NOTICE OF APPLICATION AND PRELIMINARY DECISION FOR TPDES PERMIT FOR MUNICIPAL WASTEWATER NEW

PERMIT NO. WQ0015145002

APPLICATION AND PRELIMINARY DECISION. Bradbury Development Limited, c/o Costello, Inc., 2107 CityWest Boulevard, Floor 3, Houston, Texas 77042, has applied to the Texas Commission on Environmental Quality (TCEQ) for new Texas Pollutant Discharge Elimination System (TPDES) Permit No. WQ0015145002, to authorize the discharge of treated domestic wastewater at an annual average flow not to exceed 5,000,000 gallons per day. This facility was pre-viously permitted under TPDES Permit No. WQ0015145001, which expired on June 1, 2017, but has not been constructed. TCEQ received this application on January 2, 2018.

The facility will be located approximately two miles west-northwest of the intersec-tion of Farm -to-Market Road 2090 and Interstate Highway 69, in Montgomery County, Texas 77372. The treated effluent will be discharged to Gulley Branch; thence to Peach Creek in Segment No. 1011 of the San Jacinto River Basin. The unclassified receiving water use is high aquatic life use for Gulley Branch. The desig-nated uses for Segment No. 1011 are high aquatic life use, public water supply, and primary contact recreation. In accordance with Title 30 Texas Administrative Code Section 307.5 and the TCEQ implementation procedures (June 2010) for the Texas Surface Water Quality Standards, an antidegradation review of the receiving waters was performed. A Tier 1 antidegradation review has preliminarily determined that existing water quality uses will not be impaired by this permit action. Numerical and narrative criteria to protect existing uses will be maintained. A Tier 2 review has preliminarily determined that no significant degradation of water quality is expected in Peach Creek or Gulley Branch, which have been identified as having high aquatic life use. Existing uses will be maintained and protected. The preliminary determi-nation can be reexamined and may be modified if new information is received. The TCEQ Executive Director has completed the technical review of the applica-tion and prepared a draft permit. The draft permit, if approved, would establish the conditions under which the facility must operate.
