirement; or 21

‘‘(D) the importation, sale, manufacture, trans-22

fer, or possession of any large capacity ammunition 23

feeding device by a licensed manufacturer or licensed 24

importer for the purposes of testing or experimen-1

tation authorized by the Attorney General. 2

‘‘(4) For purposes of paragraph (3)(A), the term 3

‘campus law enforcement officer’ means an individual who 4

is— 5

‘‘(A) employed by a private institution of higher 6

education that is eligible for funding under title IV 7

of the Higher Education Act of 1965 (20 U.S.C. 8

1070 et seq.); 9

‘‘(B) responsible for the prevention or investiga-10

tion of crime involving injury to persons or property, 11

including apprehension or detention of persons for 12

such crimes; 13

‘‘(C) authorized by Federal, State, or local law 14

to carry a firearm, execute search warrants, and 15

make arrests; and 16

‘‘(D) recognized, commissioned, or certified by 17

a government entity as a law enforcement officer.’’; 18

and 19

(2) by adding at the end the following: 20

‘‘(aa) SECURE STORAGE OR SAFETY DEVICE RE-21

QUIREMENT FOR GRANDFATHERED SEMIAUTOMATIC AS-22

SAULT WEAPONS.—It shall be unlawful for any person, 23

other than a licensed importer, licensed manufacturer, or 24

licensed dealer, to store or keep under the dominion or 25

control of that person any grandfathered semiautomatic 1

assault weapon that the person knows, or has reasonable 2

cause to believe, will be accessible to an individual prohib-3

ited from receiving or possessing a firearm under sub-4

section (g), (n), or (x), or any provision of State law, un-5

less the grandfathered semiautomatic assault weapon is— 6

‘‘(1) carried on the person, or within such close 7

proximity that the person can readily retrieve and 8

use the grandfathered semiautomatic assault weapon 9

as if the grandfathered semiautomatic assault weap-10

on were carried on the person; or 11

‘‘(2) locked by a secure gun storage or safety 12

device that the prohibited individual has no ability to 13

access.’’. 14

(b) IDENTIFICATION MARKINGS FOR SEMIAUTO-15

MATIC ASSAULT WEAPONS.—Section 923(i) of title 18, 16

United States Code, is amended by adding at the end the 17

following: ‘‘The serial number of any semiautomatic as-18

sault weapon manufactured after the date of enactment 19

of the Assault Weapons Ban of 2021 shall clearly show 20

the date on which the weapon was manufactured or made, 21

legibly and conspicuously engraved or cast on the weapon, 22

and such other identification as the Attorney General shall 23

by regulations prescribe.’’. 24

title 18, United States Code, as amended by this Act, is 3

amended by adding at the end the following: ‘‘A large ca-4

pacity ammunition feeding device manufactured after the 5

date of enactment of the Assault Weapons Ban of 2021 6

shall be identified by a serial number and the date on 7

which the device was manufactured or made, legibly and 8

conspicuously engraved or cast on the device, and such 9

other identification as the Attorney General shall by regu-10

(d) SEIZURE AND FORFEITURE OF LARGE CAPACITY 12

(C) by striking ‘‘or (k)’’ and inserting 22

Section 924(a)(1)(B) of title 18, United States Code, 11

is amended by striking ‘‘or (q) of section 922’’ and insert-12

ing ‘‘(q), (r), (v), (w), or (aa) of section 922’’. 13

SEC. 5. BACKGROUND CHECKS FOR TRANSFERS OF GRAND-14

FATHERED SEMIAUTOMATIC ASSAULT WEAP-15

ONS. 16

(a) IN GENERAL.—Section 922 of title 18, United 17

States Code, as amended by this Act, is amended— 18

(1) by repealing subsection (s); 19

(2) by redesignating subsection (t) as sub-20

section (s); 21

(3) in subsection (s), as redesignated— 22

(A) in paragraph (3)(C)(ii), by striking 23

‘‘(as defined in subsection (s)(8))’’; and 24

(B) by adding at the end the following: 25

‘‘(7) In this subsection, the term ‘chief law en-1

forcement officer’ means the chief of police, the 2

sheriff, or an equivalent officer or the designee of 3

any such individual.’’; and 4

(4) by inserting after subsection (s), as redesig-5

nated, the following: 6

‘‘(t)(1) Beginning on the date that is 90 days after 7

the date of enactment of the Assault Weapons Ban of 8

2021, it shall be unlawful for any person who is not li-9

censed under this chapter to transfer a grandfathered 10

semiautomatic assault weapon to any other person who is 11

not licensed under this chapter, unless a licensed importer, 12

licensed manufacturer, or licensed dealer has first taken 13

custody of the grandfathered semiautomatic assault weap-14

on for the purpose of complying with subsection (s). Upon 15

taking custody of the grandfathered semiautomatic assault 16

weapon, the licensee shall comply with all requirements of 17

this chapter as if the licensee were transferring the grand-18

fathered semiautomatic assault weapon from the licensee’s 19

inventory to the unlicensed transferee. 20

‘‘(2) Paragraph (1) shall not apply to a temporary 21

transfer of possession for the purpose of participating in 22

target shooting in a licensed target facility or established 23

range if— 24

‘‘(A) the grandfathered semiautomatic assault 1

weapon is, at all times, kept within the premises of 2

the target facility or range; and 3

‘‘(B) the transferee is not known to be prohib-4

ited from possessing or receiving a grandfathered 5

semiautomatic assault weapon. 6

‘‘(3) For purposes of this subsection, the term ‘trans-7

fer’— 8

‘‘(A) shall include a sale, gift, or loan; and 9

‘‘(B) does not include temporary custody of the 10

grandfathered semiautomatic assault weapon for 11

purposes of examination or evaluation by a prospec-12

tive transferee. 13

‘‘(4)(A) Notwithstanding any other provision of this 14

chapter, the Attorney General may implement this sub-15

section with regulations. 16

‘‘(B) Regulations promulgated under this para-17

graph— 18

‘‘(i) shall include a provision setting a max-19

imum fee that may be charged by licensees for serv-20

ices provided in accordance with paragraph (1); and 21

‘‘(ii) shall not include any provision imposing 22

recordkeeping requirements on any unlicensed trans-23

feror or requiring licensees to facilitate transfers in 24

accordance with paragraph (1).’’. 25

(b) TECHNICAL AND CONFORMING AMENDMENTS.— 1

(1) SECTION 922.—Section 922(y)(2) of title 2

18, United States Code, is amended, in the matter 3

preceding subparagraph (A), by striking ‘‘, 4

(g)(5)(B), and (s)(3)(B)(v)(II)’’ and inserting ‘‘and 5

(g)(5)(B)’’. 6

(2) SECTION 925A.—Section 925A of title 18, 7

United States Code, is amended, in the matter pre-8

ceding paragraph (1), by striking ‘‘subsection (s) or 9

(t) of section 922’’ and inserting ‘‘section 922(s)’’. 10

(c) EFFECTIVE DATE.—The amendments made by 11

this section shall take effect 90 days after the date of en-12

actment of this Act. 13

SEC. 6. USE OF BYRNE GRANTS FOR BUY-BACK PROGRAMS 14

FOR SEMIAUTOMATIC ASSAULT WEAPONS 15

AND LARGE CAPACITY AMMUNITION FEED-16

ING DEVICES. 17

Section 501(a)(1) of title I of the Omnibus Crime 18

Control and Safe Streets Act of 1968 (34 U.S.C. 19

10121(a)(1)) is amended by adding at the end the fol-20

lowing: 21

‘‘(I) Compensation for surrendered semi-22

automatic assault weapons and large capacity 23

ammunition feeding devices, as those terms are 24

defined in section 921 of title 18, United States 25

SEC. 7. SEVERABILITY. 4

If any provision of this Act, an amendment made by 5

by this Act, and the application of such provision or 9

amendment to any person or circumstance shall not be af-10

fected thereby. 11
